which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Office of Financial Research to compel data relating to the financing of artificial intelligence development, provide that data to Congress, and issue recommendations to financial regulatory agencies and Congress to mitigate financial stability risk, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AI Bubble Transparency Act</short-title></quote>.</text></section><section id="idd12b6386772849b796dab36b0fd30d21"><enum>2.</enum><header>Financial system exposure to artificial intelligence sector</header><text display-inline="no-display-inline">Subtitle B of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5341">12 U.S.C. 5341 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb1682b6555b640cfb3bd0702573c1cdc"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ide2327714573244269d3709f17e909a70"><enum>157.</enum><header>Data collection on financial system exposure to artificial intelligence sector</header><subsection commented="no" display-inline="no-display-inline" id="id0cc4fe47bb054364a71f1cd23c52dba5"><enum>(a)</enum><header display-inline="yes-display-inline">Artificial intelligence defined</header><text>In this section, the term <term>artificial intelligence</term> has the meaning given that term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></subsection><subsection id="id0a95e649b5474015ba904ca3cc437bec" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Data collection</header><paragraph commented="no" display-inline="no-display-inline" id="id79760a47cca64a46963cbb5cd3ae0c40"><enum>(1)</enum><header>Reporting on exposure</header><subparagraph commented="no" display-inline="no-display-inline" id="id61b206a3474a4de0b30400324b9a7cb5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment, the Director shall order all financial companies to submit data, subject to the limitation under paragraph (2), relating to their exposure to debt and equity instruments connected to companies that support artificial intelligence hardware and physical infrastructure, including chip makers and data centers, hyperscalers and neocloud providers, model originators and developers, and data infrastructure.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72bc435632c449e49e91c944aaebb5c9"><enum>(B)</enum><header>Data contents</header><text>The data required to be submitted under subparagraph (A) shall include the following:</text><clause commented="no" display-inline="no-display-inline" id="idb5049b7296564a7c9abe9f3be3fb5241"><enum>(i)</enum><header>Reporting of credit exposure</header><text>Data relating to credit exposure, including—</text><subclause id="id8401d32e34fe4b0aa11a08567139e70f"><enum>(I)</enum><text>type of debt instrument;</text></subclause><subclause id="id17a17c211fef4995ab92fd08a4a2c95f"><enum>(II)</enum><text>size of the exposure;</text></subclause><subclause id="id0220c8bdd4464856993d7263b103c377"><enum>(III)</enum><text>issuing company or counterparty;</text></subclause><subclause id="id736a2214a59b4ce798eae82b5e22e364"><enum>(IV)</enum><text>interest rate;</text></subclause><subclause id="idbd87a79616184d05b0d6d3e8e44d66bc"><enum>(V)</enum><text>term;</text></subclause><subclause id="idbcced87c56604a2f9987e793fe915478"><enum>(VI)</enum><text>collateral pledged; and</text></subclause><subclause id="ida9415989dd29412487240681efd80602"><enum>(VII)</enum><text>additional borrower characteristics, such as—</text><item id="id72b6afc160e249e78bce845922f499ae"><enum>(aa)</enum><text>subsector classification;</text></item><item id="idd13e631b3af04bb18314e21085c3838d"><enum>(bb)</enum><text>annual revenue and net income;</text></item><item id="id807f09ba6e764506af961cc6a31b22b6"><enum>(cc)</enum><text>total market capitalization, if applicable; and</text></item><item id="id5af95af84874404f874b96c7a3424555"><enum>(dd)</enum><text>total debt and other outstanding liabilities, including those held off-balance sheet.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7c39fc3853ed47d69db54d105accf155"><enum>(ii)</enum><header>Reporting of equity exposure</header><text>Data relating to equity exposure, including—</text><subclause commented="no" display-inline="no-display-inline" id="idacbe6036a87649cba11cc00bb9ccba4b"><enum>(I)</enum><text display-inline="yes-display-inline">type of equity instrument;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4d76b94c6f354ebeb4d7c03936893dc9"><enum>(II)</enum><text>size of the exposure; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id05b109ffea1b4bed8b2618f224729f90"><enum>(III)</enum><text>additional company characteristics, such as—</text><item commented="no" display-inline="no-display-inline" id="id48d8acc643c74176aa1f98cda9ebb0a3"><enum>(aa)</enum><text display-inline="yes-display-inline">subsector classification;</text></item><item commented="no" display-inline="no-display-inline" id="ideb910cf2f39e4d65b2cf1043f8f80068"><enum>(bb)</enum><text>annual revenue and net income;</text></item><item commented="no" display-inline="no-display-inline" id="id8fc99351e4da4723b02bf231d4ab6d47"><enum>(cc)</enum><text>total market capitalization, if applicable; and</text></item><item commented="no" display-inline="no-display-inline" id="idc6685977778043c1b10a8239228f2d02"><enum>(dd)</enum><text>total debt and other outstanding liabilities, including those held off-balance sheet.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ideff3914a3c5140c89c32bc65a5cbb85c"><enum>(iii)</enum><header>Other</header><text>Any other information the Director determines necessary for evaluating the exposure of the financial companies to debt and equity instruments connected to the artificial intelligence sector.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a660823befd4cac9c925672580ab6ac"><enum>(2)</enum><header>Limitation</header><text>The Director may exempt small financial companies, including banks with less than $10,000,000,000 in assets, and financial companies with less than $500,000,000 of financial exposure to the instruments described in paragraph (1) from the reporting requirements under this section.</text></paragraph></subsection><subsection id="id44ccdf6cbc8f48778daa4ec2b4e400d8"><enum>(c)</enum><header>Enforcement authority</header><text>The Director shall use the authority under section 153(f) to compel data from any financial company that fails to comply with the data collection required under this section.</text></subsection><subsection id="id636523c1656f4b059f076a79208a12dc"><enum>(d)</enum><header>Report and recommendations</header><paragraph commented="no" display-inline="no-display-inline" id="idcc7074c704684ff8b727ac9e3d6c7205"><enum>(1)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Chair of the Financial Stability Oversight Council shall issue and make publicly available a report on the findings of the data collection under this section that evaluates—</text><subparagraph commented="no" display-inline="no-display-inline" id="id907ad57830844db78e6c0ccf9b9721d1"><enum>(A)</enum><text>the size, scope, complexity, and interconnectedness of the financial system's exposure to debt and equity instruments connected to artificial intelligence development;</text></subparagraph><subparagraph id="id45844341860e4db1a21c2d000505d6c6"><enum>(B)</enum><text>the transmission channels through which a severe decline in value of debt and equity instruments connected to artificial intelligence could threaten the stability of the financial system of the United States; and</text></subparagraph><subparagraph id="id81ba407bd865403ba242a164ee48a3fe"><enum>(C)</enum><text>the extent to which financial companies are indirectly exposed to debt and equity instruments connected to artificial intelligence development through financing arrangements with other financial companies.</text></subparagraph></paragraph><paragraph id="ida1225c64e717456d9f2d2a59bc0c0628"><enum>(2)</enum><header>Recommendations</header><text>The Council shall use the authority under section 120 to issue policy recommendations to member agencies and to Congress to mitigate financial stability risks relating to the financing of artificial intelligence development.</text></paragraph></subsection><subsection id="idb06ddeb0310f4038a9aa6b791d182b97"><enum>(e)</enum><header>Submission to Congress</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall submit to the Chairs and Ranking Members of the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Financial Services of the House of Representatives</committee-name>, in unredacted form, the data collected under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
