<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4741</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260610">June 10, 2026</action-date><action-desc><sponsor name-id="S429">Mr. Banks</sponsor> (for himself and <cosponsor name-id="S434">Mr. Moreno</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require certain commercial entities to implement age verification methods.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safety and Age Filtering Enforcement for Kids Act of 2026</short-title></quote> or the <quote><short-title>SAFE for Kids Act of 2026</short-title></quote>.</text></section><section id="ida6dbbf049cdc403581d275b3a68707a0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id888af060837c4052a88521d260ea7425"><enum>(1)</enum><header>Commercial age verification system</header><text>The term <term>commercial age verification system</term> means a system that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5b80bbea9f164192b9ce0a348f72392c"><enum>(A)</enum><text display-inline="yes-display-inline">verifies the age of an individual by using—</text><clause id="idec6aa437c85441d0a57dba93b8903b42"><enum>(i)</enum><text>government-issued identification;</text></clause><clause id="id9ef98069bc314dfa9f684a036c97e288"><enum>(ii)</enum><text>a reasonable method that relies on public or private transactional data; or</text></clause><clause id="id9f7be7ff1b3f410f8729a07d9718d5cb"><enum>(iii)</enum><text>any other method or document that reliably and accurately indicates if a user of a covered commercial entity is a minor; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd94dca0e7bb04290bbf3cc15f7e3bafb"><enum>(B)</enum><text display-inline="yes-display-inline">can be used to prevent a minor from accessing the sexual material harmful to minors of a covered commercial entity.</text></subparagraph></paragraph><paragraph id="id06aac6eaa41443b69904002a4b0e2437"><enum>(2)</enum><header>Commercial entity</header><text>The term <term>commercial entity</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf60c0d216b384eeab4dd7b10abcba402"><enum>(A)</enum><text display-inline="yes-display-inline">means a corporation, limited liability company, partnership, limited partnership, sole proprietorship, or other legally recognized business entity;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc79f148dd5bb4baf8efeaf4191260405"><enum>(B)</enum><text>includes a social media platform; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbc165c6342ad481aa285483de552dc00"><enum>(C)</enum><text display-inline="yes-display-inline">does not include a news-gathering organization that as its primary business publishes bona fide news or public interest broadcasts, website videos, reports, or events.</text></subparagraph></paragraph><paragraph id="id176437b82b3e4144b07c2a79c8fe15e0"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="id594f0dd00adc4b3b84fdc5bf9691224a"><enum>(4)</enum><header>Covered commercial entity</header><text>The term <term>covered commercial entity</term>—</text><subparagraph id="idd13a89bbb90441b29b7f6f0e4e4456eb"> <enum>(A)</enum> <text>means a commercial entity that knowingly and intentionally publishes or distributes on an internet website material, of which greater than <fraction>1/3</fraction> of which is sexual material harmful to minors, as determined by the Commission; and</text>
 </subparagraph><subparagraph id="id1cbb6e5b81ab4a88804966a63155fa33"><enum>(B)</enum><text>includes any officer, director, or employee of a commercial entity described in subparagraph (A) while engaged in the performance of the duties of the individual as an officer, director, or employee.</text></subparagraph></paragraph><paragraph id="idfc447704675649649abe80e57bd979f0"><enum>(5)</enum><header>Digital identification</header><text>The term <term>digital identification</term> means information stored on a digital network that—</text><subparagraph id="id096a198fe5734511b640c238d5f92859"><enum>(A)</enum><text>may be accessed by a covered commercial entity; and</text></subparagraph><subparagraph id="idfddd23c7972447058678bddf6ef04830"><enum>(B)</enum><text>serves as a reasonable indication of the age of an individual.</text></subparagraph></paragraph><paragraph id="id1870b9512b5a4a42b5e25d3d90ff73a6"><enum>(6)</enum><header>Distribute</header><text>The term <term>distribute</term> means to issue, sell, give, provide, deliver, transfer, transmute, circulate, or disseminate by any means.</text></paragraph><paragraph id="idcf492a21261f422a9a828b20669b27ea"><enum>(7)</enum><header>Minor</header><text>The term <term>minor</term> means an individual who is under 18 years of age.</text></paragraph><paragraph id="id481b7f3f9d424d88b9ed03b5d2afcfce"><enum>(8)</enum><header>Publish</header><text>The term <term>publish</term> means to communicate or make information available to another person on a publicly available internet website.</text></paragraph><paragraph id="id102f18e77e5142c0a45ad3ff1fa368d6"><enum>(9)</enum><header>Sexual material harmful to minors</header><text>The term <term>sexual material harmful to minors</term> means any material that—</text><subparagraph id="idf035cc0010b5423caf8011d1b7bb29ab"><enum>(A)</enum><text>the average individual applying contemporary community standards would find, taking the material as a whole and with respect to minors, is designed to appeal to or pander to the prurient interest;</text></subparagraph><subparagraph id="idef7a925a1042456c9cd5e625674ea986"><enum>(B)</enum><text>in a manner patently offensive with respect to minors, exploits, is devoted to, or principally consists of descriptions of, actual, simulated, or animated displays or depictions of sexual acts or sexual contact as defined in section 2246 of title 18, United States Code; and</text></subparagraph><subparagraph id="id0ac6be14354c4efeb8987c412b4f832c"><enum>(C)</enum><text>taken as a whole, lacks serious literary, artistic, political, or scientific value for minors.</text></subparagraph></paragraph><paragraph id="id228fc2cbfe4b44898169ccdbf799de2e"><enum>(10)</enum><header>Transactional data</header><text>The term <term>transactional data</term> means a sequence of information that documents an exchange, agreement, or transfer between an individual, commercial entity, or third party.</text></paragraph></section><section id="idec7b0d9059b5472e9e255de5f1192861"><enum>3.</enum><header>Age verification requirements</header><subsection commented="no" display-inline="no-display-inline" id="id12e9a5b9a7214ba7ac1614475420e5ac"><enum>(a)</enum><header>In general</header><paragraph id="id7fbc1d30fcba42d7b768ecfa603ef584"><enum>(1)</enum><header>Preventing minors from accessing sexual material harmful to minors</header><text>Using the information provided in paragraph (2), a covered commercial entity shall prevent any minor from accessing sexual material harmful to minors.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id585fe0414ca54898a84a070319ebeee7"><enum>(2)</enum><header display-inline="yes-display-inline">Age verification</header><text display-inline="yes-display-inline">In order to verify that an individual attempting to access sexual material harmful to minors published or distributed by a covered commercial entity is not a minor, such covered commercial entity shall require such individual to—</text><subparagraph id="idd95bfe39c2ec4302a9ea6cdb9b198d17" commented="no"><enum>(A)</enum><text>provide digital identification; or</text></subparagraph><subparagraph id="ida335476cf46940b8b0a720dc9f1432c3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>verify their age through a commercial age verification system.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf34a6a8843f94b468b88f397f25ad946"><enum>(b)</enum><header>Use of third parties</header><text>A covered commercial entity may contract with a third party to comply with the requirements described in subsection (a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idfd5c5371c7fb4bf29f185890203cb7d2"><enum>(c)</enum><header>Privacy</header><text>A covered commercial entity or third party described in subsection (b) may not retain or sell any information collected pursuant to subsection (a)(2).</text></subsection></section><section id="id3b7d8b077a9c4f3ea935b71240c7b159"><enum>4.</enum><header>Applicability</header><text display-inline="no-display-inline">An internet service provider, a search engine provider, a cloud service provider, or an affiliate or subsidiary of such a provider may not be held to have violated this Act solely for providing access or connection to a covered commercial entity.</text></section><section id="id47ea201a1154402eb61b08b267350233"><enum>5.</enum><header>Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="id12075e8a78414defa6fbb8c1d7dfc8c8"><enum>(a)</enum><header display-inline="yes-display-inline">Enforcement by the Commission</header><paragraph commented="no" display-inline="no-display-inline" id="id1771e73a5f5342d99eedee0f25f4511c"><enum>(1)</enum><header display-inline="yes-display-inline">Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id2dce5e30a3ab42d08df722f40233b0cd"><enum>(2)</enum><header>Powers of Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="ida418edee27154bcdbe49e898f6dd6c95"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (C), the Commission shall enforce this Act and any regulation promulgated thereunder in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8cb803a51bad41b199df424643eb42a0"><enum>(B)</enum><header>Privileges and immunities</header><text>Except as provided in subparagraph (C), any covered commercial entity that violates this Act or a regulation promulgated thereunder shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc4ddbed20c1c46e598dacc1c6f4e6d3f"><enum>(C)</enum><header>Common carriers</header><text>Notwithstanding section 4, 5(a)(2), or 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>, 45(a)(2), 46) or any jurisdictional limitation of the Commission, the Commission shall also enforce this Act or a regulation promulgated thereunder, in the same manner provided in subparagraphs (A) and (B), with respect to common carriers subject to the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) and all Acts amendatory thereof and supplementary thereto.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddc828fded187458ab6bc81b1366a0af3"><enum>(D)</enum><header>Authority preserved</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to limit the authority of the Commission under any other provision of law.</text></subparagraph><subparagraph id="ida42db84d0c3f4ea3ad41596e5116e27e" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header>Rulemaking</header><text>The Commission shall promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this Act.</text></subparagraph></paragraph></subsection><subsection id="idbe293e06cda944368b6de7725fd472a0"><enum>(b)</enum><header>Enforcement by the Department of Justice</header><paragraph id="idec00a24eb0dc48309afad52f931496db"><enum>(1)</enum><header>Criminal enforcement</header><text>The Attorney General may initiate a criminal investigation of a covered commercial entity that the Attorney General has reason to believe, and may initiate a prosecution of a covered commercial entity that the Attorney General determines, is knowingly violating, or has knowingly violated, this Act.</text></paragraph><paragraph id="id63453512ca234ea4afaf9be71807f0b6"><enum>(2)</enum><header>Criminal penalties</header><text>Any covered commercial entity that knowingly violates this Act—</text><subparagraph id="id4a05fb7be3db45ac9ab2d669f90458df"><enum>(A)</enum><text>shall be fined under title 18, United States Code, imprisoned for not more than 5 years, or both; or</text></subparagraph><subparagraph id="id3a7d53bd43004f4f82274e57b1d14e9c"><enum>(B)</enum><text>shall be fined not more than $750,000, if an individual, or $1,500,000, if an organization, imprisoned for not more than 5 years, or both, if—</text><clause id="id2c393727d4ab40af98f14572b4c78861"><enum>(i)</enum><text>the violation resulted in access to sexual material harmful to minors by not less than 100,000 minors;</text></clause><clause id="id1e7502d97b464e6ca377c41e875fed37"><enum>(ii)</enum><text>the covered commercial entity had profits of more than $1,000,000 during any year that were attributable to the violation; or</text></clause><clause id="idba2090d4043f4541877e4017927b8fb1"><enum>(iii)</enum><text>the covered commercial entity engaged in efforts to deceive the Attorney General or the Commission or obstruct an investigation of an alleged violation of this Act.</text></clause></subparagraph></paragraph><paragraph id="id1599e7c86d8840e9930e5914ca0e36cb"><enum>(3)</enum><header>Coordination with the FTC</header><text>The Attorney General shall consult with the Commission to assess evidence of knowing violations of this Act and coordinate parallel civil and criminal enforcement actions, where appropriate.</text></paragraph></subsection><subsection id="idfe44e28579634a2899c522220fe09b8f"><enum>(c)</enum><header>Private right of action</header><paragraph id="id1224d672507742a186ba5b2cf292f9bf"><enum>(1)</enum><header>In general</header><text>Any individual, including the parent or legal guardian of a minor, may bring a civil action against a covered commercial entity in violation of this Act in a court of competent jurisdiction.</text></paragraph><paragraph id="idd2944983f9164f74a6d46c3a887f374a"><enum>(2)</enum><header>Relief</header><text>In a civil action brought under paragraph (1) in which the plaintiff prevails, the court may award—</text><subparagraph id="iddb9880aa35c34b019e0c7f8a74cca5e3"><enum>(A)</enum><text>declaratory or equitable relief;</text></subparagraph><subparagraph id="idfdd649ccbbeb421ca83c47b1b5ba497b"><enum>(B)</enum><text>compensatory damages;</text></subparagraph><subparagraph id="id403978ed2a60466396214ea7fe3962ab"><enum>(C)</enum><text>punitive damages; and</text></subparagraph><subparagraph id="iddd3ee6fcfb1c4e51ab9d1aa02c8e8246"><enum>(D)</enum><text>reasonable attorney’s fees and litigation costs.</text></subparagraph></paragraph></subsection></section><section id="id9cc6b9fd2627472faeeab76e48ce2ebd"><enum>6.</enum><header>Joint reporting and oversight</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and every 3 years thereafter, the Commission, in coordination with the Attorney General, shall submit to Congress a report that describes—</text><paragraph id="ida00b2b6167de4f4c977e095e60950031"><enum>(1)</enum><text>the number of investigations regarding violations of this Act that began during the reporting period;</text></paragraph><paragraph id="id88332420067d4048b7b6cc8d657ac6ed"><enum>(2)</enum><text>the number of actions brought under subsections (a) and (b) of section 5, the amount of civil penalties and criminal fines assessed, and the periods of imprisonment imposed in such actions; and</text></paragraph><paragraph id="ide2b547cf486f4cad908ffc4cb48c4a4f"><enum>(3)</enum><text>any trends or challenges regarding compliance with this Act and the enforcement thereof.</text></paragraph></section></legis-body></bill>
