which was read twice and referred to the <committee-name committee-id="SLIN00">Select Committee on Intelligence</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To implement reforms relating to foreign intelligence surveillance authorities, to prohibit reverse targeting of United States persons and persons located in the United States, and for other purposes.</official-title></form><legis-body><section commented="no" display-inline="no-display-inline" id="idd4632a9d05fd4e7788f76c1788f2c9be" section-type="section-one"><enum>1.</enum><header>Prohibition on reverse targeting of United States persons and persons located in the United States</header><subsection id="id747f9d049d0248aead40ee1876efb7a7"><enum>(a)</enum><header>Definition of covered person</header><text>Section 701(b) of the Foreign Intelligence Surveillance Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1881">50 U.S.C. 1881</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id67b2a914e2d74a81bdde94350dabcada"><paragraph id="id06633b353d2a4a1ebcbd2e0b1754c698"><enum>(6)</enum><header>Covered person</header><text>The term <term>covered person</term> means, with respect to a query, a communication, an acquisition, or creation of information, a person who is—</text><subparagraph id="id4f23bd0d7b894762851baf68ac70bee6"><enum>(A)</enum><text>a United States person; or</text></subparagraph><subparagraph id="id2a0a8f905c58431888b6a9551f65ed9e"><enum>(B)</enum><text>a person known or believed to be located in the United States—</text><clause id="iddee915a3bbff4355a9fbb00074fa2194"><enum>(i)</enum><text>at the time of the applicable query; or</text></clause><clause id="id4b0856a2b7d945248abbd17071036aa6"><enum>(ii)</enum><text>at the time of the acquisition, communication, or creation of the information subject to the applicable query.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id97feba38c5774505ac4ca80bfbb87291"><enum>(b)</enum><header>Prohibition on reverse targeting</header><text>Section 702 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a</external-xref>) is amended—</text><paragraph id="ide5464203245d479bbc2be99708416e91"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="ida534bb3259c149b29871cc4130a7107d"><enum>(A)</enum><text>in paragraph (5), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idae1775431b2444f8a0a5d48acdb3be5e"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraph (6) as paragraph (7); and</text></subparagraph><subparagraph id="id0cd48cd1a0374b20a7abe489dbdf78bd"><enum>(C)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2013f181f8c6446a8ad9cf3dee7599af"><paragraph id="idd0307227854a48ee8a0addc6e3d48a88"><enum>(6)</enum><text>may not intentionally target a person reasonably believed to be located outside the United States if a significant purpose of such acquisition is to acquire the information of one or more particular, known covered persons, unless—</text><subparagraph id="id17c3fa70e4894cc0bce352162aa7cc3e"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id830d71a7a61e47d2a1e1e04ac1b5cab6"><enum>(i)</enum><text>there is a reasonable belief that an emergency exists involving an imminent threat of death or serious bodily harm to such covered persons;</text></clause><clause id="idef962562fdd84f0cb1ea736270bcb2b5" indent="up1"><enum>(ii)</enum><text>the information is sought for the purpose of assisting that covered persons; and</text></clause><clause id="id43056cc500ea448084f6dd6239777e0d" indent="up1"><enum>(iii)</enum><text>not later than 14 days after the targeting, a description of the targeting is provided to the Foreign Intelligence Surveillance Court, the congressional intelligence committees, the Committee on the Judiciary of the House of Representatives, and the Committee on the Judiciary of the Senate; or</text></clause></subparagraph><subparagraph id="ide030bebeb0174264bf1aca611727a4bc"><enum>(B)</enum><text>the covered persons have provided consent to the targeting, or if such persons are incapable of providing consent, a third party legally authorized to consent on behalf of such covered person has provided consent; and</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id18554e984091421ba2cdddf95cb0495c"><enum>(2)</enum><text>in subsection (d)(1), by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9d01344de78442ea88ad040f6e165d69"><subparagraph id="id5daf1bfe38b94bff87183bd75d96c36d"><enum>(A)</enum><text>ensure that—</text><clause id="idd73e09bfada942a3afa5fae390be3341"><enum>(i)</enum><text>any acquisition authorized under subsection (a) is limited to targeting persons reasonably believed to be non-United States persons located outside the United States; and</text></clause><clause id="id1999c0803e044d64aec24047db39f1b9"><enum>(ii)</enum><text>except as provided in subsection (b)(6), it is not a significant purpose of an acquisition to acquire the information of one or more particular, known covered persons; and</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id69d659aaecf145a3976b53c3341859c6"><enum>(3)</enum><text>in subsection (h)(2)(A)(i), by amending subclause (I) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc4892e4ee9a043cda6beafa58da4cb13"><subclause id="id33e322d1a5cf4806acd2ba8426febdce"><enum>(I)</enum><text>ensure that—</text><item id="idb573e64fc0f44b83af39c6e9630da079"><enum>(aa)</enum><text>an acquisition authorized under subsection (a) is limited to targeting persons reasonably believed to be non-United States persons located outside the United States; and</text></item><item id="id7a062459f2fd42e7aef405ade9bd5097"><enum>(bb)</enum><text>except as provided in subsection (b)(6), it is not a significant purpose of an acquisition to acquire the information of one or more particular, known covered persons; and</text></item></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id050b4524c65d43adb151c14d316ea98e"><enum>(4)</enum><text>in subsection (j)(2)(B), by amending clause (i) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id907ac5ae30b54c39b7f50f3cba4ba550"><clause id="idca1109db93bc4204b9780b9b15e8ebff"><enum>(i)</enum><text>ensure that—</text><subclause id="id891d4c16d7dd41edab9d4499a965efbc"><enum>(I)</enum><text>an acquisition authorized under subsection (a) is limited to targeting persons reasonably believed to be non-United States persons located outside the United States; and</text></subclause><subclause id="id9043b2ce827e41a7b00132ce9631cb82"><enum>(II)</enum><text>except as provided in subsection (b)(6), it is not a significant purpose of an acquisition to acquire the information of one or more particular, known covered persons; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idcfbce39d594f43649a119a5703822010"><enum>2.</enum><header>Prohibition on warrantless acquisition of domestic communications pursuant to Section 702</header><text display-inline="no-display-inline">Section 702 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a</external-xref>) is amended—</text><paragraph id="id038fef0b578d44b886c0d5a086155e71"><enum>(1)</enum><text>in subsection (b)(4), by striking <quote>known at the time of the acquisition</quote> and inserting <quote>known or believed at the time of acquisition or communication</quote>;</text></paragraph><paragraph id="idaeaad7d002f34d4f8c094dab3d8faff8"><enum>(2)</enum><text>in subsection (d)(1)(B), by striking <quote>known at the time of the acquisition</quote> and inserting <quote>known or believed at the time of acquisition or communication</quote>;</text></paragraph><paragraph id="iddc39e833df8f43019ce88607ee1a1168"><enum>(3)</enum><text>in subsection (h)(2)(A)(i)(II), by striking <quote>known at the time of the acquisition</quote> and inserting <quote>known or believed at the time of acquisition or communication</quote>; and</text></paragraph><paragraph id="id1ea84e45b58445c6ab09327cc7c10abf"><enum>(4)</enum><text>in subsection (j)(2)(B)(ii), by striking <quote>known at the time of the acquisition</quote> and inserting <quote>known or believed at the time of acquisition or communication</quote>.</text></paragraph></section><section id="id87ef094fb7ad4ea293a4e7aa9b31b3a7"><enum>3.</enum><header>Court supervision of collection targeting United States persons and persons located inside the United States</header><subsection id="idf85c753002324a7484311bef03edc700"><enum>(a)</enum><header>In general</header><text>Title VII of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881">50 U.S.C. 1881 et seq.</external-xref>) is amended—</text><paragraph id="ida954fc5f253443ebbfad5c7e21322b4d"><enum>(1)</enum><text>by striking sections 703, 704, and 705 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881b">50 U.S.C. 1881b</external-xref>, 1881c, and 1881d); and</text></paragraph><paragraph id="id014501f8ec604619a6e04cd286894ee6"><enum>(2)</enum><text>by inserting after section 702 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbf3c5a6930c54f8e84029c6a94c18883"><section id="idc999eff3376c4919aaafdf9003d33b54"><enum>703.</enum><header>Acquisitions targeting United States persons and persons located inside the United States</header><subsection id="idcd48d97f0cbe4f1297e09f015da045c4"><enum>(a)</enum><header>Warrant requirement</header><text>No officer or employee of the Federal Government may intentionally target a covered person for the purpose of acquiring foreign intelligence information, where such acquisition would be of communications content, location information, web browsing history, or internet search history of the covered person, or the acquisition would occur under circumstances in which the person has a reasonable expectation of privacy, or a warrant would be required for the acquisition of such information if the officer or employee sought to compel production of the information inside the United States for law enforcement purposes, unless such person is the subject of—</text><paragraph id="id34c22a13ac2745fc819c542271172879"><enum>(1)</enum><text>an order or emergency authorization under section 105 or 304 of this Act covering the period of the acquisition and the acquisition is subject to the use, dissemination, querying, retention, and other minimization limitations required by such order or authorization; or</text></paragraph><paragraph id="id6332ce88f68646d19b05721cebe9598e"><enum>(2)</enum><text>a warrant issued pursuant to the Federal Rules of Criminal Procedure by a court of competent jurisdiction covering the period of the acquisition and the acquisition is subject to the use, dissemination, querying, retention, and other minimization limitations required by such warrant.</text></paragraph></subsection><subsection id="id2800a9c4f3e54f3499de2a75a1fd7855"><enum>(b)</enum><header>Pen register or trap and trace</header><text>No officer or employee of the Federal Government may intentionally target a covered person for the purpose of collecting foreign intelligence information through the installation and use of a pen register or trap and trace device, or to acquire information the compelled production of which would require a pen register or trap and trace device order if conducted inside the United States, unless such person is the subject of—</text><paragraph id="id49b071189dab48fb9901ddb7e8c24eba"><enum>(1)</enum><text>an order or emergency authorization under title IV of this Act covering the period of the acquisition and the acquisition is subject to the use, dissemination, querying, retention, and other minimization limitations required by such authorization; or</text></paragraph><paragraph id="id721d29c7b7184221b8011a92e8900de6"><enum>(2)</enum><text>an order has been issued pursuant to section 3123 of title 18, United States Code, by a court of competent jurisdiction covering the period of the acquisition.</text></paragraph></subsection><subsection id="idc09663605a404933a7ae06d3d9efbaba"><enum>(c)</enum><header>Matters relating to emergency acquisition</header><text>If an acquisition is conducted pursuant to an emergency authorization described in subsection (a)(1) or (b)(1) and the subsequent application to authorize electronic surveillance, a physical search, an acquisition, or the installation and use of a pen register or trap and trace device pursuant to section 105(e), 304(e), or 403(a) of this Act is denied, or in any other case in which the acquisition has been conducted and no order is issued approving the acquisition—</text><paragraph id="id618e43638fee4705b3af65d37177f5e7"><enum>(1)</enum><text>no information obtained or evidence derived from such acquisition may be used, received in evidence, or otherwise disseminated in any investigation, trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof; and</text></paragraph><paragraph id="id0a9b56d9db6f493b9624b7a92d22a8ec"><enum>(2)</enum><text>no information obtained or evidence derived from such acquisition concerning a covered person may subsequently be used or disclosed in any other manner without the consent of such person, except with the approval of the Attorney General, if the information indicates a threat of death or serious bodily harm to any person.</text></paragraph></subsection><subsection id="id49ee3313684e46d39db585ce091a46c3"><enum>(d)</enum><header>Rule of construction</header><text>Subsections (a), (b), and (c) shall apply regardless of the location of the acquisition.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="iddd409d5c7d254086b6716393e4ecd3d2"><enum>(b)</enum><header>Conforming amendments</header><text>The Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) is further amended—</text><paragraph id="idd92fa8e4727e41ffb8e050c66cb88e5a"><enum>(1)</enum><text>in section 601(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871(a)(1)</external-xref>)—</text><subparagraph id="id635c7a2265fb4d54adb11acc407b2c78"><enum>(A)</enum><text>by striking subparagraphs (D) through (F); and</text></subparagraph><subparagraph id="id55e010ab886943a281a4909fb5dd4302"><enum>(B)</enum><text>in subparagraph (B), by striking the semicolon and inserting <quote>; and</quote>;</text></subparagraph></paragraph><paragraph id="idefa2e40e65fa44adb4bdd6d41d1edc9a"><enum>(2)</enum><text>in section 603(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/50/1873">50 U.S.C. 1873(b)(1)</external-xref>), in the matter before subparagraph (A), by striking <quote>and sections 703 and 704</quote>; and</text></paragraph><paragraph id="id32e2af386b81438297e0a289f46b56fe"><enum>(3)</enum><text>in section 706 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881e">50 U.S.C. 1881e</external-xref>), by striking subsection (b).</text></paragraph></subsection><subsection id="iddd19290a02844ee6a2672e49ddf7fc2f"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents for such Act is amended—</text><paragraph id="id9283130bd67d4922b27bc61a10cf6648"><enum>(1)</enum><text>by striking the items relating to sections 703, 704, and 705; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5d4e3aeaf65e4e99b6b713b664a3a2e3"><enum>(2)</enum><text>by inserting after the item relating to section 702 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA94073B7A333491FBB9AD1E6F208FA9A"><toc><toc-entry level="section" bold="off">Sec. 703. Acquisitions targeting United States persons and persons located inside the United States.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idc6ae61d11ca04dc88608739f22aa3baf"><enum>4.</enum><header>Three-month extension of section 702 of the Foreign Intelligence Surveillance Act of 1978</header><subsection id="id1fe29006194f4c3bbff7c460c25a3648"><enum>(a)</enum><header>Extension of repeal date of Title VII</header><text>Section 403(b) of the FISA Amendments Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/261">Public Law 110–261</external-xref>) is amended—</text><paragraph id="ide12e3378312c45258585f241cb14ac3d"><enum>(1)</enum><text>in paragraph (1) (<external-xref legal-doc="usc" parsable-cite="usc/50/1881">50 U.S.C. 1881</external-xref> note), by striking <quote>June 12, 2026</quote> and inserting <quote>September 18, 2026</quote>; and</text></paragraph><paragraph id="ida7214487c6fc42d19ebae38a9f523b0c"><enum>(2)</enum><text>in paragraph (2) (<external-xref legal-doc="usc" parsable-cite="usc/18/2511">18 U.S.C. 2511</external-xref> note), in the matter preceding subparagraph (A), by striking <quote>June 12, 2026</quote> and inserting <quote>September 18, 2026</quote>.</text></paragraph></subsection><subsection id="id609d8a05278b41efb5ba034009dbc6ac"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall take effect on the earlier of the date of the enactment of this Act or June 11, 2026.</text></subsection></section></legis-body></bill>
