which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Infrastructure Investment and Jobs Act to establish subaccounts in the Indian Water Rights Settlement Completion Fund, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Indian Water Rights Settlements Act of 2026</short-title></quote>.</text></section><section id="id1f7513fae36b412c9ba9ffb74daf6910"><enum>2.</enum><header>Indian Water Rights Settlement Completion Fund subaccounts</header><subsection commented="no" display-inline="no-display-inline" id="id81afc7a7014446a7a6d30ed9f17b774d"><enum>(a)</enum><header>In general</header><text>Section 70101 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/25/149">25 U.S.C. 149</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1C50D1B893F04610A2BB6184E83E4569"><subsection id="id0a357b5e80434abf8af76c9111fb99ef"><enum>(e)</enum><header>Operations, Maintenance, Repair, and Ongoing Obligations Subaccount</header><paragraph id="idfd74defd76554e33bb0eeafd01b47a2e"><enum>(1)</enum><header>Establishment</header><text>There is established in the Fund a subaccount, to be known as the <quote>Operations, Maintenance, Repair, and Ongoing Obligations Subaccount</quote> (referred to in this subsection as the <term>Subaccount</term>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6157d3bc7cbf45ff9096da9a24b7f589"><enum>(2)</enum><header>Deposits</header><subparagraph commented="no" display-inline="no-display-inline" id="id3578844a3f5e4a4883ce3ec8afcb6ae2"><enum>(A)</enum><header>In general</header><text>On the later of October 1, 2026, and the date of enactment of this subsection, and on each October 1 thereafter through October 1, 2035, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall deposit in the Subaccount $45,000,000.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4ababc0dac7c422c8c8421ea3b34a4ae"><enum>(B)</enum><header>Availability</header><text>Amounts deposited in the Subaccount under subparagraph (A) shall be available to the Secretary of the Interior, without further appropriation or fiscal year limitation, for the uses described in paragraph (3).</text></subparagraph></paragraph><paragraph id="id0aead1a13240493f947863987fec5498"><enum>(3)</enum><header>Uses</header><text>Amounts deposited in the Subaccount under paragraph (2)(A) shall be used by the Secretary of the Interior, without further appropriation or fiscal year limitation, for transfers to funds or accounts authorized to receive discretionary appropriations, including Tribal trust funds established by an Act of Congress, to satisfy the obligations of the United States with respect to certain Indian water rights settlements under the following:</text><subparagraph id="id3139816214a5490dbbdaef3f05e57462"><enum>(A)</enum><text>The water delivery and operation, maintenance, repair, and related provisions of <external-xref legal-doc="public-law" parsable-cite="pl/98/530">Public Law 98–530</external-xref> (98 Stat. 2698), relating to the water rights of the Ak-Chin Indian Community.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf1ab8ba858974500935e520a32b793ee"><enum>(B)</enum><text>The water delivery and operations, maintenance, repair, and related provisions of the Colorado Ute Indian Water Rights Settlement Act of 1988 (<external-xref legal-doc="public-law" parsable-cite="pl/100/585">Public Law 100–585</external-xref>; 102 Stat. 2973), relating to the Animas-La Plata Project (as defined in section 3 of that Act (102 Stat. 2973)).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4480bdfec47941ab831d10394a9259c0"><enum>(C)</enum><text>Section 10603(g) of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1387).</text></subparagraph><subparagraph id="id6b3925166abf423ba36bd6480b8c4e44"><enum>(D)</enum><text>The water acquisition provisions of the Snake River Water Rights Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/447">Public Law 108–447</external-xref>; 118 Stat. 3431), including to carry out the Snake River Flow Component described in section 5(a) of that Act (118 Stat. 3433).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62d571f2544f4a589d9f792c18aceeb4"><enum>(E)</enum><text>The Hualapai Tribe Water Rights Settlement Act of 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/349">Public Law 117–349</external-xref>; 136 Stat. 6225), including the Hualapai Water Trust Fund Account established under section 6(a)(1) of that Act (136 Stat. 6234).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide57cc21930ca4a668134b8deada8ee10"><enum>(f)</enum><header>New and Continuing Settlements Subaccount</header><paragraph commented="no" display-inline="no-display-inline" id="id268b5790c25148929d75e17300067fd5"><enum>(1)</enum><header>Establishment</header><text>There is established in the Fund a subaccount, to be known as the <quote>New and Continuing Settlements Subaccount</quote> (referred to in this subsection as the <term>Subaccount</term>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82f41fccfa4f41a6a6af7f419c612d08"><enum>(2)</enum><header>Deposits</header><subparagraph commented="no" display-inline="no-display-inline" id="id05f29239fada4dde8425e00f7ccb98d1"><enum>(A)</enum><header>In general</header><text>On the later of October 1, 2026, and the date of enactment of this subsection, and on each October 1 thereafter through October 1, 2035, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall deposit in the Subaccount $250,000,000.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id34d04568f65c4d53ab776584691047a9"><enum>(B)</enum><header>Availability</header><text>Amounts deposited in the Subaccount under subparagraph (A) shall be available to the Secretary of the Interior, without further appropriation or fiscal year limitation, for the uses described in paragraph (3).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c41b67a7d3245e7a15def1383196be7"><enum>(3)</enum><header>Uses</header><text>Subject to paragraph (4), amounts deposited in the Subaccount under paragraph (2)(A) shall be used by the Secretary of the Interior for transfers to funds or accounts authorized to receive discretionary appropriations, including Tribal trust funds established by an Act of Congress, or to satisfy other obligations of the United States identified by the Secretary of the Interior, under any Indian water rights settlement approved and authorized by an Act of Congress.</text></paragraph><paragraph id="idad38303f33cf4a3bb0523df8d8b86318"><enum>(4)</enum><header>Scope of transfers</header><subparagraph commented="no" display-inline="no-display-inline" id="id01e5eda095bb4b5eb038b4fc3dd78289"><enum>(A)</enum><header>In general</header><text>Transfers authorized under paragraph (3) shall be made in such amounts as are determined by the Secretary of the Interior to be appropriate to satisfy the obligations of the United States, including appropriate indexing, pursuant to the applicable Indian water rights settlement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id129f4ca1cec84e55a8c7b83ee0a29724"><enum>(B)</enum><header>Sequence and timing</header><text>The Secretary of the Interior shall have the discretion to determine the sequence and timing of transfers from the Subaccount under paragraph (3) to substantially complete the eligible Indian water rights settlements as expeditiously as practicable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id13ab2e32bc2b489fa8129b1d2cfdfc44"><enum>(b)</enum><header>Conforming amendment</header><text>Section 312(e) of the White Mountain Apache Tribe Water Rights Quantification Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/291">Public Law 111–291</external-xref>; 124 Stat. 3095; 136 Stat. 6184) is amended by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAC486E2806674B5B93B7FE309FC8A7E7"><paragraph commented="no" display-inline="no-display-inline" id="idb736cefbf283431f8464f90bb7eab853"><enum>(5)</enum><header>Prohibition</header><text>Notwithstanding any other provision of law, any amounts made available under paragraph (2)(B) shall not be made available from the Reclamation Water Settlements Fund established by section 10501(a) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/407">43 U.S.C. 407(a)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id758244d2920742eb85e5f2de23ffe384"><enum>3.</enum><header>Extension of customs user fees</header><subsection commented="no" display-inline="no-display-inline" id="idb6c1850216e94760822780b3cb04bfde"><enum/><text>Section 13031(j)(3) of the Consolidated Omnibus Budget Reconciliation Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/19/58c">19 U.S.C. 58c(j)(3)</external-xref>) is amended—</text><paragraph id="idc46c4d11a66646008491e83189c02e23"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>December 31, 2031</quote> and inserting <quote>September 30, 2035</quote>; and</text></paragraph><paragraph id="id19586fe1261c4928b38806bf3f86e5fb"><enum>(2)</enum><text>in subparagraph (B)(i), by striking <quote>December 31, 2031</quote> and inserting <quote>September 30, 2035</quote>.</text></paragraph></subsection></section></legis-body></bill>
