BILL</legis-type><official-title>To amend the Federal Food, Drug, and Cosmetic Act to deem certain substances to be unsafe for use as food contact substances, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4D3CDF8280D84079934B05FF3B334204"><section section-type="section-one" id="H82FC6CE4AF6F454BA474ED34E5BF10D8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Toxic Chemicals in Food Packaging Act of 2026</short-title></quote>.</text></section><section id="HB93B18E30FF845F4A2DBC15ADA5043D0"><enum>2.</enum><header>Substances deemed unsafe for use as food contact substances</header><subsection id="H4CF7232BB3CF493CB4944CC28A588F88"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 409 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/348">21 U.S.C. 348</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7A5B2E9C0F874809B90FD24F98D5D7A0"><subsection id="HE7CE6360E4434334AAE8649B1753623A"><enum>(l)</enum><header>Substances deemed unsafe for use as food contact substances</header><paragraph id="HDD12AC3C330048FD81D67C762E124C92"><enum>(1)</enum><header>In general</header><text>For purposes of this section and section 402(a)(2)(C), the following are deemed to be unsafe for use as food contact substances:</text><subparagraph id="H34A3BBCB34EF49A6B35F7B6941120ACD"><enum>(A)</enum><text>Any chemical belonging to the class of ortho-phthalates.</text></subparagraph><subparagraph id="H8FE4AFABB09447D5A033D1309B799BAC"><enum>(B)</enum><text>Any chemical belonging to the class of PFAS.</text></subparagraph><subparagraph id="H1B66335F2C314599A0AF0299EA3012FB"><enum>(C)</enum><text>Bisphenol A, B, S, F, or AF or related compounds.</text></subparagraph><subparagraph id="HCC02C54E843F4E97BEBE2396882C0FF9"><enum>(D)</enum><text>Acrolein.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94128a2b7ad94076af6bdd701342275c"><enum>(E)</enum><text display-inline="yes-display-inline">Acrylamide.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde5205a179f8422b9b1d68d086ec67ea"><enum>(F)</enum><text display-inline="yes-display-inline">BHA (ter-Butyl-4-hydroxyanisole).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id93c874e1fece4fe185fe35ec4fab753c"><enum>(G)</enum><text display-inline="yes-display-inline">Chlorinated paraffins.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id959410f5631b4c99af3f99a2e18e4522"><enum>(H)</enum><text display-inline="yes-display-inline">1,4-Dioxane.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc0ace4460f8c40a28f90fb1d91c176b5"><enum>(I)</enum><text display-inline="yes-display-inline">Asbestos.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id69a724e9c55548f0aafb773fd17afa58"><enum>(J)</enum><text display-inline="yes-display-inline">Benzene.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc553fe25f9ba4cefa2f6b7d19832bc60"><enum>(K)</enum><text display-inline="yes-display-inline">Chloroform.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0200143dbf4c4b2bb6d0377200e912df"><enum>(L)</enum><text display-inline="yes-display-inline">Methylene chloride.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida61792f1e71c4df3b9529d8c62c30b3b"><enum>(M)</enum><text display-inline="yes-display-inline">Ethylene Oxide.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddcdb949207ea4e4cb2ea41692030aec4"><enum>(N)</enum><text display-inline="yes-display-inline">Formaldehyde.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ided257a044c224bfab0b67483599c62cb"><enum>(O)</enum><text display-inline="yes-display-inline">Styrene Polymers.</text></subparagraph></paragraph><paragraph id="H6DF5827AC9794C819D4DA496141B4366"><enum>(2)</enum><header>Alternative substances</header><text>In acting in response to any petition under this section to establish safety with respect to a food contact substance that the Secretary determines to be an alternative to a substance listed in paragraph (1), in addition to the criteria under subsection (c), the Secretary shall consider potential adverse effects of exposure to the substance on vulnerable populations.</text></paragraph><paragraph id="HE206FEAF11A5435EA08E2693C7198DA4"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="H2E1A16AD78B74D9C9C707FDFB8F7FC87"><enum>(A)</enum><text>The term <term>ortho-phthalates</term> means a class of chemicals that are non-polymeric esters of ortho-phthalic acid.</text></subparagraph><subparagraph id="H3EA7EE1B0EFB4BC9B659406F7C89EA64"><enum>(B)</enum><text>The term <term>PFAS</term> means a perfluoroalkyl substance or a polyfluoroalkyl substance that contains at least one fully fluorinated methyl or methylene carbon atom.</text></subparagraph><subparagraph id="H115AFD98E0C14185947D3380303C5E61"><enum>(C)</enum><text>The term <term>vulnerable population</term> means a human population that is subject to the potential for disproportionate exposure to, or the potential for disproportionate adverse effect from exposure to, a chemical substance or mixture, including—</text><clause id="HF321F3BA287C4F7FA4994245CB867A78"><enum>(i)</enum><text>infants, children, and adolescents;</text></clause><clause id="H8A1328B67B1D4068995434978FD25887"><enum>(ii)</enum><text>pregnant women;</text></clause><clause id="H83EF4DCF05CA45788E13CE07FD911B74"><enum>(iii)</enum><text>the elderly;</text></clause><clause id="H672D9D97C6F347788C63049FE1F7F0D2"><enum>(iv)</enum><text>individuals with preexisting medical conditions;</text></clause><clause id="HE5DABDB2B9E34D8883A37D1EE284C5EB"><enum>(v)</enum><text>workers who may be exposed to chemical substances and mixtures;</text></clause><clause id="H24F705CBE3D44DB4A9C8ABD753BB1D64"><enum>(vi)</enum><text>residents in communities subject to disproportionate exposures; and</text></clause><clause id="HED7D0E5EC8BC47BCBD6D26717C250B96"><enum>(vii)</enum><text>members of any other appropriate population identified by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id9c1f530d83b04085bf905930eca9fea5"><enum>(4)</enum><header>Relationship to State and local law</header><text>This subsection shall be construed as establishing a minimum standard for the protection of public health. Nothing in this section, or in any regulation promulgated under this section, shall be construed to—</text><subparagraph id="ide85e4c01961c42399bea30b6dcf05caa"><enum>(A)</enum><text>preempt, displace, supplant, prohibit, or restrict any provision of State or local law (including any statute, regulation, ordinance, or common law) relating to food additives or food contact materials that is equivalent to or more stringent than the requirements of this subsection, or to prevent the adoption or enforcement of such a law; or</text></subparagraph><subparagraph id="idbcde351f8f0b488295ae5dca4fe8fd47"><enum>(B)</enum><text>affect or preempt any right of action or remedy under State or local law (including any statute, regulation, ordinance, or common law), including any tort or consumer protection law, except to the extent that such law is inconsistent with this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5784D9B2ACC34D9AA794F0522875AB0B"><enum>(b)</enum><header>Delayed applicability</header><text display-inline="yes-display-inline">Section 409(l) of the Federal Food, Drug, and Cosmetic Act, as added by subsection (a), applies beginning on the date that is 2 years after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
