which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require additional disclosures with respect to nominees to serve as chiefs of mission, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H88628C066BDB47D5817F66A67D42DD95"><section section-type="section-one" id="idAEA1D74B05214FA08CCCBC6B6877F9C9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State Department Integrity and Transparency Act</short-title></quote>.</text></section><section id="HC0B1C806F9DA47359D095BF7814BFF02"><enum>2.</enum><header>Sense of Congress regarding a professional and nonpartisan Department of State</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" display-inline="no-display-inline" id="id8da625cfe1e94131a7d7de300d2d91b5"><enum>(1)</enum><text display-inline="yes-display-inline">detailed knowledge and requisite experience formulating and executing United States foreign policy, including having a working understanding of Department of State operations and procedures, is vital for Chiefs of Mission, Assistant Secretaries of State, and other senior officials at the Department of State—</text><subparagraph commented="no" display-inline="no-display-inline" id="id909044d8358847cb9e3f5235eae46b61"><enum>(A)</enum><text display-inline="yes-display-inline">to successfully advance United States national security; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6add41e3dbb24468a63e7b76938e3a04"><enum>(B)</enum><text>for managing the Federal workforce in order to effectively assert and expand United States competitiveness and leadership abroad;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb44d1aedc79c46daa1785aa12494f6ed"><enum>(2)</enum><text display-inline="yes-display-inline">the People’s Republic of China and other competitor nations are rapidly expanding their global diplomatic presences; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34fe3ae04f904cdaae2772c9914333d6"><enum>(3)</enum><text display-inline="yes-display-inline">it is imperative that the Department of State is appropriately staffed by empowered, nonpartisan foreign policy professionals and thoroughly qualified and vetted political appointees, who work together to protect United States citizens and advance United States foreign policy interests.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida9e25785d6f544b6ae55afa688aa4976"><enum>3.</enum><header display-inline="yes-display-inline">Enhancing the preparedness of Assistant Secretaries of State and Chiefs of Mission</header><subsection commented="no" display-inline="no-display-inline" id="id72756aaaca8c4b8aaea7408f29c04825"><enum>(a)</enum><header>Hiring requirement</header><text display-inline="yes-display-inline">Section 1(c)(1) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(c)(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida747cca6113241cb903c2b493d50187a"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>, United States Code</quote> after title 5; and</text></paragraph><paragraph id="id659bd3fb3fe04ffe87e1c8ba5a9107b0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by adding at the end the following: <quote>Not fewer than 75 percent of the Assistant Secretaries in the Department of State shall have served in the Senior Foreign Service or the Senior Executive Service.</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id28ed72118b9d4b7cb44400af40cdf4f0"><enum>(b)</enum><header display-inline="yes-display-inline">Disclosure requirements</header><text>Section 304(a)(4) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3944">22 U.S.C. 3944(a)(4)</external-xref>) is amended—</text><paragraph id="idf5ea78898a6f4d97a3c808d4f18673d2"><enum>(1)</enum><text>by inserting <quote>or as an assistant secretary</quote> after <quote>chief of mission</quote>; and</text></paragraph><paragraph id="id6d1d2d9236e44aff86e8667e5b79dc79"><enum>(2)</enum><text>by adding at the end the following: <quote>Each report on the demonstrated competence of a nominee shall explain the source and extent of such nominee’s knowledge of the principal language or dialect of the country, region, or institution, as applicable, in which the nominee has been nominated to serve as chief of mission or assistant secretary and the manner and extent to which such nominee meets the criteria described in paragraph (1), particularly with respect to the source and extent of such individual’s knowledge and understanding of the history, culture, economics, politics, and interests of the people of such country, region, or institution and any relevant business interests such nominee has in such country, region, or institution.</quote>.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idc87d061ab6594434a2cf6ff7ee6d80c0"><enum>4.</enum><header display-inline="yes-display-inline">Additional disclosures required with respect to nominees</header><text display-inline="no-display-inline">Section 304(b)(3) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3944">22 U.S.C. 3944(b)(3)</external-xref>) is amended—</text><paragraph id="H92125C2F9D374CFA87D661213321F127"><enum>(1)</enum><text>by striking <quote>Each</quote> and inserting the following: “(A) In this paragraph—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id174951E56068418C870CC020E31EE9A5"><clause id="id75094872826948be9318aaf9a92e92ca" indent="up2"><enum>(i)</enum><text>the term <term>bundled contribution</term> has the meaning given such term in section 304(i)(8)(A) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(i)(8)(A)</external-xref>);</text></clause><clause indent="up2" id="id70561E10310843B4B76433A144916CC6"><enum>(ii)</enum><text>the term <term>contribution</term> has the meaning given such term in section 301(8) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(8)</external-xref>); and </text></clause><clause indent="up2" id="idAF456E6D72A44C8B94C754105C283ACA"><enum>(iii)</enum><text>the term <term>immediate family</term> means—</text><subclause id="id6962BE133DF6409BB0030B0AA376C4BB"><enum>(I)</enum><text>the spouse of the nominee;</text></subclause><subclause id="idA302F10E77EF41B78D555C5132EA605E"><enum>(II)</enum><text>any child, parent, grandparent, brother, or sister of the nominee; and </text></subclause><subclause id="idB16174568BE44ABCB68BFB5CD2790C98"><enum>(III)</enum><text>the spouse of any of the individuals described in subclause (II).</text></subclause></clause><subparagraph indent="up2" id="idE9A4B411A52E4233A8EED19D2D5391E1"><enum>(B)</enum><text>Each</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idB33E10CD37544A3F8D91E751C9C0402A"><enum>(2)</enum><text>in subparagraph (B), as redesignated, by striking <quote>The report</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF2A1AC1C30334FF09E54064EC2944F39"><subparagraph id="idDDB6193703D841239902AC4C81FF9F35" indent="up2"><enum>(C)</enum><text>The report shall include the disclosure of all bundled contributions facilitated by the nominee during the period described in subparagraph (B), in accordance with section 304(i) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(i)</external-xref>), and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idD939CE8446B34A1E8EB7EBFD55F07B04"><enum>(3)</enum><text>by striking <quote>The chairman</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id229197865D7843ED88DF7E07AC744A58"><subparagraph id="idF37C2BF627B943FF800D79DA07120809" indent="up2"><enum>(D)</enum><text>The chairman </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idD967F6FFE4774E28AAD6BCB994E2D76B"><enum>(4)</enum><text>in subparagraph (D), as redesignated—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4d762c3466cb4b4bb0fc3d744e4f1f2e"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>As used in this paragraph</quote> and all that follows and inserting the following: <quote>The Secretary of State shall publish each such report and each <quote>Certificate of Competency</quote> issued pursuant to subsection (a)(5) on a publicly available website of the Department of State.</quote>.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idd9bd6bf26b85487185b4e84954eee3db"><enum>5.</enum><header>Certification of compliance with the Foreign Service Act of 1980</header><text display-inline="no-display-inline">Section 304(a) of the Foreign Service Act of 1980, as amended by section 3(b), is further amended by adding at the end the following:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H3D292A249E6740FC9760750CD76D87D9"><paragraph id="H7696BA2F29A44EBB9E9B2DE4C416EFAD" indent="up1"><enum>(5)</enum><text>The President shall certify to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id466f92da31644ec8ae069203f42a5c1c"><enum>(A)</enum><text display-inline="yes-display-inline">any individual nominated to be a chief of mission meets the qualifications required under paragraph (1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbe2e4b243d694869aeb945e835d3421e"><enum>(B)</enum><text display-inline="yes-display-inline">any contributions made by any such individual or family member, whether or not included in the report described in paragraph (4), played no role in such nomination.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3E31892432944A94A9091CFCF4E6092C"><enum>6.</enum><header>Limitations on overseas placement of special appointment positions that do not exercise significant authority</header><subsection commented="no" display-inline="no-display-inline" id="idc3d15e402e2f4439b917bc00095fefbc"><enum>(a)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text>It is the sense of Congress that all officials of the United States Government offered to receive diplomatic accreditation from a foreign nation should be thoroughly vetted and reviewed for qualification before—</text><paragraph commented="no" display-inline="no-display-inline" id="idfeca11d7a0604505b4fe1d13ab847a4b"><enum>(1)</enum><text display-inline="yes-display-inline">being authorized to represent the United States Government overseas; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30452fd566ef4cacba10f646ceb1b472"><enum>(2)</enum><text display-inline="yes-display-inline">receiving taxpayer-funded salaries, allowances, and employment benefits in connection with such a posting. </text></paragraph></subsection><subsection id="id4cefae7f68f4470e959fbefce92e921e"><enum>(b)</enum><header>Limitations</header><paragraph id="id63258f6cb36747899418aa0a86a963bc"><enum>(1)</enum><header>In general</header><text>Section 1(j)(2) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(j)</external-xref>) is amended—</text><subparagraph id="ide24d77a9d0c34446b9dcc33eecf273b6"><enum>(A)</enum><text>by redesignating subparagraphs (A), (B), and (C) as clauses (i), (ii), and (iii), respectively, and moving such clauses, as redesignated, 2 ems to the right;</text></subparagraph><subparagraph id="id99c4386e87ee481eae643a124bb6498a"><enum>(B)</enum><text>by striking <quote>The President</quote>; and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id563e6f8f7b1c49ff9b62bbdd8e36d21f"><subparagraph id="id914022ec1bb74a199bc88fb285f1dc5f"><enum>(A)</enum><header>In general</header><text>The President</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id9a535a9d1bc741599aaefffbb0e4279f"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id843858fbc84e47e8b73d0bd1a919938d"><subparagraph id="id1275792cd32444619107b85f6140051a"><enum>(B)</enum><header>Limitations</header><text>All special appointments made pursuant to subparagraph (A), and all positions described in schedule B or schedule C of subpart C of part 213 of title 5, Code of Federal Regulations, to a United States diplomatic mission may not exceed 90 days. An individual may not be appointed to more than 1 position described in this paragraph during a single calendar year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id90c57376d78a429eb771c1e135dc5e8e"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on January 1, 2029. </text></paragraph></subsection></section></legis-body></bill>
