which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food and Nutrition Act of 2008 to require States to provide data on fraud in the supplemental nutrition assistance program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE165DCCC5771416295616C2343E175AC"><section section-type="section-one" id="HA7E33C3EE5FD4E2581908A602D4FA968"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SNAP Fraud Reporting Act of 2026</short-title></quote>.</text></section><section id="HCAAF02FEA96A40A19BD4A2E232BA3C68"><enum>2.</enum><header>State submission of fraud data</header><text display-inline="no-display-inline">Section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id35da77a06d8a43c0b2d966a6a5a5d324"><subsection commented="no" display-inline="no-display-inline" id="id7c73fe02184a4fffb95f5a6d603ddc4c"><enum>(y)</enum><header>State submission of fraud data</header><paragraph id="H0E6C1F3777384E37ABE9579BF571A833"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subsection, each State shall submit to the Secretary data on fraud that occurred in the supplemental nutrition assistance program for the 5 most recent fiscal years for which such data are available.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idce4cc7d31d7b43d68e66e866d416ceb0"><enum>(2)</enum><header>Data</header><text display-inline="yes-display-inline">Data submitted under paragraph (1) shall include, as applicable—</text><subparagraph id="H00A71D8394E14A5DA49ADCDB2256C629"><enum>(A)</enum><text>the number of supplemental nutrition assistance program fraud cases open for investigation;</text></subparagraph><subparagraph id="HEA24ADE557454CD3B233CA83C5545059"><enum>(B)</enum><text display-inline="yes-display-inline">the total number of supplemental nutrition assistance program fraud cases identified, including substantiated fraud, such as card skimming and card cloning, and the total dollar amount of those fraud cases;</text></subparagraph><subparagraph id="HC43153B52F804457A0B16FA99BDEED89"><enum>(C)</enum><text>the number and type of enforcement actions taken against fraud in the supplemental nutrition assistance program;</text></subparagraph><subparagraph id="HD5FFE938E95A45A4A812A485D688AABC"><enum>(D)</enum><text>the amount of the recoveries in the cases described in subparagraph (C);</text></subparagraph><subparagraph id="H0D10F982AB804BC7BDEAFA9BEBBD48AB"><enum>(E)</enum><text display-inline="yes-display-inline">for each fiscal year that begins after the date of enactment of this subsection, data on—</text><clause commented="no" display-inline="no-display-inline" id="idd7bbaae6d8a8448ab7b811498128fc7b"><enum>(i)</enum><text display-inline="yes-display-inline">the number of individuals disqualified from the supplemental nutrition assistance program for fraud on the basis that the individual was receiving the benefits of a deceased person or using the identity of a deceased person who received benefits; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0a07f52ac8a04edbb1e44e322506b5d6"><enum>(ii)</enum><text display-inline="yes-display-inline">the dollar amount of those benefits; and</text></clause></subparagraph><subparagraph id="H35F79D98821E4B2EA6A6D7A1541FBF64"><enum>(F)</enum><text display-inline="yes-display-inline">for each fiscal year that begins after the date of enactment of this subsection, data on—</text><clause commented="no" display-inline="no-display-inline" id="idfd23924dc5374873aa0c35532c2e02a4"><enum>(i)</enum><text display-inline="yes-display-inline">the number of individuals disqualified from the supplemental nutrition assistance program for fraud on the basis that the individual submitted no social security number or used a falsified, recycled, stolen, or purchased social security number to be eligible for benefits; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id20d499b6aa294ff2a921b5b707fea9f5"><enum>(ii)</enum><text display-inline="yes-display-inline">the dollar amount of the benefits received by those individuals.</text></clause></subparagraph></paragraph><paragraph id="H08EA3326A31B4153AE69816A3A132E52"><enum>(3)</enum><header>Subsequent submission</header><text display-inline="yes-display-inline">Not later than 60 days after October 1, 2028, and not later than 60 days after each October 1 thereafter, each State shall submit to the Secretary the data described in paragraph (2) for the most recently concluded fiscal year.</text></paragraph><paragraph id="H1FFA1EE26AB645A7866E4657973EC30B"><enum>(4)</enum><header>Penalty</header><text display-inline="yes-display-inline">If a State does not provide the data required under this subsection by the applicable date, the Secretary shall withhold funds to that State under section 16 until such data is received from the State.</text></paragraph><paragraph id="H72215AB1AD064300A8C01AAA5164316C"><enum>(5)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 180 days after receiving data from each State under paragraph (1) and annually under paragraph (3), the Secretary shall submit to Congress, and make publicly available, a report that contains the findings of the Secretary based on that data.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
