<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4714</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260609">June 9, 2026</action-date><action-desc><sponsor name-id="S423">Mr. Ricketts</sponsor> (for himself, <cosponsor name-id="S359">Mr. Heinrich</cosponsor>, <cosponsor name-id="S357">Mrs. Fischer</cosponsor>, <cosponsor name-id="S330">Mr. Bennet</cosponsor>, and <cosponsor name-id="S409">Mr. Luján</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Credit Act of 1978 to authorize payments under the emergency conservation system for updating of fencing to new or emerging technology.</official-title></form><legis-body><section id="id6b658b49e9d24b859bad06e9a6c851ef" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fencing Eligibility for New Conservation Equipment Act</short-title></quote> or the <quote><short-title>FENCE Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id45146163bbed4e12bb8123454f2b8c5c"><enum>2.</enum><header display-inline="yes-display-inline">New or emerging fencing technologies under the emergency conservation program</header><text display-inline="no-display-inline">Section 401(b) of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2201">16 U.S.C. 2201(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id130eb641d9c4486b964e9c2421b1c115"><paragraph id="H7EE2B4C79BA34C1A88FE309F5506D9ED"><enum>(3)</enum><header>New or emerging technologies</header><text display-inline="yes-display-inline">Repair or replacement of fencing under this section may include updating of fencing to new or emerging technology if such updating does not increase the cost of the repair or replacement.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
