which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 28, United States Code, to prevent payouts for insurrectionists.</official-title></form><legis-body><section id="ida665f6112c304d97a086e8d0276c4dfd" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Payouts for Insurrectionists Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id805b99b81ec54c58b1aeb3cb0989ecde"><enum>2.</enum><header>Preventing payouts for insurrectionists</header><subsection id="id7176e8d26559472aa5f13a6011afe84f"><enum>(a)</enum><header>In general</header><text>Section 2680 of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1be5b83a67464ee882b6b63b19ade11b"><subsection id="id7a6f4a54b1c342678e5d40613b3a00e7"><enum>(o)</enum><text>Any claim, without regard to when the act or omission giving rise to the claim occurred, brought by any individual convicted (including any individual convicted and subsequently pardoned) of any felony or misdemeanor—</text><paragraph id="id04b488d4fddf4bba90ff196c5666951f"><enum>(1)</enum><text>arising out of or relating to the January 6, 2021, attack on the United States Capitol building and grounds;</text></paragraph><paragraph id="idea6d3d46153746d7815f354c836b4ce6"><enum>(2)</enum><text>committed with the intent to disrupt, delay, or impede the joint session of Congress certifying the results of the 2020 presidential election, including seditious conspiracy; or</text></paragraph><paragraph id="id5deda56e0012498495ac5f9fee8cb1fb"><enum>(3)</enum><text>involving an action taken to disrupt, interfere with, or unlawfully influence the administration of the 2016 presidential election, including conspiracy to defraud the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8b744899d0894322992be2cfc6912303"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to any claim pending on, or brought on or after, January 20, 2025.</text></subsection><subsection id="idb9b8d5c07ead41cb8b118a7c70ae3d92"><enum>(c)</enum><header>Recoupment of disbursed funds</header><paragraph commented="no" display-inline="no-display-inline" id="idef6677c932cc4e8080c60868b42a9258"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Any individual described in section 2680(o) of title 28, United States Code, as added by subsection (a), who received any monetary payment, judgment, award, compromise, settlement, or interest from the United States (including a payment disbursed under section 1304 of title 31, United States Code (commonly known as the <quote>Judgment Fund</quote>)) pursuant to a claim described in such section 2680(o) during the period beginning on January 20, 2025, and ending on the date of enactment of this Act, shall return the full amount of the payment, judgment, award, compromise, settlement, or interest to the Treasury of the United States.</text></paragraph><paragraph id="id10dc19a6d1d74959a091475fab1ce658"><enum>(2)</enum><header>Enforcement</header><subparagraph commented="no" display-inline="no-display-inline" id="idc2e436d7a9654087a4d51cd63014c210"><enum>(A)</enum><header display-inline="yes-display-inline">Civil action</header><text>The attorney general of any State may bring a civil action in an appropriate district court of the United States on behalf of the United States against any individual required to return funds under paragraph (1) who—</text><clause commented="no" display-inline="no-display-inline" id="id8fa5a4e060b2477f9d0d73d0bd70ad3f"><enum>(i)</enum><text display-inline="yes-display-inline">resides in the State; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id2defcbcc6441425da0b4567561a390d2"><enum>(ii)</enum><text display-inline="yes-display-inline">committed an offense described in section 2680(o) of title 28, United States Code, as added by subsection (a), within the State.</text></clause></subparagraph><subparagraph id="iddb10e7ce61df4d82b13ce1b089487dba"><enum>(B)</enum><header>Remedies</header><text>In an action brought by the attorney general of a State under subparagraph (A), the court shall order the applicable individual to—</text><clause id="id751a754f9c80433292c5a85b73ffcc01"><enum>(i)</enum><text>return the full amount of the funds owed under paragraph (1) to the Treasury of the United States; and</text></clause><clause id="ide94a41fcfa88490b8a1a694a664ee192"><enum>(ii)</enum><text>pay damages equal to 25 percent of the amount described in clause (i) to the State to defray the costs of State law enforcement and the administration of justice.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
