which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To support improved awareness and coordination of Federal communications resources during disasters and emergencies, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Communications Coordination and Preparedness Act</short-title></quote>.</text></section><section id="id5b1aa4c9fd134238876ff947f494dad2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idb581ebfedaac4befae5da4cf0b7c92d3"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ad176afa62340fe9d270a8a1f89fb79"><enum>(2)</enum><header>DIRS</header><text>The term <term>DIRS</term> means the Disaster Information Reporting System described in section 4.18 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a32fc450c9d4c2099e3f022f6a1b91e"><enum>(3)</enum><header>Mandatory Disaster Response Initiative</header><text>The term <term>Mandatory Disaster Response Initiative</term> means the requirements of section 4.17 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id05bcc8b609504f46921657014bd20655"><enum>3.</enum><header>Review of Disaster Information Reporting System activation notices</header><subsection commented="no" display-inline="no-display-inline" id="id554cf578fbfb4566829e4f0fb70b4e72"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall review (and, as appropriate, update) the procedures and practices of the Commission for providing notices regarding the activation and deactivation of DIRS.</text></subsection><subsection id="id59e4d37ad17a47ff856a243dfa62415f"><enum>(b)</enum><header>Considerations</header><text>In carrying out the review (and, if applicable, update) required under subsection (a), the Commission shall, to the extent practicable—</text><paragraph commented="no" display-inline="no-display-inline" id="id3234e14e45984636a82aa9afdfcbcde2"><enum>(1)</enum><text display-inline="yes-display-inline">consult with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7fee62a9664c44ae8f13fb0654c9f2e6"><enum>(A)</enum><text display-inline="yes-display-inline">providers that submit reports in DIRS when the Commission activates DIRS in geographic areas in which those providers provide service; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id04b4c6dcd0b04531b3002cc6559e80d0"><enum>(B)</enum><text>State, local, Tribal, and territorial emergency management and public safety authorities; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31a09f38ea5b43b384bd33687e11a69f"><enum>(2)</enum><text>consider whether any changes to the format or content of a DIRS activation or deactivation notice would improve usability for recipients of such a notice.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8e0991c6f87b4e8b815d6d228f90cb07"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to—</text><paragraph commented="no" display-inline="no-display-inline" id="id5cbdecf3fd3d41d88df641a72c34a919"><enum>(1)</enum><text display-inline="yes-display-inline">require the Commission to adopt new regulations; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id104f287770d7491f81b436dd628dc3ef"><enum>(2)</enum><text>otherwise affect the discretion of the Commission to determine whether or when to activate DIRS.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id81d6de103b5b41c6be269a68f050cd51"><enum>4.</enum><header>Enhanced coordination with public safety entities</header><subsection commented="no" display-inline="no-display-inline" id="idbbbf61c5a2a14d868b5c2f3a54efd196"><enum>(a)</enum><header>Feasibility evaluation</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall evaluate the feasibility of enhancing the existing public safety liaison functions of the Commission, including through expanded use of the 24-hour operations center of the Commission or similar resources, for the purpose of—</text><paragraph id="idcb86f1932abd46d29ef021f62564856e"><enum>(1)</enum><text>serving as a clear point of entry for State, local, Tribal, and territorial officials seeking information on communications status during a disaster or emergency; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc95e24454b7e4b8b87355052d7c90050"><enum>(2)</enum><text>facilitating coordination between the officials described in paragraph (1) and communications service providers before, during, and after a disaster or emergency.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcb793077adcd412388ac43e2d583ffae"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to—</text><paragraph commented="no" display-inline="no-display-inline" id="idef74bf0fd17c47778b0c5b8529c62611"><enum>(1)</enum><text display-inline="yes-display-inline">create a new reporting requirement or operational mandate for any provider of communications services; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11caf32dee27496991bd58e7e8c6bc59"><enum>(2)</enum><text>require the Commission to implement any action based on the evaluation conducted under subsection (a).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id1fb2e35f9aaa448eb4f5f204919fdfef"><enum>5.</enum><header>Development of disaster and emergency communications awareness materials</header><subsection commented="no" display-inline="no-display-inline" id="id1d90b8b2ac5348eebcd59fe833e2cc58"><enum>(a)</enum><header>Development</header><paragraph commented="no" display-inline="no-display-inline" id="idd9ae42f40b5f44c49a4f023ee7cb2df7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall develop and make publicly available plain-language materials to support awareness and understanding among State, local, Tribal, and territorial emergency management and public safety authorities regarding Federal communications and emergency coordination mechanisms during disasters and emergencies.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6a8ccbe72aa4c3285c6fcf6dd5668e9"><enum>(2)</enum><header>Existing resources</header><text>In carrying out paragraph (1), the Commission may draw upon and consolidate existing outreach materials, public notices, guidance documents, and other Commission resources.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfa0340f806fc4a64be80bf1c0e942cbb"><enum>(b)</enum><header>Contents</header><text>The materials developed under subsection (a) shall, to the extent practicable, include information describing—</text><paragraph commented="no" display-inline="no-display-inline" id="idba4001b280af44e8b8c1c11aa755b498"><enum>(1)</enum><text>the purpose and operation of DIRS, including how an activation of DIRS affects the operations of communications service providers and public safety authorities;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76e4ead69bd840238cf1560deeb65bc4"><enum>(2)</enum><text>the types of information that may be made available during an activation of DIRS, which shall include a discussion of—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida4672bc81839412685216b246060ecde"><enum>(A)</enum><text display-inline="yes-display-inline">communications status reports; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0f0b3519c077481f95a9ae1a593a71d3"><enum>(B)</enum><text display-inline="yes-display-inline">the limitations of that information, including applicable protections for confidential or sensitive information;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida6b6fa0a6cd74141af109db2a9d8f583"><enum>(3)</enum><text>how to access the reports described in paragraph (2)(A) and other publicly available information derived from reports submitted during a DIRS activation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida0c9dfc629d24e3684d79b88de0c153a"><enum>(4)</enum><text>the Mandatory Disaster Response Initiative and how the Mandatory Disaster Response Initiative supports coordination regarding, and restoration of, communications services during emergencies and disasters;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5da604b38e2b4fb188d758cb5760fc28"><enum>(5)</enum><text>existing Commission resources and coordination capabilities, including points of contact and the 24-hour operations capabilities of the Commission, that may be available to State, local, Tribal, and territorial officials during emergencies and disasters; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbeedb89f8b4240899d466e9b92645d25"><enum>(6)</enum><text>general information describing communications capabilities and services that may be available to support public safety communications during emergencies and disasters, including how—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfca5e1bc3942449abef5f0b1159c5cdb"><enum>(A)</enum><text display-inline="yes-display-inline">those capabilities may supplement or support other communications systems and coordination mechanisms described in this subsection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id49ace1d90bc24d7c9f66aad0ab19223f"><enum>(B)</enum><text>State, local, Tribal, and territorial authorities may coordinate with communications providers and the Commission regarding those capabilities.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb1f5493c0ef845c1a08d803797680c42"><enum>(c)</enum><header>Consultation</header><text>In carrying out this section, the Commission shall, to the extent practicable, consult with—</text><paragraph commented="no" display-inline="no-display-inline" id="id7ce3c611066347338b23426f4d5c27f3"><enum>(1)</enum><text>providers of communications services that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9c276d848d0f4e24b258d7b7d93a566b"><enum>(A)</enum><text display-inline="yes-display-inline">submit reports in DIRS when the Commission activates DIRS in geographic areas in which those providers provide service; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id68ae8d0f01b14855bbaaf1cb3c790694"><enum>(B)</enum><text>are subject to the Mandatory Disaster Response Initiative; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id12e0cb90123244d0b8f82d31cafc74e1"><enum>(2)</enum><text>State, local, Tribal, and territorial emergency management and public safety authorities.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5b99bf9e86c94471ace5dd5e9fa08a0e"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to require the Commission to adopt new regulations, or modify existing regulations, relating to DIRS or the Mandatory Disaster Response Initiative.</text></subsection></section></legis-body></bill>
