which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to prohibit the provision of minor-simulating chatbots that engage in sexually explicit conduct or sexually explicit conversation, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Illegal Minor Simulations Act</short-title></quote> or the <quote><short-title>SIMS Act</short-title></quote>.</text></section><section id="ida929aa3ff04b43a7bfd08fc7017b8a04"><enum>2.</enum><header>Prohibition on minor-simulating chatbots that engage in sexually explicit conduct or sexually explicit conversation</header><subsection commented="no" display-inline="no-display-inline" id="idb0fa021720054fc297af05e3bf88c9da"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id5ffb976174664344b5cf1d1d167e1505"><section id="id9ac4d521e02e4eef98e912a2ff4b0171"><enum>2260B.</enum><header>Prohibition on minor-simulating chatbots that engage in sexually explicit conduct or sexually explicit conversation</header><subsection commented="no" display-inline="no-display-inline" id="ide5130c532cb74dfd81a54440c2c75d27"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id92d4f335fb374190b2c94a315c40935f"><enum>(1)</enum><header>Chatbot</header><text>The term <term>chatbot</term> means any interactive computer service (as defined in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>)) or software application that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id45c5abf720cb47f3824603edfff566a1"><enum>(A)</enum><text display-inline="yes-display-inline">is designed to simulate interactive conversation with human users, especially over the internet, that mimics human-like communication characteristics, including emotions and intentions;</text></subparagraph><subparagraph id="idb16f6fbf7bd84d43992f7b1658badbab" commented="no"><enum>(B)</enum><text>produces new expressive content or responses not fully predetermined by the developer or operator of the service or application; and</text></subparagraph><subparagraph id="id3b1a4dcc65ff49b9840c330c0ec09c3b" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>accepts open-ended natural-language or multimodal user input and produces adaptive or context-responsive output.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23241a0ed5ef43d0948732d8f5e712d6"><enum>(2)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means any person that owns or operates a chatbot made available to individuals in the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11b31be3f73f4432b299b9513ee0e62d"><enum>(3)</enum><header>Minor</header><text>The term <term>minor</term> means an individual who has not attained 18 years of age.</text></paragraph><paragraph id="id1b40afe0081444e3b7318beb4f65ee48"><enum>(4)</enum><header>Sexually explicit conduct</header><text>The term <term>sexually explicit conduct</term> has the meaning given the term in section 2256.</text></paragraph><paragraph id="id3472bdf8ae344b8093def36272807c19" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Sexually explicit conversation</header><text>The term <term>sexually explicit conversation</term> means any interactive verbal or visual communication, in speech, image, or text, that simulates sexually explicit conduct.</text></paragraph></subsection><subsection id="id865c93c6cfd14e59b8cbde3d672db27f"><enum>(b)</enum><header>Offense</header><paragraph commented="no" display-inline="no-display-inline" id="id49baeee8c8994b0f94e11bdf46939166"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), it shall be unlawful for a covered entity to make available to human users a chatbot that is designed to simulate (through text, audio, visual, or other means) a minor engaged in interactive sexually explicit conduct or an interactive sexually explicit conversation with a human user, when such conduct or conversation—</text><subparagraph commented="no" display-inline="no-display-inline" id="id98c97fa7cdd74bb085868660657b404d"><enum>(A)</enum><text display-inline="yes-display-inline">is obscene; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide36e7b19f7a34e9ab181f902fc897e37"><enum>(B)</enum><text>constitutes conduct that would violate any criminal law applicable in the relevant jurisdiction.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6af1b124c922416586a8e5197330db9d"><enum>(2)</enum><header>Exemption</header><text>The Attorney General may, upon request, provide an exemption from the prohibition under paragraph (1) for the limited purpose of law enforcement investigation activities to the following entities:</text><subparagraph commented="no" display-inline="no-display-inline" id="id5b4e26d3f53f43eb92054545c49a6494"><enum>(A)</enum><text>A Federal law enforcement agency that is involved in the investigation of child sexual exploitation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id35368f165ce040c8a7b733865f525591"><enum>(B)</enum><text display-inline="yes-display-inline">A State or local law enforcement agency that is involved in the investigation of child sexual exploitation.</text></subparagraph><subparagraph id="id63834676a01748b0a33573e331ebfa88" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">A foreign law enforcement agency that—</text><clause commented="no" display-inline="no-display-inline" id="idfd33c6151ca048b7bfec933c6d74bffc"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idff63434133b046dab1831ff30ace3d4a"><enum>(I)</enum><text display-inline="yes-display-inline">is designated by the Attorney General or a foreign law enforcement agency; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida7762192326e4b10adce2ba192a4f78b" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">has an established relationship with the Federal Bureau of Investigation or INTERPOL; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id46a76aeeda0e4aa9aef32baa4d934ae8"><enum>(ii)</enum><text display-inline="yes-display-inline">is involved in the investigation of child sexual exploitation.</text></clause></subparagraph></paragraph><paragraph id="ida46bc255d8444468847b905040adb5bb"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in paragraph (1) shall be construed to—</text><subparagraph id="id447f50d9b63e44adbabb3ac52a3ccafa"><enum>(A)</enum><text>prohibit internal or external research, red-teaming, or other evaluation, or publication of the results thereof, designed to assess whether a chatbot violates the prohibition under that paragraph;</text></subparagraph><subparagraph id="id7fb43d8a43c44ceb93be0fd1d334e83e"><enum>(B)</enum><text>create liability for a user of a chatbot described in that paragraph who is not a covered entity; or</text></subparagraph><subparagraph id="id9daa3298bee04b7b9a6becd0441abb29"><enum>(C)</enum><text>depart from the standard under the Constitution of the United States applied in determining the meaning of the term <term>obscene</term>.</text></subparagraph></paragraph><paragraph id="idabe99cfd9d474f17b5d035cb8e83d07b"><enum>(4)</enum><header>Nonrequired element of offense</header><text>It is not a required element of the offense under paragraph (1) that the minor simulated actually exist.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddc8a93279ef749f1a93780bb6440a260"><enum>(c)</enum><header display-inline="yes-display-inline">Criminal penalty</header><text display-inline="yes-display-inline">Any person who willfully violates subsection (b) shall be fined not more than $100,000.</text></subsection><subsection id="id41a9556f02b44658bf63f2ddc910f093"><enum>(d)</enum><header>Civil enforcement</header><paragraph id="id38165a99471b47f585dc674eb85edefc"><enum>(1)</enum><header>In general</header><text>In the case of a violation of subsection (b) or a regulation promulgated thereunder, the Attorney General may bring a civil action in an appropriate district court of the United States to—</text><subparagraph id="idd977e805039d407e8c6c0f9dc3740c09" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">enjoin the violation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id09bf4d1db0004a8a90e2df6117bf3e39"><enum>(B)</enum><text display-inline="yes-display-inline">enforce compliance with subsection (b) or the regulation promulgated thereunder; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd655a3c9ff0e436393ff19495f4aacae"><enum>(C)</enum><text display-inline="yes-display-inline">obtain civil penalties under paragraph (3) of this subsection, restitution, and other appropriate relief.</text></subparagraph></paragraph><paragraph id="ida1c31f73a7524d3c96c11f9f1f6ea205"><enum>(2)</enum><header>Attorney General powers</header><subparagraph id="id63b2b8410a134fa6927f41bffe0ac8f9"><enum>(A)</enum><header>Investigatory powers</header><text>For the purpose of conducting investigations or bringing enforcement actions under this subsection, the Attorney General may issue subpoenas, administer oaths, and compel the production of documents or testimony.</text></subparagraph><subparagraph id="idf8a1d480abd649b2982dc63696c4e1a9"><enum>(B)</enum><header>Rulemaking</header><text>The Attorney General may promulgate any regulations necessary to carry out this section.</text></subparagraph></paragraph><paragraph id="id1d1a0928bea94cc99f4c783863357a49"><enum>(3)</enum><header>Civil penalties</header><text>Any person who violates subsection (b) or a regulation promulgated thereunder shall be subject to a civil penalty not to exceed $100,000 for each violation.</text></paragraph></subsection><subsection id="id84ea65c88cea467aa015a44dd9e27298"><enum>(e)</enum><header>Annual report</header><text>The Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives that details, for the period covered by the report—</text><paragraph id="ide3629cacb45c44939a3a88fcad979514"><enum>(1)</enum><text>the number of persons convicted under this section, disaggregated by individuals and corporations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4976f43ee03146f8ab15597d82ffaecc"><enum>(2)</enum><text display-inline="yes-display-inline">the number of criminal penalties or civil penalties imposed under this section;</text></paragraph><paragraph id="id92fd0ebc7924409080638c3c5f1b0dde"><enum>(3)</enum><text>the number of criminal or civil proceedings initiated for a violation of this section;</text></paragraph><paragraph id="iddf7a18bb09754e52bf133b1375c01155"><enum>(4)</enum><text>the number of law enforcement investigations into potential violations of this section that were conducted using chatbots described in subsection (b)(1); and</text></paragraph><paragraph id="id6353c268c30545a9ada408f542a732a8"><enum>(5)</enum><text>any other information the Attorney General considers relevant to include.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idac96141182b64315a20464db7fa1572a"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idec9584728ba54f9083ef69d708605255"><toc><toc-entry level="section" bold="off">2260B. Prohibition on minor-simulating chatbots that engage in sexually explicit conduct or sexually explicit conversation.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id87ea4b6725a3410c9b174c560214684a"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect 180 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
