which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Trade Act of 1978 to expand agricultural market access, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Market Access Act</short-title></quote>.</text></section><section id="H4F53B77E1BAB4FA184E4C046B3666562"><enum>2.</enum><header>Agricultural trade promotion and facilitation</header><subsection id="H3EB62B2403634A00ABEF98F4A73F7489"><enum>(a)</enum><header>Modification to foreign market development cooperator program</header><text>Section 203(c) of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5623">7 U.S.C. 5623(c)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block id="HDEFC33F39CBB41E49B24136238CF2A9F" style="OLC"><paragraph id="H3B27DADFCC1C4E229FF23568E516FAF2"><enum>(4)</enum><header>Technical assistance to improve infrastructure in foreign markets for united states agricultural commodities</header><subparagraph id="H647C70E284C244F2988CD67DF798DBBF"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">As part of the program established under this subsection, the Secretary shall enter into contracts or other agreements, with eligible trade organizations or with nonprofit organizations with expertise in supply chain infrastructure, to provide needs assessments, training, and other technical assistance to enhance the capabilities of infrastructure in new and developing foreign markets, including infrastructure relating to cold chain capacity, port improvements, and other developments, to ensure that United States agricultural commodities are not damaged or lost due to deficiencies of such infrastructure.</text></subparagraph><subparagraph id="H4FC96886842D4472BE7B92C7287F3EF5"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">Of the amounts made available to carry out the program established under this subsection, not more than $1,500,000 for fiscal year 2027 and not more than $5,000,000 for fiscal year 2028 and each fiscal year thereafter may be made available to carry out this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H935AAB9ADD4E42B1BFD221AE9EFF46D4"><enum>(b)</enum><header>Report on competitiveness of united states specialty crops</header><text>Section 203(e)(7) of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5623">7 U.S.C. 5623(e)(7)</external-xref>) is amended to read as follows:</text><quoted-block id="H06C19EA7AE6F401F93CCD60AC30EE9D7" style="OLC"><paragraph id="H3FE8934BAB1647B3A36B9C08113FA4B4"><enum>(7)</enum><header>Biennial report</header><subparagraph id="H5F49FBF3586E43E5AAE1CCCF8076810B"><enum>(A)</enum><header>In general</header><text>The Secretary, in consultation with the United States Trade Representative, shall submit every 2 years to the appropriate congressional committees a report detailing the competitiveness of United States specialty crops.</text></subparagraph><subparagraph id="HAD1E8BBCE9054B1FA597E2611CD55259"><enum>(B)</enum><header>Elements</header><text>The report required by subparagraph (A) shall—</text><clause id="HC11F3D88DD6B4766A55808C6BA91ADE9"><enum>(i)</enum><text>identify and analyze acts, policies, or practices of foreign countries that constitute significant barriers to, or distortions of, United States exports of specialty crops, including the imposition of—</text><subclause id="HB12E6DE9A78F450389D88AE7206876E5"><enum>(I)</enum><text>tariffs (including retaliatory tariffs) or quotas (including tariff-rate quotas); and</text></subclause><subclause id="H5074B430B73C419092E71F6D247B414D"><enum>(II)</enum><text>nontariff barriers, including technical barriers to trade, sanitary and phytosanitary measures, import licensing procedures, and subsidies;</text></subclause></clause><clause id="HBCA4556B1C584DB3B835C271B40F7AC7"><enum>(ii)</enum><text>identify acts, policies, or practices of foreign countries that enhance the competitiveness of imported specialty crops with domestic specialty crop producers;</text></clause><clause id="H1D6C31E72BAE443EBD3AC411A54964FC"><enum>(iii)</enum><text>identify and analyze any differences in applicable food safety regulations of foreign countries that may result in imported specialty crops posing a risk to United States consumers;</text></clause><clause id="H679B89610B01449C89C2AB102A76E18F"><enum>(iv)</enum><text>make an estimate of the impacts on the competitiveness of United States specialty crops of any act, policy, or practice identified under clauses (i) and (ii);</text></clause><clause id="H61F7D0B7353F4E538623104331B2F881"><enum>(v)</enum><text>assess the extent to which each act, policy, or practice identified under clauses (i) and (ii) are subject to international agreements to which the United States is a party;</text></clause><clause id="H22EBDF71DECB4448BA120BF4D3F45B9A"><enum>(vi)</enum><text>include information with respect to any action taken by the executive or legislative branch during the 2 years preceding submission of the report, or expected to be taken after submission of the report, to eliminate any act, policy, or practice identified under clauses (i) and (ii), including—</text><subclause id="H00A5D2920ABA49658CC53828A217F8E3"><enum>(I)</enum><text>any action under section 301;</text></subclause><subclause id="HEF583E9D65514EF9A0D76154BB192072"><enum>(II)</enum><text>negotiations or consultations with foreign governments, which may include engagement through the standing committee on sanitary and phytosanitary matters established under a free trade agreement to which the United States is a party; and</text></subclause><subclause id="HDCCC1A6A9E5D4840B291367C9F5422A5"><enum>(III)</enum><text>action at the World Trade Organization, including dispute settlement actions, consultations, or negotiations; and</text></subclause></clause><clause id="H6F360428F0F54BE7AD81B139CBB3A40F"><enum>(vii)</enum><text>a description of—</text><subclause id="H8DDB2888A0D143BE86ADA8B0624E069A"><enum>(I)</enum><text>any funds provided under subsection (f)(3)(A)(iv) that were not obligated in the fiscal year preceding submission of the report; and</text></subclause><subclause id="H03C154EA1CF24270B39CD83821D5557B"><enum>(II)</enum><text>the reason such funds were not obligated.</text></subclause></clause></subparagraph><subparagraph id="H45CAC950B7284FB29EB67FF13634FBB0"><enum>(C)</enum><header>Comment period</header><text>In preparing the report required by subparagraph (A), the Secretary, in coordination with the United States Trade Representative, shall seek and consider comments from the public and from the Agricultural Technical Advisory Committee for Trade in Fruits and Vegetables.</text></subparagraph><subparagraph id="H6B5DECE2E46C415A98E86639D91DAD17"><enum>(D)</enum><header>Form of report</header><text>The report required by subparagraph (A) shall be made available to the public in machine-readable format.</text></subparagraph><subparagraph id="H9688B7BF5CB24C0982B939A3FF720263"><enum>(E)</enum><header>Appropriate congressional committees defined</header><text>In this paragraph, the term <term>appropriate congressional committees</term> means—</text><clause id="H75FE109B5EBC432F8ABADBD79B6C19CF"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Agriculture and the Committee on Ways and Means of the House of Representatives; and</text></clause><clause id="H95FCB122317948F794DE0937918EB96B"><enum>(ii)</enum><text>the Committee on Agriculture, Nutrition, and Forestry and the Committee on Finance of the Senate.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H931914F849D04CA8A7CCEAA6FE96A56F" commented="no"><enum>(c)</enum><header>Modification and extension of funding</header><text>Section 203(f) of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5623">7 U.S.C. 5623(f)</external-xref>) is amended—</text><paragraph id="HD6CC7B37DFA24DED97BA17C4CF1F9002"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="HB703310C31A3461BB9A4C62FB5EFCB44" display-inline="no-display-inline"><paragraph id="H59641577AC6C4237BB2CE74812E8513B"><enum>(2)</enum><header>Funding amount</header><text display-inline="yes-display-inline">Of the funds of, or an equal value of commodities owned by, the Commodity Credit Corporation, the Secretary shall use to carry out this section the following amounts, to remain available until expended:</text><subparagraph id="H8C91153A385045689C1A84BAC8B83FB4"><enum>(A)</enum><text display-inline="yes-display-inline">For fiscal year 2026, $255,000,000.</text></subparagraph><subparagraph id="H816AB2A818BC4B0B901E3F0FF975C24A"><enum>(B)</enum><text>For fiscal year 2027, $500,000,000.</text></subparagraph><subparagraph id="HB0999FDE44824C07BC0535E0DB78F3EF"><enum>(C)</enum><text display-inline="yes-display-inline">For each of fiscal years 2028 through 2031, $533,000,000.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HCF7B047AD80540FDA51209D13DD12200"><enum>(2)</enum><text>in paragraph (3)(A)—</text><subparagraph id="H4DEA88E962E34779AB515F149A8F435F"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>For each of fiscal years 2019 through 2023, the Secretary</quote> and inserting <quote>The Secretary</quote>;</text></subparagraph><subparagraph id="H6146E9010B7A45F98304E66391363AC0"><enum>(B)</enum><text>in clause (i), by striking <quote>not less than</quote> and all that follows through the end and inserting the following:</text><quoted-block style="OLC" id="H7B8AAE6301204180AEB576FD95423CA6" display-inline="yes-display-inline"><text>not less than—</text><subclause id="H1E084151DBD44B509952B276D6DBBD09"><enum>(I)</enum><text display-inline="yes-display-inline">$200,000,000 for fiscal year 2026;</text></subclause><subclause id="H347F130A164D487495C83205E927E568"><enum>(II)</enum><text>$400,000,000 for fiscal year 2027; and</text></subclause><subclause id="HF1CABC7C7E154E28A3256125AC8E54A3"><enum>(III)</enum><text display-inline="yes-display-inline">$410,000,000 for each of fiscal years 2028 through 2031.</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HE518155763584BDDBF9C94CD64B30A25"><enum>(C)</enum><text>in clause (ii), by striking <quote>not less than</quote> and all that follows through the end and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="HBB143D2C9D744426B2933F339B45282D"><text>not less than—</text><subclause id="HE1F23BC3F7B240BB905D504B1414C8F3"><enum>(I)</enum><text display-inline="yes-display-inline">$34,500,000 for fiscal year 2026;</text></subclause><subclause id="HE00549B401744FE89E370E48F08681F8"><enum>(II)</enum><text>$70,500,000 for fiscal year 2027; and</text></subclause><subclause id="HB1456282D11348C5ACE009664B1E6753"><enum>(III)</enum><text display-inline="yes-display-inline">$82,000,000 for each of fiscal years 2028 through 2031.</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H61DA3712B15D4C7BB7B9985DD561CC77"><enum>(D)</enum><text>in clause (iii), by striking <quote>not more than</quote> and all that follows through the end and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H1684EA478458433F9EB2681EB356720B"><text>not more than—</text><subclause id="HCAE1453CE16E43A2B8DBBA29834904F6"><enum>(I)</enum><text display-inline="yes-display-inline">$8,000,000 for each of fiscal years 2026 and 2027; and</text></subclause><subclause id="HCAD9FEDA15C4411885A6FB4CAF2231A7"><enum>(II)</enum><text display-inline="yes-display-inline">$16,000,000 for each of fiscal years 2028 through 2031.</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H1E139A27B970460EAD2F123E1DDEF9A8"><enum>(E)</enum><text>in clause (iv), by striking <quote>Corporation</quote> and all that follows through the end and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H9972D64E790940DC821A7D89942F656D"><text>Corporation—</text><subclause id="HCFC287A27A794CBC9DDC5E9E07FBE350"><enum>(I)</enum><text display-inline="yes-display-inline">$9,000,000 for fiscal year 2026; and</text></subclause><subclause id="H163733EA19B44C1F91C1ED0EE34064C0"><enum>(II)</enum><text display-inline="yes-display-inline">$18,000,000 for each of fiscal years 2027 through 2031.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF1FD6B65B20D492BB3E49FCB887DA009"><enum>(F)</enum><text>in clause (v)(I), by striking <quote>commodities,</quote> and all that follows through the end and inserting the following: “commodities—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idff496073bbab4e4993bacba749fd0db5"><item commented="no" display-inline="no-display-inline" id="ida8393ce2c7fc45f1b4952544cdcc81bc"><enum>(aa)</enum><text display-inline="yes-display-inline">$3,500,000 for each of fiscal years 2026 and 2027; and</text></item><item commented="no" display-inline="no-display-inline" id="idafde272626724e2e90c95eb42ad3a177"><enum>(bb)</enum><text display-inline="yes-display-inline">$7,000,000 for each of fiscal years 2028 through 2031.</text></item><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HF859A4D3AC4240E99660DFFFB2652501"><enum>(d)</enum><header>Repeals</header><text display-inline="yes-display-inline">The following provisions of law are repealed:</text><paragraph id="H293CE7635FAC485DAD076AC71DD54F1D"><enum>(1)</enum><text>Section 718 of title VII of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 1999 (as enacted by section 101(a) of division A of <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/7/5623">7 U.S.C. 5623</external-xref> note).</text></paragraph><paragraph id="HE3A85C579EAF4D8B93F9EBA83E9D5B6E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Section 10602 of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/7/5623a">7 U.S.C. 5623a</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
