Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to award grants to eligible crisis centers to provide follow-up services to individuals receiving suicide prevention and crisis intervention services, to amend the Communications Act of 1934 to improve the accessibility of 9–8–8, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>9–8–8 Connect Act</short-title></quote>.</text></section><section id="H30D28DF0F7024EF8959F9E309FAA5852"><enum>2.</enum><header>Grants for follow-up services to individuals receiving suicide prevention and crisis intervention services</header><text display-inline="no-display-inline">Title V of the Public Health Service Act is amended by inserting after section 520E–4 (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-36d">42 U.S.C. 290bb–36d</external-xref>) the following:</text><quoted-block id="HD3809A59CB324593A09DB915F31336A1" display-inline="no-display-inline" style="OLC"><section id="HC8DB335C3FCB4812A4B9A462705E6504"><enum>520E–5.</enum><header>Follow-up services to individuals receiving suicide prevention and crisis intervention services</header><subsection id="HEF209EC0C7EC42BE8848924C73BDB2E1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary, shall award grants to eligible crisis centers to provide follow-up services to individuals receiving suicide prevention and crisis intervention services.</text></subsection><subsection id="H2991DD8C487841EC98908743C28B9A66"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to seek a grant under this section, a crisis center shall be a member of the network of crisis centers coordinated under section 520E–3(b)(1).</text></subsection><subsection id="HDDFA94802EB64B82BDE0E60894436647"><enum>(c)</enum><header>Selection</header><text display-inline="yes-display-inline">The Secretary shall select recipients of grants under this section based on the relative needs, including capacity and service gaps, of the eligible crisis centers applying for such grants.</text></subsection><subsection id="H13EEF76493DB4F9B947E6160491D85E2"><enum>(d)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance to recipients of grants under this section regarding best practices for the implementation of services through such grants.</text></subsection><subsection id="H00F08441CDCC437FBFF89B142A16AF16"><enum>(e)</enum><header>Use of funds</header><paragraph id="HE0B6F9381C394661BDE597DC5E543067"><enum>(1)</enum><header>In general</header><text>A crisis center receiving a grant under this section shall use the grant to provide follow-up services to individuals who directly contact the 9–8–8 Suicide and Crisis Lifeline (including by call, text, or chat) and who are identified by the crisis center as being at risk of suicide or experiencing a mental health or substance use crisis.</text></paragraph><paragraph id="H07310659FE7A4C90990F1BD2A10AFA2E"><enum>(2)</enum><header>Follow-up services</header><text>Follow-up services referred to in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8370c20280904ed79f2ab501e9115b58"><enum>(A)</enum><text display-inline="yes-display-inline">may include—</text><clause id="H3171E21A2B1F49928CDFC56AAD08C482"><enum>(i)</enum><text display-inline="yes-display-inline">check-ins to assess well-being and level of risk;</text></clause><clause id="H41B0828D866F4D52BDB4B46A318A8D16"><enum>(ii)</enum><text display-inline="yes-display-inline">outreach to ensure engagement in services and supports, in coordination with mobile crisis service providers if involved;</text></clause><clause id="HED0B270D05CB432287AE40BF24B05384"><enum>(iii)</enum><text>collaboration with family, caregivers, and natural social supports; and</text></clause><clause id="H91A198965CC94218A8C2F521BE9B652B"><enum>(iv)</enum><text>referrals based on the needed level of care; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18a5f2f135f24d6698ef3b61d3eb8404"><enum>(B)</enum><text>shall be provided only to individuals described in paragraph (1), consistent with subsection (f).</text></subparagraph></paragraph></subsection><subsection id="HB313499D9DC34A44911A6BE875DF5BD3" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Informed consent and privacy protections</header><paragraph id="idb5ba676513e84056a83e065ed9c6cc4f"><enum>(1)</enum><header>In general</header><text>A crisis center receiving a grant under this section may provide follow-up services to an individual only after obtaining the informed consent of such individual.</text></paragraph><paragraph id="id59ddabe52b304eccbaef7542432b8476"><enum>(2)</enum><header>Elements of consent</header><text>In obtaining informed consent under paragraph (1), the crisis center shall clearly and conspicuously disclose—</text><subparagraph id="idc2db949c741d4e478333a98381a2592a"><enum>(A)</enum><text>the nature, scope, and purpose of follow-up services;</text></subparagraph><subparagraph id="id1251440d2bde4e70adb9af55137b8228"><enum>(B)</enum><text>the types of communications that may be used;</text></subparagraph><subparagraph id="idc7a5669270c74d98a638b554923f8d5d"><enum>(C)</enum><text>the duration and frequency of such follow-up; and</text></subparagraph><subparagraph id="idfde53fa557e84fca8f75d20b2c7c61f8"><enum>(D)</enum><text>the individual’s right to decline or withdraw consent at any time without affecting access to crisis services.</text></subparagraph></paragraph><paragraph id="id811db709be3b4e2bae31a70e2e7625ca"><enum>(3)</enum><header>Limitation</header><text>Follow-up services under this section may not include the sharing of personally identifiable information with third parties without the express, written, and revocable consent of the individual, except as otherwise required by Federal or State law.</text></paragraph><paragraph id="idc9d4e8fc588b454e8367950e816418cb"><enum>(4)</enum><header>No unintended interventions</header><text>A crisis center shall ensure that follow-up services are conducted in a manner that does not result in involuntary or coercive interventions absent imminent risk.</text></paragraph><paragraph id="ided2bc821e8574dd1b2fe8027116e81ca"><enum>(5)</enum><header>Guidance</header><text>Not later than 1 year after the date of enactment of this section, the Secretary, acting through the Assistant Secretary for Mental Health and Substance Use, shall develop and disseminate model national standards for informed consent and privacy protections specific to follow-up services under this section, consistent with applicable Federal and State privacy laws, including the Health Insurance Portability and Accountability Act of 1996.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida11a9bb7c7ac4d2d918118aa50cba36e"><enum>(g)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $30,000,000 for fiscal year 2026, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id826bdf07b7644ef3bbd4e7cd908dd05f"><enum>3.</enum><header>9–8–8 Improvement</header><subsection id="idddac62fa3c03476aaf958abbbbec21f8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7585930485aa494c86c55ecad8bebadc"><enum>(1)</enum><header><enum-in-header>9–8–8</enum-in-header></header><text display-inline="yes-display-inline">The term <term>9–8–8</term> means 9–8–8, as designated as the universal telephone number within the United States for the purpose of the national suicide prevention and mental health crisis hotline system under section 251(e)(4) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251(e)(4)</external-xref>).</text></paragraph><paragraph id="id8e292e7572644191866fbef4d7965b59"><enum>(2)</enum><header>Commercial mobile service</header><text display-inline="yes-display-inline">The term <term>commercial mobile service</term> has the meaning given the term in section 332(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)</external-xref>).</text></paragraph><paragraph id="id34b1f40f6b2c489799423458f7c4084e" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Non-service-initialized handset</header><text display-inline="yes-display-inline">The term <term>non-service-initialized handset</term> has the meaning given the term in section 9.10(o)(3)(i) of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><subsection id="id4bd8781b59ab412d8a128e4d69c851ed"><enum>(b)</enum><header>Transmission of all calls and texts</header><paragraph commented="no" display-inline="no-display-inline" id="id8efd38fbde6a44c596b506fca3d19a5b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Federal Communications Commission shall promulgate regulations to ensure that each provider of commercial mobile service transmits all calls and text messages made or sent to 9–8–8, including a call or text message that originates from a non-service-initialized handset (if the call or text message originates on a phone using a compliant radio frequency protocol of the provider).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec3726279863435ea3db319b2bed8719"><enum>(2)</enum><header>Implementation</header><text>A provider of commercial mobile service shall comply with the regulations promulgated under paragraph (1) not later than 1 year after the date on which the regulations are promulgated.</text></paragraph></subsection><subsection id="id843c1329713e423fbe7ce258e211197d"><enum>(c)</enum><header>Configuration of multi-Line telephone systems for direct dialing</header><paragraph id="ida484daa3bdd940dc820eae7d6be0b79b"><enum>(1)</enum><header>In general</header><text>Section 721 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/623">47 U.S.C. 623</external-xref>) is amended—</text><subparagraph id="id0cadbc648fe942429c19e46eb35a9cc1"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="OLC">and 9–8–8</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">9–1–1</header-in-text></quote>;</text></subparagraph><subparagraph id="id03511d37ad0145e99dcba56706f903c9"><enum>(B)</enum><text>in subsection (a), by inserting <quote>or 9–8–8</quote> after <quote>9–1–1</quote>; and</text></subparagraph><subparagraph id="id6b91c0c2a32d4c8ab7b1c10ab1fd6353"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting <quote>or 9–8–8</quote> after <quote>9–1–1</quote>.</text></subparagraph></paragraph><paragraph id="id96a341ecaeda4d4e939b349ccfdc1846"><enum>(2)</enum><header>Applicability</header><subparagraph id="id91dc7889fb76481d8765ff21bc9f5aa0"><enum>(A)</enum><header>In general</header><text>The amendments made by paragraph (1) shall apply to actions occurring on and after the date that is 2 years after the date of enactment of this Act.</text></subparagraph><subparagraph id="id7d94b5b06b2341a49e57eb1016deb120" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The amendment made by paragraph (1)(C) shall not apply to the management or operation of a multi-line telephone system installed before the date that is 2 years after the date of enactment of this Act, if the system is not able to be configured to satisfy the requirements of the amendment, without an improvement to the hardware or software of the system.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
