<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4638</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260521">May 21, 2026</action-date><action-desc><sponsor name-id="S288">Ms. Murkowski</sponsor> (for herself, <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, and <cosponsor name-id="S409">Mr. Luján</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To remove administrative barriers to participation of Indian tribes in Federal child welfare programs, and increase Federal funding for tribal child welfare programs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Strong Native Families and Children Act</short-title></quote>.</text></section><section id="id1aba6339cc5f4dccb8bf0c24302b46c2"><enum>2.</enum><header>Additional resources and improvements for Tribal child welfare programs</header><subsection id="id3c5027483b9e4e4a84d1568da2947ae7"><enum>(a)</enum><header>Minimum grant amount</header><text>Section 433(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629c">42 U.S.C. 629c(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide4d962694e6247a789c7c2bb6819aed8"><subsection id="id58fe13be179c46a9b6cbabdf2a53d313"><enum>(a)</enum><header>Indian tribes or tribal consortia</header><paragraph id="id9efe4c7e060846a18f8253d8b1f90d4a"><enum>(1)</enum><header>Indian tribes</header><subparagraph id="idec21424b11884952a350a046697e541b"><enum>(A)</enum><header>In general</header><text>From the amount reserved pursuant to section 436(b)(2) for any fiscal year, the Secretary shall allot to each Indian tribe with a plan approved under this subpart—</text><clause id="id87980917ead0441c85ee9bfead25d79f"> <enum>(i)</enum> <text>$5,000; plus</text>
 </clause><clause id="idfdc1a1058fe64f09807ca3e298027eb0"><enum>(ii)</enum><text>an amount that bears the same ratio to the adjusted reserved amount as the number of children in the Indian tribe bears to the total number of children in all Indian tribes with State plans so approved, as determined by the Secretary on the basis of the most current and reliable information available to the Secretary.</text></clause></subparagraph><subparagraph id="idb9fe2f778cb34cbd89ffd64b927dd67a"><enum>(B)</enum><header>Adjusted reserve amount</header><text>In subparagraph (A), the term <term>adjusted reserved amount</term> means, with respect to a fiscal year—</text><clause id="id0b0d10c7f92446a6b32d5bdcbff8e740"> <enum>(i)</enum> <text>the amount reserved pursuant to section 436(b)(2) for the fiscal year; minus</text>
 </clause><clause id="idd653c546140f49d586f2dfc039ad6815"><enum>(ii)</enum><text>the product of—</text><subclause id="idca510f06c40848888f2631548d855ed4"><enum>(I)</enum><text>$5,000; and</text></subclause><subclause id="id37e70d2a06ec4683bc3eb91c4592c987"><enum>(II)</enum><text>the number of Indian tribes to which an allotment is made under this subsection for the fiscal year.</text></subclause></clause></subparagraph></paragraph><paragraph id="id353281005b504773a9fd8e60d8563029"><enum>(2)</enum><header>Tribal consortia</header><text>If a consortium of Indian tribes submits a plan approved under this subpart, the Secretary shall allot to the consortium an amount equal to the sum of the allotments determined for each Indian tribe that is part of the consortium.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1e4938d902a14f119cd81b557dd8dff7"> <enum>(b)</enum> <header>Elimination of special rule and recognizing authority To use funds To facilitate and support tribal customary adoptions</header> <text>Section 432(b)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629b">42 U.S.C. 629b(b)(2)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text>

 <text>Section 436(b)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629f">42 U.S.C. 629f(b)(2)</external-xref>) is amended by striking <quote>3 percent</quote> and inserting <quote>5 percent</quote>.</text>

                <enum>(d)</enum>
                <header>Increase in the tribal set-Aside of discretionary funding To promote safe
                    and stable families funding</header>
 <text>Section 437(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629g">42 U.S.C. 629g(b)(3)</external-xref>) is amended by striking <quote>3 percent</quote> and inserting <quote>5 percent</quote>.</text>

                <enum>(e)</enum>
                <header>Increase in the tribal set-Aside for the stephanie tubbs jones child welfare
                    services program</header>
 <text>Section 428(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/628">42 U.S.C. 628(a)</external-xref>) is amended by striking <quote>3 percent</quote> and inserting <quote>5 percent</quote>.</text>
 </subsection><subsection id="id9fadc9b8950b4d2a8ed0aaec0f481b65"><enum>(f)</enum><header>Streamlining of reporting requirements</header><text>Section 428(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/628">42 U.S.C. 628(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id73f13480355e46459bf48a7551d7837f"><enum>(1)</enum><text>by striking <quote>the total of</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4ea658b7ecf4f92a1c1263695b27f4d"><enum>(2)</enum><text>by striking <quote>this part</quote> and inserting <quote>this subpart or subpart 2</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3f16c198e3a74565a9afec0bfa5ffead"><enum>(3)</enum><text>by inserting <quote>or subpart 2</quote> after <quote>allotted under this subpart</quote>.</text></paragraph></subsection><subsection id="id84c7e9501af54ebcb07778f233838069"><enum>(g)</enum><header>Waiver or modification of matching requirements</header><paragraph id="idc0c1b7efc6e543738d7cd6c86778bd10"><enum>(1)</enum><header>Stephanie tubbs jones child welfare services program</header><text>Section 428 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/628">42 U.S.C. 628</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3e335f9befcf4a74b77dd334a2c30700"><subsection id="idd26b49928c2a41cea173070f9e97c6e1"><enum>(e)</enum><header>Matching rate requirements</header><text>The Secretary may waive or modify any matching requirement imposed under this subpart on an Indian tribe or tribal organization if the Secretary determines that the waiver or modification is appropriate to the needs, culture, and circumstances of the Indian tribe or tribal organization.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id9858c683afb84344807cb028cf5a8f9b"><enum>(2)</enum><header>Marylee allen promoting safe and stable families program</header><text>Section 434 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629d">42 U.S.C. 629d</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2fdb1c4828584fb18e3303ebffe7007b"><subsection id="idd9fa6bfb81d949ddac5685efaa50ab79"><enum>(e)</enum><header>Matching rate requirements</header><text>The Secretary may waive or modify any matching requirement imposed under this subpart on an Indian tribe or tribal organization if the Secretary determines that the waiver or modification is appropriate to the needs, culture, and circumstances of the Indian tribe or tribal organization.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8744ef8a70a14903953bd1224b5d54f4"> <enum>(h)</enum> <header>Authority of indian tribal organization To elect To substitute the Federal negotiated indirect cost rate for administrative costs cap for the marylee allen promoting safe and stable families program</header> <text>Section 434 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629d">42 U.S.C. 629d</external-xref>), as amended by subsection (g)(2), is amended by adding at the end the following:</text>

                        <enum>(f)</enum>
                        <header>Tribal authority To substitute the federal negotiated indirect cost
                            rate for administrative costs cap</header>
 <text>For purposes of sections 432(a)(4) and 434(d), an Indian tribal organization may elect to have the weighted average of the indirect cost rates in effect under part 225 of title 2, Code of Federal Regulations, with respect to the administrative costs of the Indian tribal organization apply in lieu of the percentage specified in each such section.</text>
                    </subsection>

 </subsection><subsection id="id8e95745965b4464abd7e6fbfb2fb1320"><enum>(i)</enum><header>Increase in funding for tribal court improvement program</header><text>Section 438(c)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629h">42 U.S.C. 629h(c)(3)</external-xref>) is amended by striking <quote>$2,000,000 for each of fiscal years 2026 through 2029</quote> and inserting <quote>$5,000,000 for fiscal year 2026 and each fiscal year thereafter</quote>.</text></subsection><subsection id="idd1a9efb7c88545588252432477f1a4f9"><enum>(j)</enum><header>Exemption from inappropriate requirements</header><text>Section 432(b)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629b">42 U.S.C. 629b(b)(2)(A)</external-xref>) is amended by striking <quote>the requirements of subsection (a)(4)</quote> and inserting <quote>any requirements</quote>.</text></subsection></section><section id="idd7debfed654b466eb437dce72dce6a73"><enum>3.</enum><header>Authority to provide social services block grants directly to Indian Tribes</header><text display-inline="no-display-inline">Section 2003 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397b">42 U.S.C. 1397b</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id0b71d3b2b3a74d2aa775371a9f4ce47e"><enum>(1)</enum><text>in subsection (a), by adding at the end the following: <quote>Allotments for Indian tribes, as defined in section 428(d), or tribal consortia, with a grant approved under this subtitle for fiscal year 2026 or any succeeding fiscal year shall be determined in accordance with subsection (d).</quote>;</text></paragraph><paragraph id="idc304c44921aa4bec9990eb5f1fbc4b0c"><enum>(2)</enum><text>in subsection (b)(1), by inserting <quote>(after application of the reservation required by subsection (d)(1))</quote> after <quote>subsection (c)</quote>; and</text></paragraph><paragraph id="ide5c371a3302a4763ab373d6fd6232376"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id575b45e1fa2c4a9499dc7b5f16f62245"> <enum>(A)</enum> <text display-inline="yes-display-inline">in paragraph (11), by striking <quote>thereafter.</quote> and inserting <quote>thereafter through fiscal year 2025; and</quote>;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida3a9e0d5a9634f8185f58e0413d33f8b"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (11), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD177D01F433C408F88634C8A4E303D44"><paragraph commented="no" display-inline="no-display-inline" id="idf14cb21ed02641139f070479c276fb76"><enum>(12)</enum><text>$1,790,000,000 for the fiscal year 2026 and each fiscal year thereafter.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idf234e6f9d37e4b91b8533b7da65047ef"><enum>(C)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="id0406679371FC4C268B10F90CD62C35C2" display-inline="no-display-inline" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id55e2786ec7ae4f3cbfeff8b8c737d6e4"><enum>(d)</enum><header>Tribal allocations</header><paragraph commented="no" display-inline="no-display-inline" id="id32254ea89e924f2ba4788d25e5f3a5c0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Of the amounts specified in subsection (c) for a fiscal year, 5 percent shall be available for grants made with Indian tribes or tribal consortia in accordance with this subsection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id355fec39c2614b0ba1195a2cc3ab4abe"><enum>(2)</enum><header>Grant authority</header><text>The Secretary shall make grants to Indian tribes or tribal consortia for planning and carrying out programs and activities under this subtitle, including through cultural preservation and traditional practices.</text></paragraph><paragraph id="id87b19fdd2d4340cfa7c5ced9db9470b9"><enum>(3)</enum><header>Criteria</header><text>The Secretary shall establish criteria, in consultation with Indian tribes and tribal consortia, for the review and approval of applications for grants under this subsection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idff1cfb42a722408cb1fcf140f030164a"><enum>(4)</enum><header>Allotments</header><subparagraph commented="no" display-inline="no-display-inline" id="ida27164d0137241f4bc0ac673901863f4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>From the amount reserved pursuant to paragraph (1) for any fiscal year, the Secretary shall allot to each Indian tribe with a grant approved under this subtitle—</text><clause commented="no" display-inline="no-display-inline" id="idde0c56b0aaed44e9a2058eb76767819a"> <enum>(i)</enum> <text>$25,000; plus</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id5166e709bae2435aa6510866dff45899"><enum>(ii)</enum><text>an amount that bears the same ratio to the adjusted reserved amount as the population of the Indian tribe bears to the population of all Indian tribes with approved grants, as determined by the Secretary on the basis of the most current and reliable information available to the Secretary. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id817d60398ab14b21b23770220b521c30"><enum>(B)</enum><header>Adjusted reserve amount</header><text>In subparagraph (A), the term <term>adjusted reserved amount</term> means, with respect to a fiscal year—</text><clause commented="no" display-inline="no-display-inline" id="idca239ced515a4596b9be7c23d8bb5137"> <enum>(i)</enum> <text>the amount reserved pursuant to paragraph (1) for the fiscal year; minus</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idbfe744b42d694a2a8f9260a396156327"><enum>(ii)</enum><text>the product of—</text><subclause commented="no" display-inline="no-display-inline" id="id1b471f19abe343a9849a934ef3a82425"><enum>(I)</enum><text>$25,000; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id65c4f097981a4d1cae48f9bb95de5902"><enum>(II)</enum><text>the number of Indian tribes which have approved grants under this subsection for the fiscal year. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96e32e228b914241a33ac806a5d35ba0"><enum>(C)</enum><header>Tribal consortia</header><text>If a grant submitted by a consortium of Indian tribes is approved under this subtitle, the Secretary shall allot to the consortium an amount equal to the sum of the allotments determined for each Indian tribe that is part of the consortium.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ff799c592424635bf2c9e91a38c6530"><enum>(5)</enum><header>Reallocation</header><text>Funds that are not distributed to Indian tribes and tribal consortia during a fiscal year shall be available for reallocation to eligible Indian tribes and tribal consortia.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1f5c6cc280dd41e08ddd444f5775ab50"><enum>(6)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to—</text><subparagraph id="idc38bd6c511e045ee830aa01b950a8c72"><enum>(A)</enum><text>serve as an authorization to limit the eligibility of any individual to participate in any program offered by a State or subdivision thereof;</text></subparagraph><subparagraph id="id86531a581b174c3081102a2d62e8734f"><enum>(B)</enum><text>modify any requirement imposed upon a State by any provision in this subtitle; or</text></subparagraph><subparagraph id="id462bbc16c2834237a68939ee23522598" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>preclude or discourage an agreement between any Indian tribe and any State that facilitates the provision of services by the Indian tribe to the service population of the Indian tribe.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id078b8a20fa774aee845e274ee212fe70"><enum>4.</enum><header>Tribal prevention-only agreement authority</header><subsection commented="no" display-inline="no-display-inline" id="ide71365451af3423aa6faa3068bc6554e"> <enum>(a)</enum> <header>Option To administer prevention services only program</header> <text>Section 479B(c)(1)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679c">42 U.S.C. 679c(c)(1)(E)</external-xref>) is amended by adding at the end the following:</text>

 <text>A tribe, organization, or consortium may elect to provide services and programs specified in section 471(e)(1) to children described in section 471(e)(2) as an independent program without submission of a plan to operate a foster care, adoption, or kinship guardianship program under this part, provided that the tribe, organization, or consortium has a court, agency, or 1 or more tribally designated individuals that is responsible for proceedings relating to foster care or that collaborates with the State on child welfare.</text>

            </subsection><subsection commented="no" display-inline="no-display-inline"

                <enum>(b)</enum>
                <header>Option To make agreements To administer prevention services only
                    program</header>
 <text>Section 471(a)(32) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(32)</external-xref>) is amended—</text>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="idbef36ba855594825adfbdb9b36bc2230">
                    <enum>(1)</enum>
 <text>by inserting <quote>, including an agreement to administer only the prevention program described in subsection (e) if the tribe has a court, agency, or tribally-designated individuals responsible for proceedings relating to foster care or that collaborates with the State on child welfare</quote> after <quote>administer all or part of the program under this part</quote>; and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="id2a20133d8ff140e3a06d6744f8cbb4f2">
                    <enum>(2)</enum>
 <text>by striking <quote>and, if the State has elected to provide such payments, kinship guardianship assistance payments under section 473(d)</quote> and inserting <quote>providing access to the kinship guardianship program under section 473(d) or the prevention program described in subsection (e) if the State has elected to implement such programs</quote>.</text>

 </subsection></section><section id="id22a90316c4754489b4606b2669b0ee9a"><enum>5.</enum><header>State option to include Tribal caseworker visits for purposes of satisfying monthly caseworker visit requirements</header><text display-inline="no-display-inline">Section 424(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/624">42 U.S.C. 624(f)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idda623075ace64d4187f9465e42cf108f"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after <quote>(f)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc813c8ccf1a741beb807201d0a87d7bd"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id95977cbb07f8482dac0ca5e4071a3100"><paragraph id="id963fbe38a72f404a8ae698daff1e6016" indent="up1"><enum>(2)</enum><text>For purposes of determining whether a State has met the requirements of paragraph (1), a State may elect to include visits made by caseworkers on behalf of a tribal child welfare agency if—</text><subparagraph commented="no" display-inline="no-display-inline" id="id82741bd75fd7420685d78972e349db85"><enum>(A)</enum><text display-inline="yes-display-inline">the tribal child welfare agency has an agreement with the State under this subpart, subpart 2, or under part E with respect to administering funds or carrying out the requirements of this subpart, subpart 2, or part E with regard to children in foster care;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaefae577a6d44f9185ef05eafb64ead6"><enum>(B)</enum><text>such visits meet the requirements of section 422(b)(17); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2466cdf47dda42eb917773c32760bb8c"><enum>(C)</enum><text>such visits are reported through a coordinated data-sharing agreement.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id3c0a85bff77e4773844dd8eb227b0ade" commented="no" display-inline="no-display-inline"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the date that is 30 days after the date of enactment of this Act.</text></section></legis-body></bill>
