which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase by 5 the number of flex waivers available in each State for J–1 nonimmigrants and to establish a secondary physician match portal to assist alien physicians who are unable to find employment in their preferred State of residence to find employment in another State.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="ida6f5474aa01a4304b954535a2d0ef131" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conrad 30 Physician Workforce Optimization Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id10572d4b4dd642da967223855f533430"><enum>2.</enum><header>Increasing the maximum number of flex waiver allowance slots in each State</header><text display-inline="no-display-inline">Section 214(l)(1)(D)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(l)(1)(D)(ii)</external-xref>) is amended by striking <quote>10</quote> and inserting <quote>15</quote>.</text></section><section id="id7847526f18e347e9ab00f974e90d6072"><enum>3.</enum><header>Secondary physician match portal</header><text display-inline="no-display-inline">Section 214(l) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(l)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0b1ced69db0f4fc4ab6f6b583a244216"><paragraph commented="no" display-inline="no-display-inline" id="id7eeb39b465bf4d6a9896c407690104d8"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0177522736324b14a041db08bc51a071"><enum>(A)</enum><text display-inline="yes-display-inline">The Director of U.S. Citizenship and Immigration Services, after consultation with the heads of a representative sample of State Departments of Public Health, shall establish a portal for alien physicians who—</text><clause commented="no" display-inline="no-display-inline" id="idff88630f76fc40b0abc6a7967f148f8c" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">have been granted the status of a nonimmigrant described in section 101(a)(15)(J)(i);</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="idaeb07e29527d474f80129bb5ff894497"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id4c2b03375598436ca0091d51d475ad68"><enum>(I)</enum><text display-inline="yes-display-inline">have applied for a waiver of the 2-year foreign residence requirement under section 212(e), but were not selected by the State to which they submitted their application; or</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id95017217ae224822a03a9dc6b5dcbdd6"><enum>(II)</enum><text>have sought to apply for a waiver of the 2-year foreign residence requirement under section 212(e), but were unable to submit an application because the State’s numerical cap had been reached, or applications were otherwise not accepted at the time of the attempted submission; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id09fcdef0198149aa82039b9d0562b335"><enum>(iii)</enum><text display-inline="yes-display-inline">request to be included in such portal.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idcefea57f66f440d486dcfd2f81245e58"><enum>(B)</enum><text display-inline="yes-display-inline">Any State, or any employer located in such State, that has not filled all of its allotted waivers under paragraph (1)(B) for the current fiscal year may use the portal established pursuant to subparagraph (A) to access information about the credentials of potential alien physicians who may be interested in obtaining full-time employment as a primary care or specialty care provider in such State.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id2f2fbe9463224f40a5ed532c4dc78b78"><enum>(C)</enum><text display-inline="yes-display-inline">Information about international medical graduates who request to be included in the portal established pursuant to subparagraph (A) shall be included on an attestation form that is sent to an organizing body to facilitate the dissemination of such information to States with available waivers.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id1c0f335c6c5a46bd8a4d96f297afd6c8"><enum>(D)</enum><text display-inline="yes-display-inline">The Director shall establish a secondary match period, not to exceed 60 days, during which employers in States with available waivers for the current fiscal year can review and interview alien physicians included in the portal before March 1st of such fiscal year.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id101dfe555c08472fb3a66c230119c556"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="idc86956c587894ad686c5d81ed0c2e60f"><enum>(i)</enum><text display-inline="yes-display-inline">The portal shall contain essential information contained in the alien physicians initial application to streamline the secondary application process for potential employers.</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id0cf32e691e9f4be8b57f2e8136be228f"><enum>(ii)</enum><text display-inline="yes-display-inline">Employers participating in the secondary application process shall certify that—</text><subclause commented="no" display-inline="no-display-inline" id="id03b04105a2c14160af3fd1f0786ab94c"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id4056f370a759422cb21692cf31688f50"><enum>(aa)</enum><text display-inline="yes-display-inline">their facilities are located in a health professional shortage area or in a medically underserved area; or</text></item><item commented="no" display-inline="no-display-inline" indent="up1" id="id60e514cbc26e4dfdab39453b786d4a78"><enum>(bb)</enum><text display-inline="yes-display-inline">they are seeking an applicable flex waiver under section 214(l)(1)(D)(ii); and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="ida26bf8a76e4b4e74beb81fa3ee6080e8"><enum>(II)</enum><text display-inline="yes-display-inline">they have unsuccessfully advertised the position for which the alien physician will be hired.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="idd1deb3bb4d5547e3ac77d721078b4ce9"><enum>(iii)</enum><text display-inline="yes-display-inline">State departments of public health and prospective employers shall be provided access to the portal in order to identify potential alien physicians.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id82c0d7fb61cb409fb8c924a196d8de7a"><enum>(F)</enum><text display-inline="yes-display-inline">The Director, after consultation with a representative sample of State departments of health or related agencies, shall publish a set of best practices and core application requirements that—</text><clause commented="no" display-inline="no-display-inline" id="id029f5c1f72d1403cb423ecd3bb83cb5b"><enum>(i)</enum><text display-inline="yes-display-inline">assist States in determining the sufficiency of waiver applications submitted for the secondary match; and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddfa88a50a87a4e5d83aff24517b58c2d"><enum>(ii)</enum><text display-inline="yes-display-inline">include the essential elements necessary to establish sufficiency and ensure a streamlined process for the secondary match applications.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
