<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4628</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260521">May 21, 2026</action-date><action-desc><sponsor name-id="S411">Mr. Marshall</sponsor> (for himself, <cosponsor name-id="S394">Ms. Smith</cosponsor>, <cosponsor name-id="S388">Ms. Hassan</cosponsor>, and <cosponsor name-id="S376">Ms. Ernst</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to establish an initiative to address the availability, quality, and cost of childcare in rural areas, and for other purposes.</official-title></form><legis-body><section id="id9f24bab9212a46998072f65e3ec74e03" section-type="section-one"><enum>1.</enum><header>Expanding Childcare in Rural America Initiative</header><subsection id="idf6de7f1d0efb4f25a7e978f649fa3012"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id11abd4481ee4467caaaf6263916fa16c"><enum>(1)</enum><header>Childcare</header><subparagraph id="id581b0b53053c40a881808debf97d57e6"><enum>(A)</enum><header>In general</header><text>The term <term>childcare</term> means any program that—</text><clause id="ida1a4f92cde8d43f490aea15ba332ec3c"><enum>(i)</enum><text>provides quality care and early education for children who have not yet entered first grade; and</text></clause><clause id="idcba43d11650c4e68a54435cbf22dc99f"><enum>(ii)</enum><text>is operated by—</text><subclause id="idf435f93f7cb04bd28c5e55f82c680845"> <enum>(I)</enum> <text>an eligible childcare provider described in section 658P(6)(A) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n(6)(A)</external-xref>); or</text>
 </subclause><subclause id="id33f31e3bef07420db69f0fb14647c34c"><enum>(II)</enum><text>a childcare provider that, on the date of enactment of this Act—</text><item id="id8a3c96f66e764b40a5e48f439029df5e"><enum>(aa)</enum><text>is licensed, regulated, or registered in the State, territory of the United States, or territory of the Indian Tribe in which the provider is located; and</text></item><item id="id30f31a7a5fac4a349a1d0935e92874de"><enum>(bb)</enum><text>meets applicable State, Tribal, territorial, and local health and safety requirements.</text></item></subclause></clause></subparagraph><subparagraph id="id97f8114351794f6c9bf8ef0930491923"><enum>(B)</enum><header>Inclusions</header><text>The term <term>childcare</term> includes—</text><clause id="id8b44af93f90644e7a05480f6d8e8db49"><enum>(i)</enum><text>a school-based program described in subparagraph (A);</text></clause><clause id="id5656c53e279441e2aaa173601e2b7740"><enum>(ii)</enum><text>a program described in subparagraph (A) that is a Head Start program, including a migrant and seasonal Head Start program, or an American Indian and Alaska Native Head Start program carried out under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>);</text></clause><clause id="idde7e630395c74233ae5a6eb16d2b1001"><enum>(iii)</enum><text>a facility used for a program described in subparagraph (A); and</text></clause><clause id="idadc4aa9167064003889bf1fddec09096"><enum>(iv)</enum><text>a service provided under a program described in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="id61d7333335c443fa97022664fcf087c0"><enum>(2)</enum><header>Initiative</header><text>The term <term>Initiative</term> means the Expanding Childcare in Rural America Initiative established under subsection (b).</text></paragraph><paragraph id="id21eb20858719456ba3b3f05d1de79cb4"><enum>(3)</enum><header>Rural area</header><text>The term <term>rural area</term> has the meaning given the term in section 343(a)(13)(A) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)(A)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfa5447d2fa0c49b8bde54b5ed7543bfd"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id9b8cf23007204059a29a0c006c366a01"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish an initiative, to be known as the <quote>Expanding Childcare in Rural America Initiative</quote>, under which the Secretary shall provide, for each of fiscal years 2027 through 2029, priority in accordance with subsection (c) to address the availability, quality, and cost of childcare in rural areas.</text></subsection><subsection id="ide3f63ea70d9e4d9f8e29131e113e4476"><enum>(c)</enum><header>Childcare priorities</header><paragraph id="idefed82c8da53448c827973b9e8c91543"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, in selecting recipients of loans and grants under a program described in paragraph (2), the Secretary shall give priority to any qualified applicant that proposes to use the loan or grant to address the availability, quality, or cost of childcare in a rural area.</text></paragraph><paragraph id="ida556b30a52ab4474a94cab7856c61755"><enum>(2)</enum><header>Description of programs</header><text>The programs referred to in paragraph (1) are the following:</text><subparagraph id="id5add782473b847fb866c2e5a448593b2"><enum>(A)</enum><text>The essential community facilities loan and grant programs authorized under section 306(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)</external-xref>).</text></subparagraph><subparagraph id="id139b2f5085d940ee8fb7b387aaf9976e"><enum>(B)</enum><text>The business and industry direct and guaranteed loan program authorized under section 310B(g) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1932">7 U.S.C. 1932(g)</external-xref>).</text></subparagraph><subparagraph id="id7e50ddedf95b4791bfc8d61d5d129e24"><enum>(C)</enum><text>The rural microentrepreneur assistance program authorized under section 379E of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2008s">7 U.S.C. 2008s</external-xref>).</text></subparagraph><subparagraph id="idfdd4a2b8759443e28f49c12cfc292cdf"><enum>(D)</enum><text>The intermediary relending program authorized under section 310H of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1936b">7 U.S.C. 1936b</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="ide5b27de20bf149168a373b9fd776604f"><enum>(d)</enum><header>Requirement</header><text>In providing funding in accordance with the Initiative, the Secretary shall ensure a balanced geographical distribution of the benefits under the Initiative.</text></subsection><subsection id="id261ec46389dc4f8aa924a94e3f411b5b"><enum>(e)</enum><header>Evaluation; report</header><paragraph id="id5dc25c1df340490d88b387fc8b10197c"><enum>(1)</enum><header>Evaluation</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall conduct a comprehensive quantitative and qualitative evaluation of the projects carried out using assistance provided under the Initiative, including—</text><subparagraph id="ide290a9802bea4a5cb33288a652e8fe79"><enum>(A)</enum><text>a description of—</text><clause id="idba18d59b86144caa9648446f4179b008"><enum>(i)</enum><text>the types of projects carried out;</text></clause><clause id="idc286ecb5e06741299828333ba2d57ceb"><enum>(ii)</enum><text>the communities in which the projects are carried out;</text></clause><clause id="id4437b417c62c4ac9b5780ef0e50cc9a5"><enum>(iii)</enum><text>the organizations and entities participating in the projects; and</text></clause><clause id="id59d5cb940a954be3bf014a54ad5b288a"><enum>(iv)</enum><text>the types of partnerships developed to carry out the projects; and</text></clause></subparagraph><subparagraph id="id50fbafe7d8b44efe921ca16e97ec978b"><enum>(B)</enum><text>the economic and social impacts of the investments in the projects.</text></subparagraph></paragraph><paragraph id="idda5d2f8fbdf14071957aad5c872dc9dd"><enum>(2)</enum><header>Report</header><text>Not later than 4 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report describing the evaluation conducted under paragraph (1), including a thorough analysis of the outcomes of the evaluation.</text></paragraph></subsection></section></legis-body></bill>
