which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Older Americans Act of 1965 to establish the Office of LGBTQI Inclusion and a rural outreach grant program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idac71893095bd44fd86c049020acba8c0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Elder Pride Act</short-title></quote>.</text></section><section id="idb46519d797f14638872638b2250b660a"><enum>2.</enum><header>Definitions</header><subsection id="ide1d03ee2df894e6db49af3e694e2d190"><enum>(a)</enum><header>In general</header><text>Section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>) is amended—</text><paragraph id="id0bd36cfe78cd4f9d9b3f0c60279d6d74"><enum>(1)</enum><text>in paragraph (24)—</text><subparagraph id="id27d6c1e1c71043a4bc5b00860fa3c8ce"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id559cb69873434105bca2fa7901949cdf"><enum>(B)</enum><text>in subparagraph (C)(ii), by striking the period and inserting a semicolon; and</text></subparagraph><subparagraph id="idf42150fd9733455d94fa4c62d3f67779"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id556df4cc2c2f4105b77fb2ceaf8efd9c"><subparagraph id="id775568288cc14275b3d36619643a08b1"><enum>(D)</enum><text>status as an LGBTQI individual; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3dfb9798fd4476eae892effa1a9ddc3"><enum>(E)</enum><text display-inline="yes-display-inline">status as an individual with HIV.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id97965cf9e72d47179421122e29a5d826"><enum>(2)</enum><text>by redesignating paragraphs (26) through (33), paragraphs (34) and (35), and paragraphs (36) through (56) as paragraphs (27) through (34), paragraphs (36) and (37), and paragraphs (39) through (59), respectively;</text></paragraph><paragraph id="idd5f0047f8afe472eb6ae75124beaee53"><enum>(3)</enum><text>by inserting after paragraph (25) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6a358598e99a42e19d1eba5090940874"><paragraph id="idb105a1af7cd64341931be53b433fd177"><enum>(26)</enum><text>The term <term>HIV</term> means human immunodeficiency virus.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id989262f34bbc40c7b5d5d27f4c44e152"><enum>(4)</enum><text>by inserting after paragraph (34) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id914ED016AF7F4852B1EF4D6DFD9E7C12"><paragraph id="idde04f1bad9ea476d9a15504ba124ef67"><enum>(35)</enum><text>The term <term>LGBTQI</term> means lesbian, gay, bisexual, transgender, queer, or intersex.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id6b5788efe03f4f01a5f2a070671512e9"><enum>(5)</enum><text>by inserting after paragraph (37) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfbf32e3a7eb94244b50a18edfd37b2e5"><paragraph id="idd5433b1e71e2496f830895863c96da2c"><enum>(38)</enum><text>The term <term>minority</term>, with respect to an individual, includes a lesbian, gay, bisexual, transgender, queer, or intersex individual.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idaae52e6135874db28cf6424102b9968a"><enum>(b)</enum><header>Conforming amendment</header><text>Section 215(e)(1)(J) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3020e-1">42 U.S.C. 3020e–1(e)(1)(J)</external-xref>) is amended by striking <quote>minorities</quote> and inserting <quote>minority individuals</quote>.</text></subsection></section><section id="id1139f2989eb84ebb85659a36cda81217"><enum>3.</enum><header>Office of LGBTQI Inclusion</header><text display-inline="no-display-inline">Section 201 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011</external-xref>) is amended—</text><paragraph id="id0413578b8ee543829da0d7f33be9e92f"><enum>(1)</enum><text>in subsection (d)(3)(J), by inserting before the semicolon the following: <quote>, including the effectiveness of such services in meeting the needs of LGBTQI older individuals</quote>; and</text></paragraph><paragraph id="idc550b64d3eba4c3587fd811d99459154"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf279e0ebad5a4bd286eaa24b7c4edfb5"><subsection id="id6ebbdc718d4b4dde991cad72a8b339ea"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id9f910ac6a9954b1bbd0c3e19274cf749"><enum>(1)</enum><text>There is established in the Administration an Office of LGBTQI Inclusion (referred to in this subsection as the <quote>Office</quote>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="id20dafbc539d04a7689ca74482efc1426"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idbbdd217b6bee4cf797ee7e5db401c0ac"><enum>(A)</enum><text>The Office shall be headed by a Director of LGBTQI Inclusion (referred to in this subsection as the <quote>Director</quote>), who shall be appointed by the Secretary.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idf755d1629e1e4b2189ef18540a1880c0"><enum>(B)</enum><text>The Office shall include an Assistant Director of LGBTQI Policy (referred to in this subsection as the <quote>Assistant Director</quote>) who shall be appointed by the Director to assist the Director in carrying out this subsection, including by carrying out the activities under paragraph (4).</text></subparagraph></paragraph><paragraph id="id1c8082302e26451e9986bc5b21d70ead" indent="up1"><enum>(3)</enum><text>The Director shall—</text><subparagraph id="id91d3ff7e1090424fb4ba7663d1eec11a"> <enum>(A)</enum> <text>coordinate activities within the Department of Health and Human Services, and between other Federal departments and agencies, to ensure a continuum of improved services for LGBTQI older individuals;</text>
 </subparagraph><subparagraph id="idd38633eff8de4be297588308de899d9d"><enum>(B)</enum><text>promote access to aging services and supports for LGBTQI older individuals;</text></subparagraph><subparagraph id="id426ee122b26746b89fee03f8ad676b5b"><enum>(C)</enum><text>collect and disseminate information related to the challenges experienced by LGBTQI older individuals; and</text></subparagraph><subparagraph id="id16725f5a824843059ec899954decd8f7"><enum>(D)</enum><text>administer and evaluate grants that will expand access to aging services and supports for LGBTQI older individuals.</text></subparagraph></paragraph><paragraph id="id7e4906ff24ba477fad1b50af6b84ed45" indent="up1"><enum>(4)</enum><text>The Assistant Director shall—</text><subparagraph id="id742eef4ef6cd4d2faa0152350f3a200c"><enum>(A)</enum><text>serve as the effective and visible advocate on behalf of LGBTQI older individuals—</text><clause id="id2e32862523eb4e5d98a5b5cbae70a804"><enum>(i)</enum><text>within the Department of Health and Human Services and with other departments and agencies of the Federal Government regarding all Federal policies affecting such individuals; and</text></clause><clause id="id845688b160d04c4d9fd11cfeb63c31d0"><enum>(ii)</enum><text>in the States to promote the enhanced delivery of services and implementation of programs, under this Act and other Federal Acts, for the benefit of such individuals;</text></clause></subparagraph><subparagraph id="id998396bb7ebd43e6a8ba75da94cdd823"><enum>(B)</enum><text>support, conduct, and arrange for research in the field of LGBTQI aging with a special emphasis on gathering statistics on LGBTQI older individuals;</text></subparagraph><subparagraph id="id63909e415fe141dc896402e763494fc1"><enum>(C)</enum><text>collect and disseminate information related to challenges experienced by LGBTQI older individuals; and</text></subparagraph><subparagraph id="id8812531a00d14397b7f823a309f42604"><enum>(D)</enum><text>recommend policies and priorities beneficial to LGBTQI older individuals and promote the implementation and adoption of culturally competent care and services for such individuals.</text></subparagraph></paragraph><paragraph id="id09d80c32e3744faab3b8945b6efb076e" indent="up1"><enum>(5)</enum><text>Not later than 5 years after the date of enactment of the <short-title>Elder Pride Act</short-title>, and every 5 years thereafter, the Director shall submit to Congress a report describing the activities carried out under this subsection during the preceding 5 years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idbb9d36bfff64460892b8fe6903459322"><enum>4.</enum><header>Rural outreach grant program</header><text display-inline="no-display-inline">Part A of title IV of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3032">42 U.S.C. 3032 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8405724289c848bb8edd2665f55683a6"><section id="id86df4e2f161645f3a85a4ab38a08fb73"><enum>423.</enum><header>Rural outreach grant program</header><subsection id="id5e9a5842479e4f2ab7a5b4b9b5ed60b6"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id288077629ba44b7892d32062418e7249"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="ida6e43cba2c884c86b5e86a0ee2d71fe7"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="id98f67431353444dfa22c5cb276ae1543"><enum>(B)</enum><text>an Indian tribe or tribal organization; or</text></subparagraph><subparagraph id="id02394a912ffa48c599248b8ae559e672"><enum>(C)</enum><text>an agency, nonprofit organization, or institution (including an area agency on aging, or a multipurpose senior center, in a rural area) that—</text><clause id="idee620f4248f2402280aa63ad3240be50"><enum>(i)</enum><text>focuses on serving the needs of older individuals, LGBTQI individuals, LGBTQI older individuals, or individuals of another protected class; or</text></clause><clause id="idbdbdbbd5d43f41218f633e1f7b7362a7"><enum>(ii)</enum><text>focuses on providing sexual health services to all older individuals, including services for older individuals with HIV.</text></clause></subparagraph></paragraph><paragraph id="id4ded7358a3b94a02bd8584937178e07c"><enum>(2)</enum><header>Protected class</header><text>The term <term>protected class</term> means a group of individuals sharing a common characteristic or identity who are legally protected against discrimination.</text></paragraph><paragraph id="id4cbdd06f14a346f08fbdc78dda92234f"><enum>(3)</enum><header>Rural area</header><text>The term <term>rural area</term> means an area that is not designated by the United States Census Bureau as an urbanized area or urban cluster.</text></paragraph></subsection><subsection id="id1b753c72c56f4b46a1e7c7fb32a623fb"><enum>(b)</enum><header>Authority for grants</header><text>The Assistant Secretary, acting through the Director of LGBTQI Inclusion, may make grants to eligible entities to carry out activities described in subsection (d) that are designed—</text><paragraph id="idfd72bf44122b4d2f864882d79d241bd0"><enum>(1)</enum><text>to create a cooperative and lasting partnership between—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3b3a9f9173604ea9a8a8f436f77accdb"><enum>(A)</enum><text display-inline="yes-display-inline">LGBTQI older individuals, or older individuals of a protected class, residing in rural areas; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcb168de9b3954a4eb54a07047bf35286"><enum>(B)</enum><text display-inline="yes-display-inline">the eligible entity receiving the grant;</text></subparagraph></paragraph><paragraph id="id725bc4d2f89f4fd7821330aa71ea5aa6"><enum>(2)</enum><text>to meet the needs of the individuals described in paragraph (1)(A); and</text></paragraph><paragraph id="id564750e9a35940bbac928213d448686a"><enum>(3)</enum><text>to provide comprehensive sexual health services to all older individuals residing in the rural areas served by the grant.</text></paragraph></subsection><subsection id="id59213995392048529fb5d1cb08e21f8b"><enum>(c)</enum><header>Applications</header><paragraph id="id1d76fce3a04d417bb5ba29b15d51f8f6"><enum>(1)</enum><header>In general</header><text>An eligible entity seeking a grant under this section shall submit an application to the Assistant Secretary at such time, in such manner, and containing such information as the Assistant Secretary may reasonably require, including the contents described in paragraph (2).</text></paragraph><paragraph id="id67c46ec3a6894dcb97992959891e2566"><enum>(2)</enum><header>Contents</header><text>An application for a grant under this section shall contain—</text><subparagraph id="id5500a6d8e64247e589b8788795db8f06"><enum>(A)</enum><text>a description of the proposed activities to be supported by the grant;</text></subparagraph><subparagraph id="id642537a39da041569e778bac910f66f1"><enum>(B)</enum><text>a description of the size and characteristics of the population in the rural area to be served by such proposed activities;</text></subparagraph><subparagraph id="ida20136d319bb41448a553eae232a7ec9"><enum>(C)</enum><text>a description of the public and private resources expected to be made available in connection with such activities;</text></subparagraph><subparagraph id="id7df6efff2cda4e6d9cb2c6ad1f169785"><enum>(D)</enum><text>a demonstrated intent to partner with local organizations in rural areas in carrying out such activities;</text></subparagraph><subparagraph id="idca9d83b3daa243938611546f32a14224"><enum>(E)</enum><text>evidence in a form acceptable to the Assistant Secretary that such activities will meet urgent needs that are not met by available public and private sources; and</text></subparagraph><subparagraph id="id9453bbd154334d9fbbdf6b8141cc7b47"><enum>(F)</enum><text>such other information or certifications that the Assistant Secretary determines necessary to achieve the purposes described in paragraphs (1) through (3) of subsection (b).</text></subparagraph></paragraph></subsection><subsection id="id2406d7291432469c8ec9b2f7ce154aaa"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity may use funds made available by a grant under this section to carry out activities that include initiatives that—</text><paragraph id="idcab87712b07e445abe0516a49b202968"><enum>(1)</enum><text>engage in education and training relating to community outreach to LGBTQI older individuals, or older individuals of a protected class, residing in rural areas;</text></paragraph><paragraph id="idcd30dc42785f4a28ab92a5f2c44e9e85"><enum>(2)</enum><text>reduce isolation and improve access to care for LGBTQI older individuals, or older individuals of a protected class, residing in rural areas by building relationships between such individuals and the local community;</text></paragraph><paragraph id="id59a0e096db2540eb897b880d306e37d8"><enum>(3)</enum><text>foster relationships between local service providers and LGBTQI older individuals, or older individuals of a protected class, residing in rural areas;</text></paragraph><paragraph id="id18a0ed55dc73473fadb910a2f9dac354"><enum>(4)</enum><text>improve cultural competency with respect to LGBTQI individuals, and older individuals of a protected class, among organizations and personnel providing services to older individuals residing in rural areas;</text></paragraph><paragraph id="id9f811689e14c4a3ba06d645fff1bd66b"><enum>(5)</enum><text>expand the use of nondiscrimination policies that—</text><subparagraph id="id5aa6155050a643c889ad3a5368723b91"><enum>(A)</enum><text>prohibit discrimination on the basis of sexual orientation, gender identity, or sex characteristics (including intersex traits); and</text></subparagraph><subparagraph id="idfda65db4c32a4df58a6459aff2e8fb4c"><enum>(B)</enum><text>create community spaces that are inclusive to LGBTQI older individuals and older individuals of a protected class; and</text></subparagraph></paragraph><paragraph id="idff7e8449fb9843738e5fe7921d936b7e"><enum>(6)</enum><text>focus on providing sexual health services to older individuals residing in rural areas, including services for older individuals with HIV.</text></paragraph></subsection><subsection id="id403bf48735604905990b14f66d1eeb9e"><enum>(e)</enum><header>Supplement not supplant</header><text>As a condition of receiving funds under this section, an eligible entity shall agree to use such funds only to supplement the level of State or local funds that would, in the absence of the receipt of funds under this section, be made available for related LGBTQI services.</text></subsection><subsection id="id6a31876e62af45ed8d0384dfaa78e91f"><enum>(f)</enum><header>Standards and guidelines</header><text>The Assistant Secretary shall establish standards and guidelines for activities supported by grants under this section. Such standards and guidelines shall permit an eligible entity receiving such grant to refine or adapt the standards and guidelines for an individual project if the refinement or adaptation is made necessary by a local circumstance.</text></subsection><subsection id="id2b4aedd2c86a4230aec24060e151ad99"><enum>(g)</enum><header>Coordination with local entities</header><paragraph id="idbae18918e61b460ea15f1da553d96a10"><enum>(1)</enum><header>Cooperation</header><text>An eligible entity that receives a grant under this section shall, in carrying out activities supported by the grant, agree to cooperate and coordinate with—</text><subparagraph id="id79970f283ed64dfa91ffddc1285364ee"><enum>(A)</enum><text>the agencies of the relevant State and local governments responsible for providing services to LGBTQI older individuals, or older individuals of a protected class, in the area served by such activities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb7052519dde042cf9b0049ded63b1892"><enum>(B)</enum><text display-inline="yes-display-inline">other public and private organizations and agencies providing services to LGBTQI older individuals, or older individuals of a protected class, in such area.</text></subparagraph></paragraph><paragraph id="id12f6ed8869e94409ba76b1ed44057002"><enum>(2)</enum><header>Prioritization</header><text>An eligible entity receiving a grant under this section shall prioritize cooperating and coordinating with public and private organizations and agencies that primarily serve populations of older individuals with the greatest social need.</text></paragraph></subsection><subsection id="id7f6abc6656dd401682a6c5494e9bd717"><enum>(h)</enum><header>Reports</header><text>Not later than 1 year after the date of enactment of the <short-title>Elder Pride Act</short-title>, and annually thereafter, the Assistant Secretary shall submit to Congress and make available to the public a report that describes the activities carried out under this section during the preceding 2-year period.</text></subsection><subsection id="idaa0dca9fabaf4c6b964ddb2060f53c15"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is to be authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2027 through 2031.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
