<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4568</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260519">May 19, 2026</action-date><action-desc><sponsor name-id="S322">Mr. Merkley</sponsor> (for himself, <cosponsor name-id="S318">Mr. Wicker</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S288">Ms. Murkowski</cosponsor>, and <cosponsor name-id="S252">Ms. Collins</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the definition of professional student in the Higher Education Act of 1965.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nursing is a Professional Degree Act</short-title></quote>.</text></section><section id="id2126ad94d888448abc7b772e251a49c1"><enum>2.</enum><header>Professional student and professional degree defined</header><text display-inline="no-display-inline">Section 455(a)(4)(C) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(a)(4)(C)</external-xref>) is amended—</text><paragraph id="id257ca82f2d9f41cdaafcb4fc9f7d9575"><enum>(1)</enum><text>in clause (ii), by striking <quote>, as defined under section 668.2 of title 34, Code of Federal Regulations (as in effect on the date of enactment of this paragraph),</quote>; and</text></paragraph><paragraph id="id7e90e896c357460faa811e07412c1509"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5c029faa02d9438496a51728e00479dc"><clause id="id669cd93e7ef44a0597361f072f807156"><enum>(iii)</enum><header>Professional degree</header><text>In this paragraph, the term <term>professional degree</term> —</text><subclause id="id2467dbae16a4471ea150e7c8c06cf2ed"><enum>(I)</enum><text>means a degree that signifies both completion of the academic requirements for beginning practice in a given profession (for which professional licensure is also commonly required), and a level of professional skill beyond that normally required for a bachelor’s degree; and</text></subclause><subclause id="idabccfa0bb08b46a49d5ad55cf15b6474"><enum>(II)</enum><text>includes each of the following:</text><item id="idec43e03d716a4de79e1f35fd11d5b3de"><enum>(aa)</enum><text>Pharmacy (Pharm.D.).</text></item><item id="id701e7e6e388b4053b590896ee5ab0300"><enum>(bb)</enum><text>Dentistry (D.D.S. or D.M.D.).</text></item><item id="id30364a5f0d88480687b2a28e4c62f852"><enum>(cc)</enum><text>Veterinary Medicine (D.V.M.).</text></item><item id="id234c2cdde08d4012a27331831c02d91a"><enum>(dd)</enum><text>Chiropractic (D.C. or D.C.M.).</text></item><item id="id551441bbd07345a8a355f2a17f350ae5"><enum>(ee)</enum><text>Law (L.L.B. or J.D.).</text></item><item id="id9dba32c2a7c942c1aae7f21ae39bc104"><enum>(ff)</enum><text>Medicine (M.D.).</text></item><item id="id15b0fa1b1eaf461d99f69147484080e1"><enum>(gg)</enum><text>Optometry (O.D.).</text></item><item id="idcd72149f80fc433da8e31ef4ad78d03c"><enum>(hh)</enum><text>Osteopathic Medicine or Osteopathy (D.O.).</text></item><item id="id26b77cc1efa44c93adcd785458e8e2d1"><enum>(ii)</enum><text>Podiatric Medicine or Podiatry (D.P.M., D.P., or Pod.D.).</text></item><item id="idd1cb30ad7df54f63a0c8fbef186bd1a2"> <enum>(jj)</enum> <text>Theology or Theological Studies (M.Div. or M.H.L.).</text>
 </item><item id="ida7647ce931204246afa7ba282aacad5e"><enum>(kk)</enum><text>Clinical Psychology (Psy.D. or Ph.D.).</text></item><item id="id0fbc3eee9fb44947a87e3afad17f1a7d"><enum>(ll)</enum><text>Nursing (MSN, DNP, DNAP, or Ph.D).</text></item><item id="id63256fe6a7074274ac0e3570064d6493"><enum>(mm)</enum><text>Any other degree that meets the requirements of subclause (I), as determined by the Secretary.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
