which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to publish, on an annual basis, an assessment of United States dependency on the exportation of agricultural commodities to adversarial countries, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Moving Away from Risk to Key Export Targets Act of 2026</short-title></quote> or the <quote><short-title>MARKET Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idee2d091b8eb04ddeb7006cc25aa36d45"><enum>2.</enum><header display-inline="yes-display-inline">Agricultural commodities export assessments and reports</header><subsection commented="no" display-inline="no-display-inline" id="id07ddf55cb7e744ab81f4de9fdbb0247b"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph id="id4a6d165df33b46999dbf8a56cda59958"><enum>(1)</enum><header>Covered export</header><subparagraph commented="no" display-inline="no-display-inline" id="id3cb65273cd4548b68bf39a7db034ae9e"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>covered export</term> means any agricultural commodity exported by the United States.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3527c7ff9b7240dea315d58df949c04d"><enum>(B)</enum><header>Inclusions</header><text>The term <term>covered export</term> includes—</text><clause id="ida8be2052b389433da75271be43607bb3"><enum>(i)</enum><text>soybeans;</text></clause><clause id="id3f3820e17d9c4455a029c07a8927a324"><enum>(ii)</enum><text>corn;</text></clause><clause id="id68b129cde14342178780289b547db049"><enum>(iii)</enum><text>beef;</text></clause><clause id="id7a4eb6b369064758a1d3cc772b37ac01"><enum>(iv)</enum><text>chicken;</text></clause><clause id="ida6b1ab999b334d58a2aa6304de750dcf"><enum>(v)</enum><text>pork;</text></clause><clause id="id770c4be200df43ca899cb4bcfb189135"><enum>(vi)</enum><text>tree nuts;</text></clause><clause id="id38e3095b452b44bbbece433592c9c590"><enum>(vii)</enum><text>sorghum;</text></clause><clause id="idaf138d6a051e4d4892d4fc0961c13049"><enum>(viii)</enum><text>cotton; and</text></clause><clause id="id1a3aade450424ea7b0137471972b1547" commented="no" display-inline="no-display-inline"><enum>(ix)</enum><text>dairy.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7157517a1bf54c3ab7e8ba323a948896"><enum>(2)</enum><header display-inline="yes-display-inline">Foreign adversary</header><text>The term <term>foreign adversary</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idde66ab0d5bb14a86b0b5a53dbb491ad8"><enum>(A)</enum><text display-inline="yes-display-inline">any foreign adversary (as defined in section 8(c) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1607">47 U.S.C. 1607(c)</external-xref>)); and</text></subparagraph><subparagraph id="idb10e12a55c844864a0d20d1f96f0770f"><enum>(B)</enum><text>any foreign country identified by the Secretary pursuant to subsection (d).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id261ee5725c3b42aabe36ceb908268362"><enum>(3)</enum><header>Nonadversarial</header><text>The term <term>nonadversarial</term>, with respect to a foreign country or a market, means, respectively—</text><subparagraph commented="no" display-inline="no-display-inline" id="id86765f58423842a6a64e25f8a4a8a27c"><enum>(A)</enum><text display-inline="yes-display-inline">that the foreign country is not a foreign adversary; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf441db4672884b03afb02df442e63fc7"><enum>(B)</enum><text>that the market is located outside the jurisdiction of a foreign adversary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd155b5bfea504f8cbe6ca53118f9dd8a"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id6802d8c7f43b43bc96e8bd3c9334e291"><enum>(b)</enum><header>Annual assessment and report</header><text>On an annual basis, the Secretary, in coordination with the United States Trade Representative, shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report that—</text><paragraph commented="no" display-inline="no-display-inline" id="idf2d8d8827e72412783ad8406d667c166"><enum>(1)</enum><text display-inline="yes-display-inline">identifies risks and vulnerabilities with respect to the existing access of the United States to covered export markets of foreign adversaries that pose a risk of exploiting such a market; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35f864850a0a427b8ce505f7322c9720"><enum>(2)</enum><text display-inline="yes-display-inline">contains an assessment of alternative markets to the markets described in paragraph (1).</text></paragraph></subsection><subsection id="idf4819a7fb0cc4f9694b0598e109c40b4"><enum>(c)</enum><header>Contents</header><text>Each report under subsection (b) shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idced00f2c98a84d70885b9b16cac8aa33"><enum>(1)</enum><text display-inline="yes-display-inline">address the current and potential market access for each covered export that could be at risk of exploitation by a foreign adversary in the event of a trade disruption or military conflict;</text></paragraph><paragraph id="id59b0d579c14645b3867632fcac4a219e"><enum>(2)</enum><text>contain recommendations of the Secretary, in coordination with the United States Trade Representative, the Secretary of Commerce, and the Secretary of State, to reduce the dependency of the United States on markets of foreign adversaries for covered exports;</text></paragraph><paragraph commented="no" id="id34e7e56d6dcf46d38cd666ef635fb157"><enum>(3)</enum><text>identify alternative markets for increasing covered exports to nonadversarial countries; and</text></paragraph><paragraph id="id3a3db5cc223b412ebe531b6cf4589c72"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1c9e6db43d8647e3bd642a79d233c769"><enum>(A)</enum><text>describe, monitor changes over time in, and otherwise address potential risks posed by foreign adversaries to covered exports in nonadversarial markets; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idadf0f5a7a8474695b00cba286229ca16" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">contain recommendations for—</text><clause commented="no" display-inline="no-display-inline" id="id320c69fe7e2f4d24b459e4df39833e0f"><enum>(i)</enum><text display-inline="yes-display-inline">methods to address the risks described in subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id496048ca85e24d4888a99234df3b0e98"><enum>(ii)</enum><text display-inline="yes-display-inline">the presence and activities of the United States, unrelated to covered exports, in nonadversarial countries for the purpose of understanding how covered export market and nonmarket presence and activities may limit or constrain the United States with respect to covered exports and related market access.</text></clause></subparagraph></paragraph></subsection><subsection id="id1addd20e0de44205950de786ddc227ca"><enum>(d)</enum><header>Identification of foreign adversaries</header><text>At the discretion of the Secretary, for purposes of inclusion in an assessment under this section, the Secretary may identify as a foreign adversary any foreign country that the Secretary determines has engaged in a long-term pattern, or 1 or more serious instances, of conduct significantly adverse to—</text><paragraph commented="no" display-inline="no-display-inline" id="idd0d3ff7eab91401fbff629bf6c3af829"><enum>(1)</enum><text display-inline="yes-display-inline">the national security of the United States; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c2a0b2c1fb5481a9be8fb2c4845d564"><enum>(2)</enum><text display-inline="yes-display-inline">the security and safety of residents of the United States.</text></paragraph></subsection><subsection id="id9896e64fdc004e2e976974791e5f38dc"><enum>(e)</enum><header>Collection, distribution, and protection of information</header><paragraph id="idf8c03208f3614c90b27e52db8b1003b2"><enum>(1)</enum><header>Voluntary basis</header><text>The Secretary may collect information as part of an assessment under this section, subject to the condition that any such collection from a private entity shall be conducted on a voluntary basis.</text></paragraph><paragraph id="id06c2ae10449446c08d25d67619757c0d"><enum>(2)</enum><header>Aggregate data</header><text>The Secretary, an officer or employee of the Department of Agriculture (or any agency thereof), or any other person shall not disclose to the public any information provided by a private entity for purposes of an assessment under this section, unless the information has been transformed into a statistical or aggregate form that does not allow the identification of the person that supplied any particular information.</text></paragraph><paragraph id="id70ed92c5ca094d82844507c1cacf37b8"><enum>(3)</enum><header>Confidentiality</header><text>The Secretary shall ensure that no report submitted under this section includes any information that is a trade secret or confidential information subject to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id54b41466f50a480f82be8026d46649bf"><enum>(A)</enum><text display-inline="yes-display-inline">section 552(b)(4) of title 5, United States Code; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4857360074a146ee9286ced9e12ea46c"><enum>(B)</enum><text display-inline="yes-display-inline">section 1905 of title 18, United States Code.</text></subparagraph></paragraph><paragraph id="idc77baf4070ae469f8585d3adc08f2a2c"><enum>(4)</enum><header>Immunity from disclosure</header><text>Information provided to the Secretary as part of an assessment under this section—</text><subparagraph commented="no" display-inline="no-display-inline" id="id01c8f555d84348498c44c3495fcbca1d"><enum>(A)</enum><text>shall be considered to be specifically exempted from disclosure under section 552(b)(3) of title 5, United States Code; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id606fdb057f5b4a65ada31bfdda962289"><enum>(B)</enum><text display-inline="yes-display-inline">shall not be used by the Secretary for any purpose other than to carry out this section.</text></subparagraph></paragraph></subsection><subsection id="id687504c397bb4a428fdcb12202fff883"><enum>(f)</enum><header>Termination of report</header><text>The Secretary shall terminate the preparation and submission of the report under this section on making a determination that all relevant covered export markets have become sufficiently diversified.</text></subsection></section></legis-body></bill>
