which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food Security Act of 1985 to establish a program to promote upland species habitat restoration, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Growing and Restoring Operational Upland Species Ecosystems Act of 2026</short-title></quote> or the <quote><short-title>GROUSE Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id8fc7b19378ea46f6914850b3fb47ac57"><enum>2.</enum><header>Upland species habitat restoration program</header><text display-inline="no-display-inline">Chapter 5 of subtitle D of title XII of the Food Security Act of 1985 is amended by inserting after section 1240M (<external-xref legal-doc="usc" parsable-cite="usc/16/3839bb">16 U.S.C. 3839bb</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id762df6712bbc495ea906485b5dcc6e53"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id821a1325c46b48378007e62e2da4cbe5"><enum>1240N.</enum><header>Upland species habitat restoration program</header><subsection commented="no" display-inline="no-display-inline" id="id9fcb3d77b2ad4f58bbbd335f385a3de7"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall establish a program to provide payments to landowners that enter into contracts with the Secretary under this section for restoration of eligible forest land.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id13a3b91bbd434a14a2d22ae00addb027"><enum>(b)</enum><header>Eligible forest land</header><paragraph commented="no" display-inline="no-display-inline" id="id45d88c4f9db348efafff91372f8188f2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Forest land for which a landowner is eligible to receive a payment under this section is an area of not less than 10 acres of nonindustrial private forest land that—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide9cc08345d4e4d3586fdb5aa9ea14f53"><enum>(A)</enum><text display-inline="yes-display-inline">was commercially logged within the previous 180-day period;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida6eb131a182141b5a023dd3cc7da8598"><enum>(B)</enum><text>is currently being commercially logged, but has not been cut and cleared into open land for the purpose of development;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb3c62441e4fc43cb8cc50b8d7c3f6899"><enum>(C)</enum><text>is currently being commercially logged and will be cut and cleared for the purpose of forest management; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43b61d0269f14041bfac6aa4a860abdb"><enum>(D)</enum><text>was affected by a major natural disaster, as determined by the Secretary, such as a tornado, hurricane, wildfire, or insect infestation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8d6e7edf49cb435aaed48587f646165f"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Of the eligible forest land described in paragraph (1) owned by a landowner, the landowner shall not receive payments under this section for more than the lesser of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbd3ccad67ea04036860100cd07fa56df"><enum>(A)</enum><text display-inline="yes-display-inline">5 percent; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id693e918f78be4bbe9367116b6889f766"><enum>(B)</enum><text>250 acres.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1649a7340ec447e2a5de2fb63133592e"><enum>(c)</enum><header>Payments</header><paragraph commented="no" display-inline="no-display-inline" id="id48f5e51ecb29457b9a5fa837107bd38d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide payments to a landowner that enters into a contract with the Secretary under this section for 75 percent of the costs of habitat restoration activities incurred by the landowner in establishing native vegetation beneficial to upland wildlife, including planting native, soft-mast tree and shrub species and other native vegetation commonly found in early successional habitats, on eligible forest land, including costs of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf083166cc7df467290dac3b583f7ce0a"><enum>(A)</enum><text display-inline="yes-display-inline">labor;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaed84f5cf78446b2942dcdc5fd5fd02b"><enum>(B)</enum><text display-inline="yes-display-inline">planting;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2a4d9d0e268043738585cc5bc9c53599"><enum>(C)</enum><text>fertilizer;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida2b1b01ee41a4eafabb19a7e6e95d13a"><enum>(D)</enum><text>seedlings; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id954a6a83fc0e483da446ccc50b7f884e"><enum>(E)</enum><text>other materials and practices, as determined by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d0fe76b79154452bc6d06c6ba65739f"><enum>(2)</enum><header>Determination of amounts</header><text display-inline="yes-display-inline">The Secretary shall establish the amounts of eligible costs under paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id353b1de4e2e2422b883909957a7ff7da"><enum>(d)</enum><header>Contracts</header><paragraph commented="no" display-inline="no-display-inline" id="id3fbf5f0d08b64934916dd0108f5c5d3c"><enum>(1)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible to enter into a contract under this section, a landowner shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide75589caf7d64e6ca8a7147d812ba502"><enum>(2)</enum><header>Term</header><text>A contract under this section shall have a term that does not exceed 5 years.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8cfe9aa14cc948258b8f58c1be7455c2"><enum>(3)</enum><header>Habitat plan</header><text>A contract under this section shall include a habitat plan developed by the applicable landowner, in consultation with private, nongovernmental, State, or Federal wildlife biologists or foresters.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id680e7cb66844470db21db62aa9dbd75b"><enum>(e)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary may provide to a landowner that enters into a contract under this section (including through a third-party provider pursuant to section 1242) technical assistance in the planting of trees and shrubs in accordance with the contract.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
