which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the America COMPETES Act to establish certain scientific integrity policies for Federal agencies that fund, conduct, or oversee scientific research, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA063F9C5F853442FB3CFE1E9249D8BA0"><section section-type="section-one" id="H5C3375F71B804C22BD4B17DD9B08F79E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Scientific Integrity Act</short-title></quote>.</text></section><section id="H209E5340F84E41C183E1406A2B129919"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H3865D908E95B4A8E9644E8CFADE4B048"><enum>(1)</enum><text>science and the scientific process should help inform and guide public policy decisions on a wide range of issues, including improvement of public health, protection of the environment, and protection of national security;</text></paragraph><paragraph id="HA7FB4015ED204472AF8344B0C508F5DD"><enum>(2)</enum><text>the public must be able to trust the science and scientific process informing public policy decisions;</text></paragraph><paragraph id="HC595FFDBD17C4AB599034687F5929FCC"><enum>(3)</enum><text>science, the scientific process, and the communication of science should be free from politics, ideology, and financial conflicts of interest;</text></paragraph><paragraph id="HEBA79CF33991497093DEE49BD46E348D"><enum>(4)</enum><text>policies and procedures that ensure the integrity of the conduct and communication of publicly funded science are critical to ensuring public trust;</text></paragraph><paragraph id="H5069108E390E430FBCEB56C6D7EE1B84"><enum>(5)</enum><text display-inline="yes-display-inline">a Federal agency that funds, conducts, or oversees research should not suppress, alter, interfere with, or otherwise impede the timely communication and open exchange of data and findings to other agencies, policymakers, and the public of research conducted by a scientist or engineer employed or contracted by a Federal agency that funds, conducts, or oversees scientific research;</text></paragraph><paragraph id="HFB9B4087213E456EBBFC65F40CC0EBE5"><enum>(6)</enum><text>Federal agencies that fund, conduct, or oversee research should work to prevent the suppression or distortion of the data and findings;</text></paragraph><paragraph commented="no" id="H7D912BE40D844DEEB8DF644AFC95C720"><enum>(7)</enum><text display-inline="yes-display-inline">under the First Amendment to the Constitution of the United States, citizens of the United States have the right to <quote>petition the government for a redress of grievances</quote>; and</text></paragraph><paragraph commented="no" id="HB536706F788A4F388AF6AC21652298AC"><enum>(8)</enum><text>Congress has further protected those rights under section 7211 of title 5, United States Code, which states, <quote>[t]he right of employees, individually or collectively, to petition Congress or a member of Congress . . . may not be interfered with or denied</quote>.</text></paragraph></section><section id="HFCAB876AC495449FAC72FFA5F4AB9C60"><enum>3.</enum><header>Amendment to America COMPETES Act</header><text display-inline="no-display-inline">Section 1009 of the America COMPETES Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6620">42 U.S.C. 6620</external-xref>) is amended by striking subsections (a) and (b) and inserting the following:</text><quoted-block style="OLC" id="HE24E550565BD46EDBDF72F10E182D54E"><subsection display-inline="no-display-inline" id="HF140719D1CC44C1292B859FC3CE89354"><enum>(a)</enum><header>Scientific integrity policies</header><paragraph id="H16DD0FB5F139479FA4B2F8604BB05412"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of the <short-title>Scientific Integrity Act</short-title>, the head of each covered agency shall—</text><subparagraph id="H9E6CF2865C144DF99A72B9DDDD9865C7"><enum>(A)</enum><text>adopt and enforce a scientific integrity policy in accordance with subsections (b) and (c); and</text></subparagraph><subparagraph id="H551A617746A04C44BCCBA5D6AF012C23"><enum>(B)</enum><text>submit such policy to the Director of the Office of Science and Technology Policy for approval.</text></subparagraph></paragraph><paragraph id="H9CC47EAA0B254423A9DA61575C6924A9"><enum>(2)</enum><header>Publication</header><text>Not later than 30 days after the Director of the Office of Science and Technology Policy approves the scientific integrity policy under paragraph (1) with respect to a covered agency, the head of that agency shall—</text><subparagraph id="H8BEDD38946A8450E8BD8F5DCE70FB0BB"><enum>(A)</enum><text>make such policy available to the public on the website of the agency; and</text></subparagraph><subparagraph id="H153D51D4C5E14AFE9A88FAFAB0A782DD"><enum>(B)</enum><text>submit such policy to the relevant Committees of Congress.</text></subparagraph></paragraph></subsection><subsection id="H04EB2F93FEDA44CA8CAE07EE94C2867F"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">A scientific integrity policy under subsection (a) for a covered agency—</text><paragraph id="H05C92A189A4D4C22AF4036E22F830397"><enum>(1)</enum><text>shall prohibit any covered individual from—</text><subparagraph id="H43B6B48E7B5948D0B54985E02D12E164"><enum>(A)</enum><text>engaging in dishonesty, fraud, deceit, misrepresentation, coercive manipulation, or other scientific or research misconduct;</text></subparagraph><subparagraph id="H6B1B5E3337C14B36ACB4D5C65AEE104B"><enum>(B)</enum><text>suppressing, altering, interfering with, delaying without scientific merit, or otherwise impeding the release and communication of, scientific or technical findings;</text></subparagraph><subparagraph id="HA463CB51EC6D4F288C945641BEE83028"><enum>(C)</enum><text>intimidating or coercing an individual to alter or censor, attempting to intimidate or coerce an individual to alter or censor, or retaliating against an individual for failure to alter or censor, scientific or technical findings; or</text></subparagraph><subparagraph id="HF4F171EEB66A458A85A4147D8DAE224A"><enum>(D)</enum><text>implementing an institutional barrier to cooperation with scientists outside the covered agency and the timely communication of scientific or technical findings;</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H0522FD99440B4239BE99F211FC1130C5"><enum>(2)</enum><text display-inline="yes-display-inline">shall allow a covered individual to—</text><subparagraph id="H81FE84AC441D46019B5FF7D7C38CD625"><enum>(A)</enum><text>disseminate scientific or technical findings, subject to existing law, by—</text><clause id="H03C9FB506AF142D3AAC7CFB7F029139F"><enum>(i)</enum><text>participating in scientific conferences; and</text></clause><clause id="HA3FE1961FE0D46A7949A2207CF48F30C"><enum>(ii)</enum><text>seeking publication in online and print publications through peer-reviewed, professional, or scholarly journals;</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="HF77E8CE6F68948CFA7307A5027656102"><enum>(B)</enum><text>sit on scientific advisory or governing boards;</text></subparagraph><subparagraph display-inline="no-display-inline" id="HE7DA1A65BC854FA1948E95E3B2B154B9"><enum>(C)</enum><text>join or hold leadership positions on scientific councils, societies, unions, and other professional organizations;</text></subparagraph><subparagraph display-inline="no-display-inline" id="H1D0E10A4FCC34D8F8C6298A56737ACA8"><enum>(D)</enum><text>contribute to the academic peer-review process as reviewers or editors; and</text></subparagraph><subparagraph display-inline="no-display-inline" id="HF0BDF94C031D4B509D3857B1124BC7A9"><enum>(E)</enum><text>participate and engage with the scientific community;</text></subparagraph></paragraph><paragraph id="H6DC3443DD67B4C90B359C11DE7FE1BCA"><enum>(3)</enum><text>may require a covered individual, before disseminating scientific or technical findings as described in paragraph (2)(A), to submit such findings to the agency for the purpose of review by the agency of the data and findings for technical accuracy if the scientific integrity policy outlines a clear and consistent process for such review; and</text></paragraph><paragraph id="HCF46E42AECC044D781F1E64E5C5A104F"><enum>(4)</enum><text>shall require that—</text><subparagraph display-inline="no-display-inline" id="H1E1DA4812C7B402382126BEB5A23D3F3"><enum>(A)</enum><text>scientific conclusions are not made based on political considerations;</text></subparagraph><subparagraph id="H936446114968497198401A9731D16996"><enum>(B)</enum><text>the selection and retention of candidates for science and technology positions in the covered agency are based primarily on the candidate’s expertise, scientific credentials, experience, and integrity;</text></subparagraph><subparagraph id="H471B839BF16F4040998B1390D6428E85"><enum>(C)</enum><text display-inline="yes-display-inline">personnel actions regarding covered individuals, except for political appointees, are not taken on the basis of political consideration or ideology;</text></subparagraph><subparagraph id="H680ABEB0F3D445D1903DDF5886DF8574"><enum>(D)</enum><text>covered individuals adhere to the highest ethical and professional standards in conducting their research and disseminating their findings;</text></subparagraph><subparagraph id="HDA7A2322D6E442D88B18107FE6A036CE"><enum>(E)</enum><text>appropriate rules, procedures, and safeguards are in place to ensure the integrity of the scientific process within the covered agency;</text></subparagraph><subparagraph id="HD6BA51D9E8CA4128AF74137EA9E9DDB1"><enum>(F)</enum><text>scientific or technological information considered in policy decisions is subject to well-established scientific processes, including peer review as appropriate;</text></subparagraph><subparagraph id="H505DA69CB3434DBEBDDAAE05A49EF8AD"><enum>(G)</enum><text>procedures, including procedures with respect to applicable whistleblower protections, are in place as necessary to ensure the integrity of scientific and technological information and processes on which the covered agency relies in its decisionmaking or that the covered agency otherwise uses; and</text></subparagraph><subparagraph id="HDB94A9F367D1410D9B7D534AB058BC34"><enum>(H)</enum><text>enforcement of such policy is consistent with the processes for an administrative hearing and an administrative appeal.</text></subparagraph></paragraph></subsection><subsection id="HAE4AC3C605F344609263BF559AFA7319"><enum>(c)</enum><header>Implementation</header><text>In carrying out subsection (a), the head of each covered agency shall—</text><paragraph id="HF9510F33EC25476197203F5C07F2D46C"><enum>(1)</enum><text display-inline="yes-display-inline">design the scientific integrity policy under such subsection to apply with respect to the covered agency;</text></paragraph><paragraph id="HC5B3EE8B06004E9E9C5DB31BE62BDFC0"><enum>(2)</enum><text>ensure that such policy is clear with respect to what activities are permitted and what activities are not permitted;</text></paragraph><paragraph id="H50957F0CFF234D6C93D0976E2AC500A7"><enum>(3)</enum><text>ensure that there is a process for individuals not employed or contracted by the agency, including grantees, collaborators, partners, and volunteers, to report violations of the scientific integrity policy;</text></paragraph><paragraph id="H025EB44F0E944B5E95B938D204D35CAF"><enum>(4)</enum><text>enforce such policy uniformly throughout the covered agency; and</text></paragraph><paragraph id="HCCB88300AF224CEF8C0F792B31D2F993"><enum>(5)</enum><text>make such policy available to the public, employees, private contractors, and grantees of the covered agency.</text></paragraph></subsection><subsection id="H9D8DA01EA8B64DBCA618662E3A181415"><enum>(d)</enum><header>Scientific Integrity Officer</header><text>Not later than 90 days after the date of the enactment of the <short-title>Scientific Integrity Act</short-title>, each covered agency shall appoint a Scientific Integrity Officer, who shall—</text><paragraph id="H19A12F1FED5145D69D380917F47722CD"><enum>(1)</enum><text display-inline="yes-display-inline">be a career employee at the covered agency in a professional position;</text></paragraph><paragraph id="H0156B2B453084092B8B34A0DF7BF0B6F"><enum>(2)</enum><text>have technical knowledge and expertise in conducting and overseeing scientific research;</text></paragraph><paragraph id="HAC39342CEA384BB4AC6A8D97F90A33A2"><enum>(3)</enum><text>direct the activities and duties described in subsections (e), (f), and (g); and</text></paragraph><paragraph id="H1CFEF6CEC90A40C89033226B92E0D2E9"><enum>(4)</enum><text>work closely with the inspector general of the covered agency, as appropriate.</text></paragraph></subsection><subsection id="HA81C7246E8F74CF3B9FFD0F2BD96C6DC"><enum>(e)</enum><header>Administrative process and training</header><text>Not later than 180 days after the date of the enactment of the <short-title>Scientific Integrity Act</short-title>, the head of each covered agency shall establish—</text><paragraph id="HA9FB6925C0CB4B40ACDF90F9DAD14F4D"><enum>(1)</enum><text>an administrative process and administrative appeal process for dispute resolution consistent with the scientific integrity policy of the covered agency adopted under subsection (a); and</text></paragraph><paragraph id="HA5E877CC895B49AEBF18D9325121F20C"><enum>(2)</enum><text>a training program to provide—</text><subparagraph id="H6770ABCCC4E848DDB1C215EBB8490F3C"><enum>(A)</enum><text>regular scientific integrity and ethics training to employees and contractors of the covered agency;</text></subparagraph><subparagraph id="H70D7EB3A4D5F4A15A5A95CB03E3B8E53"><enum>(B)</enum><text>training to new employees of the covered agency who are covered individuals within 1 month of commencing employment;</text></subparagraph><subparagraph id="HE2282CDD49F74E5AB43D98D3FAD613F4"><enum>(C)</enum><text>information to ensure that covered individuals are fully aware of their rights and responsibilities regarding the conduct of scientific research, publication of scientific research, and communication with the media and the public regarding scientific research; and</text></subparagraph><subparagraph id="H1E17C75C6CA545668691A0B6540FEE92"><enum>(D)</enum><text>information to ensure that covered individuals are fully aware of their rights and responsibilities for administrative hearings and appeals established in the scientific integrity policy of the covered agency.</text></subparagraph></paragraph></subsection><subsection id="H0F8E5165F59A4299AA53ABD73A6B7D99"><enum>(f)</enum><header>Reporting</header><paragraph id="H542CE877AB1D43E49EA21637C6C2B008"><enum>(1)</enum><header>Annual report</header><text>Each year, each Scientific Integrity Officer appointed by a covered agency under subsection (d) shall post an annual report on the public website of the covered agency that includes, for the year covered by the report—</text><subparagraph id="H9032AF8547C14F3BBD67BC5ABFD370B7"><enum>(A)</enum><text>the number of complaints of misconduct with respect to the scientific integrity policy adopted under subsection (a)—</text><clause id="HACF2AAC1B7BA4C03877650405CF21223"><enum>(i)</enum><text>filed for administrative redress;</text></clause><clause id="H3CF3357EABCF4060A0901CCE12CFC0B1"><enum>(ii)</enum><text>petitioned for administrative appeal; and</text></clause><clause id="H9A165866E0F24090B66EC482D77984E2"><enum>(iii)</enum><text>still pending from years prior to the year covered by the report, if any;</text></clause></subparagraph><subparagraph id="H5EC1B8815A794EC8821A4EA2800DFEA0"><enum>(B)</enum><text>an anonymized summary of each such complaint and the results of each such complaint; and</text></subparagraph><subparagraph id="H38010E397A5640BEAAB1B870E1845AA0"><enum>(C)</enum><text>any changes made to the scientific integrity policy.</text></subparagraph></paragraph><paragraph id="H7A625AA93E15461897740A70BAE808F4"><enum>(2)</enum><header>Incident report</header><subparagraph id="H7DAC0FC2C9B24C51A9B030095FA97195"><enum>(A)</enum><header>In general</header><text>Not later than 30 days after the date on which an incident described in subparagraph (B) occurs, the head of a covered agency shall submit a report describing the incident to the Office of Science and Technology Policy and the relevant Committees of Congress.</text></subparagraph><subparagraph id="H87370C03462D4944B8FE06EB08578968"><enum>(B)</enum><header>Incident</header><text>An incident described in this subparagraph is an incident in which an individual, acting outside the channels established under subsection (e), overrules the decision of the Scientific Integrity Officer appointed under subsection (d) with respect to a dispute regarding a violation of the scientific integrity policy adopted under subsection (a).</text></subparagraph></paragraph></subsection><subsection id="H8380C40702BA4471B3683703AB9DA852"><enum>(g)</enum><header>Office of Science and Technology Policy</header><text>The Director of the Office of Science and Technology Policy shall—</text><paragraph id="H2A4427BA01D3494E90FBCE730C57B003"><enum>(1)</enum><text>collate, organize, and publicly share all information received by the Director under subsection (f) in 1 place on the website of the Office of Science and Technology Policy; and</text></paragraph><paragraph id="H6BBB91DD9546427BA59854585C0DE700"><enum>(2)</enum><text>on an annual basis, convene the Scientific Integrity Officer of each covered agency appointed under subsection (d) to discuss best practices for implementing the requirements of this section.</text></paragraph></subsection><subsection id="H97CC734DFF4642C6A54EA6BC7304B044"><enum>(h)</enum><header>Periodic review and approval</header><paragraph id="H020D2671C62D405B8FA0EB96EECBA173"><enum>(1)</enum><header>Internal review</header><text display-inline="yes-display-inline">The head of each covered agency shall periodically conduct a review of the scientific integrity policy adopted under subsection (a) and change such policy as appropriate.</text></paragraph><paragraph id="HA4F20DF620E94A0DA2EBCBB8124B2B78"><enum>(2)</enum><header>Review by the Office of Science and Technology Policy</header><subparagraph id="H8071108489E343E1BADEB8EA87D6B78D"><enum>(A)</enum><header>Review of substantial updates</header><text display-inline="yes-display-inline">The head of each covered agency shall submit to the Office of Science and Technology Policy for approval any substantial changes to the scientific integrity policy adopted under subsection (a).</text></subparagraph><subparagraph id="HA9143B1A51924CE6B1C8FD08FA854C99"><enum>(B)</enum><header>Quinquennial review</header><text>Not later than 5 years after the date of the enactment of the <short-title>Scientific Integrity Act</short-title>, and every 5 years thereafter, the head of each covered agency shall submit the scientific integrity policy for such agency to the Office of Science and Technology Policy for review and approval.</text></subparagraph></paragraph></subsection><subsection id="H3A1F691FB4FE4D799DD3AA6E54B96821"><enum>(i)</enum><header>Comptroller General review</header><text>Not later than 2 years after the date of the enactment of the <short-title>Scientific Integrity Act</short-title>, the Comptroller General of the United States shall conduct a review of the implementation of the scientific integrity policy by each covered agency.</text></subsection><subsection id="H02416BD079214781BA3AFC3699164D89"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H19B1011CA03C4B859C7F802EDBFD0413"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="H22B22852DADE47CE816627D3941AEC67"><enum>(2)</enum><header>Covered agency</header><text>The term <term>covered agency</term> means an agency that funds, conducts, or oversees scientific research.</text></paragraph><paragraph id="HC7313B6F1D2948F7B03AFFD2B50100BF"><enum>(3)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means a Federal employee or contractor who—</text><subparagraph id="HA1D6706A4D1A407B855BE90BC40C1992"><enum>(A)</enum><text>is engaged in, supervises, or manages scientific activities;</text></subparagraph><subparagraph id="H48648556F04440659CA9DFB1F171FE53"><enum>(B)</enum><text>analyzes or publicly communicates information resulting from scientific activities; or</text></subparagraph><subparagraph id="H6F2A845BA32645BAB0E390F9A812C62D"><enum>(C)</enum><text>uses scientific information or analyses in making bureau, office, or agency policy, management, or regulatory decisions.</text></subparagraph></paragraph><paragraph id="H468CDFF5C495438BA55191ED6702E9E5"><enum>(4)</enum><header>Relevant committees of Congress</header><text>The term <term>relevant Committees of Congress</term> means—</text><subparagraph id="H57036EB85A634F238039CEB43AC71B47"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph><subparagraph id="H214C0C7F9167443F85C569C639C8FB3E"><enum>(B)</enum><text>the Committee on Science, Space, and Technology of the House of Representatives.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBFD72790C5494481A2593CD382E7E669"><enum>4.</enum><header>Existing policies; clarification</header><subsection id="H6E42011B90164C04AC000E8CD0264A13"><enum>(a)</enum><header>Existing scientific integrity policies</header><text>Notwithstanding the amendments made by this Act, the scientific integrity policy of a covered agency that was in effect on the day before the date of the enactment of this Act may satisfy the requirements under the amendments made by this Act if the head of the covered agency—</text><paragraph id="H56D17722FFBD40F9B809C201F66025B0"><enum>(1)</enum><text>makes a written determination that the policy satisfies such requirements;
