which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To disqualify aliens from establishing good moral character, maintaining eligibility for asylum, and retaining lawful permanent resident status if they engage in activities in opposition to the United States Constitution, our form of government, or support Sharia law.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ban Outsiders Openly Touting Sharia Law Act</short-title></quote> or the <quote><short-title>BOOT Sharia Law Act</short-title></quote>.</text></section><section id="iddcc86bf1387046f787788c67f34f706f"><enum>2.</enum><header>Bars to good moral character for protesting against the United States Constitution, our form of government, or supporting Sharia law</header><text display-inline="no-display-inline">Section 101(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(f)</external-xref>), is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id7843fc1f16204e99aa1d707a01958adf"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida48758673f544ec0819fe5b7b55edbe3"><paragraph id="idadb3f733d1304f0b89fb9d143043b75c"><enum>(2)</enum><text>an alien who—</text><subparagraph id="id4ba51d2b08104a09a7a353e645c82182"><enum>(A)</enum><text>adheres to, or has adhered to, Sharia law, or advocates, or has advocated for, the imposition or enforcement of Sharia law in a manner that would violate the rights of another person under the Constitution of the United States or under any Federal or State law; or</text></subparagraph><subparagraph id="ide3a3a68aada141bb8640e80d8ae2d4ae"><enum>(B)</enum><text>demonstrates, protests, riots, or participates in any demonstration, protest, riot, or other organized or ad hoc activity expressing or indicating support for any individual, entity, organization, group, or country that—</text><clause commented="no" display-inline="no-display-inline" id="id7dcb9e65af9d47c7be651c192f3d1319"><enum>(i)</enum><text display-inline="yes-display-inline">is designated as a state sponsor of terrorism pursuant to section 219(a);</text></clause><clause id="id4bc23a53a0534082a26973a6ed2d658c"><enum>(ii)</enum><text>has carried out terrorist acts against the United States or members of the United States Armed Forces; or</text></clause><clause id="id96709e0fce23439d9e02784b5f4ef78f"><enum>(iii)</enum><text>opposes the form of government, the Constitution, or the principles of the United States;</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idef92951052904c5795b08971fa8c5883"><enum>3.</enum><header>Bars to asylum and lawful permanent residence for asylees and refugees supporting Sharia law or protests against the United States Constitution or form of government</header><subsection commented="no" display-inline="no-display-inline" id="id04ef696a14bd4018b12f8f0f499efe7b"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of refugee</header><text display-inline="yes-display-inline">Section 101(a)(42) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(42)</external-xref>), is amended—</text><paragraph id="idda0cf2703ddc45dfbdeee85130019a4b"><enum>(1)</enum><text>by redesignating subparagraphs (A) and (B), as clauses (i) and (ii), respectively;</text></paragraph><paragraph id="id55db5726cb9942c2b7aa2961512a0c46" commented="no"><enum>(2)</enum><text>by striking <quote>(42) The term <term>refugee</term> means</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide35c2764ad6f430884d13008f6c9b7f1"><paragraph commented="no" display-inline="no-display-inline" id="id64dacd69f5a8437da25ed89ebaa6e834"><enum>(42)</enum><header>Refugee</header><subparagraph commented="no" display-inline="no-display-inline" id="id1463c0f0fa6f4d2c9587eb6ab3747e50"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>refugee</term> means</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ide554199849d54b719301ba62812c6e1b"><enum>(3)</enum><text>by striking <quote>The term <term>refugee</term> does not include</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd4e2814c59b14c81af549b33cae69c61"><subparagraph id="idcdc75e4410c74f31a36bd7434770ebd0"><enum>(B)</enum><header>Persecutor bar</header><text>The term <term>refugee</term> does not include</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfdf091f1398846bc934bb15cda18c490"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting before <quote>For purposes of</quote> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide23d235b81d64812800d5dbb28eb2aeb"><subparagraph id="idfacee5cccdfb4373a1e65a4e504100ab"><enum>(C)</enum><header>Jihadist bar</header><text>The term <term>refugee</term> does not include any alien who used force, coercion, violence, or terror—</text><clause id="id2643cdb96cbd44778c7234d83cbba503"><enum>(i)</enum><text>to enforce Islamic values or Sharia law;</text></clause><clause id="id4eda8b09d19d47629d35fd6e7335889c"><enum>(ii)</enum><text>to enforce conversions to Islam;</text></clause><clause id="id282d5edcc5504031a857c4cd955252c7"><enum>(iii)</enum><text>to achieve an Islamist political goal; or</text></clause><clause id="id7aab1ca1bfae468e94924a3d7fcbbfba"><enum>(iv)</enum><text>to establish Islam as the state religion.</text></clause></subparagraph><subparagraph id="ida57c8aea75c24f10921ba32a850e9847"><enum>(D)</enum><header>Presumptions</header></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ide54065bd56a54983854711d4aaec88a2"><enum>(b)</enum><header>Asylum</header><text>Section 208(b)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)(A)</external-xref>) is amended—</text><paragraph id="id173283cd1b75495092f7c956fa4b3f9a"><enum>(1)</enum><text>in clause (v), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="ide1f64b13c89347f9a3e7500cbe1ca022"><enum>(2)</enum><text>in clause (vi), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="id6cb60fba111f4b898ff931294a8a386d"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd9e587f132774d0dab6db5d7d9267fbd"><clause id="id74055978fc4440a284b22623ed778a6d"><enum>(vii)</enum><text>there are reasonable grounds to believe the alien adheres to, or has adhered to, Sharia law, or advocates, or has advocated, for the imposition or enforcement of Sharia law in a manner that would violate the rights of another person under the Constitution of the United States or any Federal or State law; or</text></clause><clause id="idb2d312d0792b49d2bdd077343ea99909"><enum>(viii)</enum><text>there are reasonable grounds to believe the alien has used coercion, force violence, or terror against another person—</text><subclause id="id8ff0d2b4d53d4a7aa139eb13f73f81ec"><enum>(I)</enum><text>to enforce Islamic values or Sharia law;</text></subclause><subclause id="id71504cdc897641d0aff541ddf2d64866"><enum>(II)</enum><text>to enforce conversions to Islam;</text></subclause><subclause id="idf00164d1342d4c20a78b6db9ec0780ec"><enum>(III)</enum><text>to achieve an Islamist political goal; or</text></subclause><subclause id="id844a3472cd8a41d0811c9ae8eac33577"><enum>(IV)</enum><text>to establish Islam as the state religion.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id689d2c0b74df4f0ca52a297c40ea34b8"><enum>(c)</enum><header>Adjustment of status of refugees</header><text>Section 209 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1159">8 U.S.C. 1159</external-xref>), is amended—</text><paragraph id="idd04b32ea1d6d4bd5ac27f367b002d5b4"><enum>(1)</enum><text>in subsection (a), by striking <quote>Any alien</quote> and inserting <quote>Except as provided in subsection (d), any alien</quote>; and</text></paragraph><paragraph id="id882c8d40d5384403b39ac9a6724b7d0d"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb4fec3e3c4ee4363a20ac8632ed23cd8"><subsection id="idce84a0d71c194ee3b4314125cf377e9b"><enum>(d)</enum><text>An alien who has been admitted to the United States as a refugee under section 207 or granted asylum under section 208 is not eligible for adjustment of his or her status to that of an alien lawfully admitted for permanent residence under this section if the Secretary of Homeland Security or the Attorney General have reasonable grounds to believe such alien—</text><paragraph commented="no" display-inline="no-display-inline" id="id8c2c96f60ce8457ebe3e6a526e41b36a"><enum>(1)</enum><text>after admission, continues to adhere to, or has adhered to, Sharia law, or advocates or has advocated for the imposition or enforcement of Sharia law in a manner that would violate the rights of another person under the Constitution of the United States or under any Federal or State law; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide3e9bb5a7cf8431db789ba2c52126665"><enum>(2)</enum><text>after admission, has used coercion, force, violence, or terror against another person—</text><subparagraph id="id8a92990fa2e848fa85c0f7cecf6b32d3"><enum>(A)</enum><text>to enforce Islamic values or Sharia law;</text></subparagraph><subparagraph id="id9ee508b1b4234b54b07d7fd0ccc4995f"><enum>(B)</enum><text>to enforce conversions to Islam;</text></subparagraph><subparagraph id="id8569013fcc334bbdaae702cbfc92df5d"><enum>(C)</enum><text>to achieve an Islamist political goal; or</text></subparagraph><subparagraph id="id653b79aee2cd41fbb2fc5c5f37588998"><enum>(D)</enum><text>to establish Islam as the state religion.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id374aa4f9d46b48f6b90c76270ff7103a"><enum>4.</enum><header>Rescission of lawful permanent resident status for aliens supporting Sharia law or protesting against the United States Constitution or form of government</header><text display-inline="no-display-inline">Section 246(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1256">8 U.S.C. 1256</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id01586b09a280400c909287056ab48a2a"><subsection id="ide5495c8ef7d94ec090f5cde9690a879c"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="no-display-inline" id="id108f7f29b592476aa27b2d3dede41bf4"><enum>(1)</enum><header display-inline="yes-display-inline">Grounds for rescission</header><text>If, at any time during the 10-year period beginning on the date on which the status of an alien is adjusted under the provisions of section 245 or 249 or under any other provision of law to that of an alien lawfully admitted for permanent residence, the Secretary of Homeland Security or the Attorney General determine that such alien—</text><subparagraph id="id4891efe45653400c956244c5c3c306ea"><enum>(A)</enum><text>was not eligible for such adjustment of status; or</text></subparagraph><subparagraph id="id7bfb317e6ce24bb1acba8c3899434244"><enum>(B)</enum><text>participated in any demonstration, protest, riot, or other organized or ad hoc activity expressing or indicating support for any individual, entity, organization, group, or country that—</text><clause commented="no" display-inline="no-display-inline" id="id288b94ac95f44f18bb7d201f61cb2127"><enum>(i)</enum><text display-inline="yes-display-inline">is designated as a state sponsor of terrorism under section 219(a);</text></clause><clause id="iddb810a695d4b487a8670a7b42c6c810b"><enum>(ii)</enum><text>has carried out terrorist acts against the United States or members of the United States Armed Forces; or</text></clause><clause id="id06b50655da69479299be40e6954600e5"> <enum>(iii)</enum> <text>opposes the form of government, the Constitution, or the principles of the United States,</text>
 </clause><continuation-text continuation-text-level="subparagraph">the Attorney General shall rescind the action taken granting an adjustment of status to such alien and cancelling his or her removal, if applicable, and such alien shall thereafter be subject to all provisions of this chapter to the same extent as if such adjustment of status had not been made</continuation-text></subparagraph></paragraph><paragraph id="id987a2ca14c444cef8ad8382c2751ace4" commented="no"><enum>(2)</enum><header>Savings provision</header><text>Nothing in this subsection may be construed to require the Attorney General to rescind the alien's status before the commencement of procedures to remove the alien under section 240, and an order of removal issued by an immigration judge shall be sufficient to rescind the alien’s status.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
