which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Small Business Act to establish a direct loan program for microbusinesses at the Small Business Administration, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Microbusiness Support Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idffb12d11035e408d91a73e2f16e1aed4"><enum>2.</enum><header>Direct loan program for microbusinesses</header><text display-inline="no-display-inline">Section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9249580D032E4278AE7F4F6A005AE819"><paragraph commented="no" display-inline="no-display-inline" id="id5607224090914c538a995091cbba15c5"><enum>(38)</enum><header>Microbusiness loan program</header><subparagraph commented="no" display-inline="no-display-inline" id="id68706e1d0451430e830b2521a2ff07ce"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header><clause commented="no" display-inline="no-display-inline" id="id8f5c9e7ddabc4fb1b6de256003fbbaa9"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>In this paragraph, the term <term>microbusiness</term> means an independently owned and operated for-profit business entity that—</text><subclause id="id81049651da814b58a0525ca852eabb21"><enum>(I)</enum><text>employs not more than 10 full-time employees, determined on a full-time equivalent basis; and</text></subclause><subclause id="idad564d5956864b3d859844e888a988c0"><enum>(II)</enum><text>has annual revenue of not more than the lesser of—</text><item commented="no" display-inline="no-display-inline" id="id7968271e3e1647c8b3a0a2f6ac4bccfa"><enum>(aa)</enum><text display-inline="yes-display-inline">$5,000,000; or</text></item><item id="id45c9d0d1079a4c3e9fb8a182804751c7"><enum>(bb)</enum><text>the size standard in dollars, if any, for the North American Industry Classification System code assigned to the business entity for the business entity to qualify as a small business concern.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id658d6e02c9224b37be87ac11ade2ed44"><enum>(ii)</enum><header>Full-time</header><text>For purposes of clause (i), the term <term>full-time</term> means that an individual—</text><subclause commented="no" display-inline="no-display-inline" id="ide2a29138c61f412787681ffde5931d13"><enum>(I)</enum><text display-inline="yes-display-inline">is employed for consideration for not less than 35 hours each week; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idcc07e924679348278f6d7b0693e2400d"><enum>(II)</enum><text display-inline="yes-display-inline">renders any other standard of service generally accepted by custom or specified by contract as full-time employment.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd8a4a692640240a991672a75413f637c"><enum>(iii)</enum><header>Verification</header><text display-inline="yes-display-inline">The Administrator may request from a business entity such documentation as may be necessary to establish that the business entity qualifies as a microbusiness under this subparagraph.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ffe9e2ef01f4174aff19d6ef5db089d"><enum>(B)</enum><header>Authority</header><text>The Administrator is authorized to originate and disburse direct loans, including through partnerships with third parties, to microbusinesses under this subsection.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4cc53cb57a1e4f3e996dc09ceea7f474"><enum>(C)</enum><header display-inline="yes-display-inline">Maximum amount</header><text>The maximum amount of a loan made under this paragraph to a microbusiness is $100,000.</text></subparagraph><subparagraph id="id474f7eab6bc1404d92bdd82ed82695b4"><enum>(D)</enum><header>Fees</header><text>With respect to each loan made under this paragraph, the Administrator, an authorized third party, or an agent may—</text><clause commented="no" display-inline="no-display-inline" id="id78979a4c49f9411da4ccef1d7aba8688"><enum>(i)</enum><text display-inline="yes-display-inline">impose, collect, retain, and utilize fees, which may be charged to the borrower, to cover any costs associated with referring applications or originating, making, underwriting, disbursing, closing, servicing, or liquidating the loan, including any direct lending agent costs, other program or contract costs, or other agent administrative expenses;</text></clause><clause commented="no" display-inline="no-display-inline" id="id943c46afa5bf4fd4bfdd63aa5ccbc2e4"><enum>(ii)</enum><text>impose, collect, retain, and utilize fees (including unused fees and draw fees), which may be charged to the borrower on loans for revolving lines of credit; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id297d770e44c349dbbfb1b9e15def3d3f"><enum>(iii)</enum><text>pay third parties, including direct lending agents and financial institutions, with which the Administration partners for assistance in referring applicants or promoting, originating, making, underwriting, disbursing, closing, servicing, or liquidating loans in accordance with this paragraph on behalf of the Administration.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53d1162777f04fd1b5758d28e80e0f7e"><enum>(E)</enum><header>Terms</header><clause commented="no" display-inline="no-display-inline" id="id1a8de6e465cf41199b6e9a9dc1580c29"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 90 days after the date of enactment of this paragraph, the Administrator shall issue interim final rules and revise any relevant rules to establish the terms and conditions for a direct loan made under this paragraph, including with respect to repayment, underwriting criteria, interest rate, maturity, and other terms.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2450d1b9c03f43209bd93e8d8900d497"><enum>(ii)</enum><header display-inline="yes-display-inline">Interest rate</header><text>The interest rate for a loan made under this paragraph shall be in accordance with paragraph (4)(A), except <quote>6 percent per annum</quote> shall be substituted for <quote>1 percent per annum</quote>.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
