which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a new ground for inadmissibility for close relatives of foreign terrorists.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Safe Haven for Terrorist Families Act</short-title></quote>.</text></section><section id="iddc3d6c7b4b1842dd871af5095f81951a"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id9e7e4cd4954d4ef2acf9b9f2fa4e083d"><enum>(1)</enum><text>The United States has a sovereign right and duty to protect its national security by denying safe haven to individuals whose close family ties to enemies of the United States create unacceptable risks.</text></paragraph><paragraph id="id2a4fc7cf68744a949f2eef57e560ebfc"><enum>(2)</enum><text>Current inadmissibility provisions related to terrorism are too narrow and discretionary to systematically evaluate the inadmissibility of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3a937bf95710495496cb510842c2bff9"><enum>(A)</enum><text display-inline="yes-display-inline">family members of designated terrorists;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85df155aa2eb40edb4d0a32db7448831"><enum>(B)</enum><text display-inline="yes-display-inline">senior officials of state sponsors of terrorism and other foreign adversaries; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4735af431f414be886ffb23c568b76e2"><enum>(C)</enum><text display-inline="yes-display-inline">sanctioned kleptocrats.</text></subparagraph></paragraph><paragraph id="id5c2e846da2d742b1b8bf2283ba6a7513"><enum>(3)</enum><text>Close family members of active threats often share access to networks, resources, and influence that can harm the United States.</text></paragraph><paragraph id="id9167da1b5303485aa69c6f19876d4afd"><enum>(4)</enum><text>Providing visas, lawful permanent residence, or other immigration benefits to close relatives of individuals referred to in paragraph (2) undermines our national security and emboldens our foreign adversaries.</text></paragraph></section><section id="idc18f89d8831945bb908f92e5349a4a08"><enum>3.</enum><header>Inadmissibility and deportability of covered family members of covered foreign threat actors</header><subsection commented="no" display-inline="no-display-inline" id="id979d8c4552674cfcb06df8f90fde4aed"><enum>(a)</enum><header display-inline="yes-display-inline">Inadmissibility</header><text display-inline="yes-display-inline">Section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e9c28f67be149e4bacc55241059277d"><enum>(1)</enum><text>in paragraph (3)(B), by adding at the end the following: <quote>This subparagraph may not be construed to limit the application of paragraph (11)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfa1a6205aacb431298c32de4012a5f3b"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd3717b24f98d4878817c64e6ca8fac2c"><paragraph id="id41d4540b895244f4bd7752cefacd525a"><enum>(11)</enum><header>Covered family members of covered foreign threat actors</header><subparagraph id="id6ae8df70ca904cdb9785175a8a35046f"><enum>(A)</enum><header>In general</header><text>Any alien who is a covered family member of a covered foreign threat actor is inadmissible.</text></subparagraph><subparagraph id="ideb66f7334c0d40619ef63110db7324b5"><enum>(B)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="id283a69c3ff984a51b82d92205debac1f"><enum>(i)</enum><header>Covered family member</header><text>The term <term>covered family member</term> means any alien who is—</text><subclause id="id804bf8fccf2e42bab5d6d2f1fa3d4b0b"><enum>(I)</enum><text>the spouse or former spouse of a covered foreign threat actor;</text></subclause><subclause id="ida1c9a52885084d6995a7eb3e9642afb9"><enum>(II)</enum><text>a parent or parent-in-law of a covered foreign threat actor;</text></subclause><subclause id="id744d95adc37248f6a268c41632a1a2c2"><enum>(III)</enum><text>a child or stepchild of a covered foreign threat actor (whether or not such relationship is current);</text></subclause><subclause id="id1429be52e96349999e734b893c7abaa6"><enum>(IV)</enum><text>a sibling (including a half-blood sibling) of a covered foreign threat actor;</text></subclause><subclause id="idb785b624222c42889bd4b2cf92fc5c0c"><enum>(V)</enum><text>a grandparent or grandchild of a covered foreign threat actor; or</text></subclause><subclause id="iddc9d591e549d4dbf9f38bf59fdb80ee5"><enum>(VI)</enum><text>a niece or nephew of a covered foreign threat actor.</text></subclause></clause><clause id="idb3c2aa4ded324ae685d13a23d2a815f3"><enum>(ii)</enum><header>Covered foreign threat actor</header><text>The term <term>covered foreign threat actor</term> means any individual who—</text><subclause id="id09d9e557452b451ab9393c0a676e37e7"><enum>(I)</enum><text>is or was designated as a Specially Designated Global Terrorist under Executive Order 13224 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism) or any successor authority;</text></subclause><subclause id="id9aa08a98a3d34d9f9a1b4a10b774aa0a"><enum>(II)</enum><text>is or was a senior leader or official (at the director level or higher) of a foreign terrorist organization so designated under section 219(a);</text></subclause><subclause id="id110fa023985b4d4db929152d0f4a9f27"><enum>(III)</enum><text>is or was a senior official (at the deputy minister level or higher, or equivalent) of the government of—</text><item commented="no" display-inline="no-display-inline" id="idc75593f6e3084934b8ed86b83ddb7ff0"><enum>(aa)</enum><text display-inline="yes-display-inline">a state sponsor of terrorism so designated under section 1754(c) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)</external-xref>) or any successor provision; or </text></item><item commented="no" display-inline="no-display-inline" id="id7a617274791840e5ac7c818f319c459b"><enum>(bb)</enum><text display-inline="yes-display-inline">any country that is a foreign adversary (as defined in section 8(c) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1607">47 U.S.C. 1607(c)</external-xref>), including the Islamic Republic of Iran, the People’s Republic of China, the Russian Federation, the Democratic People’s Republic of Korea, and the Republic of Cuba; or</text></item></subclause><subclause id="iddf19feae2c0546dfb6930ae2f6ac19ad"><enum>(IV)</enum><text>is or was sanctioned under the Global Magnitsky Human Rights Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/10101">22 U.S.C. 10101 et seq.</external-xref>), the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>), or any other Federal law for significant corruption, kleptocracy, or human rights abuses directly tied to a hostile foreign government or regime.</text></subclause></clause></subparagraph><subparagraph id="id0b44d116375d457bb48e2a2d02728877"><enum>(C)</enum><header>Retroactive application</header><text>This paragraph shall apply to any alien regardless of when the family relationship was formed or when the covered foreign threat actor was so designated.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7ef9a29243154db7b0aa604a0f784999"><enum>(b)</enum><header>Deportability</header><text>Section 237(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida6427fbe6bba444ea4733f77ba0b3cae"><paragraph commented="no" display-inline="no-display-inline" id="id3488672e62ea43938af36375cbe042b1"><enum>(8)</enum><header>Covered family members of covered foreign threat actors</header><text>Any alien described in section 212(a)(11)(A) is deportable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id14af3815ef154de1987d5997738ebaa2"><enum>4.</enum><header>Mandatory visa revocation and removal</header><subsection id="iddeb84d46ec6f4165aa0005194677bb3f"><enum>(a)</enum><header>Visa revocation</header><text>Section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>) is amended by adding at the end the following: <quote>The Secretary of State shall revoke any visa or other documentation previously issued to any alien who is inadmissible under section 212(a)(11) not later than 30 days after such alien's inadmissibility has been determined.</quote>.</text></subsection><subsection id="id70d9910ef47d4c5ab71d7b72e838e771"><enum>(b)</enum><header>Removal proceedings</header><text>Any alien within the United States who is inadmissible under section 212(a)(11) of the Immigration and Nationality Act, as added by section 3, shall be subject to removal proceedings in accordance with section 240 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a</external-xref>). The Secretary of Homeland Security shall prioritize the removal of all such aliens.</text></subsection><subsection id="id9e75a129356c48199f6aa9886a6c12d1"><enum>(c)</enum><header>No discretionary relief</header><text>Aliens who are inadmissible under section 212(a)(11) of the Immigration and Nationality Act, as added by section 3, are not eligible for cancellation of removal, adjustment of status, or any other form of discretionary relief from removal, except as expressly provided in this Act.</text></subsection></section><section id="idd91058cf68394522a50469427be0501b"><enum>5.</enum><header>Implementation and reporting</header><subsection id="id9d9c486ed44e40aca1312fd537dfd636"><enum>(a)</enum><header>Screening requirements</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State and the Secretary of Homeland Security shall implement enhanced screening procedures to identify covered family relationships using all available intelligence, law enforcement, and sanctions databases.</text></subsection><subsection id="id2f37c8cfdd874996b670464256da03de"><enum>(b)</enum><header>Annual report</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security, in consultation with the Secretary of State, shall submit a report to the appropriate congressional committees that includes, with respect to the reporting period—</text><paragraph id="id980890ef38ae40e49fb32142b98d9a2e"><enum>(1)</enum><text>the number of aliens who were determined to be inadmissible under section 212(a)(11) of the Immigration and Nationality Act, as added by section 3;</text></paragraph><paragraph id="idf761d60b4df84f1b8bce64ea78b5aecd"><enum>(2)</enum><text>the number of visas issued to aliens described in paragraph (1) that were revoked;</text></paragraph><paragraph id="id6f22ec43fb0d48a0968a26bb2c9cfb8b"><enum>(3)</enum><text>the number of removals of aliens described in paragraph (1) that were carried out; and</text></paragraph><paragraph id="idf92c584baa8544ceb7ec4dd2852f788e"><enum>(4)</enum><text>a summary of any waivers granted to aliens described in paragraph (1), including a justification for each such waiver.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id24b03ab7e1eb42e7b14a47ced2902216"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act.</text></section><section id="id48ffb8bdb0194d81b3f778aa6f0d1ce9"><enum>7.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id4096319cafbf40a593401f26334cd0f5"><enum>(1)</enum><text display-inline="yes-display-inline">take effect on the date of the enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id85f5421f43024245b2b5a8e84282c2dc"><enum>(2)</enum><text display-inline="yes-display-inline">apply to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idecd62efd938344dfb6fd35055b08b150"><enum>(A)</enum><text display-inline="yes-display-inline">all applications for visas, admissions, and adjustments of status pending on or after such date; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88f8875ae408404b9e902b8f4237f448"><enum>(B)</enum><text display-inline="yes-display-inline">all aliens who were previously admitted to the United States or granted lawful status in the United States.</text></subparagraph></paragraph></section></legis-body></bill>
