Juvenile justice and delinquency prevention.</toc-entry></toc></subsection></section><section id="idB64A7EA0DFB7449EAF782B17C481F51D"><enum>2.</enum><header>Effective date</header><text display-inline="no-display-inline">Unless otherwise provided, this Act, and the amendments made by this Act, shall take effect 1 year after the date of enactment of this Act.</text></section><title id="H1511F3942F6F44FEB1A96DD0E74E2A59"><enum>I</enum><header>School Breakfast Program</header><section id="H7CEEDD2F5B4040B88E95C4D423A8C27D"><enum>101.</enum><header>Free school breakfast program</header><subsection id="H11F217AED28E4BF89CA48DC83860F31D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4(a) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773(a)</external-xref>) is amended, in the first sentence—</text><paragraph id="id194d795b87484913a6d3362eb9106436"><enum>(1)</enum><text>by striking <quote>is hereby</quote> and inserting <quote>are</quote>; and</text></paragraph><paragraph id="id0E2278B5B11F4BDB8C0ABF36279E515D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>to provide free breakfast to all children enrolled at those schools</quote> before <quote>in accordance</quote>.</text></paragraph></subsection><subsection id="H04CD019DB559453C8922B2E1D94596CF"><enum>(b)</enum><header>Apportionment to States</header><text>Section 4(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773(b)</external-xref>) is amended—</text><paragraph id="H762BBAE8A4454299A941C9D09AA1DEC3"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="idB12A537D06EA4C1C8937ED2AEA07A4B6"><enum>(A)</enum><text>in subparagraph (A)(i), by striking subclause (II) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id27FA555720E4413B83DD2569EEA84C85"><subclause id="HAF137FB369774E7FA23A3F8FF510242C"><enum>(II)</enum><text display-inline="yes-display-inline">the national average payment for free breakfasts, as specified in subparagraph (B).</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HDE0B0612A24D457CA144CF1BC903316C"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H47A302F210EB4BD2808A35AC370840C1"><subparagraph id="HFD33CC5F0C3A497EB60E7CB2DB83F6BA"><enum>(B)</enum><header>Payment amounts</header><clause id="H703F6F3E406C49C8A25D076ED3FCAB6E"><enum>(i)</enum><header>In general</header><text>The national average payment for each free breakfast shall be $3.28, adjusted annually for inflation in accordance with clause (ii) and rounded in accordance with clause (iii).</text></clause><clause id="H98D56B5B39C6471CB5F2CFA16995E1C9"><enum>(ii)</enum><header>Inflation adjustment</header><subclause id="H4D442EBDF3E64FEAAB9E37202A4CE852"><enum>(I)</enum><header>In general</header><text>The annual inflation adjustment under clause (i) shall reflect changes in the cost of operating the free breakfast program under this section, as indicated by the change in the Consumer Price Index for food away from home for all urban consumers.</text></subclause><subclause id="H30D11654102A478995A900B8FA10C384"><enum>(II)</enum><header>Basis</header><text>Each inflation annual adjustment under clause (i) shall reflect the changes in the Consumer Price Index for food away from home for the most recent 12-month period for which that data is available.</text></subclause></clause><clause id="HBB0C9F772ED147B49CA613E0A944D07E"><enum>(iii)</enum><header>Rounding</header><text>On July 1, 2026, and annually thereafter, the national average payment rate for free breakfast shall be—</text><subclause id="idD09F98F1F1E44E808F088A9530D6147D"><enum>(I)</enum><text>adjusted to the nearest lower-cent increment; and</text></subclause><subclause id="idE545BDC99DC94709A55BDF1666BAB509"><enum>(II)</enum><text>based on the unrounded amounts for the preceding 12-month period.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H251621AD09F141429E062FAB738AE7FC"><enum>(C)</enum><text>by striking subparagraphs (C) and (E); and</text></subparagraph><subparagraph id="H00D1B4F446ED46F19042AB59FE35824B"><enum>(D)</enum><text>by redesignating subparagraph (D) as subparagraph (C);</text></subparagraph></paragraph><paragraph id="HDA950168465B49A891AE90DEA6AA63B2"><enum>(2)</enum><text>by striking paragraphs (2) and (3);</text></paragraph><paragraph id="id72DCEF0A6CB2431F93AC6A5D93F719DB"><enum>(3)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (2) and (3), respectively; and</text></paragraph><paragraph id="H44A24FA6F71B4502B25D598E7684433F"><enum>(4)</enum><text>in paragraph (3) (as so redesignated), by striking <quote>paragraph (3) or (4)</quote> and inserting <quote>paragraph (2)</quote>.</text></paragraph></subsection><subsection id="HC6DC1ECD3380413EB039DAB40D62C31C"><enum>(c)</enum><header>State disbursement to schools</header><text display-inline="yes-display-inline">Section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) is amended by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5ECC37E813434430B07203DBAC9E7AC9"><subsection id="HF68B287BBAFE4FE8AA7041BDE01BC546"><enum>(c)</enum><header>State disbursement to schools</header><text display-inline="yes-display-inline">Funds apportioned and paid to any State for the purpose of this section shall be disbursed by the State educational agency to schools selected by the State educational agency to assist those schools in operating a breakfast program.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5306CEA19B994C8694BAB7517FABA1A0"><enum>(d)</enum><header>No collection of debt</header><paragraph id="idcc744687b3ff4712aabc47bfe19d3868"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>) or any other provision of law, effective beginning on the date of enactment of this Act, as a condition of participation in the breakfast program under section 4 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>), a school—</text><subparagraph id="idCF9CDAE055364042B3A202F1B38114BF"><enum>(A)</enum><text>shall not collect any debt owed to the school for unpaid meal charges; and</text></subparagraph><subparagraph id="id99E7D3B43DFE4743ACA74C7E40F37277"><enum>(B)</enum><text>shall continue to accrue debt for unpaid meal charges—</text><clause id="id1090F1273B754B54A8796F026AF256E2"><enum>(i)</enum><text>for the purpose of receiving reimbursement under section 212; and</text></clause><clause id="idDB84896740944BEC9DF7B2452BD22715"><enum>(ii)</enum><text>until the effective date specified in section 2.</text></clause></subparagraph></paragraph><paragraph id="id86F36863FD5548629C7546EC5D7EFD2E"><enum>(2)</enum><header>Child Nutrition Act of 1966</header><subparagraph id="id53017B6AB22C49CD9E1FBBA1B7188679"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) is amended by striking subsection (d) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id103482AFA3C849648CD1300FA4FA4531"><subsection id="id7CAED3E9A74C4CAD90D2FEFC6E52B689"><enum>(d)</enum><header>No collection of debt</header><text>A school participating in the free breakfast program under this section shall not collect any debt owed to the school for unpaid meal charges.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="idB793E1E335FB4E5790CDE81FAFD782F3"><enum>(B)</enum><header>Conforming amendment</header><text>Section 23(a) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1793">42 U.S.C. 1793(a)</external-xref>) is amended by striking <quote>school in severe need, as described in section 4(d)(1)</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id12FAEDBB687E4671965C18ABF34BE611"><text>school—</text><paragraph commented="no" id="idC528C9DA7AB74E9ABFB3E37736A1065B"><enum>(1)</enum><text>that has a free breakfast program under section 4 or seeks to initiate a free breakfast program under that section; and</text></paragraph><paragraph id="idc5bc796b96194c0eb219c5ac179d2e05"> <enum>(2)</enum> <text>of which not less than 40 percent of the students are economically disadvantaged students (as identified under a measure described in section 1113(a)(5) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6313">20 U.S.C. 6313(a)(5)</external-xref>))</text>
 </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HEF619B45034B402DBA952EFD33344277"><enum>(e)</enum><header>Nutritional and other program requirements</header><text display-inline="yes-display-inline">Section 4(e) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773(e)</external-xref>) is amended—</text><paragraph id="HC7E1A1E898FF4E9A8C1D66E7D6D554E5"><enum>(1)</enum><text>in paragraph (1)(A), in the second sentence, by striking <quote>free or</quote> and all that follows through the period at the end and inserting <quote>free to all children enrolled at a school participating in the school breakfast program.</quote>; and</text></paragraph><paragraph id="H1A48F692FB6B4F6887161490E9189B26"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), in the second sentence, by striking <quote>the full charge to the student for a breakfast meeting the requirements of this section or</quote>.</text></paragraph></subsection><subsection commented="no" id="id1900756E4DA64805940D4A2B9A0704D6"><enum>(f)</enum><header>Prohibition on breakfast shaming, meal denial</header><paragraph commented="no" id="idE39A6C7BD7E943FAA99F0509115C8831"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Effective beginning on the date of enactment of this Act, a school or school food authority—</text><subparagraph commented="no" id="id0B326646619245E88F2F40AB23704409"><enum>(A)</enum><text display-inline="yes-display-inline">shall not—</text><clause commented="no" id="id29F1D8A2A37B418CA66E2D5F139F833A"><enum>(i)</enum><text>physically segregate for the purpose of debt shaming or otherwise discriminate against any child participating in the breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); or</text></clause><clause commented="no" id="idAA7234EB15D64D6288ED271C1FE65F7B"><enum>(ii)</enum><text>overtly identify a child described in clause (i) by a special token or ticket, an announced or published list of names, or any other means; and</text></clause></subparagraph><subparagraph commented="no" id="idEBC2EB8F1A5945AEB21CD9D8CE5DB34D"><enum>(B)</enum><text>shall provide the program meal to any child eligible under the program.</text></subparagraph></paragraph><paragraph commented="no" id="id72AF64F8E4CD4B9F87DE9B0BC0B3DBAA"><enum>(2)</enum><header>Child Nutrition Act of 1966</header><text>Section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2FA8E5EE0F5D49F98F24E6967651D5F4"><subsection commented="no" id="idE8FAC04DAD6848F48030B816DC8D6B12"><enum>(f)</enum><header>Prohibition on breakfast shaming</header><text display-inline="yes-display-inline">A school or school food authority shall not—</text><paragraph commented="no" id="id711E97848FEE4DABB2E9BA73B65E5378"><enum>(1)</enum><text>physically segregate for the purpose of debt shaming or otherwise discriminate against any child participating in the free breakfast program under this section; or</text></paragraph><paragraph commented="no" id="id9473175375264E4FA7E6BAB0F121F52E"><enum>(2)</enum><text>overtly identify a child described in paragraph (1) by a special token or ticket, an announced or published list of names, or any other means.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0c2fdefe84184f8392f21c3b50ca91d8"><enum>(g)</enum><header>Department of Defense Overseas Dependents' Schools</header><text>Section 20(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1789">42 U.S.C. 1789(b)</external-xref>) is amended by striking <quote>and shall determine</quote> and all that follows through <quote>under this section.</quote>.</text></subsection><subsection id="H43189B53D3514048A876D2BAE35DFA0C"><enum>(h)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">The Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>) is amended—</text><paragraph id="HD967D26BC21F496FA991E256FE1288B9"><enum>(1)</enum><text>by striking <quote>or reduced price</quote> each place it appears;</text></paragraph><paragraph id="H55E6B1EAEC9E4EF5AF69B99A730E4987"><enum>(2)</enum><text>by striking <quote>and reduced price</quote> each place it appears; Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1753">42 U.S.C. 1753(b)</external-xref>) is amended—</text><paragraph id="H1D9A635A8F2C4E25B2041F4CF0AF7BEA"><enum>(1)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0C80EEA93E3E45DAA711EA40247C16DF"><paragraph id="HD39E6D6A139C4C8299A0A8C6F9315CA3"><enum>(2)</enum><header>Payment amounts</header><subparagraph id="H468C96CEDC4D432FA5B6DE4DEB89A50B"><enum>(A)</enum><header>In general</header><text>The national average payment for each free lunch shall be $5.42, adjusted annually for inflation in accordance with subparagraph (C) and rounded in accordance with subparagraph (D).</text></subparagraph><subparagraph id="H2F848F12C9E043A284B805967A9D685F"><enum>(B)</enum><header>Additional payment for local food</header><clause commented="no" id="H043F45A8703B43539E8270129DAC8DBE"><enum>(i)</enum><header>Definition of locally-sourced farm product</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>locally-sourced farm product</term> means a farm product that—</text><subclause commented="no" id="H0CB746AAF38E496EBE06AE236CED3D40"><enum>(I)</enum><text>is marketed to consumers—</text><item commented="no" id="idE4DF9451EF004AD7AC609BA5A3FE2E9D"><enum>(aa)</enum><text>directly; or</text></item><item commented="no" id="id2D28787616AE4452BAA35D673668F8FF"><enum>(bb)</enum><text>through intermediated channels (such as food hubs and cooperatives); and</text></item></subclause><subclause commented="no" id="HFD16C0BFB160401E839367B9A22CB7FA"><enum>(II)</enum><text>with respect to the school food authority purchasing the farm product, is produced and distributed—</text><item commented="no" id="id048E432DDCE046109EF3479E5EC0CFDB"><enum>(aa)</enum><text>in the State in which the school food authority is located; or</text></item><item commented="no" id="HB166DB789AAC4B25A7E6C99D4F99FF08"><enum>(bb)</enum><text>not more than 250 miles from the location of the school food authority.</text></item></subclause></clause><clause id="H996D2CDC24494B0EB851FA72E8A31E45"><enum>(ii)</enum><header>Additional payment eligibility</header><text display-inline="yes-display-inline">During a school year, a school food authority shall receive an additional payment described in clause (iii) if the State certifies that the school food authority served meals (including breakfasts, lunches, suppers, and supplements) during the last school year of which not less than 25 percent were made with locally sourced farm products.</text></clause><clause id="HC352CCB294D04062BD52975B1711E487"><enum>(iii)</enum><header>Payment amount</header><subclause id="id4A898A4D42AC4586B66880A369B6F5F9"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The additional payment amount under this subparagraph shall be—</text><item commented="no" id="idC02A62C4EA7C4795A0AEA765D7B3002C"><enum>(aa)</enum><text display-inline="yes-display-inline">$0.30 for each free lunch and supper;</text></item><item commented="no" id="id1966F2F812EA45E5A2AD98167E9C493A"><enum>(bb)</enum><text>$0.21 for each free breakfast; and</text></item><item commented="no" id="id354BDBD2791249318DA569763B227CAA"><enum>(cc)</enum><text>$0.08 for each free supplement.</text></item></subclause><subclause id="id0272CDC716A24F428A6353593820B827"><enum>(II)</enum><header>Adjustments</header><text display-inline="yes-display-inline">Each additional payment amount under subclause (I) shall be adjusted annually in accordance with subparagraph (C) and rounded in accordance with subparagraph (D).</text></subclause></clause><clause id="H6B3D06914C554627858C13BEE9B1BA47"><enum>(iv)</enum><header>Disbursement</header><text>The State agency shall disburse funds made available under this clause to school food authorities eligible to receive additional reimbursement.</text></clause></subparagraph><subparagraph id="H924E3123A23E453FA061E6B2B30F8876"><enum>(C)</enum><header>Inflation adjustment</header><clause id="idECB13BFA381E4E42ABCD3A7D59F7E228"><enum>(i)</enum><header>In general</header><text>The annual inflation adjustment under subparagraphs (A) and (B)(iii) shall reflect changes in the cost of operating the free lunch program under this Act, as indicated by the change in the Consumer Price Index for food away from home for all urban consumers.</text></clause><clause id="idAD67CA5FC27E42FD9780F66B72C2AF34"><enum>(ii)</enum><header>Basis</header><text>Each annual inflation adjustment under subparagraphs (A) and (B)(iii) shall reflect the changes in the Consumer Price Index for food away from home for the most recent 12-month period for which that data is available.</text></clause></subparagraph><subparagraph id="id577069B0D64C474AB7E479E2DF9CFF50"><enum>(D)</enum><header>Rounding</header><text>On July 1, 2026, and annually thereafter, the national average payment rate for free lunch and the additional payment amount for free breakfast, lunch, supper, and supplement under subparagraph (B) shall be—</text><clause id="id1995D6F73B7844F19CB29F85B6A6B85F"><enum>(i)</enum><text>adjusted to the nearest lower-cent increment; and</text></clause><clause id="id8C302011F20048319A3490ED4867CBF6"><enum>(ii)</enum><text>based on the unrounded amounts for the preceding 12-month period.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id7D441D64CA544A0184DC9F4A2E9E3977"><enum>(2)</enum><text>by striking paragraph (3).</text></paragraph></section><section id="HE91BD4475F1149748FF0D6F3991C7F42"><enum>202.</enum><header>Nutritional and other program requirements</header><subsection id="H4FAADAD6258848F4B53C73B9A5DA8598"><enum>(a)</enum><header>Elimination of free lunch eligibility requirements</header><paragraph id="HEF710A7A90E946EB9E76C44B9FAEC92F"><enum>(1)</enum><header>In general</header><text>Section 9 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758</external-xref>) is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4CB6A2EF65304EA5BABDAB76035F53B7"><subsection id="HF7A058AF22F346B88AF6F4EE4B07DE78"><enum>(b)</enum><header>Eligibility</header><text>All children enrolled in a school that participates in the school lunch program under this Act shall be eligible to receive free lunch under this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idB86AC2CBEEB54E99BFBAF74223390495"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="id98F4A826B3754A46ABAFDC67EBEBBDA4"><enum>(A)</enum><text display-inline="yes-display-inline">Section 9 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758</external-xref>) is amended—</text><clause id="id35F9455AA0A343C9A8985DB3D3741687"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (c), in the third sentence, by striking <quote>or at a reduced cost</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id29A4124B37D64654AC0101E287E4CC63"><enum>(ii)</enum><text>in subsection (e), by striking <quote>, reduced price,</quote>.</text></clause></subparagraph><subparagraph commented="no" id="id3FF38C807F1A451EA9DAA5BEDE6A4A18"><enum>(B)</enum><text>Section 28 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769i">42 U.S.C. 1769i</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="id86cd5854803c46bd88ce36f88d392e90"><enum>(i)</enum><text display-inline="yes-display-inline">by striking subsection (b); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf1674ce3773d466092e2e54d8e808bf3"><enum>(ii)</enum><text>by redesignating subsection (c) as subsection (b).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H01CD0A78DD094662AC91284BA0A9CE22"><enum>(C)</enum><text display-inline="yes-display-inline">Section 17(d)(2)(A) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(2)(A)</external-xref>) is amended—</text><clause commented="no" id="HC46523BF8932440DB57090E1044E2B58"><enum>(i)</enum><text>by striking clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="HE910F25D306C41CCB907569849BCE1E2"><enum>(ii)</enum><text>by redesignating clauses (ii) and (iii) as clauses (i) and (ii), respectively.</text></clause></subparagraph><subparagraph id="H4EB2CECFB8114D3FA07DB64BCC735CB4"><enum>(D)</enum><text display-inline="yes-display-inline">Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended by striking paragraph (7) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H06AC1A10B0A44329AB381FD35E1A58BB"><paragraph commented="no" display-inline="no-display-inline" id="H8D55DE48F43A48B3A1A9A61B56117B20"><enum>(7)</enum><text display-inline="yes-display-inline">provide safeguards which restrict the use or disclosure of information concerning applicants and recipients to purposes directly connected with the administration of the plan;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="HAFB6C0DD430A411E83740C3CD7639B30"><enum>(E)</enum><text display-inline="yes-display-inline">Section 1154(a)(2)(A)(i) of title 10, United States Code, is amended by striking <quote>in accordance with section 9(b)(1) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(1)</external-xref></quote>.</text></subparagraph><subparagraph id="idBD2D0644EF80435D8DB88EB4A728B0EE"><enum>(F)</enum><text>Section 4301 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/1758a">42 U.S.C. 1758a</external-xref>) is repealed.</text></subparagraph></paragraph></subsection><subsection id="id818D611E8CD243C0BCE515A85A2063CF"><enum>(b)</enum><header>No collection of debt</header><paragraph id="idBA310A61F18041C28C62D75916124A9C"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) or any other provision of law, effective beginning on the date of enactment of this Act, as a condition of participation in the school lunch program under that Act, a school—</text><subparagraph id="id5FD36C23A50B47208A976E3F5DB2FA9C"><enum>(A)</enum><text>shall not collect any debt owed to the school for unpaid meal charges; and</text></subparagraph><subparagraph id="idDA48F717175D4BA88221D0768BD0F3EE"><enum>(B)</enum><text>shall continue to accrue debt for unpaid meal charges—</text><clause id="idA3EB2AAD82734B409336ADB6F33F83B5"><enum>(i)</enum><text>for the purpose of receiving reimbursement under section 212; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6E59862F21C34C0B83694076392F9108"><enum>(ii)</enum><text>until the effective date specified in section 2.</text></clause></subparagraph></paragraph><paragraph id="id7E6071FF0D8E47F783D39F9441343883"><enum>(2)</enum><header>National School Lunch Act</header><text display-inline="yes-display-inline">Section 9 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758</external-xref>) is amended by striking subsection (d) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6CAA02F10E3842E683F09328976177E7"><subsection id="idFB9B42B6A3DE47EF906B76E7D1796ABA"><enum>(d)</enum><header>No collection of debt</header><text>A school participating in the school lunch program under this Act shall not collect any debt owed to the school for unpaid meal charges.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HDE0BF495C9B14E11B2F19FF538EB96FD"><enum>203.</enum><header>Special assistance program</header><subsection id="id026CE50813E04EFD98983ED6356BB4C5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 11 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a</external-xref>) is repealed.</text></subsection><subsection id="idF0CC4FE50FBA433CA25864B15AAD3143"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id1E161506676044B7988EA15A687DE7A3"><enum>(1)</enum><text>Section 6 of the Richard B. and</text></clause><clause id="id402f5ebaa5344c4eab1c4a6d2fa80f9d"><enum>(v)</enum><text>in subclause (V), by striking <quote>are eligible for free or reduced price school meals under this Act and the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>)</quote> and inserting <quote>are economically disadvantaged students (as identified under a measure described in section 1113(a)(5) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6313">20 U.S.C. 6313(a)(5)</external-xref>))</quote>;</text></clause></subparagraph><subparagraph id="id94DAE8DDB1604F81871619995674F2D2"><enum>(B)</enum><text>in paragraph (2), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id177C9CCCD5154203A52B4BF895E6B285"><subparagraph commented="no" id="H21F4ADC2AD454E2F8734FBE3583D645A"><enum>(C)</enum><header>Waiver</header><text>If the Secretary determines that a program requirement under this section limits the access of children to meals served under this section, the Secretary may waive that program requirement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3BCA11EBE9C44B398D1DCE861B55D9F4"><enum>(D)</enum><header>Eligibility</header><text>All children shall be eligible to participate in the program under this section.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id364D59BA5BA44AB8BCCAA0327FE14043"><enum>(C)</enum><text>in paragraph (5), by striking <quote>only for</quote> and all that follows through the period at the end and inserting <quote>for meals served to all children.</quote>; and</text></subparagraph><subparagraph commented="no" id="H90F0300D55634CBB83ECA7E7AA5A460F"><enum>(D)</enum><text>on days that school is closed due to a natural disaster, building repair, court order, or similar cause, as determined by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" id="id6605ABB246964DDCB53F2F884F6E47B5"><enum>(2)</enum><header>Limitation on payments</header><text>A service institution shall receive payments under this section for not more than 3 meals and 1 supplement per child per day.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8E34AF1F62824AC4AE3134BAA674E0EB"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (f)(3), by striking <quote>, except that</quote> and all that follows through <quote>section</quote>.</text></paragraph></section><section commented="no" id="HF87938422C1941949CEFB9332D942C39"><enum>206.</enum><header>Summer Electronic Benefits Transfer for Children Program</header><text display-inline="no-display-inline">Section 13A of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>) is amended—</text><paragraph commented="no" id="H35A4BA5FFEB14B92A28E821BEB80FC6A"><enum>(1)</enum><text>in subsection (a)(2), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H176165C97A904FA48366D6D7BE10FFEC"><subparagraph commented="no" id="HB43DD46EAB6F4A07A956A40ED320EDCB"><enum>(B)</enum><text display-inline="yes-display-inline">any other private organization providing nonresidential child care or day care outside school hours for school children;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HD72918A137B44222A76DF35BD3CE8C01"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H24FFFADE1C5E4EEEAF219A6CEB66F2C8"><subsection commented="no" id="HE996C08F180B49D586A74B72CB3E7C78"><enum>(c)</enum><header>Free meals</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law—</text><paragraph commented="no" id="id8180591050AA44EEAE43D00413907658"><enum>(1)</enum><text display-inline="yes-display-inline">all meals and supplements served under the program authorized under this section shall be provided for free to participants of the program; and</text></paragraph><paragraph commented="no" id="HB079FC58E015470A8638D7746C9E78A6"><enum>(2)</enum><text>an institution that serves those meals and supplements shall be reimbursed—</text><subparagraph commented="no" id="HF66328FDAAAD4F25A8E2360CBBCCC819"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of breakfast, at the rate established for free breakfast under section 4(b)(1)(B)(i) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773(b)(1)(B)(i)</external-xref>);</text></subparagraph><subparagraph commented="no" id="HD541BC9398A348D19CF06A7829AD7B98"><enum>(B)</enum><text>in the case of lunch, at the rate established for free lunch under section 4(b)(2)(A); and</text></subparagraph><subparagraph commented="no" id="HE326D626B8D845E18501C7ED63614AE5"><enum>(C)</enum><text>in the case of a supplemental meal, $1.28, adjusted for inflation in accordance with section 4(b)(2)(C).</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H4A8A5C20A1234B15B333C0958C238712"><enum>(3)</enum><text>in subsection (f)—</text><subparagraph id="H20EEFE4A4E5E4A44B6A27C4A92B56EC6"><enum>(A)</enum><text>in paragraph (2), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8EF3AF9480924CB9BBF5697A7730BF7F"><subparagraph commented="no" id="HBF4F06F4F3BC4858B02A7E5DB8110DF0"><enum>(B)</enum><header>Limitation to reimbursements</header><text display-inline="yes-display-inline">An institution may claim reimbursement under this paragraph for not more than 3 meals and 1 supplement per day per child.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H53E4AB45C89E464EB37BE25731F3A37F"><enum>(B)</enum><text>by striking paragraph (3); Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766a">42 U.S.C. 1766a</external-xref>) is amended—</text><paragraph id="HAA640C743C724588B2BD0A583C1227FF"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Meal supplements</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Meals and supplements</header-in-text></quote>;</text></paragraph><paragraph id="idEF0AFD344F07496D890B17F5F7142176"><enum>(2)</enum><text>in subsection (a)(1), by striking <quote>meal supplements</quote> and inserting <quote>free meals and supplements</quote>;</text></paragraph><paragraph id="HE109CBAA67B34BE0A8FE6E27DD09FF8A"><enum>(3)</enum><text>in subsection (b), by inserting <quote>meals and</quote> before <quote>supplements</quote>; and</text></paragraph><paragraph id="H802F4BB8925D4E58A07E511980BDD27F"><enum>(4)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id69F35062A589423C888F293C9BDB94E7"><subsection id="H1CE0F7729B724884AC19604D1F70399B"><enum>(c)</enum><header>Reimbursement</header><paragraph id="idA1DBB34B2EDE4F8CA6F77D6A305CB290"><enum>(1)</enum><header>In general</header><subparagraph id="HA3927937FB714B239956F4EF7CC5EB55"><enum>(A)</enum><header>Meals</header><text>A free meal provided under this section to a child shall be reimbursed at a rate of $5.42, adjusted annually for inflation in accordance with paragraph (3)(A) and rounded in accordance with paragraph (3)(B).</text></subparagraph><subparagraph id="id21B162F35C534D799E7964264B0600D4"><enum>(B)</enum><header>Supplements</header><text>A free supplement provided under this section to a child shall be reimbursed at the rate at which free supplements are reimbursed under section 17(c)(2)(C).</text></subparagraph></paragraph><paragraph commented="no" id="idDBD707DB92EE4128A93E2A56789822E6"><enum>(2)</enum><header>Limitation to reimbursements</header><text display-inline="yes-display-inline">An institution may claim reimbursement under this section for not more than 1 meal and 1 supplement per day per child served on a regular school day.</text></paragraph><paragraph commented="no" id="id529741D7D32244A59ADBFA639F24D2C0"><enum>(3)</enum><header>Inflation; rounding</header><subparagraph id="idC93A42BD12164B1188B4DC33EC027DCA"><enum>(A)</enum><header>Inflation adjustment</header><clause id="id63F5E65A7A7B492B86EC87CFAAA9E9E5"><enum>(i)</enum><header>In general</header><text>The annual inflation adjustment under paragraph (1)(A) shall reflect changes in the cost of operating the program under this section, as indicated by the change in the Consumer Price Index for food away from home for all urban consumers.</text></clause><clause id="idE705AEB72A4542489F55EE6FD00A3544"><enum>(ii)</enum><header>Basis</header><text>Each inflation annual adjustment under paragraph (1)(A) shall reflect the changes in the Consumer Price Index for food away from home for the most recent 12-month period for which that data is available.</text></clause></subparagraph><subparagraph id="id400AEF77F3D7444889938BE0520B6C12"><enum>(B)</enum><header>Rounding</header><text>On July 1, 2026, and annually thereafter, the reimbursement rate for a free meal under this section shall be—</text><clause id="idF2B0FA8362AC4D468B2797F2B2AAF4EB"><enum>(i)</enum><text>adjusted to the nearest lower-cent increment; and</text></clause><clause id="id27A5BA3AC0054AC580403B62F7756225"><enum>(ii)</enum><text>based on the unrounded amounts for the preceding 12-month period.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="HED99A5B5C6D149DF9FAE308E563047B4"><enum>209.</enum><header>Pilot projects</header><text display-inline="no-display-inline">Section 18 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769a">42 U.S.C. 1769a(d)</external-xref>) is amended—</text><paragraph id="H0685B59BDA0E4AD293978249C74E48AB"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="idD6B1CADD95934E24A70297B2E0863A34"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>paragraph (2) of this subsection and</quote>;</text></subparagraph><subparagraph id="H21E84E79E1874F94BD87C82EBFCB9610"><enum>(B)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>school—</quote> and all that follows through <quote>submits</quote> in clause (ii) and inserting <quote>school that submits</quote>;</text></subparagraph><subparagraph id="H204F00B4A608407EA941BAE352EA6A1B"><enum>(C)</enum><text>in subparagraph (B), by striking <quote>schools</quote> and all that follows through <quote>Act</quote> and inserting <quote>high-need schools (as defined in section 2211(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6631">20 U.S.C. 6631(b)</external-xref>))</quote>; and</text></subparagraph><subparagraph id="HBE1E147322F94BA0B4EE1CC5E6AE9CA0"><enum>(D)</enum><text>in subparagraph (D)—</text><clause id="H986A74965EAE40BD83EEB96267B53B49"><enum>(i)</enum><text>by striking clause (i); and</text></clause><clause id="H5B17EEA7F79B4746B5478443F71D4B6E"><enum>(ii)</enum><text>by redesignating clauses (ii) through (iv) as clauses (i) through (iii), respectively; and</text></clause></subparagraph></paragraph><paragraph id="id2392062B77564B7FA18572BF5AA82397"><enum>(2)</enum><text>by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6ABD916E6F70412C89EE0FC1AEA1032E"><paragraph commented="no" id="H18E1A989B7E34290B2644FDA639E82AB"><enum>(2)</enum><header>Outreach to high-need schools</header><text display-inline="yes-display-inline">Prior to making decisions regarding school participation in the program, a State agency shall inform high-need schools (as defined in section 2211(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6631">20 U.S.C. 6631(b)</external-xref>)), including Tribal schools, of the eligibility of the schools for the program.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="H4A14423B72F143FB9215CE28A98D49C6"><enum>211.</enum><header>Training, technical assistance, and Food Service Management Institute</header><text display-inline="no-display-inline">Section 21(a)(1)(B) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769b-1">42 U.S.C. 1769b–1(a)(1)(B)</external-xref>) is amended in the matter preceding clause (i) by striking <quote>certified to receive free or reduced price meals</quote> and inserting <quote>who are economically disadvantaged students (as identified under a measure described in section 1113(a)(5) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6313">20 U.S.C. 6313(a)(5)</external-xref>))</quote>.</text></section><section commented="no" id="id756F8703CEC148829E3E230C5407FCB9"><enum>212.</enum><header>Reimbursement of school meal delinquent debt program</header><subsection commented="no" id="id7397C175F7754D29A74FC8C0AE21C75A"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="idAA8A0E6BEAD541A0A4203E4A0946AC56"><enum>(1)</enum><header>Delinquent debt</header><text>The term <term>delinquent debt</term> means the debt owed by a parent or guardian of a child to a school—</text><subparagraph commented="no" id="id037FAA65670F448D8FF948AC4DD327F2"><enum>(A)</enum><text>as of the effective date specified in section 2; and</text></subparagraph><subparagraph commented="no" id="idC0D632DEF8BB4F57993A710EEE78F7E3"><enum>(B)</enum><text>for meals served by the school under—</text><clause commented="no" id="idA8262FC64A514099A55E0ABE8ABACB39"><enum>(i)</enum><text>the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>);</text></clause><clause commented="no" id="id033CD3AAE93648D6A4C87DA621BB48F5"><enum>(ii)</enum><text>the school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>); or</text></clause><clause commented="no" id="id5B751EFBE76345809A7C8C025021562D"><enum>(iii)</enum><text>both of the programs described in clauses (i) and (ii).</text></clause></subparagraph></paragraph><paragraph commented="no" id="id32D6686948074FE1A2DD458969B7F488"><enum>(2)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b)(1).</text></paragraph><paragraph commented="no" id="id291C7641667441599E77E6C47ADD15AB"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection commented="no" id="id6975B8F70D454241BB431EE19B5173AF"><enum>(b)</enum><header>Reimbursement program</header><paragraph commented="no" id="id13D41E7A5CA74F3CB91296528975D195"><enum>(1)</enum><header>Establishment</header><text>Not later than 60 days after the effective date specified in section 2, the Secretary shall establish a program under which the Secretary shall reimburse each school participating in a program described in clause (i) or (ii) of subsection (a)(1)(B) for all delinquent debt.</text></paragraph><paragraph commented="no" id="idF7B04D05113045CCA380047A17902992"><enum>(2)</enum><header>Form for reimbursement</header><text>To carry out the program, the Secretary shall design and distribute a form to State agencies to collect data on all delinquent debt in applicable schools in the State, grouped by school food authority.</text></paragraph><paragraph commented="no" id="id625CBB5AE5F54D34A368E48B8BA9131B"><enum>(3)</enum><header>Completion date</header><text>The Secretary shall provide all reimbursements under the program not later than 180 days after the effective date specified in section 2.</text></paragraph></subsection><subsection commented="no" id="id85FAF019405F45D39A04B5FE62CE7585"><enum>(c)</enum><header>Report</header><text>Not later than 2 years after the effective date specified in section 2, the Comptroller General of the United States shall submit to Congress and make publicly available a report that describes the successes and challenges of the program.</text></subsection></section><section commented="no" id="H42A763F8EEC14FB7ACD6D7F2C84C4A90"><enum>213.</enum><header>Conforming amendments</header><text display-inline="no-display-inline">The Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) is amended—</text><paragraph commented="no" id="H1A752608E58B4E2088DC1990C21127ED"><enum>(1)</enum><text>by striking <quote>or reduced price</quote> each place it appears;</text></paragraph><paragraph commented="no" id="HB02878F87D3046ABBB0E12296348E0F1"><enum>(2)</enum><text>by striking <quote>or a reduced price</quote> each place it appears;</text></paragraph><paragraph commented="no" id="HDDF73AC0D3DE4257BC0EA89ED61BABB7"><enum>(3)</enum><text>by striking <quote>and reduced price</quote> each place it appears; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE34A11B418D44CB69C12616C66C09ECE"><enum>(4)</enum><text>by striking <quote>a reduced price</quote> each place it appears.</text></paragraph></section></title><title id="H8E22BF69DD76416EB9FCE280CDC71CCF"><enum>III</enum><header>Elementary and Secondary Education Data</header><section id="id562DA0666BCC46F6BCCAC0CA514DD929"><enum>301.</enum><header>Measure of poverty</header><text display-inline="no-display-inline">Section 1113(a)(5) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6313">20 U.S.C. 6313(a)(5)</external-xref>) is amended—</text><paragraph id="id3D37BCF7C9CB4169BE022FC352D03008"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>the number of children eligible for a free or reduced price lunch under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>)</quote> and inserting <quote>the number of children from low-income backgrounds, identified under subparagraph (D)</quote>; and</text></paragraph><paragraph id="idD8B7A2247C0B419EA4541EB1675BDDBF"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4E46E09E736D4DF8A25D3F1215C058F3"><subparagraph id="id83B20645A8B14541AEA5CA6CECB85882"><enum>(D)</enum><header>Identification of children from low-income backgrounds</header><clause id="idAF96701A62264F52A5D122B99D91243A"><enum>(i)</enum><header>In general</header><text>A local educational agency or State agency, for the purpose of identifying children from low-income backgrounds enrolled in a school served by a local educational agency, may—</text><subclause id="id5849C97F62CC42D7976AAEE405F00692"><enum>(I)</enum><text>maintain a record, with respect to each student for whom the local educational agency provides a free public education that contains the information collected from the survey described in clause (iii);</text></subclause><subclause id="id1A29D044261E4CCA88CDDF8B312F3E0A"><enum>(II)</enum><text>distribute and collect a student survey based on the template developed under clause (iii) to identify children from low-income backgrounds; and</text></subclause><subclause id="idD87089FDFDA94FC8A576697063FE54B5"><enum>(III)</enum><text>utilize direct certification data described in clause (iv)(I) to identify children from low-income backgrounds.</text></subclause></clause><clause id="idA5F3C045550444FFB4146DCC3A5B3AA1"><enum>(ii)</enum><header>Privacy</header><subclause id="idDBB87E2D03C74CD0A27992BAB8A8CD9D"><enum>(I)</enum><header>In general</header><text>All individual data collected under this subparagraph shall be protected by the local educational agency or State agency in a manner consistent with all applicable local, State, and Federal privacy laws.</text></subclause><subclause id="idD620361FDCF34E22A9C5442ACB098399"><enum>(II)</enum><header>Reporting data</header><text>Only aggregated data, which may include data disaggregated at the school, local educational agency, or State level, shall be reported to the Secretary at such time and in such manner as the Secretary may reasonably require.</text></subclause></clause><clause id="id9AFEF325D76845DEA17E45B46BC9A46B"><enum>(iii)</enum><header>Survey</header><text>Not later than 180 days after the date of enactment of the <short-title>Universal School Meals Program Act of 2026</short-title>, the Secretary, in consultation with the Secretary of Agriculture, shall develop a template survey—</text><subclause commented="no" display-inline="no-display-inline" id="id66aceaa5d935498d8eadde9c552fbb5f"><enum>(I)</enum><text display-inline="yes-display-inline">to identify children from low-income backgrounds that contains only the information necessary to identify a child as a child from a low-income background by using the criteria of eligibility for a free or reduced priced lunch under the Richard B. Russell National School Lunch Act, as such criteria were in effect on September 30, 2022; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8d393e37241d4f509dc978b48170c2a6"><enum>(II)</enum><text display-inline="yes-display-inline">that shall be designed to be easily accessible and in a user-friendly manner.</text></subclause></clause><clause id="id3454FF1C26C74D558DFA79903F60E540"><enum>(iv)</enum><header>Transition authority from FRPL to ESEA measures</header><text>The Secretary, in coordination with the Secretary of Agriculture, shall have the authority to take such steps as are necessary to provide for the orderly transition to, and implementation of—</text><subclause id="id6A91544CF77B48D1BD662D1FE7823094"><enum>(I)</enum><text>activities that are necessary for the continuity of direct certification carried out by local educational agencies and State agencies specified in paragraphs (4), (5), and (15) section 9(b) of the Richard B. Russell National School Lunch Act, as in effect on September 30, 2022, for the purposes of identifying any child eligible for free or reduced priced lunch under such Act, as in effect on such date, as a child from a low-income background;</text></subclause><subclause id="id219FC4B819AF4647864C76C38AB94CC5"><enum>(II)</enum><text>procedures for verification of information collected under this subparagraph, which may include procedures modeled on the requirement specified in section 9(b)(3) of the Richard B. Russell National School Lunch Act, as in effect on September 30, 2022; and</text></subclause><subclause id="id2EB5F139A74145FBB283EAFF7C6E24AA"><enum>(III)</enum><text>data privacy provisions for information collected under this subparagraph, in accordance with the requirements specified in section 9(b)(6) of the Richard B. Russell National School Lunch Act, as in effect on September 30, 2022.</text></subclause></clause><clause id="id1AA767BB4D5748D889B59F6C93A8BA8A"><enum>(v)</enum><header>Special rule</header><text>For the purposes of subparagraph (A), a local educational agency may determine the number of children from low-income backgrounds enrolled in a school served by such agency using one or more of the following methods:</text><subclause id="id6DD8228E7A4C406AAD94005E23B68C58"><enum>(I)</enum><text>Results from surveys specified in clause (i)(II). </text></subclause><subclause id="id425FCBCCEBF04FCD9F77A2E46ABFDD01"><enum>(II)</enum><text>Direct certification data specified in clause (i)(III). </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id73E57F3D5A3E4808819BBCE6C000E62A"><enum>(III)</enum><text>Utilization of both methods described in subclauses (I) and (II).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H3FCA45CC50C5437DA95827FAAE7A00A2"><enum>IV</enum><header>Amendments to Other Programs and Laws</header><section id="HB4FC283843804C72A5F04E59C155282B"><enum>401.</enum><header>Supplemental nutrition assistance program</header><subsection id="H0220AD4D8D7F400884D967D7AD5663E3"><enum>(a)</enum><header>Agreement for direct certification</header><paragraph id="id25A0C47630704C86BFB8400D3A3CF5DB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>) is amended—</text><subparagraph id="idBD2EAA3FB9B144FA906645FE785CBD9A"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsection (u); and</text></subparagraph><subparagraph id="id3F9DDC1ABFA44D9CBB63D212D8BBC074"><enum>(B)</enum><text>by redesignating subsections (v) through (x) as subsections (u) through (w), respectively.</text></subparagraph></paragraph><paragraph id="id681BB9A35F344186B7534AE3C182BB68"><enum>(2)</enum><header>Conforming amendments</header><text>Section 11(e) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(e)</external-xref>) is amended—</text><subparagraph id="id4E026224205D4E4D968FCA8EB8D6AE0F"><enum>(A)</enum><text>in paragraph (8)(F), by striking <quote>or subsection (u)</quote>; and</text></subparagraph><subparagraph id="idFBA2B6CA123D4CE0A23E44E736861A8F"><enum>(B)</enum><text>in paragraph (26)(B), by striking <quote>(x)</quote> and inserting <quote>(w)</quote>.</text></subparagraph></paragraph></subsection><subsection id="HD01EB0F8D2E6442E892975A05CDC180B"><enum>(b)</enum><header>Nutrition education and obesity prevention grant program</header><text display-inline="yes-display-inline">Section 28(a) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036a">7 U.S.C. 2036a(a)</external-xref>) is amended by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC48A0C738A914816A639938FA6447907"><paragraph id="HE1BD5DC61D9B4A2ABA7F27530121258B"><enum>(1)</enum><text display-inline="yes-display-inline">an individual eligible for benefits under this Act;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H553D6EDC1EE1475791015DC387F0EF3E"><enum>402.</enum><header>Higher Education Act of 1965</header><subsection id="H95CE641B91B046429D284F8E7765FAE0"><enum>(a)</enum><header>Teacher quality enhancement</header><text display-inline="yes-display-inline">Subparagraph (A) of section 200(11) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1021">20 U.S.C. 1021(11)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7457874D638B470E916A8057A51E0FDE"><subparagraph id="H16AF4FB379854B088853428B55C3117F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>high-need school</term> means a school that is in the highest quartile of schools in a ranking of all schools served by a local educational agency, ranked in descending order by percentage of students from low-income families enrolled in such schools, as determined by the local educational agency based on one of the following measures of poverty:</text><clause id="HA2386F72C6E7449A86774E52A11DDC06"><enum>(i)</enum><text>The percentage of students aged 5 through 17 in poverty counted in the most recent census data approved by the Secretary.</text></clause><clause id="H68078E69C96C44D3B8EAB07347DF1CD0"><enum>(ii)</enum><text>The percentage of students in families receiving assistance under the State program funded under the program of block grants to States for temporary assistance for needy families established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>).</text></clause><clause id="H1106BA460E264B628DCC77C210782A93"><enum>(iii)</enum><text>The percentage of students eligible to receive medical assistance under the program of medical assistance established under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>).</text></clause><clause id="HD673BD4F5D2E4F6B897CC1CC92EEC3F3"><enum>(iv)</enum><text>A composite of two or more of the measures described in clauses (i) through (iii).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD1F56242D7124F71AB4C9E5E057E30CA"><enum>(b)</enum><header>GEAR Up</header><text display-inline="yes-display-inline">Subparagraph (A) of section 404B(d)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-22">20 U.S.C. 1070a–22(d)(1)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H342844266DF74E608CA5BD71FBE42E44"><subparagraph id="HB92D773AF3AD4104B52977708DD53676"><enum>(A)</enum><text display-inline="yes-display-inline">provide services under this chapter to at least one grade level of students, beginning not later than 7th grade, in a participating school—</text><clause id="HDF60E6ECFB834915B0D7E51A7600253E"><enum>(i)</enum><text>that has a 7th grade; and</text></clause><clause id="H49795C089CBC4AACBDEF720E4CFD176D"><enum>(ii)</enum><text>in which—</text><subclause id="id5b4bf2d6cbb74511af4d092b1b1ab134"><enum>(I)</enum><text>at least 50 percent of the students enrolled are economically disadvantaged students (as identified under a measure described in section 1113(a)(5) of the Elementary and Secondary Education Act of 1965); or</text></subclause><subclause id="HD45C1FD67D024D6FBA685D12D94B5B25"><enum>(II)</enum><text>if an eligible entity determines that it would promote the effectiveness of a program, an entire grade level of students, beginning not later than the 7th grade, reside in public housing, as defined in section 3(b)(1) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)(1)</external-xref>).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H994D1BAA929A4B29A03C85AFA0293A29"><enum>(c)</enum><header>Early Federal Pell Grant commitment demonstration program</header><text display-inline="yes-display-inline">Section 894(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1161y">20 U.S.C. 1161y(b)</external-xref>) is amended—</text><paragraph id="id4b0d044f1c7c47f6a5a0efb5ba0c80ef"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>qualify for a free or reduced price school lunch under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) or the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>)</quote> and inserting <quote>are economically disadvantaged students (as identified under a measure described in section 1113(a)(5) of the Elementary and Secondary Education Act of 1965)</quote>; and</text></paragraph><paragraph id="idd04582f0dbb0412e899c4cc0f5ced4c0"><enum>(2)</enum><text>in paragraph (5), by striking <quote>eligible for a free or reduced price school lunch under the Richard B. Russell National School Lunch Act,</quote>.</text></section><section id="H3143A56EB8004AC98DB2F3346040917F"><enum>405.</enum><header>Workforce Innovation and Opportunity Act</header><text display-inline="no-display-inline">Section 3(36)(A) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102(36)(A)</external-xref>) is amended—</text><paragraph id="HBCDBA7FAFF8E44739FF62131B36FB37F"><enum>(1)</enum><text>by striking clause (iv); and</text></paragraph><paragraph id="id7c4ecff011b04ef9bbec7ba05fc05f3a"><enum>(2)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd9ca966368314cb5ac1d9b0eb635bb92"><paragraph id="id5c9f6990a78c43f58422a4b6132f7169"><enum>(3)</enum><header>Economically disadvantaged students factor</header><text>In this subsection, the term <term>economically disadvantaged students factor</term> means the ratio of the number of children in the State who are economically disadvantaged students (as identified under a measure described in section 1113(a)(5) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6313">20 U.S.C. 6313(a)(5)</external-xref>)) to the number of such children in all the States as determined annually by the Secretary of Education.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="HA4331D6A81854312978F29AF94488E65"><enum>408.</enum><header>Children’s Health Act of 2000</header><text display-inline="no-display-inline">Section 1404(b) of the Children’s Health Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/9859c">42 U.S.C. 9859c(b)</external-xref>) is amended—</text><paragraph id="id294a5411a9eb45f095152c48884419c1"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>school lunch factor</quote> and inserting <quote>economically disadvantaged students factor</quote>; Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>).</text></paragraph><paragraph id="H31B22031FA9E4EDEB874E8C04F75F1B6"><enum>(2)</enum><header>Guidance</header><text>Not later than 1 year after the date of the enactment of the <short-title>Universal School Meals Program Act of 2026</short-title>, the Attorney General, in consultation with the Secretary of Agriculture, shall provide guidance to States relating to the options for school food authorities in the States to apply for reimbursement for free lunches under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) for juveniles who are incarcerated.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC82F39325CB5422C9BD5F75E9115BC04"><enum>(3)</enum><header>Eligible juvenile detention center defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>eligible juvenile detention center</term> does not include any private, for-profit detention center.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title></legis-body></bill>
