which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require officers and employees of the Department of Homeland Security to receive training with respect to Indian tribes, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1F4C610EC26347AC81F68FB6860B0F6E"><section section-type="section-one" id="H7B9FDCB516F84A569D199892E606EF5E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Respect Tribal IDs Act of 2026</short-title></quote>.</text></section><section id="HE51C44646D3A46A7B83A05E74B0110A8"><enum>2.</enum><header>Department of Homeland Security training standards for immigration enforcement personnel</header><text display-inline="no-display-inline">Section 287 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA02805122442450F9B698061532EEF24"><subsection id="H803C13B362964EC9B180C40F5D9E14DF"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF4B21A3DB11F45E4AF43C738162A8421"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the <short-title>Respect Tribal IDs Act of 2026</short-title>, the Secretary of Homeland Security, in collaboration with the Bureau of Indian Affairs and in consultation with representatives of Indian tribes, shall develop training curricula for all immigration enforcement officers and employees of the Department of Homeland Security with respect to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id24a9f71ed1354083bf34165bee6bd37d" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">appropriate protocol for interacting with any enrolled member of an Indian tribe;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idd95a4c4674ef42d99624cf3ac6acfb7f"><enum>(B)</enum><text display-inline="yes-display-inline">how to identify a Native American tribal document;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id4ed460afdd63449dbd24eb9325b5a912"><enum>(C)</enum><text display-inline="yes-display-inline">accepting a Native American tribal document as proof of United States citizenship;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id42dfe3163c1344f89b80623376b39595"><enum>(D)</enum><text display-inline="yes-display-inline">how to access examples of Native American tribal documents; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id82bd27c0300c40cf95a62e2d1fed5444"><enum>(E)</enum><text display-inline="yes-display-inline">the Indian trust responsibility of the United States Government.</text></subparagraph></paragraph><paragraph id="H29835F980F2C48E093575EFD126270E7" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The curricula developed pursuant to paragraph (1) shall include—</text><subparagraph id="H298684F978DE43528FDE5BCCB4B37161"><enum>(A)</enum><text display-inline="yes-display-inline">the contact information, names, locations, and Native American tribal document formats of all Indian tribes in the region where an officer or employee will perform duties relating to the enforcement of the immigration laws;</text></subparagraph><subparagraph id="H0B980579E0BB4FFDB48054C5829A435D"><enum>(B)</enum><text>scenario-based exercises;</text></subparagraph><subparagraph id="H30F9ED3C3AF64681AEF7BEB1BABF04E4"><enum>(C)</enum><text>the development of a database with examples of Native American tribal documents;</text></subparagraph><subparagraph id="HF122F3CE25BB4BAB9EAB96047CCC3D5C"><enum>(D)</enum><text>pre-training and post-training assessments; and</text></subparagraph><subparagraph id="H33C2A87962D44E2484F643737ECB5AEE"><enum>(E)</enum><text>training regarding the history of the granting to American Indians of United States citizenship and the trust responsibilities of the United States Government.</text></subparagraph></paragraph><paragraph id="HD16888B165D5424A8A13C4B61594B726" indent="up1"><enum>(3)</enum><text>An officer or employee of the Department of Homeland Security may not perform any duty relating to the enforcement of the immigration laws unless such officer or employee—</text><subparagraph commented="no" display-inline="no-display-inline" id="id11715209964444b79bc150287c0c5364"><enum>(A)</enum><text display-inline="yes-display-inline">has completed the training curricula developed pursuant to paragraph (1) with respect to the region to which such officer or employee has been assigned; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9de2e92bc454998906a1ca7d6a445f1"><enum>(B)</enum><text display-inline="yes-display-inline">has completed retraining on such curricula not less than annually.</text></subparagraph></paragraph><paragraph id="HD340366D22004B769486A05AF3CDCC12" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the <short-title>Respect Tribal IDs Act of 2026</short-title>, the Secretary of Homeland Security shall submit a report on the development and implementation of the training curricula required under this subsection to—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide4a7c75ccc8d45a7afa0d6b07cdc90f9"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc292ea560e59405bb825f13064eb386f"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id027dcf96533a4fdea13de942a55d2191"><enum>(C)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SLIA00">Committee on Indian Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc528526023fc4066913412e33590274e"> <enum>(D)</enum> <text display-inline="yes-display-inline">the <committee-name committee-id="HJU00">Committee on the Judiciary of the House of Representatives</committee-name>;</text>
                        </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbd20f93d34224cc49fff09d48be54711">
                            <enum>(E)</enum>
 <text display-inline="yes-display-inline">the <committee-name committee-id="HHM00">Committee on Homeland Security of the House of Representatives</committee-name>; and</text>
                        </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida5149b17c8b04846987fb25235a81181">
                            <enum>(F)</enum>
 <text display-inline="yes-display-inline">the <committee-name committee-id="HII00">Committee on Natural Resources of the House of Representatives</committee-name>.</text>
 </subparagraph></paragraph><paragraph id="H141E4CE4392E499BA695595CF0989218" indent="up1"><enum>(5)</enum><text>In this subsection—</text><subparagraph id="HD2262677A4FC41C4A25F018869429C4D"><enum>(A)</enum><text>the term <term>Indian tribe</term> has the meaning given such term in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>); and</text></subparagraph><subparagraph id="H405C9EE255D04A67B1E8BAE06C4E2E96"><enum>(B)</enum><text>the term <term>Native American tribal document</term> includes—</text><clause id="H3E704D93983B41008E23C7769EB219DA"><enum>(i)</enum><text display-inline="yes-display-inline">Native American tribal cards issued pursuant to section 7209 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1185">8 U.S.C. 1185</external-xref> note);</text></clause><clause id="HE6F7FB84FA044BBFAA83D79A4AD8C35A"><enum>(ii)</enum><text display-inline="yes-display-inline">documentary evidence issued by an Indian tribe, including any Indian tribe located in a State that has an international border, which—</text><subclause id="H0CAFCAEACE5E418EB18274441400FDB9"><enum>(I)</enum><text display-inline="yes-display-inline">identifies the Indian tribe that issued the document;</text></subclause><subclause id="H024EBBEF47DB477789179AB4A92A3DD8"><enum>(II)</enum><text display-inline="yes-display-inline">identifies the individual by name; and</text></subclause><subclause id="HBF1FF0D98E414A2AB5583F69A4BAE905"><enum>(III)</enum><text display-inline="yes-display-inline">confirms the individual's membership, enrollment, or affiliation with the Indian tribe; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2baf812860314851ac1bbd335dd59ee8"><enum>(IV)</enum><text>includes—</text><item id="ideaa3da907bd847398ca13523052ff04e"><enum>(aa)</enum><text>a tribal enrollment card;</text></item><item id="id1053f9ce7ca44d82a768b2c3ccc0c872"><enum>(bb)</enum><text>a certificate of degree of Indian blood;</text></item><item id="id539f02d1f19d45d989541867bcb0dff4"><enum>(cc)</enum><text>a tribal census document; and</text></item><item id="id6f070212533149679607464aa424da82"><enum>(dd)</enum><text>a document on tribal letterhead, issued under the signature of the appropriate tribal official, that meets the requirements of subclauses (I) through (III); and</text></item></subclause></clause><clause id="HFC4DBF45B1844448B3F63D7A514BCBDA"><enum>(iii)</enum><text>any other document approved by the Secretary of Homeland Security as confirming United States citizenship.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
