which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Department of Agriculture Reorganization Act of 1994 to improve the Office of Urban Agriculture and Innovative Production, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Urban and Innovative Farming Act of 2026</short-title></quote>.</text></section><section id="id6eecdb7ef6d546b497d238fcaaa1e398"><enum>2.</enum><header>Office of Urban Agriculture and Innovative Production</header><text display-inline="no-display-inline">Section 222 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6923">7 U.S.C. 6923</external-xref>) is amended—</text><paragraph id="ida36070f4de694a4f8605990d7e3af08e"><enum>(1)</enum><text>in subsection (a)(3)—</text><subparagraph id="idf7608b7845f14012a4cf2c916b75ad8f"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>production</quote> after <quote>emerging agricultural</quote>;</text></subparagraph><subparagraph id="id4112b042761044aeaae60a901d0482e3"><enum>(B)</enum><text>in subparagraph (D)—</text><clause id="idffca244ef0c04c99adee6fc383331511"><enum>(i)</enum><text>by inserting <quote>controlled-environment agriculture, including</quote> before <quote>hydroponic</quote>; and</text></clause><clause id="id8f3733290b9a4fa29cc81e1b93894eaa"><enum>(ii)</enum><text>by striking <quote>and</quote> at the end;</text></clause></subparagraph><subparagraph id="idd3463d9dae7940d38c54cd4d5481bb17"><enum>(C)</enum><text>by redesignating subparagraph (E) as subparagraph (H); and</text></subparagraph><subparagraph id="idc6c8094f2c104f1b9bf179f21f462587"><enum>(D)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id14cb1a787a0e4c25843e385ac7a62fe4"><subparagraph id="id463cbf4b164943898487664ef760bdb1"><enum>(E)</enum><text>using the resources of the Department and of State, Tribal, and local agencies to provide technical assistance for business incorporation, navigating local zoning, and managing farm tract numbers for smaller, noncontiguous parcels to growers implementing activities described in this paragraph;</text></subparagraph><subparagraph id="id9e134b863c29410eaf7ed950ecd2023e"><enum>(F)</enum><text>using the resources of the Department and of State, Tribal, and local agencies to promote conservation techniques unique to urban agriculture and innovative production, including techniques that address stormwater runoff and the impacted nature of urban land and the subsurface of the land;</text></subparagraph><subparagraph id="id412c724c66f5449b953fad718c737f98"><enum>(G)</enum><text>assisting urban and innovative producers in navigating Federal, State, Tribal, and local policies and regulations that impact business or operations; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id1a2532dc4d9d4b1696b1f5992656ed27"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id9a1e7f67ad4a49bc995d5783cd396ebb"><enum>(A)</enum><text>in paragraph (5)(B), by striking <quote>2023</quote> and inserting <quote>2030</quote>; and</text></subparagraph><subparagraph id="id74f9d9fba6b14c2ebf1e5d3f62e893fc"><enum>(B)</enum><text>in paragraph (7)(A), by striking <quote>the date that is 5 years after the date on which the members are appointed under paragraph (2)(B)</quote> and inserting <quote>September 30, 2030</quote>;</text></subparagraph></paragraph><paragraph id="id7858b4764f2341da96a4ade7f4ed173b"><enum>(3)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2d45dda7311345b6811d6e9df0f4d01e"><subsection id="id12fdafde40c54478bdd001e6499bf1c7"><enum>(c)</enum><header>Grants and cooperative agreements</header><paragraph id="ide52021838f614325a34536856307783e"><enum>(1)</enum><header>Grants</header><subparagraph id="idbf343dd5939145f9995a9189ff3f6d5d"><enum>(A)</enum><header>In general</header><text>The Director shall award competitive grants to support the development of urban and innovative agricultural production and technical or financial assistance to producers.</text></subparagraph><subparagraph id="idf5a50518f7764d44a4a4cc23237b8c33"><enum>(B)</enum><header>Subgrants</header><text>An eligible entity may use funds from a grant under subparagraph (A) to provide subgrants to urban and innovative producers to support the growth of the farm or farm business of the urban and innovative producers.</text></subparagraph><subparagraph id="idf082d14cad214d90928adc7ca9dcf959"><enum>(C)</enum><header>Priority</header><text>In awarding competitive grants under this paragraph, the Director shall prioritize projects that improve access to local foods in areas where access to fresh, healthy food is limited.</text></subparagraph><subparagraph id="id9603cb44938344ec85ae6d612205fc06"><enum>(D)</enum><header>Eligible entities</header><text>An entity eligible to receive a grant under subparagraph (A) is—</text><clause id="id7b6cbecfbc614e32b3efe88f4464416f"><enum>(i)</enum><text>a nonprofit organization;</text></clause><clause id="id04a4caf6ca0c474b95ff64ef5299d9c1"><enum>(ii)</enum><text>a unit of local government;</text></clause><clause id="idcd27bfda50f44f1bb5e6f0d0aeb338a9"><enum>(iii)</enum><text>a Tribal organization;</text></clause><clause id="idbfd71b6e6bee45fb8889226b996256e4"><enum>(iv)</enum><text>an agricultural cooperative or other agricultural business entity or a producer network or association; or</text></clause><clause id="id5968fe1b806a46d185a3f118401e11aa"><enum>(v)</enum><text>a school that serves any of grades kindergarten through grade 12.</text></clause></subparagraph></paragraph><paragraph id="idab9975ef3bdc485896b2e4e8e6137474"><enum>(2)</enum><header>Cooperative agreements</header><subparagraph id="id0f0991eeff74497a80bff3eb0a9995e6"><enum>(A)</enum><header>In general</header><text>The Director may enter into cooperative agreements with eligible entities to support the development of urban and innovative agricultural production.</text></subparagraph><subparagraph id="idac7ad187f7ad4a63b4ee540bd141c80a"><enum>(B)</enum><header>Eligible entities</header><text>An entity eligible to enter into a cooperative agreement under subparagraph (A) is—</text><clause id="id8e1c8a3be54d4fd5894d012733b7b7f9"><enum>(i)</enum><text>a nonprofit organization;</text></clause><clause id="id184d4879da66482ebaf4b5374c35eba0"><enum>(ii)</enum><text>a unit of local government;</text></clause><clause id="id2516e6079b634308953830f68d98d5ea"><enum>(iii)</enum><text>a Tribal organization; or</text></clause><clause id="idba0f70b6be8c475ba568d923e58c166b"><enum>(iv)</enum><text>an agricultural cooperative or a producer network or association.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id9bdb139deb644f1281f4d56c05f55862"><enum>(4)</enum><text>in subsection (d)—</text><subparagraph id="idc71e4b046f5c47b1ae09789bd0957cbe"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Pilot projects</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Projects</header-in-text></quote>;</text></subparagraph><subparagraph id="idb4e72e13dad742f3bdbaf8dc04411ca5"><enum>(B)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="ide340f454f3094cdda4960098e656edd9"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>Not later than 1 year after the date of enactment of this section, the Secretary shall establish a pilot program for not fewer than 5 years that</quote> and inserting <quote>The Secretary shall carry out a program that</quote>; and</text></clause><clause id="ida047d5ffe0c0418683a1fa347105de3b"><enum>(ii)</enum><text>in subparagraph (C)—</text><subclause commented="no" display-inline="no-display-inline" id="ide745c04b38fb44a3a97363d3c5ca85de"><enum>(I)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>2023</quote> and inserting <quote>2030</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id94942dad63c947d08176015a001f01b0"><enum>(II)</enum><text>in clause (i), by striking <quote>pilot</quote>; and</text></subclause></clause></subparagraph><subparagraph id="id2789ea2587af4b77adfa6c1e53a13e83"><enum>(C)</enum><text>in paragraph (2)—</text><clause id="id00ab9aede69243a5bfa4b1a8f3e345dc"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause commented="no" display-inline="no-display-inline" id="id4e64c24c98954146b71dd4ccd6f8702e"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>pilot</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfe1213d1ae23486280973743e1cb4f28"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>local or municipal</quote> and inserting <quote>local, municipal, Tribal, State, or United States territory</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idcb716b43d9d04cc5b504ef445c6f59dd"> <enum>(III)</enum> <text>by inserting <quote>or territories</quote> after <quote>States</quote>;</text>
 </subclause></clause><clause id="id7563004abc774bb193ec1397686bea5f"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause id="id43554b0a7bcd442191e9481f1565bb8d"><enum>(I)</enum><text>in the subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">pilot</header-in-text></quote>; and</text></subclause><subclause id="id552f9c63f5f9448a94d11fa50b21c647"><enum>(II)</enum><text>in the matter preceding clause (i), by inserting <quote>Tribal governments, States, United States territories,</quote> after <quote>local governments,</quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id0ffdc41d4ded4bc783e191be4833ff7f"><enum>(iii)</enum><text>in subparagraph (C), by striking <quote>pilot</quote> each place it appears; and</text></clause></subparagraph></paragraph><paragraph id="idea2ecde1b4d04c8da4f383bb3917b0a1"><enum>(5)</enum><text>by striking subsection (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6d4f2b766d7440d5b6ba9cdafeca800a"><subsection commented="no" id="idcb34cfedc6f34a4ebe544d7e64804b48"><enum>(e)</enum><header>Funding</header><paragraph commented="no" id="id20d542598f9f45949bb9e1cf1d645c24"><enum>(1)</enum><header>Mandatory funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $15,000,000 for fiscal year 2026 and each fiscal year thereafter.</text></paragraph><paragraph id="id8d9054eae55c4ba79b5f6d5f296b1498"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $50,000,000 for each of fiscal years 2026 through 2030.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idce1d0fa09ffa48348f53f2d5224f2392"><enum>3.</enum><header>Agriculture and Food Research Initiative</header><text display-inline="no-display-inline">Section 2(b)(2)(E) of the Competitive, Special, and Facilities Research Grants Act (<external-xref legal-doc="usc" parsable-cite="usc/7/3157">7 U.S.C. 3157(b)(2)(E)</external-xref>) is amended—</text><paragraph id="id78f1a536a5ad4e59a90e79729b6636a3"><enum>(1)</enum><text>in clause (iv), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id7d770f21e309426889aae90da59ca6ad"><enum>(2)</enum><text>in clause (v), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id2fdb6328aa474767bda2db8d1e21198f"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id956d85a110a84874a83ad01665809df6"><clause id="id4ca7ea0ef132458d982fb5765bc6a205"><enum>(vi)</enum><text>hydroponics, aquaponics, aeroponics, and other production technologies used in controlled-environment agriculture production.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id4dfb9b4bf68641b49f322092ed5d3f33"><enum>4.</enum><header>Data collection</header><text display-inline="no-display-inline">Section 7212(b) of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>; 132 Stat. 4812) is amended—</text><paragraph id="id6cb7ebeeb340484e894e5083f68f065c"><enum>(1)</enum><text>in paragraph (1), in the matter preceding subparagraph (A)—</text><subparagraph id="idfce15c3796be4302865402a73760bf70"><enum>(A)</enum><text>by striking <quote>Not later than one year after the date of enactment of this Act, the</quote> and inserting <quote>The</quote>; and</text></subparagraph><subparagraph id="ida09929b1d1874a7984f0fba44d07e0ea"><enum>(B)</enum><text>by striking <quote>the census of agriculture conducted in the calendar year 2017</quote> and inserting <quote>each census of agriculture</quote>; and</text></subparagraph></paragraph><paragraph id="idd2e8285833d54442aca13606b50b15a8"><enum>(2)</enum><text>in paragraph (2), by striking <quote>$14,000,000 for the period of fiscal years 2019 through 2021</quote> and inserting <quote>$18,000,000 for each of fiscal years 2026 through 2030, to remain available until expended</quote>.</text></paragraph></section></legis-body></bill>
