<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4464</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260430">April 30, 2026</action-date><action-desc><sponsor name-id="S423">Mr. Ricketts</sponsor> (for himself and <cosponsor name-id="S418">Mr. Fetterman</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Meat Inspection Act and the Poultry Products Inspection Act to ensure that consumers can make informed decisions in choosing between meat and poultry products and cell-cultivated protein products, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE9937F9EDC0841F8BC1F42E92648BDD4"><section section-type="section-one" id="H2F44C6A60450423592572BBCE737A82D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair and Accurate Ingredient Representation on Labels Act of 2026</short-title></quote> or the <quote><short-title>FAIR Labels Act of 2026</short-title></quote>.</text></section><section id="H36551D328DE34CD6A1170189FB7F6128"><enum>2.</enum><header>Revised memorandum of understanding between Secretary of Agriculture and Secretary of Health and Human Services regarding regulation of cell-cultivated protein product</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Agriculture and the Secretary of Health and Human Services shall jointly revise the Memorandum of Understanding entitled <quote>Formal Agreement Between FDA and USDA Regarding Oversight of Human Food Produced Using Animal Cell Technology Derived from Cell Lines of USDA-amenable Species</quote> entered into March 7, 2019, so that with respect to the regulation of cell-cultivated protein products—</text><paragraph id="HB87C658A616D49CA98412E9372412E77"><enum>(1)</enum><text>the Secretary of Agriculture shall conduct such activities as are necessary to implement the amendments made by this Act; and</text></paragraph><paragraph id="HF9F06CBBA0204B238627ED06D9F6C0F4"><enum>(2)</enum><text>the Secretary of Health and Human Services shall—</text><subparagraph display-inline="no-display-inline" id="H40326E5FFA204AFB9168A6E5FBCA5EAE"><enum>(A)</enum><text>conduct premarket consultation processes to evaluate production materials and processes and manufacturing controls, including oversight of tissue collection, cell lines and banks, and all components and inputs;</text></subparagraph><subparagraph id="HF90FDA7527FB47A5B2B53DE16A0EBD44"><enum>(B)</enum><text>oversee the initial cell collection and the development and maintenance of qualified cell banks;</text></subparagraph><subparagraph id="H5C04116388F64703862BC33F53A96AFA"><enum>(C)</enum><text>oversee the proliferation and differentiation of cells up to the time of harvest;</text></subparagraph><subparagraph id="H6F946BB2AA6540AFA9D901467D4DC19F"><enum>(D)</enum><text>ensure that the appropriate entities comply with applicable requirements of the Food and Drug Administration, including facility registration, the current good manufacturing practices and preventive controls regulation, and requirements applicable to substances that become a component of food or otherwise affect the characteristics of food;</text></subparagraph><subparagraph id="H3F9CD40590F94EE8B25AE0A66AECBF61"><enum>(E)</enum><text>develop additional requirements for cell bank and cell culturing facility conditions and processes to ensure that biological material exiting the culture process is safe; and</text></subparagraph><subparagraph id="HA63DC426385D4E3A8A32BBA562F3F8C8"><enum>(F)</enum><text>conduct appropriate inspections and follow-up activities, including taking enforcement action if necessary, to ensure that cell bank and cell culturing facilities are in compliance with applicable laws (including regulations).</text></subparagraph></paragraph></section><section id="HFA7A7A3ED8BB4BB981E55D9DDAF4C2E5"><enum>3.</enum><header>Regulation of cell-cultivated protein products by Secretary of Agriculture</header><subsection id="H73DC6DFCF47945A7BC4B8E0C3D073EB8"> <enum>(a)</enum> <header>Cell-Cultivated protein products</header> <paragraph id="H5C16955E0C224AFCA3F720BD4FE57325"> <enum>(1)</enum> <header>Definition</header> <text display-inline="yes-display-inline">Section 1 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601</external-xref>) is amended by adding at the end the following:</text>

              <enum>(x)</enum>
 <text display-inline="yes-display-inline">The term <term>cell-cultivated protein product</term> means any product capable of use as human food that—</text>

                <enum>(1)</enum>
 <text display-inline="yes-display-inline">is made wholly or in part from any cell culture or the DNA of an amenable species using animal cell culture technology; and</text>
              </paragraph>
              <paragraph id="H7BFCDA54D03A4599AD84196DB81C7602">
                <enum>(2)</enum>
 <text display-inline="yes-display-inline">is grown or cultivated outside of the live animal from which the cell culture or DNA was acquired.</text>
              </paragraph>
            </subsection>

          <enum>(2)</enum>
          <header>Misbranding</header>
 <text>Section 1(n)(3) of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601(n)(3)</external-xref>) is amended to read as follows:</text>
          <quoted-block style="traditional" display-inline="no-display-inline"

              <enum>(3)</enum>
 <text display-inline="yes-display-inline">if it is a cell-cultivated protein, unless its label—</text>

                <enum>(A)</enum>
 <text display-inline="yes-display-inline">clearly indicates in a prominent, conspicuous, and legible manner the words <quote>cell-cultivated</quote>, in type of uniform size and prominence, immediately adjacent to the name of the food so as to render it likely to be read and understood by the ordinary individual under customary conditions of purchase and use;</text>
              </subparagraph>
              <subparagraph id="HD751A9A9FA9648DA8C3CB3CD8978C9A4">
                <enum>(B)</enum>
 <text>bears a statement that the cell-cultivated protein product is derived from sources other than meat, in type of uniform size and prominence, immediately adjacent to the name of the food; and</text>
              </subparagraph>
              <subparagraph id="HF9B2B9EE5D204AB0986EE92B1705C88C">
                <enum>(C)</enum>
 <text display-inline="yes-display-inline">bears a disclaimer that clearly indicates that the cell-cultivated protein product in its final product form is not derived from, or does not contain, naturally produced meat from a live amenable species;</text>
              </subparagraph>
            </paragraph>

        </paragraph>
        <paragraph id="HDA36192AA9764CBE95FE3C28BAE85DA2">
          <enum>(3)</enum>
          <header>Applicability</header>
 <text>Section 25 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/625">21 U.S.C. 625</external-xref>) is amended—</text> <subparagraph id="HAD764F986A934F1C831E32A1DA0BE3CF"> <enum>(A)</enum> <text>by striking <quote>Notwithstanding</quote> and inserting <quote><header-in-text level="subsection" style="OLC"><enum-in-header>(a) </enum-in-header></header-in-text>Notwithstanding</quote>; and</text>
          </subparagraph>
          <subparagraph id="HED34A570F3C446B189D0461AC819D25E">
            <enum>(B)</enum>
 <text>by adding at the end the following:</text> <quoted-block style="traditional" display-inline="no-display-inline" id="H71D822A831DD437CBBAA3DB811B17668"> <subsection id="HB6467F41DC4D43C387435E12BFC22526"> <enum>(b)</enum> <text>The requirements of this Act shall apply with respect to cell-cultivated protein products in the same manner as such requirements apply to meat and meat food products.</text>

        <enum>(b)</enum>
        <header>Cell-Cultivated poultry products</header>

          <enum>(1)</enum>
          <header>Definition</header>
 <text display-inline="yes-display-inline">Section 4 of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/453">21 U.S.C. 453</external-xref>) is amended by adding at the following:</text>

              <enum>(cc)</enum>
 <text display-inline="yes-display-inline">The term <term>cell-cultivated protein product</term> means any product capable of use as human food that—</text>

 <text display-inline="yes-display-inline">is made wholly or in part from any cell culture or the DNA of a live bird using animal cell culture technology; and</text>
              </paragraph>
              <paragraph id="HBEFCBCF281E14CDBB28174F65109EB56">
                <enum>(2)</enum>
 <text display-inline="yes-display-inline">is grown or cultivated outside of the live bird from which the cell culture or DNA was acquired.</text>
              </paragraph>
            </subsection>

 <text display-inline="yes-display-inline">clearly indicates in a prominent, conspicuous, and legible manner the words <quote>cell-cultivated</quote>, in type of uniform size and prominence, immediately adjacent to the name of the food so as to render it likely to be read and understood by the ordinary individual under customary conditions of purchase and use;</text>
              </subparagraph>
              <subparagraph id="H609527A50582400480D3E5EAD23730C3">
                <enum>(B)</enum>
 <text display-inline="yes-display-inline">bears a statement that the cell-cultivated protein product is derived from sources other than poultry, in type of uniform size and prominence, immediately adjacent to the name of the food; and</text>
              </subparagraph>
              <subparagraph id="HE8F42AFD28814E0789B8277004ADE973">
                <enum>(C)</enum>
 <text display-inline="yes-display-inline">bears a disclaimer that clearly indicates that the cell-cultivated protein product in its final product form is not derived from, or does not contain, a live amenable bird;</text>
              </subparagraph>
            </paragraph>

        </paragraph>
        <paragraph id="H6C6478937E254CB7AD99AB161B2A3BD1">
          <enum>(3)</enum>
          <header>Applicability</header>
 <text>Section 18 of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/467a">21 U.S.C. 467a</external-xref>) is amended by adding at the end the following:</text>

              <enum>(d)</enum>
 <text>The requirements of this Act shall apply with respect to cell-cultivated protein products in the same manner as such requirements apply to poultry and poultry products.</text>

        </paragraph>
 </subsection><subsection id="H4CD0F6497D944100AB07AE8692724AC3"><enum>(c)</enum><header>Plant-Based Alternative Protein Product</header><text>The Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) is amended—</text><paragraph id="HFC9E38FAF9F04A63916716F75FA09B34"><enum>(1)</enum><text>in section 201 (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>), by adding at the end the following:</text><quoted-block style="traditional" display-inline="no-display-inline" id="HF797D0246E674FA9BA27766CE97C044E"><subsection id="H7EE287FEA0E9477E80444C1599A5323A"><enum>(tt)</enum><text display-inline="yes-display-inline">The term <term>plant-based alternative protein product</term> means any food product that—</text><paragraph id="H5C1B0BC6D95B404FBA6F5A7130F3A01F"><enum>(1)</enum><text>is made wholly or in part from any plant species;</text></paragraph><paragraph id="H1FE2E01B410B4BA0B1B1BB1E736EC28F"><enum>(2)</enum><text>approximates the aesthetic qualities (primarily texture, flavor, and appearance) of meat, poultry, or a food product thereof; and</text></paragraph><paragraph id="H9C24BDE5D598409BBA848DAF5B345F97"><enum>(3)</enum><text>is manufactured to appear as meat, poultry, or a food product thereof.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H9FAF82D49C7B4858B48211A898A03E88"><enum>(2)</enum><text>in section 403 (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>), by adding at the end the following:</text><quoted-block style="traditional" display-inline="no-display-inline" id="HB0D048BDAED9415AB2BF61C212476CA6"><subsection id="H7A5A55C7FF4B4BFABBF2D0802726288F"><enum>(z)</enum><text display-inline="yes-display-inline">If it is a plant-based alternative protein product, unless its label—</text><paragraph id="H131274728D9C469CA2B45F15570F9994"><enum>(1)</enum><text display-inline="yes-display-inline">bears, in type of uniform size and prominence, the phrase <quote>plant-based alternative protein product</quote> and, immediately thereafter, the name of the food; and</text></paragraph><paragraph id="H5BBD17E3DA424DDBA9F1ACF154C979A3"><enum>(2)</enum><text display-inline="yes-display-inline">in a prominently placed, conspicuous, and legible manner so as to render it likely to be read and understood by the ordinary individual under customary conditions of purchase and use, bears a statement that clearly indicates that the product is not derived from, or does not contain, naturally produced meat or poultry from a live animal or bird species.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7128D9CE52034A7292A546D22D9782CB"><enum>(d)</enum><header>Standards of identity</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Agriculture, in consultation with the Secretary of Health and Human Services, shall develop common standards of identity for cell-cultivated protein products and plant-based alternative protein products that are consistent with the definitions specified in section 1 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601</external-xref>), section 4 of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/453">21 U.S.C. 453</external-xref>), and section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301</external-xref>), respectively, as amended by this section.</text></subsection></section></legis-body></bill>
