which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/37">chapter 37</external-xref> of title 18, United States Code, to improve the prohibition on espionage.</official-title></form><legis-body><section id="id1ea7b2af37304c2a972b5af4cf609503" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Visual Protection of Strategic Assets Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id1288fe10c0914c12a98fbac9507ea05f"><enum>2.</enum><header display-inline="yes-display-inline">Improvements to the prohibition on espionage</header><subsection commented="no" display-inline="no-display-inline" id="ide43cd3dcfdb1402e983759ed875955d0"><enum>(a)</enum><header display-inline="yes-display-inline">Gathering, transmitting, or losing defense information</header><text display-inline="yes-display-inline">Section 793 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide8542f68a6e047ccaa1691d01debe0aa"><subsection commented="no" display-inline="no-display-inline" id="idebe166ccdb784a85b33f929222b10507"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id807c5c30c19b4d43b4d079c7949c45cf"><enum>(1)</enum><text>In this subsection—</text><subparagraph id="idcb15baea7f704069a06eb6650130b3c8" indent="up1"><enum>(A)</enum><text>the term <term>country of concern</term> means—</text><clause id="id03453bb9162a4301bfeccb3b3145440d"><enum>(i)</enum><text>the Democratic People's Republic of Korea;</text></clause><clause id="ida5a9da8e6b654005afd7e062db73b274"><enum>(ii)</enum><text>the People's Republic of China;</text></clause><clause id="id3de6e41a0fff4f9698dca5e4da245d48"><enum>(iii)</enum><text>the Russian Federation; and</text></clause><clause id="id5bd2e34ae6474c198e08d759c499e37c"><enum>(iv)</enum><text>the Islamic Republic of Iran;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6fc6ca7c360247f9bb366a524a683762" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>covered person</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id39b311e721ac4672b5f7657e62aea92d"><enum>(i)</enum><text display-inline="yes-display-inline">a citizen or national of a country of concern; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idb194721ab1d84052bd8aad13bbdaad08"><enum>(ii)</enum><text display-inline="yes-display-inline">a person acting on behalf of a citizen or national of a country of concern;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idda7613cac5e8402cafbcf96c1ad8821c"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>high-value asset</term> means an asset included on the list maintained under paragraph (3); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idfe377893e95643d0911896d18add7184"><enum>(D)</enum><text display-inline="yes-display-inline">the term <term>tier-1 installation</term> means a military installation designated as a tier-1 installation by the Secretary of Defense under paragraph (4).</text></subparagraph></paragraph><paragraph id="idb3744871611743d1b6da118d7488e205" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1865a6b87d644d4e88e24b5a70d66fb7"><enum>(A)</enum><text>For purposes of this section, there shall be a rebuttable presumption that a covered person who photographs, videos, or tracks a high-value asset or tier-1 installation photographed, videoed, or tracked the high-value asset or tier-1 installation with intent or reason to believe the information would injure the United States or advantage a foreign nation.</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id8e7621654414476f96f6add9a1426487"><enum>(B)</enum><text>A covered person may rebut the presumption under subparagraph (A) by demonstrating, by clear and convincing evidence, that the covered person photographed, videoed, or tracked the high-value asset or tier-1 installation with prior approval from the Secretary of Defense.</text></subparagraph></paragraph><paragraph indent="up1" commented="no" display-inline="no-display-inline" id="idcb73bd94e3114836a8825eef38c44c12"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall maintain a list of high-value assets of the Department of Defense, which shall include—</text><subparagraph id="ide6c424707a5e4e949ea8c4707720b393"><enum>(A)</enum><text>the Boeing E–4B <quote>Nightwatch</quote> aircraft;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4ed18891b153482d8748783a9d629ddb"><enum>(B)</enum><text display-inline="yes-display-inline">the Boeing RC–135 aircraft;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3aa5351affb9479d804fb37c252bfb6d"><enum>(C)</enum><text display-inline="yes-display-inline">the Northrop B–2 <quote>Spirit</quote> aircraft;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d7437090e064cd09bc95ba7b3f35138"><enum>(D)</enum><text display-inline="yes-display-inline">the Rockwell B–1 <quote>Lancer</quote> aircraft; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ec1c23dfb5b4524811089b27bf5af47"><enum>(E)</enum><text display-inline="yes-display-inline">any nuclear command platform.</text></subparagraph></paragraph><paragraph id="ida84be3e8e83547c099d8dedbec741d74" indent="up1"> <enum>(4)</enum> <text>The Secretary of Defense, in consultation with the Chairman of the Joint Chiefs of Staff and the Secretaries of the military departments, shall designate as a tier-1 installation each military installation that—</text>
                            <subparagraph id="id10136d2cae6d45a38ffca2776e0dec16">
                                <enum>(A)</enum>
 <text>houses, supports, or serves as a primary operating location for 1 or more high-value assets; or</text>
                            </subparagraph>
                            <subparagraph id="id860272eb51d948788da4fd9f5bed35b5">
                                <enum>(B)</enum>
 <text>is critical to the execution of national strategic missions, including nuclear deterrence, global strike, or strategic intelligence collection.</text>
                            </subparagraph>
 </paragraph><paragraph indent="up1" commented="no" display-inline="no-display-inline" id="ida0596ff826904b78b0edf068c758c524"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfe629ff281d148ad8db31cc981a39451"><enum>(A)</enum><text display-inline="yes-display-inline">not less frequently than annually, make publicly available an updated list of high-value assets and tier-1 installations; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id68f41202ed2a4b7bb8870bd34892dde5"><enum>(B)</enum><text display-inline="yes-display-inline">install signs and other markers—</text><clause commented="no" display-inline="no-display-inline" id="id97f80eb503a04eff9ee0229c211f36e3"><enum>(i)</enum><text display-inline="yes-display-inline">identifying high-value assets and tier-1 installations; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4a5c10ebc8244180bdfe1ad237337d3c"><enum>(ii)</enum><text>stating that photography and other surveillance of the high-value assets and tier-1 installations are strictly prohibited.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="ida113df8a9285463791455d1b32f4cf42"><enum>(b)</enum><header>Modernizing and strengthening the prohibition on photographing and sketching defense installations</header><paragraph commented="no" display-inline="no-display-inline" id="id396989ae7872472cba58ce372c260a83"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Section 795 of title 18, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2ab806a73207423c8182a616947698fd"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>photograph,</quote> and inserting <quote>photograph (including a digital photograph), video (including the transmission of video content over the internet contemporaneously with, or nearly contemporaneously with, the capturing of the video content), visual depiction enhanced using artificial intelligence (as defined in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>)),</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8dddeef8ad3c41d2b81caa4b9715b116"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idafbd2562c7564dc68917f23d81a88ec9"><subsection commented="no" display-inline="no-display-inline" id="id15497f79fc89435aa79217044bbd2ace"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id42a4f272e3844c27bd1f203f788aaf3d"><enum>(1)</enum><text>In this subsection, the terms <term>country of concern</term>, <term>high-value asset</term>, and <term>tier-1 installation</term> have the meanings given such terms in section 793(i)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id230beed05fc54b418ef257fe73f304c3" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Whoever violates this section—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9e3e1cc9d8554a9494af6d21ce7d9d18"><enum>(A)</enum><text display-inline="yes-display-inline">shall be fined under this title, imprisoned for not more than 1 year, or both;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idceaa3001025949508e1d9dc4efa34149"><enum>(B)</enum><text display-inline="yes-display-inline">if the violation involved a high-value asset or a tier-1 installation, shall be fined under this title, imprisoned for not more than 7 years, or both; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3a9ac0a627a3444fb9ac69b061a70c36"><enum>(C)</enum><text display-inline="yes-display-inline">if the defendant is a citizen or national of a country of concern, shall be fined under this title, imprisoned for not less than 5 years and not more than 10 years, or both.</text></subparagraph></paragraph></subsection><subsection id="id5ad5f91ffc764d6f986b74bb12321dca"><enum>(c)</enum><text>Any person who violates this section shall—</text><paragraph indent="up1" commented="no" display-inline="no-display-inline" id="idbe7c5c8fd7b144b5ac8fc554ec0ca236"><enum>(1)</enum><text display-inline="yes-display-inline">forfeit to the United States, irrespective of any provision of State law, any electronic or other device used in the commission of the violation; and</text></paragraph><paragraph indent="up1" commented="no" display-inline="no-display-inline" id="id64f0fc9420d74ad6ba7c98874d336c89"><enum>(2)</enum><text display-inline="yes-display-inline">be subject to a civil penalty of not more than $100,000.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idb95f15baf6e0414589bd6bb4e43eb584" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Visa revocation</header><text>Any citizen or national of a country of concern (as defined in section 793(i)(1) of title 18, United States Code), as added by subsection (a), who has been convicted of a violation described in section 795 of title 18, United States Code, as amended by paragraph (1), shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida4235e67729a4b82a2aac48d44eab124"><enum>(A)</enum><text display-inline="yes-display-inline">have his or her visa revoked, in accordance with section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd323bdf40e904b4c9830e7a46ee3124d"><enum>(B)</enum><text display-inline="yes-display-inline">shall be placed in removal proceedings, in accordance with sections 239 and 240 of such Act (8 U.S.C. 1229 and 1229a).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
