of 1986 to ensure that low alcohol by volume kombucha is exempt from any excise taxes and any regulations under chapter 53 of such Code which are imposed on alcoholic beverages.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H09FD82F3BA984D779976592730D01E7F"><section section-type="section-one" id="H531416109DB64A47B88CC76E8CD678AF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Our Manufacturers from Being Unfairly taxed while Championing Health Act</short-title></quote> or <quote><short-title>KOMBUCHA</short-title></quote>.</text></section><section id="H85382AA7C32F4482B30FE49245B3DC03"><enum>2.</enum><header>Tax-free production of low alcohol by volume kombucha</header><subsection id="H59819C0C70C446BD9889AA843B09B5EC"><enum>(a)</enum><header>Exemption from tax on wine</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5042">Section 5042(a)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2A762D06525741DB9F66A7D2E0F3C0EE"><paragraph id="id18d252ce612f4cefb8cd214f1dffa81a"><enum>(4)</enum><header>Low alcohol by volume kombucha</header><subparagraph commented="no" display-inline="no-display-inline" id="id43c68811b0fb4655bda05359cc5aefbe"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to regulations prescribed by the Secretary, low alcohol by volume kombucha shall not be subject to—</text><clause commented="no" display-inline="no-display-inline" id="id7673f5de65b14d9697eb3804ef7b01f6"><enum>(i)</enum><text display-inline="yes-display-inline">tax as wine, or</text></clause><clause commented="no" display-inline="no-display-inline" id="idcb8692e71fc645279e4a3bce3ce6a1ef"><enum>(ii)</enum><text display-inline="yes-display-inline">the provisions of subchapter F.</text></clause></subparagraph><subparagraph id="idD657FA4B7CB04B9592464DCFB9076488"><enum>(B)</enum><header>Definition</header><text>For purposes of this chapter, the term <term>low alcohol by volume kombucha</term> means a beverage which—</text><clause id="id08164F414E5D4E1E97D42602C3E66B7F"><enum>(i)</enum><text>is fermented solely by a symbiotic culture of bacteria and yeast,</text></clause><clause id="id3C8C71A26D4341B3A0BD16C12399B1F1"><enum>(ii)</enum><text>contains not more than 1.25 percent of alcohol by volume,</text></clause><clause id="id79BB08A7E2CF41E9B7D55A88307F15F9"><enum>(iii)</enum><text>is sold or offered for sale as kombucha, and</text></clause><clause id="id07A6DE0306E1427C93C4EBC2D19C426B"><enum>(iv)</enum><text>is derived from—</text><subclause id="idC65A85866F7E4B8081AFE70DCD47EC3B"><enum>(I)</enum><text>fermentable sugars, including sugar, malt or malt substitute, honey, and fruit juice, and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id48F76096B641469F96FEDF3CBF30C1BB"><enum>(II)</enum><text>plant materials, including tea and coffee.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA7FFCAAC6BCA40649EF1F2438B2238AA"><enum>(b)</enum><header>Exemption from tax on beer</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5053">Section 5053</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H34A6206B98424A43953B7A2495C4C66D"><enum>(1)</enum><text>by redesignating subsection (i) as subsection (j), and</text></paragraph><paragraph id="H69F986E36C7444B7B12A5036F9474FEB"><enum>(2)</enum><text>by inserting after subsection (h) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE0018068FE4C42E4A8EDA04DC8D03799"><subsection id="HE0E21F27981D4ADD97CE53B00A4D9654"><enum>(i)</enum><header>Production of low alcohol by volume kombucha</header><text>Subject to regulations prescribed by the Secretary, low alcohol by volume kombucha (as defined in section 5042(a)(4)(B)) shall not be subject to—</text><paragraph commented="no" display-inline="no-display-inline" id="id806640d2279c48e4a85b01bc51a0b2fa"><enum>(1)</enum><text display-inline="yes-display-inline">tax as beer, or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9cbe940e672f4825884ea75647f90558"><enum>(2)</enum><text display-inline="yes-display-inline">the provisions of subchapter G.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H22ADA7060E0E4A1E95D99F80736C53A9"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to calendar quarters beginning after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
