which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Assistant Secretary of Commerce for Communications and Information to create tools for tracking the progress of grant recipients under the Broadband Equity, Access, and Deployment Program, to require the Assistant Secretary to help executive agencies improve compliance with the statutory deadline for processing communications use applications, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accelerating Broadband Permits Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id4a63df6e59cb422ba1e6a664e73d5ecc"><enum>2.</enum><header>Tracking BEAD progress and permits</header><subsection commented="no" display-inline="no-display-inline" id="id19c5b5c45f704b26b42fad574738f3e7"><enum>(a)</enum><header display-inline="yes-display-inline">Progress dashboard</header><text display-inline="yes-display-inline">Section 60102(j) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1702">47 U.S.C. 1702(j)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id531de0c7450c4903aeede47db3b25b52"><paragraph id="id92a71389a9e94df0b9bcde72aa94a46c"><enum>(5)</enum><header>Progress dashboard</header><text>The Assistant Secretary shall make available on a public website a dashboard that tracks the progress of each eligible entity through major milestones under the Program, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6f7b14b74ad343b5aba8ea0b5276f530"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of grant funds received under this section that the eligible entity has expended; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd91fa60d637d4f74ad6b7d22a62a534a"><enum>(B)</enum><text display-inline="yes-display-inline">the number of locations at which broadband service has been made available using grant funds received by the eligible entity under this section, and the number of those locations at which broadband service has been utilized.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id383493a61beb4077aef420a7df6998a7"><enum>(b)</enum><header>Tracking permits</header><text>Section 60102(h) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1702">47 U.S.C. 1702(h)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id534bfe11ddf34003b77be4a5fcc8f821"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (6) as paragraph (7); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b2c6af5eac640ad837789b91dec522d"><enum>(2)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4f030f64f4b74dd39b1a09eaac7c08fa"><paragraph id="id559b1dfb851a4ecb9d71dcb68725fd5c"><enum>(6)</enum><header>Tracking permits</header><text>The Assistant Secretary shall create a tool to help each eligible entity—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcf91a39b5ab043a5a8fdbe119028bbff"><enum>(A)</enum><text display-inline="yes-display-inline">identify the relevant Federal permit requirements for each subgrantee of the eligible entity; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id95baaea9908c4b5587ed5a0eea95525c"><enum>(B)</enum><text display-inline="yes-display-inline">monitor the progress of each subgrantee of the eligible entity toward obtaining Federal permits.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id2798B86E7B6E489E99EB9FCAA04BAABE"><enum>3.</enum><header>Tracking and improving processing times for communications use applications</header><text display-inline="no-display-inline">Section 6409(b)(3) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(b)(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB5518EA7B9B445C9A3E9C128EB86469E"><subparagraph id="id9A6D1325613D415681002C22B07FA720"><enum>(E)</enum><header>Tracking and improving processing times</header><clause id="id05468F959BF94215A1C17E01B50D1A00"><enum>(i)</enum><header>Data controls</header><text>Not later than 90 days after the date of enactment of the <short-title>Accelerating Broadband Permits Act of 2026</short-title>, the Assistant Secretary shall develop controls to ensure that data is sufficiently accurate and complete for an executive agency to track the processing time for each application described in subparagraph (A) received by the executive agency.</text></clause><clause id="id57D5951EB7C54B8D8D7F69C4CF59A784"><enum>(ii)</enum><header>Requirement to analyze, address, and report on delay factors</header><text>With respect to the factors that contribute to delays in processing applications described in subparagraph (A), the Assistant Secretary shall—</text><subclause id="idDCEBC1DAA9834178B5A6D3C63671CFDC"><enum>(I)</enum><text>analyze the factors as the delays are occurring;</text></subclause><subclause id="idC8E647ECF8994E7092085EDF17C8ACD8"><enum>(II)</enum><text>take actions to address the factors; and</text></subclause><subclause id="idCEBE180119384B768D1E33D1021CEFD0"><enum>(III)</enum><text>provide an annual report on the factors to—</text><item id="idF1405BE8EC1342D1BFC60CDB7BA14E2D"><enum>(aa)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></item><item id="id3C896945491942EB89605AD2995BB36B"><enum>(bb)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></item><item id="idDBD89B8DFC674EF0BBAFD3582DBED462"><enum>(cc)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></item><item id="id2BFC1BB69BF241198CDC915770FE27BF"><enum>(dd)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></item></subclause></clause><clause id="idc5142d5f2d9842aeb9abbdc39ab4c71a"><enum>(iii)</enum><header>Method for alerting staff to at-risk applications</header><text>Not later than 90 days after the date of enactment of the <short-title>Accelerating Broadband Permits Act of 2026</short-title>, the Assistant Secretary shall establish a method to alert employees of an executive agency to any application described in subparagraph (A) with respect to which the executive agency is at risk of failing to meet the 270-day deadline under that subparagraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idc910e7e943494a06878f7cf7511ffbf9"><enum>4.</enum><header>Minimum broadband project cost</header><text display-inline="no-display-inline">Section 41001(6)(A) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m(6)(A)</external-xref>) is amended—</text><paragraph id="id57F42071D13A45E3A8FE87D77696E8B3"><enum>(1)</enum><text>in clause (iii), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="id91643A1B4F1143F6B52FCB5FEE8982DA"><enum>(2)</enum><text>by redesignating clause (iv) as clause (v); and</text></paragraph><paragraph id="idDCB7EC6329AD4BE6A387284D24BD9D0B"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after clause (iii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idaca2b95db3be4ce495444b4acf0e425d"><clause id="idfcc738aa3416485ab360eb37e8b34040"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="id11F059650DF24E08B45A93D21D805C7D"><enum>(I)</enum><text>is subject to NEPA;</text></subclause><subclause indent="up1" id="id85B896962703450BA7EA44352D6C2DE7"><enum>(II)</enum><text>involves the construction of infrastructure for broadband; and</text></subclause><subclause indent="up1" id="idE94E08261EE743AEAD0D440C8273E4DB"><enum>(III)</enum><text>is likely to require a total investment of more than $5,000,000; or</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
