which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Controlled Substances Act to prevent the importation of illicit pill press machines with the intent to counterfeit substances, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9339E5B16F314D38AAA0DD289972D984"><section section-type="section-one" id="H7981835620684CEF934EFD3FE1227954"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Rogue Equipment for Synthetic Substances Act</short-title></quote> or the <quote><short-title>PRESS Act</short-title></quote>.</text></section><section id="HE1BA5E45B19741FB995EA2FF61B42C01"><enum>2.</enum><header>Providing for extraterritorial jurisdiction</header><subsection id="HFCD2EB60B2064FD9A285FC3101E47CEF"><enum>(a)</enum><header>Possession, manufacture, or distribution for purposes of unlawful importation</header><text display-inline="yes-display-inline">Section 1009 of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/959">21 U.S.C. 959</external-xref>) is amended—</text><paragraph id="H0CC98290E045447AB5E0052BF860CFA0"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively;</text></paragraph><paragraph id="HD9518FD71843469491D5A6913B7086B3"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFDB24821D0764122B222F21679ECE305"><subsection id="HFB60ABB86A904D759BBF7F192A00B285"><enum>(c)</enum><text display-inline="yes-display-inline">It shall be unlawful for any person to manufacture or distribute a tableting machine, encapsulating machine, press punch, die system, gelatin capsule, or any equipment, chemical, product, or material—</text><paragraph id="HAA64037481674EB9855C046B00FCF52D"><enum>(1)</enum><text display-inline="yes-display-inline">intending or knowing that it will be used to manufacture a controlled substance or listed chemical; and</text></paragraph><paragraph id="H03429E0FC48A4491A586F5EC0D764EAC"><enum>(2)</enum><text display-inline="yes-display-inline">intending, knowing, or having reasonable cause to believe that the controlled substance or listed chemical will be unlawfully imported into the United States.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H155DC2AA854847B48C7CFF66E0679DC0"><enum>(3)</enum><text>in subsection (d), as so redesignated—</text><subparagraph id="H69E97BD9FD4A4AFD848B7C239CE73D3B"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HDDF6F0AF88F948A2A97D9A562E41E343"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H859B040DD47141B083E0478FC6F59ECA"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6B0E93DE07DF41FC95D4CFA48B41309B"><paragraph id="H1880EB0E12E94DBDA5F47037C7872C1B"><enum>(3)</enum><text display-inline="yes-display-inline">manufacture or distribute a tableting machine, encapsulating machine, press punch, die system, gelatin capsule, or any equipment, chemical, product, or material—</text><subparagraph commented="no" id="H1DC0F4A319FE4737AB27C576580617BB"><enum>(A)</enum><text>intending or knowing that it will be used to manufacture a controlled substance or listed chemical; and</text></subparagraph><subparagraph commented="no" id="H9BF81B03E90F460ABC49D21462C50A14"><enum>(B)</enum><text>intending, knowing, or having reasonable cause to believe that the controlled substance or listed chemical will be unlawfully imported into the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HCEDB3DA2A7C24FD0863439C9126D13ED"><enum>(b)</enum><header>Prohibited acts</header><text>Section 1010 of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960</external-xref>) is amended—</text><paragraph id="HC5EDF63D1ECE46A2AE433ED227465AEF"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="H8C0B2F5CFBF64C1A872C40AA3F42041E"><enum>(A)</enum><text>in paragraph (6), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H1EC628A0B6A846188C2C1BF485AE1A87"><enum>(B)</enum><text>in paragraph (7)—</text><clause id="H2C9C318007A54F73BA64FCCE50486D69"><enum>(i)</enum><text>by striking <quote>section 959 of this title</quote> and inserting <quote>section 1009</quote>; and</text></clause><clause id="H83E91AD937FA48CAA75107FB97C8F189"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; or</quote>;</text></clause></subparagraph><subparagraph id="HDBF7E52FFA744A769953FEF21EF6F053"><enum>(C)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H48061AC9EC164FE2AB05A3677EABF550"><paragraph id="H5861053CA7FA4676AE168E9F16905A6E"><enum>(8)</enum><text display-inline="yes-display-inline">manufactures or distributes a tableting machine, encapsulating machine, press punch, die system, gelatin capsule, or any equipment, chemical, product, or material in violation of subsection (c) of section 1009,</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H1AAB21F02C1544A9A446BC0E05F4620B"><enum>(D)</enum><text>in the matter following paragraph (8), as added by subparagraph (C) of this paragraph, by striking <quote>shall be fined</quote> and all that follows through <quote>or both</quote> and inserting the following: <quote>shall be fined in accordance with title 18, United States Code, imprisoned for the applicable period described in subsection (e), or both</quote>; and</text></subparagraph></paragraph><paragraph id="H41F3386980234A8EB799604A7CEAF236"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H99DBB24A276F4E4A88EEB2665E64668A"><subsection id="H502FBA0ACCAB43188190EC9A0C6A0483"><enum>(e)</enum><text display-inline="yes-display-inline">The applicable period described in this subsection is as follows:</text><paragraph id="H302798D4422A4B05B673E4C15903D368"><enum>(1)</enum><text>In the case of a violation of paragraph (1) or (3) of subsection (d) involving a list I chemical, not more than 20 years.</text></paragraph><paragraph id="HE6740EA3F84E4BBAB1F267F4C7EE781A"><enum>(2)</enum><text>Subject to paragraph (4), in the case of a violation of paragraph (7) of subsection (d), not more than 10 years.</text></paragraph><paragraph id="H87690D22B87E4BDD9ACDEF6214875FCB"><enum>(3)</enum><text>Subject to paragraph (4), in the case of a violation of paragraph (8) of subsection (d), not more than 8 years.</text></paragraph><paragraph id="HFBC0B79DDBBA476E8B252089988333AC"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of a violation of paragraph (7) or (8) of subsection (d) that involves more than 1,000 kilograms of a chemical or product or more than 100 machines that are tableting machines or encapsulating machines, not more than 15 years.</text></paragraph><paragraph id="H010D6DBCB492494394561C902B17EBE7"><enum>(5)</enum><text>In the case of a violation of subsection (d) other than a violation of paragraph (1), (3), (7), or (8) of such subsection, not more than 10 years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H39E89BA4873B4973B346785AF40116E4"><enum>(c)</enum><header>United States Sentencing Commission</header><text display-inline="yes-display-inline">Pursuant to its authority under section 994(p) of title 28, United States Code, the United States Sentencing Commission shall review and amend the Federal sentencing guidelines and policy statements of the Commission, as appropriate, in accordance with this Act and the amendments made by this Act.</text></subsection></section></legis-body></bill>
