<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4441</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260429">April 29, 2026</action-date><action-desc><sponsor name-id="S391">Mr. Young</sponsor> (for himself, <cosponsor name-id="S359">Mr. Heinrich</cosponsor>, <cosponsor name-id="S381">Mr. Rounds</cosponsor>, and <cosponsor name-id="S370">Mr. Booker</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the National Artificial Intelligence Research Resource, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Creating Resources for Every American To Experiment with Artificial Intelligence Act</short-title></quote> or the <quote><short-title>CREATE AI Act</short-title></quote>.</text></section><section id="id3a084ca1997d41869bbbce405aae994f"><enum>2.</enum><header>National Artificial Intelligence Research Resource</header><subsection commented="no" display-inline="no-display-inline" id="idfc0a9b8fd5fc4ae5886d4a23e4e52c03"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6d25e12ff0ed44e398713f3b1d9f85ca"><title id="id4aeb1362ea7245f8acb5d4bdbd90bb3f"><enum>LVI</enum><header>National Artificial Intelligence Research Resource</header><toc><toc-entry level="section" idref="idf6f47f98521d4e95a6c8c1abd7c118d7">Sec. 5601. Definitions.</toc-entry><toc-entry level="section" idref="id7161ddbd37e54d21a9cdde8af5b37a40">Sec. 5602. Establishment; governance.</toc-entry><toc-entry level="section" idref="idca162f7166b74a52a3ad2414b5078bd5">Sec. 5603. NAIRR processes and procedures.</toc-entry></toc><section id="idf6f47f98521d4e95a6c8c1abd7c118d7"><enum>5601.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="id20f5d38744bc48c394abb17f2a4f92f2"><enum>(1)</enum><header>Executive agency</header><text>The term <term>Executive agency</term> has the meaning given such term in section 105 of title 5, United States Code.</text></paragraph><paragraph id="id58591e67920740c48c9a8a487f5603c0"><enum>(2)</enum><header>National Artificial Intelligence Research Resource; NAIRR</header><text>The terms <term>National Artificial Intelligence Research Resource</term> and <term>NAIRR</term> have the meaning given the term <term>National Artificial Intelligence Research Resource</term> in section 5106(g).</text></paragraph><paragraph id="id666f825c7f4f4648a38afa830730530d"><enum>(3)</enum><header>Program management office</header><text>The term <term>Program Management Office</term> means the Program Management Office established under section 5602(c).</text></paragraph><paragraph id="id7060859762d34386b07c9ada3a8fbe82"><enum>(4)</enum><header>Resource of the NAIRR</header><text>The term <term>resource of the NAIRR</term> means a resource described in section 5603(1).</text></paragraph></section><section id="id7161ddbd37e54d21a9cdde8af5b37a40"><enum>5602.</enum><header>Establishment; governance</header><subsection id="idbc9984ce62b842d689a0fd2f651983a3"><enum>(a)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of the <short-title>Creating Resources for Every American To Experiment with Artificial Intelligence Act</short-title>, the Director of the National Science Foundation shall establish the National Artificial Intelligence Research Resource to—</text><paragraph commented="no" display-inline="no-display-inline" id="idddeace9fd32e4cfd8ea7f40be114d2ab"><enum>(1)</enum><text display-inline="yes-display-inline">advance artificial intelligence research and research that employs artificial intelligence; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb726f5853f1d4bcf92529c820b763e8e"><enum>(2)</enum><text display-inline="yes-display-inline">develop artificial intelligence skills for the United States workforce.</text></paragraph></subsection><subsection id="id258867b0a53a4a989c377de9c41b9a5f"><enum>(b)</enum><header>Function</header><text>The function of the NAIRR shall be to connect United States researchers and educators to computational, data, software, and educational resources, provided by Executive agencies, State governments, or nongovernmental entities.</text></subsection><subsection id="idebc510ed0ce44a018b933d1660da7950"><enum>(c)</enum><header>Program Management Office</header><paragraph id="id030fb39bd7694f17a8bb2d16cefd496a"><enum>(1)</enum><header>Establishment</header><text>The Director of the National Science Foundation shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd7aac5280c2949f8b05da9f596104ace"><enum>(A)</enum><text display-inline="yes-display-inline">establish within the Office of Advanced Cyberinfrastructure (or a successor office) of the National Science Foundation a Program Management Office to oversee the functions of the NAIRR; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8f051d3d67894bfcba98d9eea9c8eff2"><enum>(B)</enum><text display-inline="yes-display-inline">appoint an individual to head the Program Management Office.</text></subparagraph></paragraph><paragraph id="id2b00b50a7ddf4ffb9444b38b7c1d813a"><enum>(2)</enum><header>Duties</header><text>The duties of the Program Management Office shall include—</text><subparagraph id="iddffec015f0ee42a192c9d4c18dc896a1"><enum>(A)</enum><text>developing the budget for the NAIRR;</text></subparagraph><subparagraph id="idba2d36ff06f9479c9593655a9dd39cce"><enum>(B)</enum><text>as needed, and with appropriate oversight, delegating operational tasks to 1 or more nongovernmental organizations that shall be selected through a competitive and transparent process;</text></subparagraph><subparagraph id="idb7049169d73042bb8fc922653b70067d"><enum>(C)</enum><text>coordinating resource contributions from participating Executive agencies, State governments, and nongovernmental entities; and</text></subparagraph><subparagraph id="idc96e30810c434b14bec462f93760e34f"><enum>(D)</enum><text>establishing policies and procedures for the NAIRR that carry out all requirements of section 5604.</text></subparagraph></paragraph></subsection><subsection id="id20aae06173594a1f80360101c67e667e"><enum>(d)</enum><header>Reporting</header><text>The Director of the National Science Foundation shall develop, and make publicly available, an annual report on the progress of the NAIRR.</text></subsection></section><section id="idca162f7166b74a52a3ad2414b5078bd5"><enum>5603.</enum><header>Resources of the NAIRR</header><text display-inline="no-display-inline">The head of the Program Management Office shall—</text><paragraph id="idb9420a997f9b461682bce4d80d1bd840"><enum>(1)</enum><text>coordinate and provision resources of the NAIRR, which shall include computational resources, data, software, models, testbeds, and educational resources;</text></paragraph><paragraph id="id644564b2f9e44ac98ac186d2088595ea"><enum>(2)</enum><text>establish processes to manage the acquisition and integration of new resources of the NAIRR, and intake of in-kind contribution of resources of the NAIRR, from Executive agencies, State governments, or nongovernmental entities; and</text></paragraph><paragraph id="id885ec58d5ccf4b249e821c1f9e41eb92"><enum>(3)</enum><text>publicly report a summary of categories of available resources of the NAIRR.</text></paragraph></section><section id="id76c220e8de9d4e9db40a9b4bec51ba78"><enum>5604.</enum><header>NAIRR processes and procedures</header><subsection id="id698b644628f44c50b680a7ffd42d2149"><enum>(a)</enum><header>User eligibility</header><paragraph id="id731a9e25834c498cb64a2eb2805b6406"><enum>(1)</enum><header>Eligible users</header><text>Subject to paragraph (3), the following users shall be eligible for access to the NAIRR:</text><subparagraph id="id52e551b463704382af528e5497f5d39b"><enum>(A)</enum><text>A researcher, educator, or student based in the United States that is affiliated with an entity described in paragraph (2).</text></subparagraph><subparagraph id="id80e110561d5349d89e3dad91fc457810"><enum>(B)</enum><text>An employee of an entity described in subclause (III) or (IV) of paragraph (2)(A)(ii) with a demonstrable mission-need.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21851394c59045708ef0112043712adc"><enum>(2)</enum><header>Entities described</header><text display-inline="yes-display-inline">An entity described in this paragraph is one of the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="iddda4d3a0aa944d8b89c85bd79fc8eb05"><enum>(A)</enum><text>An entity that—</text><clause commented="no" display-inline="no-display-inline" id="idf9c4ca4673da44cca7b22705180061e6"><enum>(i)</enum><text display-inline="yes-display-inline">is based in the United States; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4b1b13a36d684861aa845416848d25bf"><enum>(ii)</enum><text display-inline="yes-display-inline">is—</text><subclause id="id42a7c4ea8df347339aa7d6f652f47859"> <enum>(I)</enum> <text>an institution of higher education (as such term is defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>));</text>
 </subclause><subclause id="id0b3361ccd30d4f839296c9d3b7eb9d91"><enum>(II)</enum><text>a nonprofit institution (as such term is defined in section 4 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3703">15 U.S.C. 3703</external-xref>));</text></subclause><subclause id="id97cb29fca223468bb5941f8534fd16db"><enum>(III)</enum><text>an Executive agency, Congress, an agency of the legislative branch, or an agency of the judicial branch;</text></subclause><subclause id="id748967646b7d46ebb3470dca36672463"><enum>(IV)</enum><text>a federally funded research and development center;</text></subclause><subclause commented="no" id="id1a542093a0d64968ab20213750c48dbc"><enum>(V)</enum><text>a small business concern (as such term is defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>), notwithstanding section 121.103 of title 13, Code of Federal Regulations) that has received funding from an Executive agency, including through the Small Business Innovation Research Program or the Small Business Technology Transfer Program (as described in section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>)); or</text></subclause><subclause id="id7840af26d04a4c7197a3c49402de571b"><enum>(VI)</enum><text>a consortium composed of entities described in subclauses (I) through (V).</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb5a0b43b3687472b9e55a9f5b17f7d77"><enum>(B)</enum><text>An entity that is determined to be eligible by the Director of the National Science Foundation and the Director of the Office of Science and Technology Policy.</text></subparagraph></paragraph><paragraph commented="no" id="id4c892801b29540e990fbebe7ada9e3c5"><enum>(3)</enum><header>Excluded entities</header><subparagraph commented="no" display-inline="no-display-inline" id="id1f8a3b4d5f6841db9afa60e7abb813ec"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No individual is authorized to be an eligible user under paragraph (1) if the individual is employed by a foreign country that is listed in section 4872(f)(2) of title 10, United States Code, or is otherwise authorized by such country to act for or on its behalf.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d7bd85c82b945ac8fa0ec299e7e10f2"><enum>(B)</enum><header>Enforcement</header><text>The Director of the National Science Foundation shall ensure that individuals authorized as eligible users meet the requirements of subparagraph (A).</text></subparagraph></paragraph><paragraph id="id67f6ebc74bf145fea370591d14192c6d"><enum>(4)</enum><header>User access selection</header><text>The head of the Program Management Office shall establish an application process for eligible users to request access to the NAIRR.</text></paragraph></subsection><subsection commented="no" id="id4486e6f9d895449eb293b4df87866134"><enum>(b)</enum><header>Research security</header><text>The head of the Program Management Office shall—</text><paragraph id="id65ae350b2bc1427796994ce41334c185"> <enum>(1)</enum> <text>ensure conformance with the requirements of National Security Presidential Memorandum-33 (relating to supported research and development national policy), issued January 2021, and its implementation guidance on research security and research integrity, or any successor policy document or guidance; and</text>
                </paragraph><paragraph commented="no" id="id65e46b6b44044befab165829c6f47a7e">
                  <enum>(2)</enum>
                  <subparagraph commented="no" display-inline="yes-display-inline"
                    id="idf65273cfd9a14ab78f545f734924e394">
                    <enum>(A)</enum>
 <text>designate a member of the Program Management Office as a research security point of contact with responsibility for overseeing conformance with National Security Presidential Memorandum-33 and its implementation guidance, or any successor policy document or guidance; and</text>
                  </subparagraph>
                  <subparagraph commented="no" display-inline="no-display-inline" indent="up1"
                    id="id6c4c874231c04695b8038bec7ab4b41a">
                    <enum>(B)</enum>
 <text>if the head of the Program Management Office delegates responsibilities to another entity under section 5602(c)(2)(B), require the entity to designate a member of the leadership team for such entity to serve as a research security point of contact as described in subparagraph (A), with respect to the delegated responsibilities.</text>
                  </subparagraph>
 </paragraph></subsection><subsection id="idde10b319f4694c3b8505f69e4596b6c1"><enum>(c)</enum><header>Open source</header><text>The head of the Program Management Office shall establish policies to encourage software developed to administer the NAIRR, and software developed using resources of the NAIRR, to be open-source.</text></subsection><subsection id="id04aee325fc1a4595aa3cbbb65ee81d65"><enum>(d)</enum><header>Fee schedule</header><paragraph id="id00e4c508248d4ce3a8996877ee652c3e"><enum>(1)</enum><header>In general</header><text>The head of the Program Management Office may establish a fee schedule for access to the NAIRR. Access to the NAIRR may only require a fee if the fee is assessed according to such fee schedule. Such fee schedule—</text><subparagraph id="id6c92824efc75431c8b53e238fb22561e"><enum>(A)</enum><text>may differ by type of eligible user and type of affiliated entity described in subsection (a);</text></subparagraph><subparagraph id="id80129ffd360e4e979761c73b0856230e"><enum>(B)</enum><text>shall include a free tier of access based on available funds and anticipated costs and demand;</text></subparagraph><subparagraph id="ida52dec7f070c4e4686780e2ac50c3893"><enum>(C)</enum><text>may include cost-based charges for specified eligible users; and</text></subparagraph><subparagraph id="id71a38a52a2c04ab6b7a3b0c9782ebd8f"><enum>(D)</enum><text>shall ensure that the primary purpose of the NAIRR is to support research.</text></subparagraph></paragraph><paragraph id="idcd1d04236b974933a8e58ded2d6a60ca"><enum>(2)</enum><header>Retention and use of funds</header><subparagraph id="id1fa777369c21465a9135e01b82385f60"><enum>(A)</enum><header>Retaining of funds</header><text>Notwithstanding section 3302 of title 31, United States Code, the head of the Program Management Office may retain fees collected under this subsection.</text></subparagraph><subparagraph id="idd7225a4d18da4eb596b8a0459f615973"><enum>(B)</enum><header>Availability and use of funds</header><text>Amounts retained under subparagraph (A) shall—</text><clause id="idfc1c9d29341e4102b027a5ca789aea93"><enum>(i)</enum><text>remain available until expended; and</text></clause><clause id="id39479f84f0cc49949eb783bf3158a7d1"><enum>(ii)</enum><text>be available to the head of the Program Management Office, without further appropriation, for the purposes of this title.</text></clause></subparagraph></paragraph></subsection><subsection id="id766e8facf8f14a29bc2b27492f523766"><enum>(e)</enum><header>Advanced cyberinfrastructure advisory committee</header><paragraph commented="no" display-inline="no-display-inline" id="idad11cb7d90de40e2aa4434d3228160df"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the National Science Foundation shall establish an advisory committee to assess, and make recommendations regarding, the activities of the Office of Advanced Cyberinfrastructure, including the management of the NAIRR.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6ee9710722024b2f81a0c5b2e14c6ad1"><enum>(2)</enum><header>Members</header><text display-inline="yes-display-inline">The membership requirements for the committee established under paragraph (1) shall be the same as the membership requirements described in section 10386(b) of the Research and Development, Innovation, and Competition Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19106">42 U.S.C. 19106(b)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idce7f294410984c338349e7ded58b2ebc"><enum>(3)</enum><header>Nonapplicability of FACA</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, shall not apply to the committee established under paragraph (1).</text></paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id62eda274ef8e4d26a01d5fd159b05abe"><enum>(b)</enum><header>Conforming amendments</header><text>The table of contents in section 2(b) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>; 134 Stat. 3388) is amended by inserting after the items relating to title LV the following:</text><quoted-block style="OLC" id="idf2c7af98-df3d-4159-b065-ad61917315cf"><toc><toc-entry level="title" idref="id4aeb1362ea7245f8acb5d4bdbd90bb3f">TITLE LVI—National Artificial Intelligence Research Resource</toc-entry><toc-entry level="section" idref="idf6f47f98521d4e95a6c8c1abd7c118d7">Sec. 5601.
