<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4432</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260429">April 29, 2026</action-date><action-desc><sponsor name-id="S404">Mr. Scott of Florida</sponsor> (for himself and <cosponsor name-id="S322">Mr. Merkley</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a determination regarding atrocities in Tibet, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tibet Atrocities Determination Act</short-title></quote>.</text></section><section id="id8caddda6ada24ba590e5f28a4cb3c0ac"><enum>2.</enum><header>Mandate for determination</header><subsection id="id3122e340ce814af7939cb4602ab59b9e"><enum>(a)</enum><header>Determination deadline</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of State shall submit to the appropriate congressional committees a determination as to whether acts carried out by officials or agents of the People’s Republic of China against Tibetans in Tibet constitute either—</text><paragraph commented="no" display-inline="no-display-inline" id="id46ec1adc3dce45e5972ac6461f907706"><enum>(1)</enum><text display-inline="yes-display-inline">an ongoing genocide against the Tibetan people, consistent with, but not limited to, the Genocide Convention Implementation Act of 1987 (the Proxmire Act) (<external-xref legal-doc="usc" parsable-cite="usc/18/1091">18 U.S.C. 1091 et seq.</external-xref>); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37e43cb1fc154f4787781d1bf64afcb6"><enum>(2)</enum><text>crimes against humanity.</text></paragraph></subsection><subsection id="ide19f4e416176432d94e105d60c677032"><enum>(b)</enum><header>Definitions of crimes against humanity and genocide indicators</header><text>For purposes of this Act, the Secretary shall specifically consider, among other factors—</text><paragraph id="idd7efdfff7f054ff9bdda995e5cfe9db5"><enum>(1)</enum><text>systematic killing, including intentional, repeated acts leading to the death of Tibetan individuals or groups;</text></paragraph><paragraph id="id28fcb4d72ffd4bc7a951461bda44b28a"><enum>(2)</enum><text>serious bodily or psychological harm, including physical violence, torture, psychological intimidation, forced indoctrination, or other actions causing severe suffering;</text></paragraph><paragraph id="idde4ce84d36b246b7805c39f3d22ca471"><enum>(3)</enum><text>life conditions calculated to destroy, including forced displacement, mass detentions, systemic deprivation of food, water, medical care, or shelter, and policies with foreseeable fatal consequences for the Tibetan population;</text></paragraph><paragraph id="ide132ba55ebd648b2a8de91f46d9df572"><enum>(4)</enum><text>measures intended to prevent births, including enforced sterilization or coercive abortion practices;</text></paragraph><paragraph id="id2d4106e99dcb4526804b39fc54c9fe4b"><enum>(5)</enum><text>forced transfer of children, including the removal of Tibetan children from their families or communities, including through China’s <quote>colonial boarding school system</quote>; and</text></paragraph><paragraph id="idc0058c7646324d2fbf83237a5c49affe"> <enum>(6)</enum> <text>any other factors deemed relevant by the Secretary.</text>
 </paragraph></subsection></section><section id="id4485d9e208ac4c84966630f4aaa453a2"><enum>3.</enum><header>Scope of determination</header><subsection commented="no" display-inline="no-display-inline" id="id1f4dc300c4164c7abfc4ec91d4f55dc6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall, concurrent with the determination described in section 2, submit to the appropriate congressional committees a written report that includes—</text><paragraph commented="no" display-inline="no-display-inline" id="id674ac0fb1ced48b687c5a688790f12b5"><enum>(1)</enum><text display-inline="yes-display-inline">the evidentiary basis for the determination, including documentation of specific acts and policies;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51ef4245a05d42e98d8b14b3dfa4e97d"><enum>(2)</enum><text display-inline="yes-display-inline">a review of actions and statements by the Government of the People's Republic of China intended to sinicize Tibetan Buddhism or repress Tibetan language and culture that contribute to policies resulting in genocide or crimes against humanity against the Tibetan people;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id381ef1087b964808ab119e5a1f4ffcbc"><enum>(3)</enum><text display-inline="yes-display-inline">findings from Department of State reports and credible third-party analyses; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd36dded7e6454a1495cd29a0513255a5"><enum>(4)</enum><text display-inline="yes-display-inline">recommendations for United States policy responses, including potential sanctions, including, but not limited to, visa restrictions and diplomatic actions.</text></paragraph></subsection><subsection id="id0abc0bce1b6940728c99b4c7f80cdc30"><enum>(b)</enum><header>Consultation requirements</header><text>The Secretary may consult with—</text><paragraph id="idcbed9b223dc84997a45154efe790e1a0"><enum>(1)</enum><text>experts in Tibetan culture, religion, and internationally recognized human rights;</text></paragraph><paragraph id="idbf640b3c13b248ff85b048674ccfce4d"><enum>(2)</enum><text>nongovernmental organizations, including Tibetan advocacy groups; and</text></paragraph><paragraph id="id9864b2f1113b4886b84f6c81bf70d1fe"><enum>(3)</enum><text>members of the Tibetan diaspora.</text></paragraph></subsection><subsection id="idf6595105fbe84773a4274f0e54cc6c66"><enum>(c)</enum><header>Form</header><text>This report shall be submitted in unclassified form, but may contain a classified annex.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id8225bcaab8954fba93b4c21f340abca5"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id56ca7b37b9934f2bbc5c35b57828b9b4"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52f5aa99b6054852a57ee0895a92392e"><enum>(2)</enum><header>Tibet</header><text>The term <term>Tibet</term> means the traditional Tibetan provinces of Amdo, Kham, and U-Tsang within the People’s Republic of China.</text></paragraph></section></legis-body></bill>
