(Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) is amended by inserting after section 223 (<external-xref legal-doc="usc" parsable-cite="usc/42/6605">42 U.S.C. 6605</external-xref>) the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H00999557B55141FF83FBBAB66F71A716"><section id="H8702CC4B6CC3476AB2691C169793AB0E"><enum>223A.</enum><header>Prohibition on research and development awards for certain institutions of higher education</header><subsection id="H322C7E9739D140B7810048A55377A52B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If an institution of higher education receives from a foreign source funds to carry out a specified task, such institution may not, for a period of 5 years after such receipt, be awarded a research and development award.</text></subsection><subsection id="H86D89A8D00B246BD9978CB1744B706C9"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H96CB72B0E01D42218447B7A99AD792A9"><enum>(1)</enum><header>Artificial intelligence</header><text display-inline="yes-display-inline">The term <term>artificial intelligence</term> has the meaning given such term in section 5002.</text></paragraph><paragraph id="HA7E0E227FCDE464EB30861AC1F86FB56"><enum>(2)</enum><header>Biotechnology</header><text display-inline="yes-display-inline">The term <term>biotechnology</term> means the application of science and engineering in the direct or indirect utilization of living organisms or parts or products of such organisms, including modified forms of such organisms, parts, or products, as the case may be.</text></paragraph><paragraph id="HF3CA23E6B3804419A918BB282D726DCC"><enum>(3)</enum><header>Foreign source</header><text display-inline="yes-display-inline">The term <term>foreign source</term> means any of the following entities:</text><subparagraph id="HDC150A1136A7415D87328EC97CBD1200"><enum>(A)</enum><text>A specified foreign government.</text></subparagraph><subparagraph id="HA7737146A5194B16B2631F5BEAE2CD9E"><enum>(B)</enum><text>An entity established under the laws of such government.</text></subparagraph><subparagraph id="H4A3422706AEC4D32A18F815D148AF32C"><enum>(C)</enum><text>An entity in which such government holds ownership interest of not less than 25 percent.</text></subparagraph><subparagraph id="H5D4FD2FC73A046E7A544DA2EA4A15415"><enum>(D)</enum><text>An agent of any of the entities described in subparagraphs (A) through (C), including any of the following:</text><clause id="H1579DF4DA7F644A1AFD4FF8B45CA1351"><enum>(i)</enum><text>A subsidiary of such an entity.</text></clause><clause id="H6697E4B3321A43ECAAA992C0043E3677"><enum>(ii)</enum><text>A person that operates primarily for the benefit of, or under the auspices of, such an entity, such as a foundation of such entity, or an educational, cultural, or language entity.</text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HDCDDED297C7443309D94249B5554EFB7"><enum>(4)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given such term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="HC6D68F9C87734BF1A8B3C9CFC3C4C1FA"><enum>(5)</enum><header>Quantum information science</header><text display-inline="yes-display-inline">The term <term>quantum information science</term> has the meaning given such term in section 2 of the National Quantum Initiative Act (<external-xref legal-doc="usc" parsable-cite="usc/15/8801">15 U.S.C. 8801</external-xref>).</text></paragraph><paragraph id="H0A5B2024EE9D486A92738242B5F5456E"><enum>(6)</enum><header>Research and development award</header><text>The term <term>research and development award</term> has the meaning given such term in section 223.</text></paragraph><paragraph id="H061E1D7CA4704566A89072D4129D8BBC"><enum>(7)</enum><header>Specified foreign government</header><text>The term <term>specified foreign government</term> means the government of any of the following countries:</text><subparagraph display-inline="no-display-inline" id="H0D18B5925BBE40419CFF72086828E958"><enum>(A)</enum><text>The Bolivarian Republic of Venezuela.</text></subparagraph><subparagraph id="HBD5989B622D74A98906DA93CE837B679"><enum>(B)</enum><text>The Democratic People’s Republic of Korea.</text></subparagraph><subparagraph id="H5E3510DE276C4823A7AC957DA915C1A1"><enum>(C)</enum><text>The Islamic Republic of Iran.</text></subparagraph><subparagraph id="H5BF4F9AC2D934B6AB9A740D87781992A"><enum>(D)</enum><text>The People’s Republic of China.</text></subparagraph><subparagraph id="HF6990514DC204EE69B3CFB62981E8917"><enum>(E)</enum><text>The Republic of Cuba.</text></subparagraph><subparagraph id="H455AD33F9BBE463A974CD4D86553F06D"><enum>(F)</enum><text>The Republic of Turkey.</text></subparagraph><subparagraph id="H674D7E186E6D4F36993A466C87488634"><enum>(G)</enum><text>The Russian Federation.</text></subparagraph><subparagraph id="HFE154CE8A37640B1861A62FAB64DB13B"><enum>(H)</enum><text>The State of Qatar.</text></subparagraph><subparagraph id="H7639413528C04F598275942CA037B3C8"><enum>(I)</enum><text>Any other country the Secretary of State determines appropriate.</text></subparagraph></paragraph><paragraph id="H88F309DDDB9245CB8672FBB23D22F486"><enum>(8)</enum><header>Specified task</header><text>The term <term>specified task</term> means research and development relating to a national security or military application, including relating to any of the following:</text><subparagraph id="HA6A283B5E929458E8E75CA76B470A54C"><enum>(A)</enum><text>Artificial intelligence.</text></subparagraph><subparagraph id="H04E871CE3ED64C41A9139F27AB1826F8"><enum>(B)</enum><text>Biotechnology.</text></subparagraph><subparagraph id="HF695F6D1388941049F17C510B50419B9"><enum>(C)</enum><text>Quantum information science.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0867A04ECAC14AF3A006203CA8F12DE6"><enum>(b)</enum><header>Clerical amendments</header><text>The William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) is amended in the table of contents in section 2(b) and in title II of division A by inserting after the items relating to section 223 the following new items:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDCB7D67A4EE04368AD23ABDDE4294BA0"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 223A.
