<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4420</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260428">April 28, 2026</action-date><action-desc><sponsor name-id="S359">Mr. Heinrich</sponsor> (for himself and <cosponsor name-id="S381">Mr. Rounds</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to provide for the participation of physical therapists in the National Health Service Corps Loan Repayment program, to amend title XVIII of the Social Security Act to expand Medicare Rural Health Clinic Services and Federally Qualified Health Center Services to include physical therapy services, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC80B026BCE1948CAB25D36D99C735BA1"><section section-type="section-one" id="HA0B191D93C18435D9DBD6ED312861F9E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Physical Therapist Workforce and Patient Access Act of 2026</short-title></quote>.</text></section><section id="HF9B85A141109448F908CC5D97E99D3FF"><enum>2.</enum><header>National Health Service Corps; participation of physical therapists in loan repayment program</header><subsection id="H8D12E2CBBB6F4D42A415053BDCF8B6A4"><enum>(a)</enum><header>Mission of corps; definition of primary health services</header><text>Section 331(a)(3)(D) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254d">42 U.S.C. 254d(a)(3)(D)</external-xref>) is amended by striking <quote>or mental health,</quote> and inserting <quote>mental health, or physical therapy,</quote>.</text></subsection><subsection id="H5456ABD747E340B08C7DF4DBBD39537F"><enum>(b)</enum><header>Physical therapy health professional target areas</header><text display-inline="yes-display-inline">Section 332 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254e">42 U.S.C. 254e</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBE16129EE9E64B2BBD418FC980B2B57C"><subsection id="H488931DB3D5945E8884F6FE12A6F6DD2"><enum>(l)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idb3a8cc873845494f833cbf95e949e9b0"><enum>(1)</enum><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall identify, based on the data collected under paragraph (3), physical therapy health professional target areas that satisfy the criteria described in paragraph (2) for purposes of, in connection with receipt of assistance under this title, assigning to such identified areas physical therapy health professionals who, without application of this subsection, would otherwise be eligible for such assistance. The Secretary shall distribute physical therapy health professionals within health professional shortage areas using the physical therapy health professional target areas so identified.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd85d478c1957431c82b1b6961a0246e6" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1), the Secretary shall establish criteria for physical therapy health professional target areas that identify geographic areas within health professional shortage areas that have a shortage of physical therapy health professionals.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="idaa73b4f3e57f4dcd966b66a806905b88"><enum>(3)</enum><text display-inline="yes-display-inline">For purposes of this subsection, the Secretary shall collect and publish in the Federal Register data comparing the availability and need of physical therapy health services in health professional shortage areas and in areas within such health professional shortage areas.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="id32dbab1f9c9b4f82b610b421c33621c4"><enum>(4)</enum><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary shall seek input from relevant provider organizations, including medical societies, organizations representing medical facilities, and other organizations with expertise in physical therapy health services.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="id2f9af0a8fd814b3ea31203e6085a82d4"><enum>(5)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall be construed as—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1e728e66567c486b93fe628446691d10"><enum>(A)</enum><text display-inline="yes-display-inline">requiring the identification of a physical therapy health professional target area in an area not otherwise already designated as a health professional shortage area; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0eb23dbc8bdf48339e23d3cd27041610"><enum>(B)</enum><text display-inline="yes-display-inline">affecting the types of health professionals, without application of this subsection, otherwise eligible for assistance, including a loan repayment or scholarship, pursuant to the application of this section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H30B98B6332CD4657969CF28300AB59C2"><enum>(c)</enum><header>Loan repayment program</header><text>Section 338B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254l-1">42 U.S.C. 254l–1</external-xref>) is amended—</text><paragraph id="H3BF7517E9997474FA802AB3F43DA52C7"><enum>(1)</enum><text>in subsection (a)(1), by inserting <quote>physical therapists,</quote> after <quote>dentists,</quote>; and</text></paragraph><paragraph id="H97F08468C1FF476E9F9F1A62F3E67E5B"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcb6264591e5c4aa090ba86a65ed35c0a"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>, or be certified as a nurse midwife, nurse practitioner, or physician assistant</quote> and inserting <quote>; be certified as a nurse midwife, nurse practitioner, or physician assistant; or have a doctoral or master's degree in physical therapy</quote>;</text></subparagraph><subparagraph id="H6691E22D6ADB4C74A64666B6A090C671"><enum>(B)</enum><text>in paragraph (1)(B), by inserting <quote>physical therapy,</quote> after <quote>mental health,</quote>; and</text></subparagraph><subparagraph id="H96292C9B39AE45649ABBA55F38CBC1C0"><enum>(C)</enum><text>in paragraph (1)(C)(ii), by inserting <quote>physical therapy,</quote> after <quote>dentistry,</quote>.</text></subparagraph></paragraph></subsection></section><section commented="no" id="HC2057D63AB4445059A2219A8B044C895"><enum>3.</enum><header>Additional funding for participation of physical therapists in the National Health Service Corps Loan Repayment Program</header><text display-inline="no-display-inline">Section 10503(b)(2)(L) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b-2">42 U.S.C. 254b–2(b)(2)(L)</external-xref>) is amended by inserting before the period at the end the following: <quote>, and an additional $15,000,000 for such period for loan repayments for physical therapists participating in the National Health Service Corps Loan Repayment Program under section 338B of the Public Health Service Act</quote>.</text></section><section id="H876148D463404D8DB08DF757F3AC5419"><enum>4.</enum><header>Expanding Medicare Rural Health Clinic Services and Federally Qualified Health Center Services to include physical therapy services</header><subsection id="H5307A6C04891446E857370A39683BD62"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>) is amended—</text><paragraph id="HAF3BF16B4F1744A5A8E8CF0A71BD0AEE"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H1A123E594E72433590A258C5C06E75A2"><enum>(A)</enum><text>in subparagraph (C), by striking at the end <quote>and</quote>;</text></subparagraph><subparagraph id="H3387D545E17B4D15996DDE9A7854C6CB"><enum>(B)</enum><text>in subparagraph (D), by adding <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="H13E3D3CA74C34E0ABF55952EADD45375"><enum>(C)</enum><text>by inserting after subparagraph (D) the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4B06D774F536494081A37C4B0E9895CD"><subparagraph id="H02A43B04830B4E0D95AD3F3CA7A70267" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">such physical therapy services (as defined in subsection (p)) furnished by a physical therapist,</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5151E447DDE24CDBA0DF4E6C1D59255E"><enum>(2)</enum><text>in paragraph (3)(A), by striking <quote>subparagraphs (A) through (D)</quote> and inserting <quote>subparagraphs (A) through (E)</quote>.</text></paragraph></subsection><subsection id="H5D71FDA129FB411C81D78D7AC17E3D40"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to services furnished on or after January 1, 2027.</text></subsection></section></legis-body></bill>
