<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4416</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260428">April 28, 2026</action-date><action-desc><sponsor name-id="S288">Ms. Murkowski</sponsor> (for herself, <cosponsor name-id="S229">Mrs. Murray</cosponsor>, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, and <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish procedures for the detailing of Public Health Service officers for purposes of advancing care in underserved communities.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Health Services for Advancing Care and Creating Efficient Support Systems in Underserved Communities Act</short-title></quote> or the <quote><short-title>PHS ACCESS Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id98f16f413a78489084bafb96ac60351f"><enum>2.</enum><header>Detail of personnel</header><subsection commented="no" display-inline="no-display-inline" id="idd16cc0f21cc94317bec7ee0ecffc005d"><enum>(a)</enum><header>In general</header><text>Section 214 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/215">42 U.S.C. 215</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3f4c0f813db1453793f16741a832191d"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (d) and (e) as subsections (e) and (f), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb23d0da04fae4de1879053d2d2b65a9d"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id70733C177D39465B9A0609DAE01E53FC"><subsection id="id8f143e3df0ef4721af088faad19b29bc"><enum>(d)</enum><text>The Secretary may detail Public Health Service Commissioned Corps officers to Urban Indian organizations, as defined in section 4 of the Indian Health Care Improvement Act, to cooperate in or conduct work related to the functions of the Department of Health and Human Services.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id7af44acd91164e4392d46a1150414ccf"><enum>(3)</enum><text>in subsection (e), as so redesignated—</text><subparagraph commented="no" display-inline="no-display-inline" id="id910edab60c204db395391dc9c2552fba"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>subsections (b) and (c)</quote> and inserting <quote>subsection (b) or (c)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9d491fdd3cf841fea7e6f86825dee4e7"><enum>(B)</enum><text>by striking <quote>subsections (b) or (c)</quote> and inserting <quote>subsection (b) or (c)</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id90d173c379ff431a96bb46546d6d3681"><enum>(b)</enum><header>Appointment of personnel</header><text>Section 207(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/209">42 U.S.C. 209(d)</external-xref>) is amended—</text><paragraph id="id63b7154d831b450ba0156f354857cf71"><enum>(1)</enum><text>in paragraph (1), by striking <quote>shall,</quote> and inserting <quote>may, at the discretion of the Secretary, after consideration of the criteria described in paragraph (5),</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida8158934899a4ef18af5173f4c457b61"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8DA75592648647C09AFDB1A2462757FD"><paragraph id="idc710494e4e38424ca843a902fd51c28b" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idae66875feaec4e6f8b692bb0133e785d"><enum>(A)</enum><text>The Secretary shall develop objective, transparent criteria for purposes of determining whether to grant a person appointed under subsection (a) constructive credit for length of service as described in paragraph (1). Such criteria shall—</text><clause commented="no" display-inline="no-display-inline" indent="up1" id="id4ddc0fefaa5e4d858aa53900c69fa7c5"><enum>(i)</enum><text display-inline="yes-display-inline">give preference to appointees who—</text><subclause commented="no" display-inline="no-display-inline" id="ida3bf422471be4ae9bf13136f6a9b5403"><enum>(I)</enum><text display-inline="yes-display-inline">serve in a rural or remote (as determined by the Secretary in accordance with objective and transparent criteria established by the Secretary) agency for which the Service is statutorily required to provide services;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id63362a45c2ce4aa2902444299646b8b9"><enum>(II)</enum><text display-inline="yes-display-inline">are specialists in an area with a demonstrated workforce shortage; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id911ade2e008343f8aae0709a4f8cb5d2"><enum>(III)</enum><text display-inline="yes-display-inline">serve in an area with significant access to care challenges; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7b5aadb38be44456bc6be86a5d1d9257"><enum>(IV)</enum><text>serve with an Indian tribe, tribal organization, or Urban Indian organization (as such terms are defined in section 4 of the Indian Health Care Improvement Act); and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id5a200d9b9a874a24ab88c9e8bd2e6d9c"><enum>(ii)</enum><text display-inline="yes-display-inline">consider established Federal designation systems and workforce assessments.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idf6136396030a46089c076b8ed9b68068"><enum>(B)</enum><text>The Secretary shall review and update the criteria established under subparagraph (A) periodically to reflect current workforce needs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
