which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify eligibility for small business loans, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Investing in the American Dream Act</short-title></quote>.</text></section><section id="iddd9395c824c542888421760d6a23deb7"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id8f16d17eb7f949e9bd727fe607006662"><enum>(1)</enum><header>Covered loan</header><text>The term <term>covered loan</term> means—</text><subparagraph id="id7c8fb7a35a124f4baa089f7f657b8754"><enum>(A)</enum><text>a loan guaranteed under section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79577a5fcf2549e48fa9cca977e53275"><enum>(B)</enum><text display-inline="yes-display-inline">a microloan under section 7(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide55cf369fc7d457387f71f20d3688365"><enum>(C)</enum><text>a loan guaranteed under title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id8c2df3aed9a44dc1a020720ef6f1ff8f"><enum>(D)</enum><text>a surety bond guarantee from the Small Business Administration pursuant to part B of title IV of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/694a">15 U.S.C. 694a et seq.</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5d58b33f8fb94af8be0cab04802e0fee"><enum>(2)</enum><header>Eligible individual</header><text>The term <term>eligible individual</term> includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf54743e7d7ef463b96c805b01369e5ac"><enum>(A)</enum><text display-inline="yes-display-inline">an alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)) that meets the requirements under section 2(i) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631(i)</external-xref>), including—</text><clause commented="no" display-inline="no-display-inline" id="id02054653f7244a0587eceb62de4adb1b"><enum>(i)</enum><text>an alien granted asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id4a965b48a1654306aa255e2e8b525559"><enum>(ii)</enum><text>a refugee admitted to the United States under section 207 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id56b5bf11d8504564a641876bf6ec1323"> <enum>(iii)</enum> <text>any alien admitted to the United States as a nonimmigrant described in section 101(a)(15) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) whose period of authorized stay has not expired;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id1811864bda7349e4a7ffbead3f92590c"><enum>(iv)</enum><text display-inline="yes-display-inline">an alien lawfully admitted for permanent residence (as defined in section 101(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)), including an alien lawfully admitted for permanent residence on a conditional basis; and</text></clause><clause id="id21292f7207344ec5bee06a0619ebfc6d" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text>an alien granted deferred action pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idabe672225c3c406fac7684e63685df24"><enum>(B)</enum><text>an individual the principal residence of whom is outside the United States and its territories and possessions.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5fe5f1eea80b4858aa436a98a873fa1f"><enum>(3)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given the term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id1018ab0a962c466abb2ad403296d31ed"><enum>3.</enum><header>Eligibility for business loans</header><subsection commented="no" display-inline="no-display-inline" id="id42ab01ca898d4cf8ab965081dc636118"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">To be eligible for a covered loan, a small business concern shall be—</text><paragraph commented="no" display-inline="no-display-inline" id="ide1f923bb6bf94f7b97cdcd93870ae88d"><enum>(1)</enum><text>located in the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7ac178913a36427c8c5ebd32d2d0095a"><enum>(2)</enum><text>not less than 51 percent owned and controlled by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2ccde7285b5a4264852142c25d8331f0"><enum>(A)</enum><text display-inline="yes-display-inline">citizens or nationals of the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddbf7eb11d9004664ab8dddbbdc1aa58d"><enum>(B)</enum><text display-inline="yes-display-inline">eligible individuals, provided that at the time of application for a covered loan, such individuals are—</text><clause commented="no" display-inline="no-display-inline" id="id46522e3c8b9e4079a07d94a2dfca8a6c"><enum>(i)</enum><text display-inline="yes-display-inline">lawfully present in the United States; and</text></clause><clause id="idaed3f2a04acf43e1a44dd8d05eac223c" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>authorized to be employed in the United States.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd2b8ce6f31b64dcd82701ab92a04abec"><enum>(b)</enum><header>Prohibition</header><text>A small business concern shall not be denied eligibility for a covered loan because the small business concern is owned by eligible individuals, provided the small business concern meets the requirements under subsection (a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idde351845e485460082909284e4a461c8"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed to provide the Small Business Administration with the authority to increase the percentage of the requirement under subsection (a)(2).</text></subsection></section></legis-body></bill>
