which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the creation of family accounts for children to be able to use artificial intelligence chatbots, to require verifiable parental consent for teens using artificial intelligence chatbots, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children’s Health, Advancement, Trust, Boundaries, and Oversight in Technology Act</short-title></quote> or the <quote><short-title>CHATBOT Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id15c49304b5994c1cad8dff2c248b8546"><enum>2.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="ided1f45c01a274d6f93e8706d8fad10c8"><enum/><text>In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idce2a1d215b614f64bf7ca4e088de0841"><enum>(1)</enum><header>Artificial intelligence</header><text>The term <term>artificial intelligence</term> has the meaning given such term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph><paragraph id="id0dfd44159b1d4bb091be1479c95ea306"><enum>(2)</enum><header>Artificial intelligence chatbot</header><text>The term <term>artificial intelligence chatbot</term> means artificial intelligence that, in an open-ended natural-language or multimodal manner—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0675bac075d74e42951182d8305a9857"><enum>(A)</enum><text display-inline="yes-display-inline">accepts user input;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85b065758ff2481081db5d3b11835587"><enum>(B)</enum><text display-inline="yes-display-inline">engages in interactive conversations with a user; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f848d0a4a454b778e334ddbb0c28d40"><enum>(C)</enum><text>provides outputs that are not—</text><clause commented="no" display-inline="no-display-inline" id="id4aa7ec6b1bdf45908edf2451caf8f736"><enum>(i)</enum><text display-inline="yes-display-inline">pre-determined or scripted;</text></clause><clause commented="no" display-inline="no-display-inline" id="id314b4c6863ed47fab30aa1dfb84ce7e6"><enum>(ii)</enum><text>limited to contextualized replies or to a narrow, specified purpose, such as—</text><subclause commented="no" display-inline="no-display-inline" id="id57ea0a865ba4428f9baa55b425722673"><enum>(I)</enum><text display-inline="yes-display-inline">customer service;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide9e379b50bef41a69bbbe53f76c3a040"><enum>(II)</enum><text display-inline="yes-display-inline">any operational purpose of a business;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc411f6c359c24b769b6364154639bd13"><enum>(III)</enum><text display-inline="yes-display-inline">productivity and analysis related to source information;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4a7d65d99a714817bfed585bc88ac862"><enum>(IV)</enum><text display-inline="yes-display-inline">internal research; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida5f2703f1821496b8f9852013f8ffa4e"><enum>(V)</enum><text display-inline="yes-display-inline">technical assistance; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida674faaa41d148179d615fe931be87b1"><enum>(iii)</enum><text>limited to an educational product or service that primarily provides information, experience, training, or instruction for the purpose of building any knowledge, skill, or craft.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40408fc02ac34d069a9e2fc386e6b735"><enum>(3)</enum><header>Child</header><text>The term <term>child</term> means an individual who is under the age of 13.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ce8f3fa4a344723998c8e60f28aed37"><enum>(4)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id638f43a00e60475eb196cc54913602fd"><enum>(5)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means any public-facing website, online service, or software application that, as its primary function, provides an artificial intelligence chatbot to users.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5da558692746417fad45cc3cfa42e2a7"><enum>(6)</enum><header>Know</header><text>The term <term>know</term> means to have actual knowledge or knowledge fairly implied on the basis of objective circumstances.</text></paragraph><paragraph id="id3e2b059a4d9546fda5e18c708bc9543d"><enum>(7)</enum><header>Parent</header><text>With respect to a child or teen, the term <term>parent</term> includes a legal guardian of the child or teen.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb2803b890eb84ac4be0fc9fb2de8b322"><enum>(8)</enum><header>Personal data</header><text>The term <term>personal data</term> has the meaning given the term <term>personal information</term> in section 1302 of the Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d1315ece0434b16b06d4fd4e628d3cf"><enum>(9)</enum><header>Targeted advertising</header><text>The term <term>targeted advertising</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida6321206dcb341ae8f73e98fe577ee70"><enum>(A)</enum><text display-inline="yes-display-inline">means advertising or any other effort to market a product or service to a child or teen user based on any personal data collected from the child or teen; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida88723d562b949c8b8a98b8e5504ffa8"><enum>(B)</enum><text>does not include—</text><clause commented="no" display-inline="no-display-inline" id="idca28d1ba1a4c4e87bd4bbbeb2afbe307"><enum>(i)</enum><text display-inline="yes-display-inline">advertising or marketing to a child or teen user in response to the most recent prompt input by the child or teen user;</text></clause><clause commented="no" display-inline="no-display-inline" id="id01ce473ba38c4b368fbc95083fc4a83c"><enum>(ii)</enum><text>contextual advertising, such as when an advertisement is displayed to a child based on the content of the website, online service, or software application of a covered entity in which the advertisement appears and does not vary based on the personal data of the child or teen user; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id7e6d6b89b6ef442d973908883f664ecf"><enum>(iii)</enum><text>processing personal data solely for the purpose of measuring or reporting advertising or content performance, reach, or frequency, including independent measurement.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id41aa85245b034e68b534ebe70bca596b"><enum>(10)</enum><header display-inline="yes-display-inline">Teen</header><text>The term <term>teen</term> means an individual who has attained 13 years of age but has not attained 18 years of age.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb6d1bfed05b14d84a079e1cfecfc5a85"><enum>(11)</enum><header>Transparency label</header><text display-inline="yes-display-inline">The term <term>transparency label</term> means a notice that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6971c72bec5a4a1ba37efc9712789c34"><enum>(A)</enum><text display-inline="yes-display-inline">is clearly and conspicuously displayed to a user;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1c007cfffca24aeb9161d9c37abb7873"><enum>(B)</enum><text>disappears only if the user—</text><clause commented="no" display-inline="no-display-inline" id="idb1ad8958047f4f44963c775b02418625"><enum>(i)</enum><text display-inline="yes-display-inline">exits the artificial intelligence chatbot; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ida913500e624f4e22914f1c11cfc57566"><enum>(ii)</enum><text>affirmatively dismisses the notice; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id508f30018fee440aa61157de1831fd5e"><enum>(C)</enum><text>discloses that—</text><clause commented="no" display-inline="no-display-inline" id="idff364a4847004f3daa34ad362f1b83d2"><enum>(i)</enum><text display-inline="yes-display-inline">the artificial intelligence chatbot is artificial intelligence and not a natural person; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb6ebfb4a54854c8e8a15ccc77451c254"><enum>(ii)</enum><text>any output of the artificial intelligence chatbot is generated using artificial intelligence.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id758eaae88c3c47ed86d88941b54197b5"><enum>(12)</enum><header>User</header><text display-inline="yes-display-inline">The term <term>user</term> means, with respect to a covered entity, an individual who registers an account or creates a profile in order to access the artificial intelligence chatbot of the covered entity.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd4de17ff8a204ed6b4dc4925cec3654f"><enum>3.</enum><header display-inline="yes-display-inline">Family account requirement for children; termination of existing user accounts and profiles; deletion of personal data</header><subsection commented="no" display-inline="no-display-inline" id="id8cc1507f6079497aadaf333fb7157366"><enum>(a)</enum><header display-inline="yes-display-inline">Creation and maintenance of family accounts</header><text>A covered entity shall require an individual to create and maintain a family account that meets the requirements described in section 5 to access an artificial intelligence chatbot of the covered entity if the covered entity knows such individual is a child.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id779b591d8b9b45f7a52a451d1a5fec3f"><enum>(b)</enum><header>Termination of existing user accounts and profiles of child and teen users</header><text display-inline="yes-display-inline">A covered entity shall terminate any user account or profile of an artificial intelligence chatbot of the covered entity that exists as of the effective date of this Act if the covered entity knows such user is—</text><paragraph commented="no" display-inline="no-display-inline" id="id2a75919dc38c4cd6a8ffb19359422af3"><enum>(1)</enum><text display-inline="yes-display-inline">a child and such child has not created a family account; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb57487d09a5d4a9da5bb80fd8a85617d"><enum>(2)</enum><text>a teen and the parent of such teen has not provided verifiable parental consent pursuant to section 4(a)(1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5bbaf2631c1240749be89a1ed12d5ef9"><enum>(c)</enum><header>Deletion of personal data of children and teens</header><paragraph commented="no" display-inline="no-display-inline" id="id6e727ae5bd504186adf600a25bb49e7a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), upon termination of a user account or profile pursuant to subsection (b), a covered entity shall immediately delete all personal data collected from the user or submitted by the user (including data of the user collected from or submitted by the parent of such user) to the artificial intelligence chatbot of such entity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idac2b192556154d8484b9977a5ad10e1e"><enum>(2)</enum><header>Access of children and teens to personal data</header><text display-inline="yes-display-inline">During the 90-day period beginning on the date on which a covered entity terminates a user account or profile pursuant to subsection (b), to the extent technically feasible and not in violation of any licensing agreement, the covered entity shall make available to such user or parent of such user, upon request, a copy of the personal data collected from the user or submitted by the user to the artificial chatbot of such entity in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7b3a245e386a4b42b12f2320e6f03f5d"><enum>(A)</enum><text display-inline="yes-display-inline">a manner that is readable and able to be understood by a reasonable person; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id78fb0520665d43d1bb150f4f2e31eed7"><enum>(B)</enum><text display-inline="yes-display-inline">a portable, structured, and machine-readable format.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42a2463bd2cf412fbba882e4f67ee01b"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to prohibit a covered entity from retaining—</text><subparagraph commented="no" display-inline="no-display-inline" id="id44f01494d1fa43a8980f06745151602d"><enum>(A)</enum><text display-inline="yes-display-inline">a record of the termination of a user account or profile; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71f479abe20e459ab09d77144cb0cf29"><enum>(B)</enum><text display-inline="yes-display-inline">the minimum information necessary for ensuring compliance with this section.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id589940ea1ac6435b9e69d0981f99dff0"><enum>4.</enum><header>Verifiable parental consent and option for family accounts for teens</header><subsection commented="no" display-inline="no-display-inline" id="idab8604466f0d4913ad7871bb85160c05"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph commented="no" display-inline="no-display-inline" id="ide6b27a5ac0de49a0965ba35cf27607a0"><enum>(1)</enum><header>Notice and verifiable parental consent</header><text display-inline="yes-display-inline">Prior to an individual's creation of a user account or profile with an artificial intelligence chatbot of a covered entity, if the covered entity knows such individual is a teen, the covered entity shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4e72322e32e14292910fd5ba6d7068e5"><enum>(A)</enum><text display-inline="yes-display-inline">provide direct notice to a parent of the teen of the attempt by such teen to create such user account or profile; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd4631b68d10d43a09d00e65791d85f49"><enum>(B)</enum><text display-inline="yes-display-inline">obtain verifiable parental consent (as defined in section 1302(9) of the Children’s Online Privacy Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501(9)</external-xref>)) from the parent of the teen in order for the teen to create such user account or profile.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6a84d80ab0274731951793aac6b819a9"><enum>(2)</enum><header>Option for family accounts</header><text>In obtaining verifiable parental consent under paragraph (1), a covered entity shall provide a parent of a teen with the option to create a family account for the teen that meets the requirements described in section 5.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide5ca5996440a4da68fb91c38e65285d3"> <enum>(3)</enum> <header>Default features</header> <subparagraph commented="no" display-inline="no-display-inline" id="id410f9f8bf8a5467ba924aa4a677880b0"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">Subject to subparagraph (B), if the parent of a teen user does not create a family account for the teen as permitted in paragraph (2), a covered entity shall set and fix any feature or setting described in section (5)(a)(1) at the default setting required by section 5(b)(1) for the user account or profile of such teen.</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id1dae9b557c9e4f35bd66f53bc60979f4">
                        <enum>(B)</enum>
                        <header>Later creation of a family account</header>
 <text display-inline="yes-display-inline">If a parent of a teen user creates a family account for the teen user after such teen user first creates a user account or profile, the covered entity shall permit such parent to adjust any default setting set and fixed under subparagraph (A).</text>
                    </subparagraph>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idebaefc31c6804806b060004353d13082"><enum>(4)</enum><header display-inline="yes-display-inline">Reasonable efforts</header><text display-inline="yes-display-inline">A covered entity shall be deemed compliant with the requirements of this subsection if the covered entity is in compliance with the requirements of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>) to use reasonable efforts (taking into consideration available technology) to provide a parent with direct notice and to obtain verifiable parental consent.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc0c30fd17f964c44815f548d69463e79"><enum>(b)</enum><header>Revocation of consent</header><paragraph commented="no" display-inline="no-display-inline" id="ide8a64684feff409bbf4da652f194e571"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a parent of a teen who has provided verifiable parental consent under subsection (a)(1), a covered entity shall provide such parent with the ability to revoke such consent.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddaaa4cc5123b49239a5bda3377abff9e"><enum>(2)</enum><header>Effect of verifiable parental consent</header><text display-inline="yes-display-inline">If a covered entity receives a revocation of verifiable parental consent under paragraph (1), the covered entity shall suspend, delete, or otherwise disable the user account or profile of the teen on the artificial intelligence chatbot that is subject to such revocation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id33885054dd9842d0917f0fc8105df399"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to require a covered entity to require a teen or the parent of such teen to provide government-issued identification for—</text><paragraph commented="no" display-inline="no-display-inline" id="id39dbab2136e741ae97bc26e04cc30e15"><enum>(1)</enum><text display-inline="yes-display-inline">relationship verification; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5d02b407e7e04a5aa249bec28954fb14"><enum>(2)</enum><text display-inline="yes-display-inline">the provision of verifiable parental consent under subsection (a)(1).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id6bf6471bdede4d13a8c3fbf1a2b9951e"><enum>5.</enum><header display-inline="yes-display-inline">Parental controls and settings for family accounts</header><subsection commented="no" display-inline="no-display-inline" id="id94a1115fec9d428e83aa70822700d8cd"><enum>(a)</enum><header display-inline="yes-display-inline">Parental controls and settings</header><text>Any family account provided by a covered entity to meet the requirements of section 3 or 4 shall permit the parent of a child or teen user, as applicable, to—</text><paragraph commented="no" display-inline="no-display-inline" id="id7537df7f0a8d4b40b4aa9b8617e5e489"><enum>(1)</enum><text display-inline="yes-display-inline">determine the privacy and account settings for the user account or profile of such child or teen, including the ability to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2df9ba66ed3041c8b2b3a9520acd70ea"><enum>(A)</enum><text display-inline="yes-display-inline">limit the amount of time the child or teen is able to spend using the artificial intelligence chatbot of the covered entity;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfde91f4ba7c146348a132e9bfcc7b70f"><enum>(B)</enum><text>disable rewards or incentives, including badges or other visual award symbols, based on frequency, time spent, or the activity of the child or teen using the artificial intelligence chatbot;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9ff6fb5cf5041bf814d1e2ad853a5df"><enum>(C)</enum><text>disable notifications and push alerts;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5afd82742d854e6fb818785c814be76e"><enum>(D)</enum><text>disable any financial transaction made available while using the artificial intelligence chatbot;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc115d25bd9394bf986fdef00201385f9"><enum>(E)</enum><text>disable the generation of an output from the artificial intelligence chatbot that is not in response to the input of a user; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d36fd2608d24d9ba4bc2ab29e383b86"><enum>(F)</enum><text>enable a requirement that the covered entity display a transparency label and set the intervals at which the transparency label should be displayed;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id093bce36825c4d99a995bba03850b9f1"><enum>(2)</enum><text>set the number of inputs that, or the period of time during which, an artificial intelligence chatbot may use the personal data of, or such inputs provided by, a child or teen user to generate outputs before such data and such inputs must be deleted from any memory used by the artificial intelligence chatbot to generate outputs;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide58c8b00e46a479c9c4e0c1688218b30"><enum>(3)</enum><text>access—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb2df76391ec542ada81ee0e712c0076e"><enum>(A)</enum><text display-inline="yes-display-inline">a full record of the conversations and activity of the child or teen with such artificial intelligence chatbot; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5992fbf63d5449da8b6e308d93f4a692"><enum>(B)</enum><text display-inline="yes-display-inline">features that allow the parent to monitor, analyze, and understand, at scale, the record of such conversations and activity; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6ce477a99bf3434bbcdf15aa8b982ed1"><enum>(4)</enum><text>receive customized notifications or other alerts when the child or teen attempts to bypass, disable, or violate any parental control or setting described in paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbd61c87f1f0048a9a44845c4429d8fca"><enum>(b)</enum><header>Default safeguards and parental control options</header><paragraph commented="no" display-inline="no-display-inline" id="id2ecb270543d7492eb3cceda5553995a0"><enum>(1)</enum><header display-inline="yes-display-inline">Default safeguards</header><text>Each covered entity shall ensure that the default setting of any parental control or setting described in subsection (a) for a family account is the option, or pre-set option (for purposes of paragraph (2)), that provides the most protective level of control with respect to the use of the artificial intelligence chatbot by a child or teen user.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2655668367fb4a1794914ac9bc18c5c0"><enum>(2)</enum><header>Pre-set options for parents</header><text display-inline="yes-display-inline">Each covered entity shall provide a parent of a child or teen user with the option to select between several pre-set tiered options for governing the settings described in subsection (a)(2) that balance the tradeoffs between the protectiveness to the child or teen user and the effectiveness of the artificial intelligence chatbot.</text></paragraph></subsection><subsection id="id5eb3aeed95a34474a2a86b18b138b5e0"><enum>(c)</enum><header>Disclosure and transparency</header><paragraph id="ide87c341410614cba816881f10eabe86c"><enum>(1)</enum><header>In general</header><text>Each covered entity shall ensure that the default setting of any parental control or setting described in subsection (a) within a family account is accompanied by a clear and conspicuous disclosure that defines the scope of the setting in a manner that is understandable by an ordinary consumer.</text></paragraph><paragraph id="id7457c82f5cf341d4a6131af58f57911e"> <enum>(2)</enum> <header>Provision of information</header> <text>Prior to the creation of a family account, a covered entity shall provide to the parent of a child or teen clear and conspicuous information, which may include a link to a web page of the covered entity, regarding—</text>
                    <subparagraph id="ida0111f99d8a8409682d9a7bd4a38ae90">
                        <enum>(A)</enum>
 <text>the policies and practices of the covered entity with respect to each parental control or setting described in subsection (a), including an easy-to-understand explanation of the options described in such subsection, the pre-set options described in subsection (b)(2), and the effect of each option or pre-set option; and</text>
                    </subparagraph>
                    <subparagraph id="idb199d5aed188444082dfacdcdd0f1b14">
                        <enum>(B)</enum>
 <text>how to access and manage the family account for the child or teen user, including an easy-to-understand explanation of how to view, change, and determine each parental control or setting described in subsection (a).</text>
                    </subparagraph>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6d713ae17ac048ee91a6bb2ab177c79b"><enum>(d)</enum><header>Report</header><text>A covered entity shall provide an easily accessible means for a child or teen user or the parent of such child or teen user to—</text><paragraph commented="no" display-inline="no-display-inline" id="id0f99e0fcfb25492f8d52cc1ad41b9fc8"><enum>(1)</enum><text display-inline="yes-display-inline">report violations of the parental controls or settings specified in subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e83624668e7407caf79394c327f875e"><enum>(2)</enum><text display-inline="yes-display-inline">contact the covered entity with respect to any matter related to child or teen use of the artificial intelligence chatbot of the covered entity.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id2ed74f2d43354cb79c49eee3cf59300e"><enum>6.</enum><header>Prohibition on targeted advertising</header><subsection commented="no" display-inline="no-display-inline" id="id1442df0038384273b8154fd36ce3d194"><enum>(a)</enum><header>In general</header><text>A covered entity shall not use the personal data of a user that the covered entity knows is a child or teen for purposes of targeted advertising.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idac885883f62348288ab44f37b3182184"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in subsection (a) shall be construed to prohibit a covered entity that knows the age of the child or teen from delivering advertising or marketing that—</text><paragraph commented="no" display-inline="no-display-inline" id="id30063170d3be400d84606711afcf6f34"><enum>(1)</enum><text display-inline="yes-display-inline">complies with the prohibition described in subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida708e27c026a4ac08f3cd11f5ada5c5d"><enum>(2)</enum><text display-inline="yes-display-inline">is age-appropriate and intended for a child or teen audience, so long as the covered entity does not use any personal information other than the age of the child or teen to display such advertisement.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id167cff082781413aa602a98a30c92366"><enum>7.</enum><header display-inline="yes-display-inline">Determination of whether a covered entity knows that an individual is a child or teen</header><subsection commented="no" display-inline="no-display-inline" id="idef1826750c3d404dad3d9c3e86f536b2"><enum>(a)</enum><header display-inline="yes-display-inline">Rule of construction</header><text>For purposes of determining whether a covered entity knows that an individual is a child or teen, the Commission or attorney general of a State shall rely on competent and reliable evidence, taking into account the totality of circumstances, including whether a reasonable and prudent person under the circumstances would have known that the individual is a child or teen.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id82111b5021e34b85a261b12989ee9a50"><enum>(b)</enum><header>Protections for privacy</header><text>Nothing in this Act, including a determination described in subsection (a), shall be construed to require a covered entity to—</text><paragraph commented="no" display-inline="no-display-inline" id="id4d5ceca3323f46ebb5200c21775f5e14"><enum>(1)</enum><text>implement an age gating or age verification functionality; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbc6e477d63204a299fcce00f13f3fd83"><enum>(2)</enum><text display-inline="yes-display-inline">affirmatively collect any personal data with respect to the age of any individual that the covered entity is not already collecting in the normal course of business.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id93e7a54289744a34a138d68dafc82fd2"><enum>(c)</enum><header>Restriction on use and retention of personal data</header><text display-inline="yes-display-inline">If a covered entity (or a third party acting on behalf of a covered entity) voluntarily collects personal data for the purpose of complying with this Act, the covered entity (or third party) shall not—</text><paragraph commented="no" display-inline="no-display-inline" id="id4177c338fa844753aad9a5e3d54adb29"><enum>(1)</enum><text display-inline="yes-display-inline">use any personal data collected for a purpose other than for sole compliance with the requirements of this Act; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51be40a4798b4553b7e62764ed3563f6"><enum>(2)</enum><text>retain any personal data collected for longer than is necessary to comply with the requirements of this Act or than is minimally necessary to demonstrate such compliance.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id2e3bd7f905de4fc6adc52e9971b1c210"><enum>8.</enum><header>Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="idf0f9cd8df4294188ad95d283ee4ccf11"><enum>(a)</enum><header display-inline="yes-display-inline">Enforcement by the Commission</header><paragraph commented="no" display-inline="no-display-inline" id="idbbdde8e0d55844e7b353d167f840dd5b"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id98ddf5dcaccf4bf088dbe168d0ab4a9b"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="id948cfa77f7df4447b3bf683a5e623e8a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6eae8703e5614cb8acb840a8b58f662f"><enum>(B)</enum><header>Privileges and immunities</header><text display-inline="yes-display-inline">Any person who violates this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5628a2d329b44171a392c5f520d078b0"><enum>(C)</enum><header>Authority preserved</header><text>Nothing in this Act shall be construed to limit the authority of the Commission under any other provision of law.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3cb8370e179146c0a7686700a10120a6"><enum>(b)</enum><header>Enforcement by States</header><paragraph commented="no" display-inline="no-display-inline" id="id7683a87a940b426eaa1a42ac3e8ec861"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">Subject to paragraph (3), in any case in which the attorney general of a State has reason to believe that an interest of the residents of the State has been or is threatened or adversely affected by the engagement of a covered entity in a practice that violates section 3 or 4, the attorney general of the State may, as parens patriae, bring a civil action against the covered entity on behalf of the residents of the State in an appropriate district court of the United States to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5c8e337cf1414fb8ab90a44b6be804c5"><enum>(A)</enum><text display-inline="yes-display-inline">enjoin such practice;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4a762008eae74c2ebb5690d37a34ef6b"><enum>(B)</enum><text>enforce compliance with this Act;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21c1a4d9f6b64ce985cac934b931c748"><enum>(C)</enum><text>on behalf of residents of the State, obtain damages, restitution, or other compensation, each of which shall be distributed in accordance with State law; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1b7d0f7c8b1043d9a8bd87129360fab9"><enum>(D)</enum><text display-inline="yes-display-inline">obtain such other relief as the court may consider to be appropriate.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id205c4f1c635c4b308a54bd63ab4099fb"><enum>(2)</enum><header>Rights of the Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="id0d79cd98d0e343718d1229f0ab01729b"><enum>(A)</enum><header>Notice to the Commission</header><clause commented="no" display-inline="no-display-inline" id="id2a86611c16744907ab15772154c79dcd"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), before initiating a civil action under paragraph (1), the attorney general of a State shall provide to the Commission a written notice of such action and a copy of the complaint for such action.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0d101539afd94fa5b6ba5df380b63e33"><enum>(ii)</enum><header>Exception</header><text display-inline="yes-display-inline">If the attorney general determines that it is not feasible to provide the notice described in clause (i) before initiating a civil action under paragraph (1), the attorney general shall provide written notice of the action and a copy of the complaint to the Commission immediately upon initiating the civil action.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f18e5fa39c34996abe9790426cb9996"><enum>(B)</enum><header>Intervention by the Commission</header><text>Upon receiving the notice required under subparagraph (A), the Commission may—</text><clause commented="no" display-inline="no-display-inline" id="id9693eba9325a4a7999544bc983c79c3c"><enum>(i)</enum><text display-inline="yes-display-inline">intervene in the civil action that is the subject of the notice; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6e08dba1f31c4b2386a4a44ef9a959c5"><enum>(ii)</enum><text>upon intervening—</text><subclause commented="no" display-inline="no-display-inline" id="ide8a02c72893a4c1eb389b1ed336022b1"><enum>(I)</enum><text display-inline="yes-display-inline">be heard with respect to any matter that arises in such action; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id64cd75201cbb4f599845fb6aea397f9d"><enum>(II)</enum><text>file a petition for appeal for any decision in such action.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idebacacc8c8524971b63d197c43eb8588"><enum>(3)</enum><header>Investigatory powers</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9eadd2faf2b14411af23d5b11221e85f"><enum>(A)</enum><text display-inline="yes-display-inline">conduct investigations;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89cfeecb24064cff92c751e250af4bc3"><enum>(B)</enum><text>administer oaths or affirmations; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96ea4a8ac0f94c0f8410a80e0d1e8f76"><enum>(C)</enum><text>compel the attendance of witnesses or the production of documentary or other evidence.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id143f528ae63f4d8baeb58dc12157dcd2"><enum>(4)</enum><header>Preemptive action by the Commission</header><text>In any case in which an action is instituted by or on behalf of the Commission for a violation of this Act, no State may, during the pendency of that action, institute a separate civil action under paragraph (1) against any defendant named in the complaint in the action instituted by or on behalf of the Commission for that violation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2c00e571e1b44bf85ba1493e9a563a3"><enum>(5)</enum><header>Venue; service of process</header><subparagraph commented="no" display-inline="no-display-inline" id="idf3098fea477749879b7e2e5c49796203"><enum>(A)</enum><header>Venue</header><text display-inline="yes-display-inline">Any action brought under paragraph (1) may be brought in—</text><clause commented="no" display-inline="no-display-inline" id="id437c6916ed18486a974ab70be8cdc290"><enum>(i)</enum><text display-inline="yes-display-inline">the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id0e4a2c234439424ab3ee3af006ee6f10"><enum>(ii)</enum><text display-inline="yes-display-inline">another court of competent jurisdiction.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bf278993f95477aa995fbbb3814c1f7"><enum>(B)</enum><header>Service of process</header><text display-inline="yes-display-inline">In an action brought under paragraph (1), process may be served in any district in which the defendant—</text><clause commented="no" display-inline="no-display-inline" id="id4a1dbfde68444956995eb5a420b11099"><enum>(i)</enum><text display-inline="yes-display-inline">is an inhabitant; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idbb30663e48e54db289d138b4a84aeada"><enum>(ii)</enum><text>may be found.</text></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida1de87e1cba8416e87a714b96344931d"><enum>9.</enum><header>Relationship to other laws</header><subsection id="id4c31d572606c46fbb158dfa6b757d447"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the provisions of this Act shall preempt any related State law, rule, or regulation only to the extent that such State law, rule, or regulation conflicts with a provision of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide6e151f7f77445628fa973aa17f2ca3a"><enum>(b)</enum><header>Rules of construction</header><text>Nothing in this Act shall be construed to—</text><paragraph commented="no" display-inline="no-display-inline" id="idb21fc8b7edbd4012ab014ee7749ddf35"><enum>(1)</enum><text display-inline="yes-display-inline">prohibit a State from enacting a law, rule, or regulation that provides greater protection to children than the protections provided in this Act; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92c143b53c384064ab7571dd7fff0c89"><enum>(2)</enum><text display-inline="yes-display-inline">affect the application of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4e53807e06c042d1817599d7559eba24"> <enum>(A)</enum> <text display-inline="yes-display-inline">section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>, commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>) or other Federal or State laws governing student privacy; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc3e57b39e3374167a8d12b95b64c4d3e"><enum>(B)</enum><text display-inline="yes-display-inline">the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>) or any rule or regulation promulgated under such Act.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id01c63846cc2c49bfa73bba57a2509bf9"><enum>10.</enum><header>Study on the impact of artificial intelligence chatbots on child and teen human relationships and social needs</header><subsection commented="no" display-inline="no-display-inline" id="id5e0ffe0cb71b43799f62deaf15afc552"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Director of the National Science Foundation shall conduct or commission a study on the effects of artificial intelligence chatbots on human relationships and the social needs of children and teens.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide164c95e761142f0a42c4652c9e6636c"><enum>(b)</enum><header>Scope</header><text display-inline="yes-display-inline">The study required under subsection (a) shall examine, with respect to children and teens—</text><paragraph commented="no" display-inline="no-display-inline" id="id7e51106173d24e6ea79b86e45ae98c65"><enum>(1)</enum><text display-inline="yes-display-inline">the use of artificial intelligence chatbots by children and teens to meet companionship or social needs and the resulting effects on the real-world social engagement and mental health of children and teens;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a7d35f32bde4b26851a679db75334a3"><enum>(2)</enum><text display-inline="yes-display-inline">the prevalence and effects of sycophantic or excessively affirming behavior by artificial intelligence chatbots on children and teens; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a00fe509758452bbf496ec0797f8df1"><enum>(3)</enum><text display-inline="yes-display-inline">the role of design features of artificial intelligence chatbots in shaping the results of paragraphs (1) and (2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc3ecba28c8554a11a5f8e1af2c0f7aca"><enum>(c)</enum><header>Methodology</header><text display-inline="yes-display-inline">The study required under subsection (a) shall draw on existing research, expert consultation, and, where feasible, observational, experimental, and survey-based data collection, consistent with applicable ethical standards and requirements for research involving children and teens.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide02fade646ae452dabd25391ff861ce8"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Director of the National Science Foundation shall submit to the Committee on Commerce, Science and Transportation of the Senate and the Committee on Energy and Commerce and the Committee on Science, Space, and Technology of the House of Representatives a report containing the findings of the study conducted under subsection (a).</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idf0df6c19bed04aa7a75370f430f7b3b2"><enum>11.</enum><header>GAO report on recommendations and best practices</header><subsection commented="no" display-inline="no-display-inline" id="ida62f8876873744b5b259cd87134fa931"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 2 years after the date described in section 12, the Comptroller General of the United States (in this section referred to as the <quote>Comptroller General</quote>) shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce and the Committee on Science, Space, and Technology of the House of Representatives that examines—</text><paragraph commented="no" display-inline="no-display-inline" id="idb6c9e599543c4936b19317bcec45f2eb"><enum>(1)</enum><text display-inline="yes-display-inline">the effectiveness of this Act, including the overall effectiveness of the family account requirements described in sections 3, 4, and 5;</text></paragraph><paragraph id="id8e45a51db7e641e6a890bfe5c15b42c5"><enum>(2)</enum><text>the adoption rate of family accounts by parents of children and teens;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc346465b760a4af3b8d4db7ef98dbf13"><enum>(3)</enum><text>the rate of compliance with the requirements of this Act by covered entities;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86497ab726244023bb8ef7b0ecc29fe3"><enum>(4)</enum><text>the effectiveness of each parental control or setting required within a family account, including recommendations or best practices to provide the most protective or ideal level of control for children and teens, including analysis of the parental control described in section 5(a)(2), including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6bb337679d0e4536a71707a3d0b55103"><enum>(A)</enum><text display-inline="yes-display-inline">using best available research or industry data; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida162074ffa534e0dbc9440393ac02211"><enum>(B)</enum><text display-inline="yes-display-inline">an analysis of model drift with specific consideration of the number of inputs or the duration of time that causes an artificial intelligence chatbot to generate outputs not consistent with its behavior parameters;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87afc589df6047a0990a4968e27a7a6d"><enum>(5)</enum><text>recommendations for parents and covered entities to provide the most protective level of control for children and teens with respect to the use of the parental control described in section 5(a)(2), including recommended settings for limiting the number of inputs or the retention of personal data within the memory of the artificial intelligence chatbot, with reference to the data described in paragraph (4);</text></paragraph><paragraph id="id151e0dd331f948f48361dd2fc3e99357"><enum>(6)</enum><text>recommendations for parents, based on available data, with respect to best practices for maximizing the protection of a child or teen within a family account while ensuring the effectiveness of an artificial intelligence chatbot;</text></paragraph><paragraph id="id97ea493d25d94d668f34ad156eb9bfdf"><enum>(7)</enum><text>recommendations to the Commission for improving enforcement of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc40f0ef8c1274308bb258389b237bacf"><enum>(8)</enum><text>recommendations to Congress for potential legislative improvement to this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc533041c515b44f399a7e73409773ca4"><enum>(b)</enum><header>Consultation requirement</header><text>In carrying out the report required under subsection (a), the Comptroller General shall consult with each of the following:</text><paragraph id="ide0cd30357d214e02819b89d856aa6a74"><enum>(1)</enum><text>The National Institute of Standards and Technology.</text></paragraph><paragraph id="id28a63e165a224f7cbae70be43b3b9e21"><enum>(2)</enum><text>The Commission.</text></paragraph><paragraph id="id4f2f3119350a4fc8b608421953ada18f"><enum>(3)</enum><text>Representatives of covered entities.</text></paragraph><paragraph id="idb795693d6a3540d097c7af4a4fa7dc6e"><enum>(4)</enum><text>Parents of children or teen users of artificial intelligence chatbots.</text></paragraph><paragraph id="id7fb657066c3148b8949b3fa444f56701"><enum>(5)</enum><text>Individuals with experience advocating for online child safety, consumer protection, or online privacy.</text></paragraph><paragraph id="id02d215896bdf483d9d2da6e26e3d210c"><enum>(6)</enum><text>Individuals with experience in artificial intelligence, computer science, and software engineering.</text></paragraph><paragraph id="idce06110e30b64a8581171ea200602d00"><enum>(7)</enum><text>Academic experts with expertise in prevention of online harms to children or teens.</text></paragraph><paragraph id="ide38b329abc984bce88bc3fce7cc7a33e"><enum>(8)</enum><text>Other relevant Federal agencies with expertise in child or teen online safety.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id8326b130444b474196daf8cc253f6bab"><enum>12.</enum><header>Effective date</header><subsection commented="no" display-inline="no-display-inline" id="idca0847e57ea342b5aa2a0744ddd2921c"><enum/><text>This Act shall take effect on the date that is 1 year after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
