under that Act, to strike an exemption under that Act, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Passes for Polluters Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idf86bb1e93ad740f89df0d6038da8b969"><enum>2.</enum><header>Congressional approval of use of exemptions under the Clean Air Act</header><subsection id="id31ddce3d4d784a86830d20b634af3dc3"><enum>(a)</enum><header>Approval process</header><paragraph commented="no" display-inline="no-display-inline" id="idcc2b7524e66e4e9c89c595400364d16e"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7601">42 U.S.C. 7601 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="id4E0EAD6D01644F5E81F01D4AB579930B" act-name=""><section section-type="subsequent-section" id="id61070F0F5D984898AF837CA528A399D5"><enum>330.</enum><header>Congressional approval of use of exemptions</header><subsection commented="no" display-inline="no-display-inline" id="id382e6c6d69bb4bafa018cff6af6b3e7b"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph id="id139183e98c4e47f6819619a747fc5b8a"><enum>(1)</enum><header>Comptroller General</header><text>The term <term>Comptroller General</term> means the Comptroller General of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5b08a2da5b8d4f778072b81c8119b3eb"><enum>(2)</enum><header>Covered exemption</header><subparagraph commented="no" display-inline="no-display-inline" id="id0dd23ac4ebe44e9baa83cd419a742d3b"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>covered exemption</term> means an exemption, including the adoption of regulations or issuance of orders, as applicable, under—</text><clause commented="no" display-inline="no-display-inline" id="ide2ca10472f2f4b02b9ba7526c09e79d7"><enum>(i)</enum><text display-inline="yes-display-inline">section 118(b);</text></clause><clause commented="no" display-inline="no-display-inline" id="idbd6b84a7f12b49d38673a9c6ab19a62e"><enum>(ii)</enum><text display-inline="yes-display-inline">section 248(e); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb8cc39a7d5674c39be6ced7a5a588bf7"><enum>(iii)</enum><text display-inline="yes-display-inline">section 604(f).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbb4eed1f2db24c6e86fe715482c6d3c0"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>covered exemption</term> includes an extension of a covered exemption, if that extension is authorized under applicable law.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id540813d0d271427b894a8d3a8a043dbc"><enum>(3)</enum><header>Joint resolution</header><text display-inline="yes-display-inline">The term <term>joint resolution</term> means a joint resolution of the House of Representatives or the Senate that only expresses the approval of Congress of a proposed use of a covered exemption set forth in a special message.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ed4c9d85c2d433dac1a562b1c6e5f2d"><enum>(4)</enum><header>Special message</header><text>The term <term>special message</term> means a special message transmitted by the President to the Senate and the House of Representatives pursuant to subsection (c)(1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7ce9713c0f53491d8d7fb2f6b76c41ee"><enum>(b)</enum><header>Limitation on use of exemptions</header><text>Notwithstanding any other provision of this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id2541716c76044644a8acf756b5922b18"><enum>(1)</enum><text display-inline="yes-display-inline">neither the President, the Administrator, the head of any Federal department or agency, nor any office or employee of the United States may use a covered exemption or, as applicable, extend a covered exemption except after a joint resolution is enacted in accordance with this section; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1195326458af42dca2ed7985da76c962"><enum>(2)</enum><text>neither the use of a covered exemption nor, as applicable, the extension of a covered exemption shall have any force or effect except after a joint resolution is enacted in accordance with this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc4e05e9b448246268514409e3768463f"><enum>(c)</enum><header>Proposed use of exemption</header><paragraph commented="no" display-inline="no-display-inline" id="idd7b900a72c9f4409a3b2c6c2cf70c39c"><enum>(1)</enum><header display-inline="yes-display-inline">Transmittal of special message</header><text>Whenever the President, the Administrator, the head of any Federal department or agency, or any officer or employee of the United States proposes to use a covered exemption, the President shall transmit to the Senate and the House of Representatives, electronically or through physical means, a special message describing—</text><subparagraph commented="no" display-inline="no-display-inline" id="id04f1c92063be4f4eba8ef093840cf39b"><enum>(A)</enum><text display-inline="yes-display-inline">the covered exemption proposed to be used;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0a0a1b8f8e2e4e64bfd35cfd69c86b55"><enum>(B)</enum><text>the period of time during which the covered exemption is proposed to be used;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf95a54e04484d3e810c65bba45c3896"><enum>(C)</enum><text>the reasons for the proposed use of a covered exemption, including any legal authority invoked to justify that proposed use; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16a9836abb8b4e94819d0439df700fbe"><enum>(D)</enum><text>all facts, circumstances, and considerations relating to or bearing on the proposed use of the covered exemption, including—</text><clause commented="no" display-inline="no-display-inline" id="id6e8841e7f80b484182433b63bd6c141f"><enum>(i)</enum><text display-inline="yes-display-inline">an analysis of the application of those facts, circumstances and considerations to any legal authority invoked to justify the proposed use of the covered exemption; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id06dea696dbbf404a8fd77a969e4cf84e"><enum>(ii)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, the estimated effect of the proposed use.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf0ab7753fb4c4b268383dfb407b1f9b9"><enum>(2)</enum><header>Inclusion of multiple uses</header><text display-inline="yes-display-inline">A special message may include 1 or more proposed uses of covered exemptions.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7b8cd1c604af466e953cdfc28461fabc"><enum>(3)</enum><header>Consistency with legislative policy</header><subparagraph commented="no" display-inline="no-display-inline" id="id4fc572d7e39e4a71bb221a72ad450a82"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The use of a covered exemption shall only be permissible as specifically provided by law.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86af557536494cfa85f6611516aa9668"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">No officer or employee of the United States may use a covered exemption for any purpose other than a purpose described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0377a0a65a4e4b6d82e78f127178fffd"><enum>(d)</enum><header>Transmission of special messages; publication</header><paragraph commented="no" display-inline="no-display-inline" id="id67193919cb7f417cb8a818160f55d50c"><enum>(1)</enum><header display-inline="yes-display-inline">Delivery to Houses of Congress</header><subparagraph commented="no" display-inline="no-display-inline" id="id06502d5837d246f8846e4a8b7091a00e"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each special message shall—</text><clause commented="no" display-inline="no-display-inline" id="id9d162312f11143818bfb858dc555c723"><enum>(i)</enum><text display-inline="yes-display-inline">be transmitted to the Senate and the House of Representatives on the same day;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf2a536aa7c3f4f5e904fbe5bb3b4d277"><enum>(ii)</enum><text>if the Senate is not in session on the day the special message is transmitted, be delivered to the Secretary of the Senate; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2ec8a939b1434292a2d25a18e00debf8"><enum>(iii)</enum><text>if the House of Representatives is not in session on the day the special message is transmitted, be delivered to the Clerk of the House of Representatives.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33af12b5dfdc4e8782c3d0cf67ec7308"><enum>(B)</enum><header>Committee referral; printing</header><text>Each special message transmitted to the Senate and the House of Representatives shall—</text><clause commented="no" display-inline="no-display-inline" id="idf3e56f3b4aef40808febe859c3ca2703"><enum>(i)</enum><text display-inline="yes-display-inline">be referred to the appropriate committee of the Senate and the House of Representatives; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id97ef3a7cab534e39b0ab3aa695126042"><enum>(ii)</enum><text>be printed as a document of each House.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id98ade1aafdc54b54b82b89c198d3deb0"><enum>(2)</enum><header>Delivery to Comptroller General</header><subparagraph commented="no" display-inline="no-display-inline" id="idf2ed8b0f6fc7466384e4cb9dc39e5e43"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A copy of each special message shall be transmitted to the Comptroller General on the same day that the special message is transmitted to the Senate and the House of Representatives.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1889083214f84decb28d1408269ed9f1"><enum>(B)</enum><header>Notification</header><text>In order to assist Congress in the exercise of the functions of Congress under this section, the Comptroller General shall review each special message and notify the Senate and the House of Representatives as soon as practicable as to—</text><clause commented="no" display-inline="no-display-inline" id="id712a7c728f55498a9b030a7bb7d9f38e"><enum>(i)</enum><text display-inline="yes-display-inline">the facts surrounding the proposed use of the applicable covered exemption; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id49096f6fcc7b4343819a1933896c58c2"><enum>(ii)</enum><text>whether or not (or to what extent), in the judgment of the Comptroller General, the proposed use of the applicable covered exemption is in accordance with existing statutory authority.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90fb11be85574d64864814749a6dac6a"><enum>(3)</enum><header>Transmission of supplementary messages</header><subparagraph commented="no" display-inline="no-display-inline" id="idb1c739c4699e44c7bf50c728e0dcdce9"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>If any information contained in a special message is subsequently revised, the President shall transmit to both Houses of Congress and the Comptroller General a supplementary message stating and explaining the revision.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc33ccd81cd8843e4b24b7aad69f5fc7a"><enum>(B)</enum><header>Applicability of provisions</header><text>Any supplementary message under subparagraph (A) shall be delivered, referred, and printed as provided in paragraph (1).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5256f62060ca451eb28ac2fa7e27a2b4"><enum>(C)</enum><header>Comptroller General notification</header><text display-inline="yes-display-inline">The Comptroller General shall promptly notify the Senate and the House of Representatives of any change in the notification under paragraph (2)(B) that may necessitated by the supplementary message under subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id26fe2134ce924bcaab1d68a1c065c034"><enum>(4)</enum><header>Printing in Federal Register</header><text>Any special message transmitted to Congress, and any supplementary message transmitted to Congress under paragraph (3)(A), shall be printed in the first issue of the Federal Register published after the transmission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6798bae2ddb4e469b5d672d67200edf"><enum>(5)</enum><header>Cumulative reports</header><subparagraph commented="no" display-inline="no-display-inline" id="id85a2c49c77f645e6b32c05f8d073d460"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than the 10th day of each month during a fiscal year, the President shall submit to the Senate and the House of Representatives a report that describes—</text><clause commented="no" display-inline="no-display-inline" id="id27e5ce673d3f4b0e84caeecad56a856a"><enum>(i)</enum><text display-inline="yes-display-inline">as of the first day of that month, each special message transmitted to Congress during the previous month; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1ed1bf817a3548478a3bcd530c2adc5b"><enum>(ii)</enum><text>with respect to each special message transmitted to Congress during the previous month, the information required to be submitted in that special message.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idafbdce6b3acd42f184dca2895a00e347"><enum>(B)</enum><header>Publication</header><text>Each report submitted under subparagraph (A) shall be printed in the first issue of the Federal Register published after the submission of the report to the Senate and the House of Representatives.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id72855c60c3294fada1ca435eed599eca"><enum>(e)</enum><header>Reports by Comptroller General</header><paragraph commented="no" display-inline="no-display-inline" id="id1fbe8ec9fe34442aaefa1f440e5f1201"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General shall submit to both Houses of Congress a report described in paragraph (2) if the Comptroller General finds that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id31098be19a1e49f7935976f55f809e78"><enum>(A)</enum><text>the President, the Administrator, the head of any department or agency of the United States, or any other officer or employee of the United States has ordered, permitted, or approved the use of an exemption under this Act that is a covered exemption; and</text></subparagraph><subparagraph id="id82ebde5e13a64f9cb76f18b149fbde09"><enum>(B)</enum><text>the President has failed to transmit a special message with respect to the use of the covered exemption.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97c3d495cfbb43d78b43359a7dfca43f"><enum>(2)</enum><header>Report</header><text>A report under paragraph (1) shall include any available information concerning the use of a covered exemption described in that paragraph.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idebf3876c04584b66b6039694caca1ded"><enum>(3)</enum><header>Applicability</header><text>With respect to a report under paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0260f269c0a04b0886f4163fea5950c6"><enum>(A)</enum><text display-inline="yes-display-inline">the provisions of this section shall apply to the proposed use of a covered exemption described in that report in the same manner and with the same effect as if the report were a special message transmitted by the President; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06237e4591d34990822ac9641fd33211"><enum>(B)</enum><text>for purposes of this section, the report shall be considered a special message.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd85d2da595004c3bbba7385c3310b38f"><enum>(f)</enum><header>Procedure in the Senate and House</header><paragraph commented="no" display-inline="no-display-inline" id="id18bf63f35414467caa8bef3bec2176d3"><enum>(1)</enum><header display-inline="yes-display-inline">Referral</header><text>Any joint resolution introduced with respect to a special message shall be referred to the Committee on Environment and Public Works of the Senate or the Committee on Energy and Commerce of the House of Representatives, as applicable.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf1f19acf6626482bad4f5f6506121e1a"><enum>(2)</enum><header>Discharge of committee</header><subparagraph commented="no" display-inline="no-display-inline" id="id804ad7ae2a4f45baa9bdaeaa50a96ba2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>If the committee to which a joint resolution has been referred has not reported the joint resolution by the end of the 15-session day period that begins on the date of the introduction of the joint resolution, it shall be in order to move—</text><clause commented="no" display-inline="no-display-inline" id="id315ef0f14a7b466d9ebe75f874f6d2ff"><enum>(i)</enum><text display-inline="yes-display-inline">to discharge the committee from further consideration of the joint resolution; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id7db5023e649f41df8e9ee34cafaae06a"><enum>(ii)</enum><text>to discharge the committee from further consideration of any other joint resolution with respect to the same special message with respect to the same proposed use of a covered exemption, as the case may be, that has been referred to the committee.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd4cdac5ea6de42468f9ccfb534e47f37"><enum>(B)</enum><header>Procedure on floor</header><clause commented="no" display-inline="no-display-inline" id="id12520f69020e484d9b768218e092eb96"><enum>(i)</enum><header>Motion to discharge</header><text display-inline="yes-display-inline">A motion to discharge described in subparagraph (A)—</text><subclause commented="no" display-inline="no-display-inline" id="idcfdd6894044d4a5c8c1dceadf50bfab2"><enum>(I)</enum><text display-inline="yes-display-inline">may be made only—</text><item commented="no" display-inline="no-display-inline" id="id0b6a970409a843dda7c52cf5f073dcb4"><enum>(aa)</enum><text display-inline="yes-display-inline">by an individual favoring the joint resolution; and</text></item><item commented="no" display-inline="no-display-inline" id="iddff956d877204fffa408ba84a1c47c73"><enum>(bb)</enum><text>if supported by <fraction>1/5</fraction> of the Members of the applicable House (a quorum being present); and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id5f074e47401a45a5ad17ea133a519f89"><enum>(II)</enum><text>may not be made after the committee has reported a joint resolution with respect to the same special message.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida924df82a12f41aa9c714580a1c48d48"><enum>(ii)</enum><header>Status</header><text display-inline="yes-display-inline">A motion to discharge described in subparagraph (A) is—</text><subclause commented="no" display-inline="no-display-inline" id="idbfd42f44f92d4507b002d7ae96a297fe"><enum>(I)</enum><text display-inline="yes-display-inline">privileged in the Senate; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id43abdf8ab9384fc0b7b4e88a86e3950c"><enum>(II)</enum><text>highly privileged in the House of Representatives.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id46840f13dbd34f63ba40e0f6c969a7cb"><enum>(iii)</enum><header>Debate</header><text>Debate on a motion to discharge in described in subparagraph (A) shall be limited to not more than 1 hour in each House, the time for which—</text><subclause commented="no" display-inline="no-display-inline" id="id06d3eca54c444a548d6f2e3292ea1871"><enum>(I)</enum><text display-inline="yes-display-inline">in the Senate, shall be divided equally between, and controlled by, the majority leader and the minority leader (or their designees); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide8e9796febe74f9b97912f403988a8fe"><enum>(II)</enum><text>in the House of Representatives, shall be divided equally between those favoring and those opposing the joint resolution.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3f5d5606e4fa49d29a1623f57b8d36b9"><enum>(iv)</enum><header>No amendment</header><text>No amendment to a motion to discharge described in subparagraph (A) shall be in order.</text></clause><clause commented="no" display-inline="no-display-inline" id="idf2a1d3f6287648eda0b124215e0713aa"><enum>(v)</enum><header>No motion to reconsider</header><text>It shall not be in order to move to reconsider the vote by which a motion to discharge described in subparagraph (A) is agreed to or disagreed to.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a64723b5d9049828eebd2e69548c2d0"><enum>(3)</enum><header>Floor consideration in the Senate</header><subparagraph commented="no" display-inline="no-display-inline" id="id6498e6d6533e4d0a8978dab54b6aee1d"><enum>(A)</enum><header display-inline="yes-display-inline">Debate</header><text>Debate in the Senate on any joint resolution and debatable motions and appeals in connection with that joint resolution shall be limited to not more than 10 hours, with the time to be equally divided between, and controlled by, the majority leader and the minority leader (or their designees).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc45e0f1538c9466499fb0b55172bfa4e"><enum>(B)</enum><header>Motion to further limit debate</header><text>A motion to further limit debate on a joint resolution is not debatable in the Senate.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0227502e276a4d7ea98dc6f83d4b9d5e"><enum>(C)</enum><header>No amendments or motions to recommit</header><text>No amendment to or motion to recommit a joint resolution is in order in the Senate.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81531ab26e584268a2d78cd72ee196f2"><enum>(D)</enum><header>Vote required</header><text>The Senate may only agree to a joint resolution on the affirmative vote of <fraction>2/3</fraction> of the Members of the Senate present and voting.</text></subparagraph></paragraph><paragraph id="id44effc4b12e54324b5575c99c40688a2"><enum>(4)</enum><header>Procedure in the House</header><subparagraph commented="no" display-inline="no-display-inline" id="idcab81b71cc844388a29889aa01fec072"><enum>(A)</enum><header display-inline="yes-display-inline">Motion to proceed</header><clause commented="no" display-inline="no-display-inline" id="idf581b51ab0b64508849366d42ecacb7e"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">When the Committee on Energy and Commerce of the House of Representatives has reported, or has been discharged from further consideration, a joint resolution, it shall at any time thereafter be in order (even though a previous motion to the same effect has been disagreed to) to move to proceed to the consideration of the joint resolution.</text></clause><clause commented="no" display-inline="no-display-inline" id="id27906cf047b2444d85d56af959a72692"><enum>(ii)</enum><header>Status</header><text>A motion under clause (i) shall be highly privileged and not debatable.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2de3b063fdab493baf26ac999899a4c8"><enum>(iii)</enum><header>No amendments or motions to reconsider</header><text>No amendment to or motion to reconsider a motion under clause (i) shall be in order.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf44ed2de626e448d89abee16f761c797"><enum>(B)</enum><header>Debate</header><clause commented="no" display-inline="no-display-inline" id="idc4d100a7f3e349ee827d8b39f5efe792"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Debate on a joint resolution shall be limited to not more than 2 hours, which shall be divided equally between those favoring and those opposing the joint resolution.</text></clause><clause commented="no" display-inline="no-display-inline" id="idc837fadb533248c5a35e1108880eaafd"><enum>(ii)</enum><header>Motion to further limit debate</header><text>A motion to further limit debate on a joint resolution in the House of Representatives shall not be debatable.</text></clause><clause commented="no" display-inline="no-display-inline" id="id54c9e74cbf0f40399cd757eda5849517"><enum>(iii)</enum><header>No amendments or motions to recommit</header><text>No amendment to or motion to recommit a joint resolution in the House of Representatives is in order.</text></clause><clause commented="no" display-inline="no-display-inline" id="id97f7b1a224594275bd77b3fdb3d8a813"><enum>(iv)</enum><header>No motion to reconsider</header><text>It shall not be in order to move to reconsider the vote by which a joint resolution is agreed to or disagreed to in the House of Representatives.</text></clause><clause commented="no" display-inline="no-display-inline" id="id7d8602ce15e24f168c1d2be3149ce64f"><enum>(v)</enum><header>Appeals</header><text>All appeals from the decisions of the Chair relating to the application of the Rules of the House of Representatives to the procedure relating to a joint resolution shall be decided without debate.</text></clause><clause commented="no" display-inline="no-display-inline" id="id849592192c7242069e9f4084464ef7b9"><enum>(vi)</enum><header>Applicability of rules</header><text>Except to the extent specifically provided in this paragraph, consideration of a joint resolution shall be governed by the Rules of the House of Representatives applicable to other joint resolutions in similar circumstances.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9af3c4f9db5349b19ba3d3b1e505e6f1"><enum>(C)</enum><header>Vote required</header><text>The House of Representatives may only agree to a joint resolution on the affirmative vote of <fraction>2/3</fraction> of the Members of the House of Representatives present and voting.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89124486e3dc495ca4e9d2d61c6e4841"><enum>(5)</enum><header>Continuity of Congress</header><text display-inline="yes-display-inline">For purposes of any time limit under this section—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcfe475ef91af419791ab31ae008da228"><enum>(A)</enum><text display-inline="yes-display-inline">the continuity of a session of Congress shall be considered broken only by an adjournment of Congress sine die; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf8fe2f97885b4000a663e78ed1b02f94"><enum>(B)</enum><text display-inline="yes-display-inline">the days on which either House is not in session because of an adjournment of more than 3 days to a day certain shall be excluded in the computation of the 15-day period described in paragraph (2)(A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb28b9dec637c4630888edb5b1c35dec6"><enum>(6)</enum><header>Exercise of rulemaking powers</header><text display-inline="yes-display-inline">This subsection is enacted—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1e39222a7f8f4ee6bfdab87201425f86"><enum>(A)</enum><text display-inline="yes-display-inline">as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, but only with respect to the procedure to be followed in the House in the case of joint resolutions, and supersedes other rules only to the extent that it is inconsistent with such other rules; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaf684055390a4ddbaa184e65dcea6bbc"><enum>(B)</enum><text display-inline="yes-display-inline">with full recognition of the constitutional right of either House to change the rules (relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf93444466c944a3ca5069f9ddff0cc37"><enum>(g)</enum><header>Enforcement</header><text display-inline="yes-display-inline">A person may commence a civil action under section 304 on his or her own behalf against any person (including, notwithstanding any provision of that section, the United States, the President, the Administrator, the head of any Federal department or agency, and any officer or employee of the United States) who is alleged to use a covered exemption a joint resolution for which has not been enacted in accordance with this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbd6974ffb87e4996a184ad7401dccd38"><enum>(2)</enum><header>Conforming amendment</header><text>Section 304(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7604">42 U.S.C. 7604(b)</external-xref>) is amended, in the undesignated matter following paragraph (2), by striking <quote>(f)(4)</quote> and inserting <quote>(f)(4), a civil action described in section 330(g), or</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1d7907004a0c4941a679639065d59d80"><enum>(b)</enum><header>Other amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id43c0de13209e494ea5b5ba1fe6ced185"><enum>(1)</enum><header>Exemption of executive branch emissions from requirements under the Clean Air Act</header><text>Section 118(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7418">42 U.S.C. 7418(b)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida3378bc557e347d19a5af93141e3a1fb"><enum>(A)</enum><text>by striking the sixth sentence;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id091798ea2a1c4de990096a6dec4547c3"><enum>(B)</enum><text display-inline="yes-display-inline">by striking the fifth sentence and inserting the following:</text><quoted-block style="OLC" id="id3ED0217E554A4100AEC486B56E5D4756" act-name=""><subparagraph id="id8415AF3EA2754049A7111024F39D9BF7"><enum>(B)</enum><header>Reconsideration</header><text>The President shall reconsider the need for any regulations issued under subparagraph (A) at 3-year intervals.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id884fe09300ac4ebea211c3c2bfa6d3fa"><enum>(C)</enum><text>in the fourth sentence—</text><clause commented="no" display-inline="no-display-inline" id="id65492e6c054142e98cd7af3a3cd6e6ea"><enum>(i)</enum><text>by inserting <quote>and subject to the enactment of a joint resolution under section 330 authorizing the regulations</quote> after <quote>to do so</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id561cab9af3f34554a51d8cc28b069b14"><enum>(ii)</enum><text>by striking <quote>he determines</quote> and inserting <quote>the President determines</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id568944a801644e5983823b4c3de36dfa"><enum>(iii)</enum><text>by striking <quote>In addition to any such exemption of a particular emission source</quote> and inserting the property</header><subparagraph commented="no" display-inline="no-display-inline" id="idaeaa38908cd34dd6a70bc4d0c8ff1394"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any exemption of a particular emission source under paragraph (1)</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida1fcfe91504d42358bbcfdc7d402a126"><enum>(D)</enum><text>in the third sentence—</text><clause commented="no" display-inline="no-display-inline" id="idca43e9e864504b64959687b41732190d"><enum>(i)</enum><text>by inserting <quote>, subject to the enactment of a new joint resolution under section 330 authorizing the extension,</quote> after <quote>exemptions may</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id61d2e9187e9f42c2ac2a20cd5a82d2b8"><enum>(ii)</enum><text>by striking <quote>Any display-inline="no-display-inline" id="id73121faf3fae4f108841e9c310510a8b"><enum>(2)</enum><header>Exemption from Federal agency fleet requirements</header><text>Section 248(e) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7588">42 U.S.C. 7588(e)</external-xref>) is amended by inserting <quote>, subject to the enactment of a joint resolution under section 330 authorizing the exemption</quote> before the period at the end.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id945e60e2ded546b2ac3e42fceef92259"><enum>(3)</enum><header>Exemption from phase-out of production and consumption of certain substances</header><text>Section 604(f) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7671c">42 U.S.C. 7671c(f)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id66a68db99d1c4fd7b1568c284879a28c"><enum>(A)</enum><text>in the eighth sentence, by striking <quote>No exemption shall be granted under this paragraph due to</quote> and inserting the
