which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a report on the use of artificial intelligence with respect to access to unminimized information collected pursuant to the Foreign Intelligence Surveillance Act of 1978, and for other purposes.</official-title></form><legis-body><section id="ida689bc6fc0d6418d95971e09a2c5d996" section-type="section-one"><enum>1.</enum><header>Definition of artificial intelligence</header><text display-inline="no-display-inline">In this Act, the term <term>artificial intelligence</term> has the meaning given that term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></section><section id="id6213cc575a14446ca362ade3462eef36"><enum>2.</enum><header>Report on use of artificial intelligence</header><subsection id="idc2f22db145a04bbf95499baeee49362d"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Attorney General and the Director of National Intelligence shall jointly submit to the entities and individuals specified in subsection (c) a report describing all use of artificial intelligence with access to unminimized information collected pursuant to any section of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>).</text></subsection><subsection id="id3e1a8ec2d5c34c4a8fd47285f9aafaf0"><enum>(b)</enum><header>Contents</header><text>The report required by subsection (a) shall include, for each use of artificial intelligence included in the report, the following:</text><paragraph id="id7f02ef15aaf54c8dbfca09801a4317bd"><enum>(1)</enum><text>The name of the artificial intelligence system, if applicable, and a description of its use, function, and purpose.</text></paragraph><paragraph id="id1a12d6260e4b4d8e96aebf24864ad7b2"><enum>(2)</enum><text>A description of the testing and evaluation process prior to adoption, as well as the process for continuous monitoring of the system’s performance, including a description of mechanisms and protocols for continuous human review.</text></paragraph><paragraph id="id75bc6ed83d6e4a3495057e89b707d010"><enum>(3)</enum><text>An identification of the entity, whether an office within a government agency or a private entity, that developed, trained, initiated the training of, or intentionally modified the artificial intelligence system.</text></paragraph><paragraph id="id45355445eb3643c7b7f78217a6b68269"><enum>(4)</enum><text>A description of the data used to train or fine-tune the artificial intelligence system, including a description of the fitness of the selected model and its training data for the functions described in paragraph (1), as well as any stated limitations of the selected model indicated in documentation associated with the selected model.</text></paragraph><paragraph id="idba7027cac0154e98a58919be0b2f48f5"><enum>(5)</enum><text>An identification of—</text><subparagraph id="id43bb2385a79d42868691569450ed3be5"><enum>(A)</enum><text>when the artificial intelligence system was initially allowed access to unminimized information collected pursuant to the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>);</text></subparagraph><subparagraph id="id42c6ca82af044074882b9866f2cfdac1"><enum>(B)</enum><text>what access the artificial intelligence system has to that information; and</text></subparagraph><subparagraph id="ida61d571f3df54b7e9203f2027c1a0f7b"><enum>(C)</enum><text>any additional data sources the artificial intelligence system uses for operation in the functions identified in paragraph (1).</text></subparagraph></paragraph><paragraph id="id8c9b38f9d52a47f7bf3b753766906653"><enum>(6)</enum><text>Whether the use of the artificial intelligence system has previously been reported to the entities and individuals specified in subsection (c) and, if so, whether the Foreign Intelligence Surveillance Court has issued any orders or opinions regarding the use of the artificial intelligence, including as part of minimization or targeting procedures.</text></paragraph><paragraph id="idfda119da5f6e4241b820c60cc0b5ff60"><enum>(7)</enum><text>Any additional information determined necessary by the Attorney General or the Director of National Intelligence.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf4708060c33c4f1fb02d1ca5bc78629b"><enum>(c)</enum><header>Entities and individuals specified</header><text>The entities and individuals specified in this subsection are—</text><paragraph commented="no" display-inline="no-display-inline" id="id155277bf3fb6413293870a50906aadef"><enum>(1)</enum><text display-inline="yes-display-inline">the congressional intelligence committees (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>));</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a3f746e05af4a4799f9bef03069a916"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the Senate;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5e7bd0bca0184a3bb3bd3a7da6219766"><enum>(3)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the House of Representatives;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a1a1209adee4b379ce5fdafd34f42a7"><enum>(4)</enum><text display-inline="yes-display-inline">the presiding judge of the Foreign Intelligence Surveillance Court; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id291159a0023e4c29aab7ac3a3463e6f3"><enum>(5)</enum><text display-inline="yes-display-inline">the presiding judge of the Foreign Intelligence Surveillance Court of Review.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddb1737bca8de4715af05e217b162f747"><enum>(d)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified and classified form.</text></subsection><subsection id="idaca5dd94b9e1497784df5a486c918848"><enum>(e)</enum><header>Public availability</header><text>The unclassified version of the report required by subsection (a) shall be made publicly available on the websites of the Department of Justice and the Office of the Director of National Intelligence.</text></subsection></section><section id="id3c1d8b5ef9614bca830c62b6f1360a45"><enum>3.</enum><header>Requirement relating to use of artificial intelligence</header><text display-inline="no-display-inline">Before providing any future artificial intelligence system with access to unminimized information collected pursuant to any section of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), the Attorney General and the Director of National Intelligence shall jointly provide to the entities and individuals specified in section 2(c) the following:</text><paragraph id="id903808550ea747d2a7b2160ba4bf6a87"><enum>(1)</enum><text>A notification describing the proposed name, function, and access to information of the artificial intelligence system.</text></paragraph><paragraph id="idf1761c38d2214094a7f48e8e8d807077"><enum>(2)</enum><text>An assessment of whether such use of the artificial intelligence complies with the Foreign Intelligence Surveillance Act, existing procedures or opinions adopted or issued by the Foreign Intelligence Surveillance Court, and any other applicable laws, directives, and regulations.</text></paragraph></section></legis-body></bill>
