<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4398</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260427">April 27, 2026</action-date><action-desc><sponsor name-id="S378">Mr. Lankford</sponsor> (for himself and <cosponsor name-id="S410">Ms. Lummis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require new State-issued driver's licenses and identification cards to indicate whether or not the holder is a United States citizen in order to be acceptable for Federal recognition and to establish minimum requirements for Federal recognition of State-issued commercial driver's licenses and non-domicile commercial driver's licenses.</official-title></form><legis-body><section id="id2977cfc5294548d0b7b6e4ba1141e642" section-type="section-one"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Citizenship Documented License Act</short-title></quote> or the <quote><short-title>CDL Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="idc49a21fa97e0482ba4929b05ec9cb398"><enum>2.</enum><header display-inline="yes-display-inline">Requirement for Federally-recognized driver's licenses and identification cards to indicate whether the holder is a United States citizen</header><subsection commented="no" display-inline="no-display-inline" id="ide1feed40d8984bac884f1b3472550fb9"> <enum>(a)</enum> <header display-inline="yes-display-inline">In general</header> <text display-inline="yes-display-inline">Section 202(b) of the REAL ID Act of 2005 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/109/13">Public Law 109–13</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/30301">49 U.S.C. 30301</external-xref> note) is amended by adding at the end the following:</text>

 </subsection><subsection id="ide4e86f61ef0d4c9585996b578aa7aadb" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date; applicability</header><text display-inline="yes-display-inline">The requirement described in section 202(b)(10) of the REAL ID Act of 2005, as added by subsection (a), shall only apply to State-issued driver's licenses and identification cards issued on or after the date that is 60 days after the date of the enactment of this Act.</text></subsection></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="idfe4c6b6e467f4b4b81e93653fbd85227"><enum>3.</enum><header display-inline="yes-display-inline">Minimum requirements for commercial driver's licenses and non-domicile commercial driver's licenses to warrant Federal recognition</header><text display-inline="no-display-inline">Title II of the REAL ID Act of 2005 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/109/13">Public Law 109–13</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/30301">49 U.S.C. 30301</external-xref> note) is amended by inserting after section 202 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbddd6c3cba524915a20a040e185c016b"><section commented="no" display-inline="no-display-inline" id="ide434dbe5734d4583be1975b36c274a5d"><enum>202A.</enum><header>Minimum requirements for commercial driver's licenses and non-domicile commercial driver's licenses to warrant Federal recognition</header><subsection commented="no" display-inline="no-display-inline" id="id7c5307111c8646aaba7bf94db2387457"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (b), a Federal agency may not accept, for any official purpose, a commercial driver's license issued by a State to any person unless the State, before issuing such a license—</text><paragraph commented="no" display-inline="no-display-inline" id="id3af8ce4bd2a7476d8c1a54858c24f782"><enum>(1)</enum><text display-inline="yes-display-inline">required the person to present, and verified the validity of, the information described in section 202(c)(1); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60d2c090e8434ed6866334f637dbceae"><enum>(2)</enum><text display-inline="yes-display-inline">has verified the person is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3c65c3f6f5d2495395bfc6898b1ab99b"><enum>(A)</enum><text display-inline="yes-display-inline">a national of the United States (as defined in section 101(a)(22) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id048ad694eead4348a154f1564b9a0bef"><enum>(B)</enum><text>an alien lawfully admitted for permanent residence (as defined in section 101(a)(20) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(20)</external-xref>)); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8fb653fbff144cf2a3daf654311e01a2"><enum>(C)</enum><text>a nonimmigrant described in subparagraph (E)(ii), (H)(ii)(a), or (H)(ii)(b) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) who is in possession of a valid, unexpired nonimmigrant visa issued to such nonimmigrant.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida93ba0d4090b47feb3dc6dbdff3e4dfb"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The provisions relating to minimum issuance standards set forth in clauses (v) through (ix) of subparagraph (B) and subparagraph (C) of section 202(c)(2) shall not apply to the issuance of a commercial driver's license under subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
