<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4397</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260427">April 27, 2026</action-date><action-desc><sponsor name-id="S423">Mr. Ricketts</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Toxic Substances Control Act to improve transparency of the regulatory process and coordination of science among Federal agencies, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sound Science Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idea869594959c4bd38f51bd700542f8f5"><enum>2.</enum><header>Testing</header><subsection id="HF8A814496D3B456FBB83CEA7C2557E16" commented="no"><enum>(a)</enum><header>Testing requirement rule, order, or consent agreement</header><text>Section 4(b)(1)(B) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2603">15 U.S.C. 2603(b)(1)(B)</external-xref>) is amended—</text><paragraph id="H67754E67193648D895C3A5D60C0D94E1"><enum>(1)</enum><text>by striking <quote>methodologies</quote> and inserting <quote>technically feasible methodologies</quote>; and</text></paragraph><paragraph id="H8A185B5F1242495586152743236C2D76" commented="no"><enum>(2)</enum><text>by inserting <quote>the intended and known purposes to be manufactured, processed, distributed in commerce, used, or disposed of for</quote> after <quote>the development of information for</quote>.</text></paragraph></subsection><subsection id="HFAE9A56F636C4CD791D67C5A2EB18124"><enum>(b)</enum><header>Required actions</header><text display-inline="yes-display-inline">Section 4(f) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2603">15 U.S.C. 2603(f)</external-xref>) is amended, in the undesignated matter following paragraph (2), by striking <quote>, made without consideration of costs or other nonrisk factors,</quote>.</text></subsection><subsection id="H42CE20FCD2B4459D89F1481D946A4F56"><enum>(c)</enum><header>Testing modernization</header><text>Section 4(h) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2603">15 U.S.C. 2603(h)</external-xref>) is amended—</text><paragraph id="H1AE0463835D241BC9EC4CC714B907722"> <enum>(1)</enum> <text>in paragraph (1)(B)(i), by inserting <quote>, including by requiring the use of relevant Test Guidelines that are published by the Organisation for Economic Cooperation and Development and identified by the Administrator and included on the list under paragraph (2)(C)</quote> before the semicolon; and</text>
 </paragraph><paragraph id="H2652727CBED942F296B4A0752611FDCE"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H09D893AF9CAA480984B440307474359D"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>on a regular basis</quote> and inserting <quote>at least once every 2 years</quote>; and</text></subparagraph><subparagraph id="H0051D9A2A6D24A7C997609A49B8C0F22" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D)—</text><clause id="HDD30678876DF4A56B2F8560E547FDA03" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>public notice and comment on the contents of the plan</quote> and inserting the following:</text><quoted-block style="OLC" id="H347B98DBE8E5477983F51CE7BF51582A" display-inline="yes-display-inline"><text>public notice and comment on—</text><clause id="H819DABBC72AC4516B6C7BA9AD2A55082"><enum>(i)</enum><text>the contents of the plan</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="HD7015642A7EB4FDC9C90DA332ADEC774"><enum>(ii)</enum><text>in clause (i) (as so designated), by adding <quote>and</quote> after the semicolon at the end; and</text></clause><clause id="H63299B4516DC426795418240147B1FE7" commented="no"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H20FB830EC7B34C26B4EDC21FF231147C" display-inline="no-display-inline"><clause id="HDA6FC0DEA0304FC690ABB045D72E6FD0" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the test methods and strategies proposed to be identified pursuant to subparagraph (C) for inclusion on the list under such subparagraph;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id38c01634cfdb44ecb6a84a10a49bac0b"><enum>3.</enum><header>Consistency among existing requirements and among Federal department risk information</header><subsection id="HC234093E87314DF2895F7476A7531C0F"><enum>(a)</enum><header>Scope of regulation</header><text display-inline="yes-display-inline">Section 6(a) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>apply one or more of the following requirements to such substance or mixture to the extent necessary so that the chemical substance or mixture no longer presents such risk:</quote> and inserting <quote>apply, to the extent necessary, one or more of the following requirements to such substance or mixture in order to minimize, to the extent reasonably feasible, such risk of injury to health or the environment:</quote>.</text></subsection><subsection id="HABAB56CA11BA42DF9E5578C9FFADF52F" commented="no"><enum>(b)</enum><header>Risk evaluations</header><text>Section 6(b)(4) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(b)(4)</external-xref>) is amended—</text><paragraph id="H67D7918938A344249C5DD0CD363CE976" commented="no"><enum>(1)</enum><text>in subparagraph (F)—</text><subparagraph id="HB270941F96FF44F7BFD296B64DCC5343" commented="no"><enum>(A)</enum><text>by striking clause (ii) and inserting the following:</text><quoted-block id="H486AC52FF61D473BA7D229BF2EFBEC81" style="OLC"><clause id="H846A65ADCA284DBEA9456B6E69B09BCD" commented="no"><enum>(ii)</enum><text>consider—</text><subclause id="H69E3381D73514F79981F5CCF335C72CA" commented="no"><enum>(I)</enum><text>only hazards and exposures that are more likely than not to result in an unreasonable risk of injury to health or the environment;</text></subclause><subclause id="HD7821DA439D94EE48565C4AF2C7C4235" commented="no"><enum>(II)</enum><text>sentinel exposures to the chemical substance; and</text></subclause><subclause id="H394FA3302DA14407B7DF5BC879C0334D" commented="no"><enum>(III)</enum><text>aggregate exposures only if the Administrator issues a written determination that such consideration is necessary to provide greater clarity or precision in the risk evaluation;</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H06C1CB96E0334C87B02DF3E0B11AA6F7" commented="no"><enum>(B)</enum><text>in clause (iv), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="HE11D36C8EE0A435587FAB97D428B6523" commented="no"><enum>(C)</enum><text>in clause (v), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H267F8D37E9474E2DA2B4B8A8173F766C" commented="no"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="H257984772ACB458D8937ACCCD075D3B4" style="OLC"><clause id="H06AF20D2414847A1B3CF9240AC4F93DE" commented="no"><enum>(vi)</enum><text>consider any exposure limits or thresholds relating to the chemical substance developed by another Federal department or agency under any applicable law or regulation; and</text></clause><clause id="H704A53ABB0EA47FAB29EB89E6DE600D6" commented="no"><enum>(vii)</enum><text display-inline="yes-display-inline">not assume noncompliance with any such applicable law or regulation relating to the chemical substance, including any occupational safety and health standard promulgated under section 6 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655</external-xref>) relating to the chemical substance.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA7CE001A550C4589B95CE1E7A68EEB9C" commented="no"><enum>(2)</enum><text>in subparagraph (H), by striking <quote>30 days</quote> and inserting <quote>60 days</quote>; and</text></paragraph><paragraph id="H74E24ABE0E78439AAC51F4DEB0D0D20D" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H8CC30CDB999547CABE7C26B33C23E9FD" style="OLC"><subparagraph id="HBFFB9D346BF34EFDA82715DEE5F49A42" commented="no"><enum>(I)</enum><header>Interagency review</header><text display-inline="yes-display-inline">In conducting a risk evaluation under this subsection, the Administrator shall provide a process for Federal departments and agencies to submit information and feedback on critical uses, alternatives, and supply chain impacts, including by providing not less than 30 days to submit comments on the draft risk evaluation prior to providing public notice and an opportunity for comment in accordance with subparagraph (H).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H46CA9A8F876C4E8E91634B567AB35585"><enum>(c)</enum><header>Promulgation of subsection (a) rules</header><text>Section 6(c)(2) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(c)(2)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text><quoted-block id="H5847CDBDC8464756B52953222B812449" display-inline="no-display-inline" style="OLC"><subparagraph id="HC352520039584BA2A87F393A74353603" commented="no"><enum>(B)</enum><header>Selecting requirements</header><text display-inline="yes-display-inline">In selecting among requirements under subsection (a), the Administrator shall—</text><clause id="H50D579D4202A46049F1AEEABCA71D93C" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">factor in, to the extent practicable—</text><subclause id="H76DFBC271C284AFF9FC4974E25D58E53" commented="no"><enum>(I)</enum><text>the considerations under subparagraph (A), in accordance with subsection (a); and</text></subclause><subclause id="H98C76985052C42598E6C8690262CBB0E" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">any occupational safety and health standards promulgated under section 6 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655</external-xref>) relating to the chemical substance; and</text></subclause></clause><clause id="HF607FD2D25CB47A1879FA88135E98448" commented="no"><enum>(ii)</enum><text>select those requirements that, to the extent applicable—</text><subclause id="H34834BC5E8BB47E1B4C1450339F639E1" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">are cost-effective in relation to the minimization of the unreasonable risk; and</text></subclause><subclause id="H3A52BC49604440FBB7618E47E60B0C13" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>do not result in the creation of greater risks for health or the environment.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idd6ce596371fb4c98842bcf58b7935f6b"><enum>(d)</enum><header>Reasonably available information</header><text display-inline="yes-display-inline">Section 26(k) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2625">15 U.S.C. 2625(k)</external-xref>) is amended by inserting <quote>and the existing requirements, prohibitions, and restrictions for the chemical substance or mixture under the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>) (including regulations promulgated under that Act)</quote> before the period at the end.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id22fc696d6374457e8333c536955307f9"><enum>4.</enum><header>Improving accountability of final agency actions</header><text display-inline="no-display-inline">Section 6(i)(2) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(i)(2)</external-xref>) is amended by inserting <quote>and any scientific assessment relied on by the Administrator in conducting a risk evaluation for that chemical substance under subsection (b)</quote> after <quote>environment</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id63371606f3184397b14f595bf374d445"><enum>5.</enum><header>Strengthening scientific standards</header><text display-inline="no-display-inline">Section 26 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2625">15 U.S.C. 2625</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idff19605e403a413fbb53f0c997b39022"><enum>(1)</enum><text>in subsection (h)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id96717c0a614541babdad73254e301edd"><enum>(A)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id558a63738a44450db0d9443e2bf4c439"><enum>(B)</enum><text>in paragraph (5), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="id00bb5aaff26d42f192a90052e5fc7d2c"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="id1EF5A81174B4487595124A714BF8BC56" style="OLC" act-name=""><paragraph id="id73EA5A1F7ED74226B6BE552480D7D50C"><enum>(6)</enum><text>if the Administrator is relying on the scientific standards described in this subsection or the weighting described in subsection (i), the extent to which any draft or final scientific assessment or risk evaluation developed by the Administrator is consistent with those standards or that weighting;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2df0dd21eb014b28a39e3bb1ea322dfc"><enum>(7)</enum><text display-inline="yes-display-inline">to the extent that the Administrator establishes any worker protection standards, the results of consultations with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5d7227c8c5114ba18dbb07cc4b36b313"><enum>(A)</enum><text display-inline="yes-display-inline">other Federal departments and agencies, including the Occupational Safety and Health Administration; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id827c73e5fcef45e291d33f62716828cd"><enum>(B)</enum><text display-inline="yes-display-inline">to evaluate the need for a unique worker protection standard established by the Administrator, trained experts in industrial hygiene, toxicology, engineering, and process safety (including industry experts); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddd52cbdb16ab4163a01d37e93378f5fb"><enum>(8)</enum><text display-inline="yes-display-inline">the comments and expertise of other Federal departments and agencies, as provided pursuant to the interagency review process required under section 6(b)(4)(F)(viii), including the Department of Defense, the Department of Energy, the Occupational Safety and Health Administration, and the Department of Agriculture.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93e63c231a9446d299259affac5fca69"><enum>(2)</enum><text>in subsection (o), by adding at the end the following:</text><quoted-block id="id26D15CB4E98C4408936790C026EA7914" style="OLC" act-name=""><paragraph id="id5754223C878C4693BBB678B6D74B82B4"><enum>(5)</enum><header>Committee review</header><subparagraph commented="no" display-inline="no-display-inline" id="idae03bbcd14a74ee3870c0dcd7372c27a"><enum>(A)</enum><header>In-person peer review</header><text display-inline="yes-display-inline">When reviewing a risk evaluation carried out under section 6(b), the Committee shall conduct a complete in-person peer review.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf2ef92004dad46a2a2039f9e4617a383"><enum>(B)</enum><header>Period of review</header><text display-inline="yes-display-inline">In carrying out subparagraph (A), the Committee shall provide a period of not less than 30 days to allow reviewers—</text><clause commented="no" display-inline="no-display-inline" id="id7e82016c65f64571969d73cfd942fece"><enum>(i)</enum><text display-inline="yes-display-inline">to conduct peer reviews; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6c828121abe64562a68feb91cb52e10a"><enum>(ii)</enum><text display-inline="yes-display-inline">to ensure a thorough review of—</text><subclause commented="no" display-inline="no-display-inline" id="id57f020a90fd244f9a4640dbcd8f1c2fe"><enum>(I)</enum><text display-inline="yes-display-inline">the risk evaluation, including the underlying science relied on by the Administration and the risk determinations of the Administrator; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idaf9be204908d4db2873a1c809122e364"><enum>(II)</enum><text display-inline="yes-display-inline">the quality and scientific veracity of any draft or final scientific assessment relied on by the Administrator in conducting the risk evaluation.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
