<congress display="yes">119th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 4394</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act of 1968 to improve the COPS program with respect to training command-level personnel, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="idcc400dd6-fb5a-40e8-911e-527a4814209d" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Police Leadership Act</short-title></quote>.</text></section><section id="id63779ebe-67cb-4875-9035-5603be62d5cc" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Commander curriculum development</header><subsection id="id7090d1ba-285b-48b8-a30f-21d0e6b29762" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 901(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251(a)</external-xref>) is amended—</text><paragraph id="idb41aec4d-3e1c-4b5a-b1be-7d8992718285" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (32), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id7b63d8b9-5686-40ef-9a64-c4931bebf560" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (33)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id20f0672e-6445-4314-9971-dd1c04e3b8a2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfc0bd452-6fbb-46a6-88a3-3b290a7329a0" changed="not-changed"><paragraph id="id65298ab9-e4a5-4a6d-8b24-2e5c3bdcaf67" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(34)</enum><text display-inline="yes-display-inline">the term <term>command-level personnel</term> means law enforcement officers employed by a State, local, or Tribal law enforcement agency whose responsibilities include managing, directing, or overseeing law enforcement operations within a geographic subunit of the jurisdiction in which such agency has primary responsibility for law enforcement activities.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idf2e3d6a6-a4a8-4ec5-ba3c-3486a2bcaa71" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Cops program</header><text display-inline="yes-display-inline">Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd6873878-14cf-4e20-b727-489908fb4e9f" changed="not-changed"><subsection id="id0d1feb38-5ef4-48fc-93da-7da8f74f6a0a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(q)</enum><header display-inline="yes-display-inline">Training in improving police command-level personnel leadership, management, and effectiveness</header><paragraph id="ided5b6f5d-10a6-4e43-8702-31ee1845120b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Training curricula</header><subparagraph id="idb85bc6af-f028-4cc2-bb35-79ea34061cb0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subsection, the Attorney General shall develop training curricula or identify effective existing training curricula for command-level personnel relating to—</text><clause id="idcb533a81-8283-4c12-9537-fd6aef71f758" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">leadership and strategic thinking;</text></clause><clause id="idf681facb-4430-4f28-8366-77bed0d509b2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">critical incident response and management, including understanding, preparing for, and responding to the effect of critical incidents on officers and communities;</text></clause><clause id="idc7bcb1cb-9d8b-40c4-a079-94053c7de708" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">risk management;</text></clause><clause id="idc0a6de70-8803-4922-89d7-6e6470b5f0c5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">officer wellness;</text></clause><clause id="id5632850f-e815-4d6e-939b-ab9310702908" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">data analysis and data-driven policing tactics;</text></clause><clause id="idcd64b32a-519f-4f8e-95da-a75009f8ae7f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">evidence-based decision making; and</text></clause><clause id="ida92dbb92-d4ad-4f2e-920e-f87595a3ff92" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">building community trust.</text></clause></subparagraph><subparagraph id="idf01ff396-4968-46b5-aeee-ea513f1abb35" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The training curricula developed or identified under this paragraph shall include—</text><clause id="idf0aaffee-50a7-4a4a-9ef8-3abfcc4d55c9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">primarily in-person instruction and peer-to-peer learning;</text></clause><clause id="id6a6d702a-5128-4c3f-a427-23614f71cf62" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a framework for a practical, evidence-based problem solving component under which participating command-level personnel—</text><subclause id="ide2a7e5b7-db72-48b0-a416-360bb0371680" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">identify and develop a proposed solution to a leadership, operational, or management challenge relevant to personnel in the command-level personnel’s employing law enforcement agency;</text></subclause><subclause id="id04a8c5fd-7695-4eb0-ad3b-da4bffe1558c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">receive feedback from curriculum instructors and other participating command-level personnel to refine the proposed solution accordingly to meet the needs of the law enforcement agency and community served; and</text></subclause><subclause id="id636991a8-4188-4efe-8c02-f8a402ae8ba4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">present a final, implementable product emphasizing evidence-based strategies to program instructors and the command-level personnel’s district or geographic command; and</text></subclause></clause><clause id="id3535803e-0791-4ea7-9272-a0fa85eeea5b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the incorporation of pre-course and post-course assessments to measure knowledge acquisition and leadership competencies relevant to the training curricula.</text></clause></subparagraph><subparagraph id="ide1e0a7ae-dab6-4220-9ed6-12b1697a90fb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Attorney General shall develop and identify training curricula under this paragraph in consultation with relevant law enforcement agencies of States and units of local government, organizations and fraternal associations representing law enforcement officers, universities with appropriate law enforcement or leadership programs, and any other entities the Attorney General determines appropriate.</text></subparagraph></paragraph><paragraph id="id746a1dd5-7ab8-48e7-9b79-6b2c11c3bfeb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Certified programs and courses</header><subparagraph id="idf1b5a8f8-95dc-4e0b-a27f-44f9d653648d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which training curricula are developed or identified under paragraph (1), the Attorney General shall establish a process to—</text><clause id="id3104f936-6af5-40fe-937d-b7b6fb30c4eb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">certify training programs and courses offered to command-level personnel which incorporate 1 or more of the training curricula developed or identified under paragraph (1), or equivalents to such training curricula, which may include certifying training programs or courses offered on or before the date on which the Attorney General establishes the process; and</text></clause><clause id="id886288a7-243f-4e37-b6d0-12bede4a9218" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">terminate the certification of a training program or course that fails to meet the standards developed or identified under paragraph (1).</text></clause></subparagraph><subparagraph id="iddcc4ae11-7e94-44b8-bdb0-289bacdf6fce" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Partnerships with educational institutions</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which training curricula are developed or identified under paragraph (1), the Attorney General shall develop criteria to ensure that entities which offer training programs or courses that are certified under subparagraph (A) collaborate with educational institutions to evaluate and continuously improve the curricula and coursework of those educational institutions.</text></subparagraph></paragraph><paragraph id="id81b4e03d-3447-41a2-9838-07e4352c7330" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">List</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Attorney General completes the activities required under paragraphs (1) and (2), the Attorney General shall publish a list of law enforcement agencies of States and units of local government employing law enforcement officers who have successfully completed a course using the training curricula developed or identified under paragraph (1), or equivalents to such training curricula, which shall include—</text><subparagraph id="idbac4d46c-c9b2-460d-b53c-664ac9afbd03" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the total number of law enforcement officers that are employed by the law enforcement agency; and</text></subparagraph><subparagraph id="id8ba12dcc-2e38-4d9e-bc5d-c411e9af5d63" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the number of law enforcement officers who have completed such a course.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section><section id="id7db6c922-b04f-41e0-9d56-61f2b29e9deb" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Attorney General reports</header><subsection id="id1de50ad6-ef7f-4d43-b7aa-aa0c9a0776d9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and annually thereafter until the date that is 3 years after the date of enactment of this Act, the Attorney General shall submit to Congress a report on the activities carried out as a result of the amendments made under section 2.</text></subsection><subsection id="iddac1c81a-8dd9-4f33-9df0-ecb4d504405a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include, at a minimum, information on—</text><paragraph id="id76812ba4-e894-42b2-ab79-810f2289b999" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">steps taken by the Attorney General to develop or identify curricula under section 1701(q)(1) of the Omnibus Crime Control and Safe Streets Act of 1968, as added by section 2;</text></paragraph><paragraph id="idb7c0444d-e2e7-4b62-ad73-802f0f8036ad" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">any assessments conducted or identified by the Attorney General on the effectiveness and utilization of curricula developed or identified under section 1701(q)(1) of the Omnibus Crime Control and Safe Streets Act of 1968, as added by section 2;</text></paragraph><paragraph id="iddc32eb61-d15f-4bfa-b588-82624a5f91bf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">recommendations for curriculum updates and improvements; and</text></paragraph><paragraph id="id825c1933-af33-4507-9f7e-0dea20abb4cf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">barriers to training implementation.</text></paragraph></subsection></section><section id="idcab8dc72-4048-4683-91b1-54c4307949af" commented="no" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">GAO report</header><text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this Act, the Comptroller General of the United States shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id86409668-1f39-497b-8fc2-e4942fc83ba9" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a review of the actions taken by the Attorney General pursuant to this Act and the amendments made by this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb414e5e5-9330-4f79-89b8-32ce3ed21de1" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">submit to Congress a report on the review conducted under paragraph (1), which shall include a description of—</text><subparagraph id="idcb8cba88-964b-48c3-8f77-6c1db45bcaa1" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the process for developing and identifying curricula under section 1701(q)(1) of the Omnibus Crime Control and Safe Streets Act of 1968, as added by section 2, including the effectiveness of the consultation by the Attorney General with the agencies, associations, and organizations identified under that section; and</text></subparagraph><subparagraph id="idcfd48cbd-b85f-4023-b69f-b971e25e5cc9" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the certification of training programs and courses under section 1701(q)(2) of the Omnibus Crime Control and Safe Streets Act of 1968, as added by section 2, including the development of the process for certification and its implementation.</text></subparagraph></paragraph></section><section id="ida7a7fc2e-4ec6-4ca4-9819-c180a3fc189d" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">State certifications and training standards</header><text display-inline="no-display-inline">Nothing in this Act, or an amendment made by this Act, shall be construed to preempt or replace the authority of any State or local government, including any Peace Officer Standards and Training entity or similar certifying body, to set and enforce certification, training, or qualification standards for law enforcement officers.</text></section></legis-body><attestation><attestation-group><attestation-date date="20260610" chamber="Senate">Passed the Senate June 10, 2026.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
