Enhancement of non-defense contractor protection from reprisal for disclosure of certain information.</toc-entry></toc></section><division id="idca2477b1cedf4971889fc6c6d05136f3" style="OLC"><enum>A</enum><header>Recovering stolen funds</header><title id="idec302c4a9403482e9e932d6fd8eb1f86" style="OLC"><enum>I</enum><header>Improper Payments</header><section id="ida6b5f758b2ef4978b3ef141e43528d68" section-type="subsequent-section"><enum>1101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Stop Fraud Before Payment Act</quote>.</text></section><section id="idf0dd5460c7cc4122a41e62f4a11ca34c"><enum>1102.</enum><header>Preventing fraud in child care services</header><subsection commented="no" display-inline="no-display-inline" id="id3671160af0a248979124821095d35955"><enum>(a)</enum><header display-inline="yes-display-inline">State plan</header><text display-inline="yes-display-inline">Section 658E of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858c">42 U.S.C. 9858c</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8535fa96890648e59fb1d2b76f21ed90"><enum>(1)</enum><text>in subsection (c)(2), by adding by striking subparagraph (S) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5BC5FB290672485883AF1501815F3F8C"><subparagraph id="idbcee2ed96f204632b57e4b7324f4e529"><enum>(S)</enum><header>Attendance-based billing</header><text>The plan shall include an assurance that the lead agency will provide payment under this subchapter to a child care provider based on recorded attendance, rather than enrollment alone, in the program of the provider.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81192ba6a678462581774d50ca8a66e4"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8AEDA1BECE314019B813F6A221ACE76A"><subsection id="id61c020b3aac6440bb9b3033d6f65338c"><enum>(e)</enum><header>Timing of payment</header><text>Nothing in this subchapter shall be construed to require a lead agency to make a payment to a child care provider prior to the provision of child care services. The lead agency shall make a payment under this subchapter to such a provider as reimbursement, in a timely manner, and on the basis of the provider's provision of child care services.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8ae7f205cde3435b93af755cc6489692"><enum>(b)</enum><header>Audits</header><text>Section 658K of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858i">42 U.S.C. 9858i</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id05f6889b85b44fd0837e4cb4f29f4639"><subsection id="idfa9ca674248a4db98fa83f972556448b"><enum>(c)</enum><header>Federal audits</header><text>Each child care provider that receives a payment under this subchapter shall prepare a record of attendance in the provider's program and of the provider's provision of child care services, and maintain the record for a period of 7 years after the date of preparation of such record. The provider shall make such records available for audits by the Secretary, the Attorney General, and the Comptroller General of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id55afaa86c061491480b40f04928ea6fb"><enum>1103.</enum><header>Identifying fraud in health care services</header><subsection id="idec1f940ae1154f0fbd20673e35f9e7d2"><enum>(a)</enum><header>Medicare</header><paragraph commented="no" display-inline="no-display-inline" id="idee1e95b336744773871b6ca4f9818bd6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary of Health and Human Services shall, not later than 60 days after making a determination described in paragraph (2), notify the Inspector General of the Department of Health and Human Services of such determination.</text></paragraph><paragraph id="id3b658b1100e845abaa69b65d13ffadb0"><enum>(2)</enum><header>Determination</header><text>A determination described in this paragraph is a determination that—</text><subparagraph id="idafb1f3cc1cf44185ac27d53965dec1e3"><enum>(A)</enum><text>the aggregate amount paid under the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) for an item or service or items or services in a zip code and county or county equivalent increased by more than 100 percent in a single year; or</text></subparagraph><subparagraph id="id34add632107542c3af278df373681eb2"><enum>(B)</enum><text>the number of provider of services or suppliers (as those terms are defined under section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>)) who received payment for items or services furnished under the Medicare program increased in a zip code and county or county equivalent by more than 100 percent in a single year.</text></subparagraph></paragraph></subsection><subsection id="idb28c6e211dd842fc9c232b1847fc3d6e"><enum>(b)</enum><header>Qualified health plans under the American Health Benefit Exchanges</header><paragraph id="id25130a2d68a64f9e8127106383a6f4b8"><enum>(1)</enum><header>In general</header><text>The Secretary of Health and Human Services shall, not later than 60 days after making a determination described in paragraph (2), notify the Inspector General of the Department of Health and Human Services of such determination.</text></paragraph><paragraph id="id269a5b8638c545dea01635c3f1ebcd6d"><enum>(2)</enum><header>Determination</header><text>A determination described in this paragraph is a determination that—</text><subparagraph id="id5658a05996ce41ff8fabb68d8fbd947d"><enum>(A)</enum><text>the aggregate amount paid under all qualified health plans offered through the American Health Benefit Exchanges established under sections 1311 and 1321 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031</external-xref>, 18041) for an item or service or items or services in a zip code and county or county equivalent increased by more than 100 percent in a single year; or</text></subparagraph><subparagraph id="idca954846487243c08ef7a057bd0adae6"><enum>(B)</enum><text>the number of providers of services who received payment for items or services under such qualified health plans increased in a zip code and county or county equivalent by more than 100 percent in a single year.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95deaa89aedf4be2bec5afb2c02fd3c0"><enum>(3)</enum><header display-inline="yes-display-inline">Requirement to submit certain information</header><text>Annually, each American Health Benefit Exchange established under section 1311 or 1321 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031</external-xref>, 18041) shall collect from each qualified health plan offered through such an Exchange, and submit to the Secretary of Health and Human Services, the information necessary for the Secretary to make a determination described in paragraph (2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide326ebbb0e804445aa6b654825978d20"><enum>(c)</enum><header>Medicaid and CHIP</header><paragraph commented="no" display-inline="no-display-inline" id="id797dfd0fc1eb4eaa96a49bb5b69b51dc"><enum>(1)</enum><header display-inline="yes-display-inline">Medicaid</header><text>Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1030f8b8a6fd410381400dd5f6557b70"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><clause commented="no" display-inline="no-display-inline" id="idd51a638cd94240c48dc9f55385f77ec2"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (88), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause commented="no" display-inline="no-display-inline" id="idcfef3c32963f4085b2268fd6fa0314c6"><enum>(ii)</enum><text>in paragraph (89), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd9da61fcc2ec4e468f32c483e171fa1f"><enum>(iii)</enum><text>by adding after paragraph (89) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf15c1d7745f046ef9a577a1792b81c2a"><paragraph id="idc30aef7eb53b4c43b73e55ccef5b969a"><enum>(90)</enum><text>provide that, not later than 60 days after making a determination described in subsection (yy), the State agency shall notify the Secretary and the Inspector General of the Department of Health and Human Services of such determination.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id95bfc39e701a496eb1e46ad8376b644b"><enum>(B)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id14f37b94d6124fd498a562ace47b7149"><subsection id="id3c1fab1d90394328a24df6124ae00420"><enum>(yy)</enum><header>Determination of certain increased payments or providers in a single year</header><text>For purposes of subsection (a)(90), a determination described in this subsection is a determination that—</text><paragraph commented="no" display-inline="no-display-inline" id="id355ba4e33b4d49ea8b921961d16eaaac"><enum>(1)</enum><text display-inline="yes-display-inline">the aggregate amount paid under the State plan under this title, or under a waiver of such plan, for an item or service or items or services in a zip code and county or county equivalent increased by more than 100 percent in a single year; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f970bc58de24bdab0465ae34649b5fc"><enum>(2)</enum><text display-inline="yes-display-inline">the number of providers of items or services who received payments for items or services furnished in a zip code and county or county equivalent under such State plan or waiver increased by more than 100 percent in a single year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfb52b815c3d7417db307e7ef1c0c3cf5"><enum>(2)</enum><header>CHIP</header><text>Section 2107(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)</external-xref>) is amended by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id03a5096c85fb4d18a44edd295bfe4545"><enum>(A)</enum><text display-inline="yes-display-inline">redesignating subparagraphs (I) through (W) as subparagraphs (J) through (X), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id064bfb7f80334b9a9ee9d18ea444f3c2"><enum>(B)</enum><text>inserting after subparagraph (H) the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id55cc0edaa5e044af9f75a22f95508c71"><subparagraph id="id3e7d58e87c9f496b98a691d164680dc0"><enum>(I)</enum><text>Subsections (a)(90) and (yy) of section 1902 (relating to determination of certain increased payments or providers in a single year and notification to the Secretary and the Inspector General of Health and Human Services).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id74562e8ae61f4cbaabbc3433e5294b17"><enum>(d)</enum><header>Audit by the Inspector General of Health and Human Services</header><text>Not later than 5 years after the date of enactment of this Act, and annually thereafter, the Inspector General of Health and Human Services shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idad33cab2ffbe407782ed020e6a6e4361"><enum>(1)</enum><text display-inline="yes-display-inline">identify, based on the results of any notifications received under subsection (a) or (b), or under section 1902(a)(90) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(90)</external-xref>) or section 2107(e)(1)(I) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)(I)</external-xref>), any program or State plan or waiver (in the case of Medicaid and the State Children's Health Insurance Program) under which the aggregate amount paid for an item or service or items or services in a zip code and county or county equivalent or the number of providers of items or services or suppliers, as applicable, who received payments for items or services furnished in a zip code and county or county equivalent increased by at least 400 percent during the preceding 5-year period; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id954081d11d214ff780b3724dac9ead20"><enum>(2)</enum><text>audit any such program, State plan, or waiver.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb1200968ae66493ba1f84a1bca5568ec"><enum>(e)</enum><header>Effective date</header><paragraph commented="no" display-inline="no-display-inline" id="id0df633d755d84ce38168fd28de1f16ad"><enum>(1)</enum><header>Medicare</header><text>Subsection (a) shall take effect on the date that is 180 days after the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida492de3fe597426db1c6f6b631ffe2ba"><enum>(2)</enum><header>Qualified health plans under the American Health Benefit Exchanges</header><text>Subsection (b) shall take effect on the date that is 180 days after the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae760a5ed22a414d9aec9f3bdac7abf3"><enum>(3)</enum><header>Medicaid and CHIP</header><subparagraph commented="no" display-inline="no-display-inline" id="id066114e14dbd4197a4acf748f6772b7d"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the amendments made by subsection (c) shall take effect on the date that is 180 days after the date of enactment of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide8f45925b8894eeeb5d058c2b778b4ef"><enum>(B)</enum><header>Delay permitted if State legislation required</header><text>In the case of a State plan approved under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) or title XXI of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>) which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by the amendments made by subsection (c), the State plan shall not be regarded as failing to comply with the requirements of such title XIX or XXI (as applicable) solely on the basis of the failure of the plan to meet such additional requirements before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that ends after the 1-year period beginning with the date of enactment of this section. For purposes of the preceding sentence, in the case of a State that has a 2-year legislative session, each year of the session is deemed to be a separate regular session of the State legislature.</text></subparagraph></paragraph></subsection></section><section id="id44eee0b3e7bb4159852fbf6077e24157"><enum>1104.</enum><header>Recovering improper payments</header><subsection id="idc6b678738b144c71bc1008854bc12c32"><enum>(a)</enum><header>Guidance</header><text>The Director of the Office of Management and Budget shall prescribe guidance to all agencies (as defined in section 551 of title 5, United States Code) to ensure that all improper payments (as defined in section 3351 of title 31, United States Code) are recovered.</text></subsection><subsection id="id129551f19fdb4428b4abbb2400c0986d"><enum>(b)</enum><header>Annual Inspector General report</header><text>Section 3353(a)(1) of title 31, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id418d0e7b2f3446d9a55a6fbfda658087"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee6ad25520d34e1fa7aa5384c9bed68a"><enum>(2)</enum><text>in subparagraph (B)(iv), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbebbaf80e5f64a0092c99ff8abbdaee0"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida64e9e848d1245c6941ff67b4ced717a"><subparagraph id="idf5f5da5ef0c040fb80a417ec14518c63"><enum>(C)</enum><text>include in each report submitted under subparagraph (B) the amount of improper payments recovered by the executive agency in the fiscal year covered by the report.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></title><title id="idedb9d4ef99864578a513001dbcb45a8b" style="OLC"><enum>II</enum><header>Assisting Small Businesses Not Fraudsters</header><section section-type="subsequent-section" id="H2FEDD3C3489F4BB388AD0337EAC05E30"><enum>1201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Assisting Small Businesses Not Fraudsters Act</quote>.</text></section><section section-type="subsequent-section" id="HF959BF11155A49FC8033F569AF2470F6"><enum>1202.</enum><header>Assistance prohibited after fraud conviction</header><subsection id="HCAE6B1F5902A4B0A8A96BAC1880BEDA2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 16 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/645">15 U.S.C. 645</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H06B23B03F9814A80BE7E9DB64AC1AB6E"><subsection id="H169872CDA25B40D6A0A83B82F2305C81"><enum>(h)</enum><header>Financial assistance prohibition</header><paragraph id="H3F82F5876B2A40FFB92D60D5453BFED5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An associate of a small business concern who is finally convicted of any crime involving or relating to financial misconduct or a false statement with respect to a covered loan or grant shall be ineligible to receive any financial assistance from the Administrator, other than financial assistance under section 7(b).</text></paragraph><paragraph commented="no" id="H27669FD36ADA45829480E11305E95C16"><enum>(2)</enum><header>Business concerns</header><text display-inline="yes-display-inline">A small business concern that has as an associate an individual subject to paragraph (1) shall be ineligible to receive any financial assistance from the Administrator, other than financial assistance under section 7(b).</text></paragraph><paragraph id="H2C9D1C77DECE473C93D56106A038FFD1"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HEC0E8788FC6D4F3482CBE36C21111AF5"><enum>(A)</enum><header>Associate</header><text display-inline="yes-display-inline">The term <term>associate</term> means, with respect to a small business concern—</text><clause id="HD726AFEC60D440D5B5EE624AA7CBA8D4"><enum>(i)</enum><text display-inline="yes-display-inline">an officer, director, or owner of more than 20 percent of the equity of, or a key employee of, such small business concern;</text></clause><clause id="H5A81F0B5B831480D8EC1073719A7A762"><enum>(ii)</enum><text display-inline="yes-display-inline">any entity not less than 20 percent owned or controlled by one or more individuals referred to in clause (i); and</text></clause><clause id="H3C172BDA9E3A47DF918757ACAF6CDA29"><enum>(iii)</enum><text display-inline="yes-display-inline">any other individual or entity in control of or controlled by such small business concern, except for a licensed small business investment company (as defined in section 103(3) of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/662">15 U.S.C. 662(3)</external-xref>)).</text></clause></subparagraph><subparagraph id="H194E004D0FB7426A830B3C38D2FC5413"><enum>(B)</enum><header>Covered loan or grant</header><text>The term <term>covered loan or grant</term> means—</text><clause id="H9C76E97339844971827D9844A383058C"><enum>(i)</enum><text>a loan made under—</text><subclause id="H68670F9F096A42118DFDC5E376D0C332"><enum>(I)</enum><text>paragraph (36) or (37) of section 7(a); or</text></subclause><subclause id="H210944F54073407EBC4B9FD776B5509E"><enum>(II)</enum><text>section 7(b) in response to the COVID–19 pandemic; or</text></subclause></clause><clause id="H3C15AF6376FB48E99D094C590D97068E"><enum>(ii)</enum><text>a grant made under—</text><subclause id="H7D30735ACEB047739E00426EDEAA30CA"><enum>(I)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>); or</text></subclause><subclause id="HD7A996F9D0124C96ACC29C6087FB7413"><enum>(II)</enum><text>section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>).</text></subclause></clause></subparagraph><subparagraph id="H6F70369CA03E4CB09D47868B3DCD9DB4"><enum>(C)</enum><header>Finally convicted</header><text>The term <term>finally convicted</term> means, with respect to a person, that such person has been convicted of an offense and such conviction—</text><clause id="H18116406934E451CAE7B240A0C3A30C6"><enum>(i)</enum><text>has not been appealed and is no longer appealable because the time for taking an appeal has expired; or</text></clause><clause id="HFCDDC639282D44ACB8C47C0E08E76F67"><enum>(ii)</enum><text>has been appealed and the appeals process for such conviction is completed.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9D642290CC76472C930B1EEE39554906" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (h) of section 16 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/645">15 U.S.C. 645</external-xref>), as added by subsection (a) of this section, shall not apply to any contract or other agreement entered into by the Government prior to the date of enactment of this Act.</text></subsection></section></title><title id="id2b32d61bd32848389e07b2fcd2c32284" style="OLC"><enum>III</enum><header>Welfare Abuse and Laundering Zillions</header><section section-type="subsequent-section" id="H86665DEA1836419F9E4B0943FF451EAD"><enum>1301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Welfare Abuse and Laundering Zillions Act</quote> or the <quote>WALZ Act</quote>.</text></section><section id="H8E4496F5764242E69CD5F9F17832C3F7" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>1302.</enum><header>Requiring investigations of certain payment increases under State programs funded by the Department of Health and Human Services</header><text display-inline="no-display-inline">In the case that the total amount paid to providers of services and suppliers under a State program that receives Federal financial assistance administered by the Secretary of Health and Human Services during any 6-month period increases by 10 percent or more as compared to that amount during the prior 6-month period, the Inspector General of the Department of Health and Human Services shall open an investigation into such program.</text></section></title><title id="id1272052647344d1da8ead3a4ae5a01ae" style="OLC"><enum>IV</enum><header>Returning Unspent COVID Funds</header><section id="id48a241ab9fec4231af362c1f97bcea49" section-type="subsequent-section"><enum>1401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Returning Unspent COVID Funds Act</quote>.</text></section><section id="idd00950c085714bcda760569b739407ed" section-type="subsequent-section"><enum>1402.</enum><header>Rescission of unused COVID funding</header><subsection commented="no" display-inline="no-display-inline" id="ide39edff3a1ab408ebab629086540051a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (b), effective on the date of enactment of this Act, the unobligated balances of amounts made available under the following are rescinded: </text><paragraph id="id7e9eac90f50b4f92a97527f224ea4ee3"><enum>(1)</enum><text>The American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; and</text></subparagraph><subparagraph id="idCEE760B55800445FB215BEB07004C261"><enum>(D)</enum><text>the rescission of which would not be detrimental to the full execution of the purposes for which the amounts were made available.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id0C811E2A912A40D8B4BD567F2C0A9FAA"><enum>(2)</enum><header>Authority</header><text>Section 4512 of title 5, United States Code, is amended—</text><subparagraph id="id72ACF334D86D400CB382B7B39811F1AC"><enum>(A)</enum><text>in subsection (a)—</text><clause id="idE8D680A57F494E5B9F3738C3297ADDF7"><enum>(i)</enum><text>in the matter preceding paragraph (1), by inserting <quote>or identification of surplus salaries and expenses funds</quote> after <quote>mismanagement</quote>;</text></clause><clause id="id1781FB03F8CD4465A0C07A0B3BA397DD"><enum>(ii)</enum><text>in paragraph (2), by inserting <quote>or identification</quote> after <quote>disclosure</quote>; and</text></clause></subparagraph><subparagraph id="idB457583AACFA41299159549CC8A53F55"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE215EA97DA1E427294E3D409EAFD029D"><subsection id="id2BBBDA0A494F4D22B81596790CEA9A33"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idC1F03E9C0A14464BB8632F2A9A54919D"><enum>(1)</enum><text>The Inspector General of an agency or other agency employee designated under subsection (b) shall refer to the Chief Financial Officer of the agency any potential surplus salaries and expenses funds identified by an employee that the Inspector General or other agency employee determines meet the requirements under subparagraphs (B) and (D) of section 4511(a)(2), along with any recommendations of the Inspector General or other agency employee.</text></paragraph><paragraph id="idA1AA5A821B0D4FE394ABBE3310B5CE8C" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id13A8FE1166674EE7A3D697F2B40463CA"><enum>(A)</enum><text>If the Chief Financial Officer of the agency determines that potential surplus salaries and expenses funds referred under paragraph (1) meet the requirements under section 4511(a)(2), except as provided in subsection (d), the head of the agency shall transfer the amount of the surplus salaries and expenses funds from the applicable appropriations account to the general fund of the Treasury.</text></subparagraph><subparagraph id="idDCC975A927A94659A4AD6C6BBB0062CD" indent="up1"><enum>(B)</enum><text>Any amounts transferred under subparagraph (A) shall be deposited in the Treasury and used for deficit reduction, except that in the case of a fiscal year for which there is no Federal budget deficit, such amounts shall be used to reduce the Federal debt (in such manner as the Secretary of the Treasury considers appropriate).</text></subparagraph></paragraph><paragraph id="idE8C5C4239C9044A594223F271A313782" indent="up1"><enum>(3)</enum><text>The Inspector General or other agency employee designated under subsection (b) for each agency and the Chief Financial Officer for each agency shall issue standards and definitions for purposes of making determinations relating to potential surplus salaries and expenses funds identified by an employee under this subsection.</text></paragraph></subsection><subsection id="id425273D7D0FF41118FAF73DB30F93AB3"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id52BB38A51256419A9BD9BED2C2437617"><enum>(1)</enum><text>The head of an agency may retain not more than 10 percent of amounts to be transferred to the general fund of the Treasury under subsection (c)(2).</text></paragraph><paragraph id="idDF493C8252C64046A2093C86BBFFFC93" indent="up1"><enum>(2)</enum><text>Amounts retained by the head of an agency under paragraph (1) may be—</text><subparagraph id="id21D4A08D0C55497A897A074FB0277736"><enum>(A)</enum><text>used for the purpose of paying a cash award under subsection (a) to 1 or more employees who identified the surplus salaries and expenses funds; and</text></subparagraph><subparagraph id="id0EE767618CE04FFCB952B038B14AB6F7"><enum>(B)</enum><text>to the extent amounts remain after paying cash awards under subsection (a), transferred or reprogrammed for use by the agency, in accordance with any limitation on such a transfer or reprogramming under any other provision of law.</text></subparagraph></paragraph></subsection><subsection id="ID32179da5647f45ed84127c39a6a26cb5"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id61910360C88B45BBB9640D70AFDCD603"><enum>(1)</enum><text>Not later than October 1 of each fiscal year, the head of each agency shall submit to the Secretary of the Treasury a report identifying the total savings achieved during the previous fiscal year through disclosures of possible fraud, waste, or mismanagement and identifications of surplus salaries and expenses funds by an employee.</text></paragraph><paragraph id="id6F53074CD59F4492A03D739B7B44D025" indent="up1"><enum>(2)</enum><text>Not later than September 30 of each fiscal year, the head of each agency shall submit to the Secretary of the Treasury a report that, for the previous fiscal year—</text><subparagraph id="IDe653f36a6c5047dba21ec97b86a79eae"><enum>(A)</enum><text>describes each disclosure of possible fraud, waste, or mismanagement or identification of potentially surplus salaries and expenses funds by an employee of the agency determined by the agency to have merit; and</text></subparagraph><subparagraph id="IDc2cfd08fcc044a4ebb968b9e4d63befc"><enum>(B)</enum><text>provides the number and amount of cash awards paid by the agency under subsection (a).</text></subparagraph></paragraph><paragraph id="IDb03ee892caaa4de7a276e8b74492a7af" indent="up1"><enum>(3)</enum><text>The head of each agency shall include the information described in paragraphs (1) and (2) in each budget request of the agency submitted to the Office of Management and Budget as part of the preparation of the budget of the President submitted to Congress under section 1105(a) of title 31.</text></paragraph><paragraph id="IDadbdb4df30a74598b2e57b8a7c9b3b3e" indent="up1"><enum>(4)</enum><text>The Secretary of the Treasury shall submit to the Committee on Appropriations of the Senate, the Committee on Appropriations of the House of Representatives, and the Government Accountability Office an annual report on Federal cost saving and awards based on the reports submitted under paragraphs (1) and (2).</text></paragraph></subsection><subsection id="ID4177e92bad5f4f1499a642ce80e2643b"><enum>(f)</enum><text>The Director of the Office of Personnel Management shall—</text><paragraph id="idB686D699EC0545FEB5A4795B3EB36CB7"><enum>(1)</enum><text>ensure that the cash award program of each agency complies with this section; and</text></paragraph><paragraph id="id1314E3D990234F27B7545E972E901A0D"><enum>(2)</enum><text>submit to Congress an annual certification indicating whether the cash award program of each agency complies with this section.</text></paragraph></subsection><subsection id="id01341A8788784ABF8CDB83D2D34F67F4"><enum>(g)</enum><text>Not later than 3 years after the date of enactment of this subsection, and every 3 years thereafter, the Comptroller General of the United States shall submit to Congress a report on the operation of the cost savings and awards program under this section, including any recommendations for legislative changes.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id97AFFAC5D5534DFABA69CCDC65DD99E7"><enum>(3)</enum><header>Technical and conforming amendment</header><text>The table of sections for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/45">chapter 45</external-xref> of title 5, United States Code, is amended by striking the item relating to section 4511 and inserting the following:</text><quoted-block style="OLC" id="id51685b1e-b69c-442c-a254-783706846181"><toc><toc-entry level="section">4511. and</text></clause><clause id="H03A38DFFBA894B779EC8D324BED54DDF"><enum>(ii)</enum><text display-inline="yes-display-inline">each program and activity whose improper payment amounts and rates did not change over such years; and</text></clause></subparagraph><subparagraph id="H775B78AC76F44BA1A0A2FA0752367BA5" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any corrective actions, including any such action in any corrective action plan under section 3352(d), with respect to such programs and activities that are incomplete, and steps the executive agency will take to address issues relating to improper payment amounts and rates.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></title></division><division style="OLC" commented="no" level-type="subsequent" id="idb9efda3613474d5485c632733d39e336"><enum>B</enum><header>Protecting taxpayers</header><title id="id91250d5d9078493cb645d398fb653726" style="OLC"><enum>I</enum><header>Strengthening TANF Program Integrity</header><section id="id3178adcba62645df9dd63c89e93837b9"><enum>2101.</enum><header>Strengthening program integrity by measuring improper payments</header><subsection id="H0848D675BD62497292C76C5A278390F7"><enum>(a)</enum><header>Applicability of improper payments laws</header><text display-inline="yes-display-inline">Section 404 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/604">42 U.S.C. 604</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H269D1C58623C4A9A960D96D9503DEAA7"><subsection id="HE3EEEC286530485EABD28969206A565C"><enum>(l)</enum><header>Applicability of improper payments laws</header><paragraph id="H15117B151E3345D29C90D8CA3B9FDE06"><enum>(1)</enum><header>In general</header><text>The Improper Payments Information Act of 2002 and the Improper Payments Elimination and Recovery Act of 2010 shall apply to a State in respect of the State program funded under this part and any other State program funded with qualified State expenditures (as defined in section 409(a)(6)(B)(i)) in the same manner in which such Acts apply to a Federal agency.</text></paragraph><paragraph id="HEB664ABB77144172A5C38612A82CA41A"><enum>(2)</enum><header>Regulations</header><text>Within 2 years after the date of the enactment of this subsection, the Secretary shall prescribe regulations governing how a State reviews and reports improper payments under the State program funded under this part and any other State program funded with qualified State expenditures (as defined in section 409(a)(6)(B)(i)).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCC4887AE5F2C4044B38BF6FAA5EA9559" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report to Congress</header><text>Within 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services shall submit to the Congress a written report that contains a plan to reduce or eliminate improper payments made by States under part A of title IV of the Social Security Act within 10 years.</text></subsection></section><section id="H47A847B994DA406896B2FC7454AE7AA8"><enum>2102.</enum><header>Prohibition on State diversion of Federal funds to replace State spending</header><text display-inline="no-display-inline">Section 408(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEACE9109382A4073A1CA5B74219D437A"><paragraph id="H717C0CE1DB17433E81100BDFE75F3C70"><enum>(13)</enum><header>Non-supplantation requirement</header><text display-inline="yes-display-inline">Funds made available to a State under this part shall be used to supplement, not supplant, State general revenue spending on activities described in section 404.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF6273E470B7B45A2848659F5B1006717"><enum>2103.</enum><header>Aligning and improving data reporting</header><subsection id="H9988B9BAE412444B92FEA97CF4FBE2AD"><enum>(a)</enum><header>Requirement that States report full-population data</header><text display-inline="yes-display-inline">Section 411(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611(a)(1)</external-xref>) is amended—</text><paragraph id="H43F979A5D53347FE9AFB80EA65D57549"><enum>(1)</enum><text>by striking subparagraph (B);</text></paragraph><paragraph id="H03AFFCAC16F448BC93A2706A4ABDED18"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>(1) <header-in-text level="paragraph" style="OLC">General reporting requirement.—</header-in-text></quote>; and</text></clause><clause id="H09E947A17EA14D538169EACD3022F95C"><enum>(v)</enum><text display-inline="yes-display-inline">subclauses (I) through (V) of clause (xvi) as clauses (i) through (v), respectively; and</text></clause></subparagraph><subparagraph id="H4A0BBDD5837B4BAFBA0897C6105ADABD"><enum>(B)</enum><text>moving each such redesignated provision 2 ems to the left.</text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HFB2E55911EF64226A6F90E2FAAB992D1"><enum>(b)</enum><header>Report on participation in work activities</header><text display-inline="yes-display-inline">Section 411(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611(a)(1)</external-xref>), as amended by subsection (a)(3) of this section, is further amended by striking subparagraphs (K) and (L) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HABBBACE26FBF4EF99AA171B1253A2625"><subparagraph id="HED70D77E32894024B9AFB1DDC78DF1C9"><enum>(K)</enum><text display-inline="yes-display-inline">The work eligibility status of each individual in the family, and—</text><clause id="H715A859AFCA940E3BDBF6CB695A7BCB8"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of each work-eligible individual (as defined in the regulations promulgated pursuant to section 407(i)(1)(A)(i)) in the family, the number of hours (including zero hours) per month of participation in work activities (as defined in section 407(d)); and</text></clause><clause id="HDF7653AE9ED34DC88EE6BC5BEAB9828B"><enum>(ii)</enum><text>in the case of each individual in the family who is not a work-eligible individual (as so defined), the reason for that status.</text></clause></subparagraph><subparagraph id="H30C8892499004E198C1003147C3D6CF8"><enum>(L)</enum><text>For each work-eligible individual (as so defined) and each adult in the family who did not participate in work activities (as so defined) during a month, the reason for the lack of participation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2EF01BA1ECA44C999DAEEF2F80143D04"><enum>(c)</enum><header>Reporting of information on employment and earnings outcomes</header><text>Section 411(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611(c)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5B005A18D1EA469CB49831AED57E322D"><subsection id="H418C1E98816A4E619BCD8E3A96D333D0"><enum>(c)</enum><header>Reporting of information on employment and earnings outcomes</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Labor, shall determine the information that is necessary to compute the employment and earnings outcomes and the statistical adjustment model for the employment and earnings outcomes required under section 407, and each eligible State shall collect and report that information to the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="HC7C4CB9D921F4013BA4408A1B518EB44"><enum>2104.</enum><header>Technical corrections to data exchange standards to improve program coordination</header><subsection id="H8037EF6296314553B2BC9D7A8BE345CB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 411(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611(d)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6073086E84A94E388B41FF8FA598E41C"><subsection id="H82B06218A307466396FDCA563E78A306"><enum>(d)</enum><header>Data exchange standards for improved interoperability</header><paragraph id="H5E691C5B4304464DB7DB64A3468CD46C"><enum>(1)</enum><header>Designation</header><text display-inline="yes-display-inline">The Secretary shall, in consultation with an interagency work group established in consultation with the Office of Management and Budget and considering State government perspectives, by rule, designate data exchange standards to govern, under this part—</text><subparagraph id="H66ADCA1554B0471D856ADE3DC0CBCA25"><enum>(A)</enum><text display-inline="yes-display-inline">necessary categories of information that State agencies operating programs under State plans approved under this part are required under applicable Federal law to electronically exchange with another State agency; and</text></subparagraph><subparagraph id="HF23FD607294548BCA964643C5B3BE560"><enum>(B)</enum><text>Federal reporting and data exchange required under applicable Federal law.</text></subparagraph></paragraph><paragraph id="HD64EFE0ACED14B559E57AC39BB517D23"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The data exchange standards required by paragraph (1) shall, to the extent practicable—</text><subparagraph id="HF17C84991F144290BEBF190F00296914"><enum>(A)</enum><text display-inline="yes-display-inline">incorporate a widely accepted, non-proprietary, searchable, computer-readable format, such as the eXtensible Markup Language;</text></subparagraph><subparagraph id="H5DB52068079C4FCD80948ABE8CC346A1"><enum>(B)</enum><text>contain interoperable standards developed and maintained by intergovernmental partnerships, such as the National Information Exchange Model;</text></subparagraph><subparagraph id="H3828BB09CB6542328862E51F9E9A3BC8"><enum>(C)</enum><text>incorporate interoperable standards developed and maintained by Federal entities with authority over contracting and financial assistance;</text></subparagraph><subparagraph id="HF30B08AFE6984A27A5242E37328699F0"><enum>(D)</enum><text>be consistent with and implement applicable accounting principles;</text></subparagraph><subparagraph id="H9C7EAB50202448A0BB1AF39E9FFD563D"><enum>(E)</enum><text>be implemented in a manner that is cost-effective and improves program efficiency and effectiveness; and</text></subparagraph><subparagraph id="HB9716176063845258C12E66E59338265"><enum>(F)</enum><text>be capable of being continually upgraded as necessary.</text></subparagraph></paragraph><paragraph id="H338C4DDD5C4F4C97ABB9ACB644FE0138"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to require a change to existing data exchange standards found to be effective and efficient.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H12C86C6A2D4F436F85F5F0C06AC62C24"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">Not later than the date that is 24 months after the date of the enactment of this section, the Secretary of Health and Human Services shall issue a proposed rule that—</text><paragraph id="HB01CE33686474FB9B61E9A6BEEE26900"><enum>(1)</enum><text>identifies federally required data exchanges, include specification and timing of exchanges to be standardized, and address the factors used in determining whether and when to standardize data exchanges; and</text></paragraph><paragraph id="H3B009A12640E4425874F0ABD3E593033" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>specifies State implementation options and describes future milestones.</text></paragraph></subsection></section></title><title id="id38a802076b1e4d828bfd6a90c122255b" style="OLC"><enum>II</enum><header>Restriction on United States assistance for foreign agents</header><section id="idef706ebcf18b4c298ff44fcb2fe9a00e" section-type="subsequent-section"><enum>2201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>No Funding for Foreign Agents Act</quote>.</text></section><section id="idcf57b5d0ad0a465485a7b83ef1760473"><enum>2202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="id006b746841db42f2be4e490ff2cf106c"><enum>(1)</enum><header>Agent of a covered foreign principal</header><text>The term <term>agent of a covered foreign principal</term> means—</text><subparagraph id="id86c069743612424ea9c944a603371f6c"><enum>(A)</enum><text>any person who acts as an agent, representative, employee, or servant, or in any other capacity at the order, request, or under the direction or control, of a covered foreign principal or of a person any of whose activities are directly or indirectly supervised, directed, controlled, financed, or subsidized in whole or in major part by a covered foreign principal, whether or not that person represents the interests of such foreign principal before any agency or official of the Government of the United States or engages in any official activity within the United States;</text></subparagraph><subparagraph id="id3f929b2eafbd43efa4e060def164b5b3"><enum>(B)</enum><text>any duly accredited diplomatic or consular officer of the government of a covered nation who is so recognized by the Department of State;</text></subparagraph><subparagraph id="id1bc228cd615e43b79dd9e0abc8009cba"><enum>(C)</enum><text>any official of the government of a covered nation whose duties are known by the Department of State;</text></subparagraph><subparagraph id="id867091c27cb345f89e095cc07324e3c1"><enum>(D)</enum><text>any member of the staff of, or any person employed by, a duly accredited diplomatic or consular officer of the government of a covered nation who is so recognized by the Department of State;</text></subparagraph><subparagraph id="idac8b1c28f03c41c09eb98bf734c5e17b"><enum>(E)</enum><text>any agent of a covered foreign principal who engages in lobbying activities and has registered or would be required to register under section 4 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603</external-xref>); and</text></subparagraph><subparagraph id="id93aa552699314bb6ac50b001b50cc49e" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>any person who has provided notice to the Attorney General as an agent of a foreign government or would be required to provide such notice under section 951 of title 18, United States Code.</text></subparagraph></paragraph><paragraph id="idfdd53fd541c2464db85e372d145a8bd9"><enum>(2)</enum><header>Controlled</header><text>The term <term>controlled</term> has the meaning given the term <quote>control</quote> in section 80.208 of title 31, Code of Federal Regulations, provided that any officer, executive, proprietor, director, partner, senior manager, or combination of agents who together own a majority or a dominant minority of the total outstanding voting interest, of an entity shall be understood to control it for purposes of this Act.</text></paragraph><paragraph id="idd979b9d53bc24e319d60b5433240986e"><enum>(3)</enum><header>Covered foreign principal</header><text>The term <term>covered foreign principal</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0d138411ea964f9f852329c9c3854ada"><enum>(A)</enum><text display-inline="yes-display-inline">the government of a covered nation and any political party in a covered nation;</text></subparagraph><subparagraph id="id7fc527718db647caaa00249c254bde78"><enum>(B)</enum><text>a person in a covered nation, unless such person—</text><clause commented="no" display-inline="no-display-inline" id="id0dae820f984448d5982003dce6178034"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id97357da7f4f842cbbaee2c4e58146ba6"><enum>(I)</enum><text display-inline="yes-display-inline">is an individual citizen of, and domiciled within, the United States; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9ff8bd1677a844728d9a47ea2e70dea4" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">is not an agent of a covered foreign principal; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ide3d1cce0285c41369e342a6616c38419"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id8f4ec3fa1add4dd395a4356ad8c41731"><enum>(I)</enum><text display-inline="yes-display-inline">is not an individual;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idda123dc0328a4e28a0e3eb7c527169b1" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">is organized under, or created by, the laws of the United States or of any State or other place subject to the jurisdiction of the United States;</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id623fa3c0d65b463a9d278a7e2e441629"><enum>(III)</enum><text display-inline="yes-display-inline">has its principal place of business within the United States; and</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="idb1ca268221d84990be092991be9bb06d"><enum>(IV)</enum><text>is not controlled by an agent of a covered foreign principal;</text></subclause></clause></subparagraph><subparagraph id="id82aee4bba66a4438806cb71113cff02b"><enum>(C)</enum><text>a partnership, association, corporation, organization, or other combination of persons organized under the laws of, or having its principal place of business in, a covered nation; or</text></subparagraph><subparagraph id="id9dfb7b32005b48a2805aa44f5d1b12c3"><enum>(D)</enum><text>any organization named in section 1003 of the Anti-Terrorism Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/22/5202">22 U.S.C. 5202</external-xref>).</text></subparagraph></paragraph><paragraph id="id4bf9c4eb29344022a844566638fa6b46"><enum>(4)</enum><header>Covered nation</header><text>The term <term>covered nation</term> means the Democratic People’s Republic of Korea, the People’s Republic of China, the Russian Federation, the Islamic Republic of Iran, the Islamic Emirate of Afghanistan, Burkina Faso, Myanmar (formerly known as <quote>Burma</quote>), Chad, Republic of the Congo, Equatorial Guinea, Eritrea, Haiti, Laos, Libya, Mali, Niger, Sierra Leone, Somalia, South Sudan, Sudan, Syria, or Yemen.</text></paragraph><paragraph id="idd8ae1ca890c042ddba09a1f9e5aa340e"><enum>(5)</enum><header>Direct financial assistance</header><text>The term <term>direct financial assistance</term> means financial assistance from the Government of the United States that is received by an entity selected by the Government or a pass-through entity, including any contract, grant, loan, cooperative agreement, or other agreement.</text></paragraph><paragraph id="id199fec605cfe498cb049e4e3b4b3a9f7"><enum>(6)</enum><header>Entity</header><text>The term <term>entity</term> means any partnership, association, corporation, organization, or other combination of individuals.</text></paragraph><paragraph id="id9998d10f72d34773a9f21a33fe9096c3"><enum>(7)</enum><header>Indirect financial assistance</header><text>The term <term>indirect financial assistance</term> means financial assistance from the Government of the United States that is received by a service provider which is paid by means of a voucher, certificate, or other means of Government-funded payment provided to a beneficiary who is able to choose a service provider.</text></paragraph><paragraph id="id727f89c37f0c4f66ac131b81116b2ed9" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header>Pass-through entity</header><text>The term <term>pass-through entity</term> means any entity, including a nonprofit or nongovernmental organization, acting under a contract, grant, loan, cooperative agreement, or other agreement with the Government of the United States or with a State or local government in the United States that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3132215e678f45c5a9f1055b2e0751a4"><enum>(A)</enum><text display-inline="yes-display-inline">accepts direct financial assistance as a primary recipient or grantee; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id23843cfd38b74f7ea9586d0d4c6196d8"><enum>(B)</enum><text display-inline="yes-display-inline">distributes such assistance to other organizations that provide services.</text></subparagraph></paragraph><paragraph id="id33d46d06af1c41aeb951f0ba81737c49"><enum>(9)</enum><header>Person</header><text>The term <term>person</term> means any individual, partnership, association, corporation, organization, or other combination of individuals.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id917cb880ce93434680ab4dc9e0d569c3"><enum>2203.</enum><header>Restriction on United States financial assistance</header><text display-inline="no-display-inline">Any entity that is controlled by an agent of a covered foreign principal is ineligible to receive direct financial assistance or indirect financial assistance.</text></section><section id="ida604a3875da4447f86f800d051533f70"><enum>2204.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this title may be construed to terminate—</text><paragraph commented="no" display-inline="no-display-inline" id="id9c40bd797f0841b7b15aeb8f22dcb8ee"><enum>(1)</enum><text display-inline="yes-display-inline">United States financial assistance to entities that are not controlled by an agent of a covered foreign principal; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93a90868c0fa41e3b2686e95bc7dd22a"><enum>(2)</enum><text>any foreign assistance (as defined in section 634(b)(1) of the Foreign Assistance Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/22/2394">22 U.S.C. 2394(b)(1)</external-xref>)).</text></paragraph></section></title><title id="id83c2e8304ea24008beeaeecefad969b1" style="OLC"><enum>III</enum><header>Opposing international support for the Taliban</header><section id="id2638ed2d-7740-4b37-a579-405781fcd1aa" section-type="subsequent-section" changed="not-changed"><enum>2301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>No Tax Dollars for Terrorists Act</quote>.</text></section><section id="id44920f11-7914-4435-bb82-ace14618167a" changed="not-changed"><enum>2302.</enum><header>Strategy to oppose foreign assistance by foreign countries and nongovernmental organizations to the Taliban</header><subsection id="id7831e4ed-3cf9-40be-ab5e-0e4b41eef08c" changed="not-changed"><enum>(a)</enum><header>Statement of policy</header><text display-inline="yes-display-inline">It is the policy of the United States—</text><paragraph id="ideaa627bd-e82a-46c8-b246-a992983471bc" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">to oppose the provision of foreign assistance by foreign countries and nongovernmental organizations to the Taliban, particularly those countries and organizations that receive United States-provided foreign assistance; and</text></paragraph><paragraph id="id791842dc-420f-4cc8-8d4b-0cebd1e6ae06" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">to review United States-provided foreign assistance to such foreign countries and nongovernmental organizations that have provided foreign assistance to the Taliban.</text></paragraph></subsection><subsection id="id06af99df-778c-41f2-9e1d-b30d67bbfbf2" changed="not-changed"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall submit a report to the appropriate congressional committees that identifies, to the extent possible—</text><paragraph id="idd2cb0e1e-6562-4598-86ba-234a86368f2d" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">foreign countries and nongovernmental organizations that have provided foreign assistance to the Taliban, including—</text><subparagraph id="idf00464a2-b7db-43e8-82b2-a92e80e4e020" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of United States-provided foreign assistance each country or organization receives, if any; </text></subparagraph><subparagraph id="id037e7edd-c040-4311-a900-400599bc7901" changed="not-changed"><enum>(B)</enum><text>the amount of foreign assistance each country or organization has provided to the Taliban; and</text></subparagraph><subparagraph id="id346a787b-d0d5-4742-b8b6-ce9cdb110dea" changed="not-changed"><enum>(C)</enum><text>a description of how the Taliban has utilized such foreign assistance; and</text></subparagraph></paragraph><paragraph id="id1a966087-7132-4d9f-af26-d38b1a080d2f" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">efforts the United States has taken since August 2021 to oppose foreign countries and nongovernmental organizations from providing foreign assistance to the Taliban, particularly those foreign countries and organizations that receive United States-provided foreign assistance.</text></paragraph></subsection><subsection id="id6e880642-a149-49fd-a14d-d5e082a690db" changed="not-changed"><enum>(c)</enum><header>Strategy and reports</header><paragraph id="id8a186662-82c8-453a-b9cd-6e6f53a82153" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall develop and implement a strategy to discourage foreign countries and nongovernmental organizations from providing foreign assistance to the Taliban. The strategy shall include efforts to support Afghan women and girls who are suffering under Taliban edicts, in a way that does not support the Taliban. </text></paragraph><paragraph id="id8dd374c7-54cb-424b-ae42-2a3dd9e47ac2" changed="not-changed"><enum>(2)</enum><header>Reports</header><subparagraph id="id7d13fb0e-d933-457a-bce1-c0c6fe030ab1" changed="not-changed"><enum>(A)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than the date on which the strategy required under paragraph (1) is completed, the Secretary of State shall submit a report to the appropriate congressional committees detailing the strategy and a plan for its implementation. </text></subparagraph><subparagraph id="ide93aa812-9150-47e2-bb0b-51f8e21dd231" changed="not-changed"><enum>(B)</enum><header>Subsequent reports</header><text>Not later than 180 days after the date on which the strategy required under paragraph (1) is completed, and every 180 days thereafter for the following 5 years, the Secretary of State shall submit a report to the appropriate congressional committees describing the implementation of the strategy, including the impact of the strategy in discouraging foreign countries and nongovernmental organizations from providing financial or material support to the Taliban.</text></subparagraph><subparagraph id="ideee3f071-7b06-46f1-9f0a-56208e3cf80d" changed="not-changed"><enum>(C)</enum><header>Additional report</header><clause id="id918b413a-eecc-4e76-8f48-116c96706f37" changed="not-changed"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary of State shall submit a report to the appropriate congressional committees regarding the decision to terminate the bounty on Sirajuddin Haqqani and other key members of the Haqqani Network under the Rewards for Justice program.</text></clause><clause id="id0545c08c-e4cc-4c6b-b40e-fd1a3b26e942" changed="not-changed"><enum>(ii)</enum><header>Matters to be included</header><text display-inline="yes-display-inline">The report required under clause (i) shall include the following:</text><subclause id="id09a05e22-f454-41c7-af75-2b49ad84de2a" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">The status of the bounty on Sirajuddin Haqqani, Abdul Aziz Haqqani, and Yahya Haqqani under the Rewards for Justice program and the rationale for any changes made since September 1, 2021. </text></subclause><subclause id="id7e41ed48-708a-450a-87ff-43e729ec0d44" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">An identification of members of the Haqqani Network who are Specially Designated Global Terrorists and the status of the designation of the Haqqani Network as a foreign terrorist organization. </text></subclause><subclause id="id257e1120-ffc5-4985-893b-ede011cdcace" changed="not-changed"><enum>(III)</enum><text display-inline="yes-display-inline">A description of any United States Government engagements with Sirajuddin Haqqani, Abdul Aziz Haqqani, Yahya Haqqani, or the Haqqani Network since September 1, 2021. </text></subclause><subclause id="id08fcf164-33b5-4c5b-8f76-358bc2c6cad6" changed="not-changed"><enum>(IV)</enum><text display-inline="yes-display-inline">Whether new information has emerged relating to the involvement of the Haqqani Network in terrorist attacks targeting the United States Military or United States civilians.</text></subclause></clause><clause id="idac97c7b4-df93-4b6c-ba47-d2770127650a" changed="not-changed"><enum>(iii)</enum><header>Form</header><text display-inline="yes-display-inline">The report required under clause (i) shall be submitted in unclassified form, but may include a classified annex. </text></clause></subparagraph></paragraph></subsection><subsection id="idec48a31e173a47619ff88e5b4febd8bc" changed="not-changed"><enum>(d)</enum><header>Suspension of foreign assistance</header><text>The Secretary of State shall immediately suspend all foreign assistance being sent to any country or nongovernmental organization that has provided assistance to the Taliban, as determined by the Secretary.</text></subsection></section><section id="id6d63af5d-ea4b-4e67-bfae-d7be26216be7" changed="not-changed"><enum>2303.</enum><header>Report on direct cash assistance programs in Afghanistan</header><subsection id="id3c26e581-171b-4795-9dba-0621832d7977" changed="not-changed"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall submit a report to the appropriate congressional committees regarding United States Government-funded direct cash assistance programs in Afghanistan during the period beginning on August 1, 2021, and ending on the date that is 30 days after the date of the enactment of this Act. </text></subsection><subsection id="ide4cca584-2a86-49c8-b35c-1b81034ee065" changed="not-changed"><enum>(b)</enum><header>Matters to be included</header><text>The report required under subsection (a) shall, with respect to such direct cash assistance programs, include—</text><paragraph id="id04e8bc52-c0b8-46ce-b815-6818da787fad" changed="not-changed"><enum>(1)</enum><text>a general description of the types of implementing partners and recipients; </text></paragraph><paragraph id="id9e30f5c2-6fcb-44bd-a4d4-bdb70e798648" changed="not-changed"><enum>(2)</enum><text>a description of method of payments; </text></paragraph><paragraph id="idf3460e6c-b4e6-4cc6-b37b-893b9cc56c68" changed="not-changed"><enum>(3)</enum><text>a description of how and where currency exchanges occur; </text></paragraph><paragraph id="idc7ad0b0c-e081-465b-b801-5bf7751bf462" changed="not-changed"><enum>(4)</enum><text>a description of how hawalas are used and the oversight mechanism in place regarding use of hawalas to transfer funds;</text></paragraph><paragraph id="id8d477df913ff42aea447bc80ba04a05a" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">concealment of all personally identifiable information of individuals or groups that received United States Government-funded direct cash assistance; and</text></paragraph><paragraph id="ide0ab3a46-f52b-4bb6-8279-4e73d42888ea" changed="not-changed"><enum>(6)</enum><text>a description of how oversight is conducted, including information on how the Department of State prevents the Taliban from accessing cash assistance under such programs. </text></paragraph></subsection><subsection id="id83b95202-a67f-438b-b5c3-af0c4c19d64e" changed="not-changed"><enum>(c)</enum><header>Defined term</header><text>In this section, the term <term>hawala’</term> means a system of transferring money through a network of money lending brokers.</text></subsection></section><section id="id81de82d4-7ccc-470c-b685-ff3b6b8bae6f" changed="not-changed"><enum>2304.</enum><header>Report on status of Afghan Fund</header><subsection id="idb70570bd-f042-4f11-a45c-1b371cb3b49a" changed="not-changed"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and every 180 days thereafter for the following 5 years, the Secretary of State, in consultation with the Secretary of the Treasury, shall submit a report to the appropriate congressional committees regarding the status of the Afghan Fund.</text></subsection><subsection id="id23d293d3-1be1-4b2e-bc39-312b3b8204a2" changed="not-changed"><enum>(b)</enum><header>Matters to be included</header><text>The report required under subsection (a) shall, to the extent possible, include—</text><paragraph id="id6f43f676-928b-4b7a-a31c-c0b2e0838d40" changed="not-changed"><enum>(1)</enum><text>a list of Taliban members working at Da Afghanistan Bank or serving on the Bank’s board; and </text></paragraph><paragraph id="id5992d6b9-f314-4b2b-b235-d76fb32584eb" changed="not-changed"><enum>(2)</enum><text>a description of—</text><subparagraph id="id4540e4a1-eda2-4c7f-870b-8c1e7cd09512" changed="not-changed"><enum>(A)</enum><text>the Taliban’s influence over Da Afghanistan Bank;</text></subparagraph><subparagraph id="id49aa769f-6b89-444f-abcd-bcecbee32e10" changed="not-changed"><enum>(B)</enum><text>the Afghan Fund’s board of trustees, including how the Fund’s trustees were vetted and selected, and what United States agencies were involved in the vetting and selection process; </text></subparagraph><subparagraph id="id50bef26f-f2c3-4637-b256-cd4cb38732a1" changed="not-changed"><enum>(C)</enum><text>the conditions necessary for funds in the Afghan Fund to be released to Da Afghanistan Bank;</text></subparagraph><subparagraph id="id95c6e7b4-9fce-471b-a0c3-6e1bdd04dec6" changed="not-changed"><enum>(D)</enum><text>how the Afghan Fund’s board of trustees will decide on the type and appropriateness of the Fund’s activities, including what kind of information will inform the board’s decisions and how the board will collect and verify this information; and</text></subparagraph><subparagraph id="id90bed803-4ddb-4866-bf0a-56afbfeb5681" changed="not-changed"><enum>(E)</enum><text>a description of what controls have been put into place to ensure funds are not diverted to or misused by the Taliban or other actors when the Fund begins making disbursements.</text></subparagraph></paragraph></subsection><subsection id="id248365f42acd44348c549f2be2733ce2" changed="not-changed"><enum>(c)</enum><header>Rescission of funding for Afghan reconstruction activities for deficit reduction purposes</header><paragraph commented="no" display-inline="no-display-inline" id="ida47d558b8e0d427baf71c7cfaf54099c" changed="not-changed"><enum>(1)</enum><header>Rescission</header><text display-inline="yes-display-inline">There is hereby rescinded all of the unobligated balances from the amounts appropriated or otherwise made available for reconstruction activities in Afghanistan through any of the following funds, programs, or accounts:</text><subparagraph id="id3af3b9e5ed6a4fcba94a9935ce7d3ac1" changed="not-changed"><enum>(A)</enum><text>The Afghanistan Security Forces Fund (ASFF).</text></subparagraph><subparagraph id="id8c0630845d794365bc47d85f6020b3b4" changed="not-changed"><enum>(B)</enum><text>The Economic Support Fund (ESF).</text></subparagraph><subparagraph id="id08175d48f6914c51a41bca1f3d3a9631" changed="not-changed"><enum>(C)</enum><text>International Narcotics Control and Law Enforcement (INCLE).</text></subparagraph><subparagraph id="idcf41ac1082cf499b9431df8cbe0250f3" changed="not-changed"><enum>(D)</enum><text>The Commanders’ Emergency Response Program (CERP).</text></subparagraph><subparagraph id="idf933a87b96d841798512eb445cefcd85" changed="not-changed"><enum>(E)</enum><text>Drug Interdiction and Counter-Drug Activities (DICDA).</text></subparagraph><subparagraph id="idd212a12d12c84625a028016d45c96f75" changed="not-changed"><enum>(F)</enum><text>Migration and Refugee Assistance (MRA).</text></subparagraph><subparagraph id="ide8aae91ee716412c922e45f94b0f2d83" changed="not-changed"><enum>(G)</enum><text>International Disaster Assistance (IDA).</text></subparagraph><subparagraph id="idc426da04694c4da385e402660b034bc8" changed="not-changed"><enum>(H)</enum><text>Non-Proliferation, Antiterrorism, Demining, and Related (NADR).</text></subparagraph><subparagraph id="idcbe579da690b459db1ecd8f1b514eda5" id="idd74b9878c8944093beb251010dffa50f" changed="not-changed"><enum>(2)</enum><text>ceases the taking of United States citizens as hostages and the wrongful detention or persecution of Afghans who—</text><subparagraph id="ide58e45e81af34fa28b9627e35490144c" changed="not-changed"><enum>(A)</enum><text>worked for, or on behalf of, the United States;</text></subparagraph><subparagraph id="id6485637e15ab44aa98f9821ad467beca" changed="not-changed"><enum>(B)</enum><text>served in the Government or security forces of the Islamic Republic of Afghanistan; or</text></subparagraph><subparagraph id="idde5e905d9f2f4bb5900cd8c6731b33d3" changed="not-changed"><enum>(C)</enum><text>advocated for good governance or internationally recognized human rights, including the rights of women, girls, and minority groups in Afghanistan;</text></subparagraph></paragraph><paragraph id="idc5a108afabdb429ea3398d75bad88d2c" changed="not-changed"><enum>(3)</enum><text>repeals all edicts and policies prohibiting, and takes demonstrable and consistent action to support, the education, employment, free movement, and free expression of women and girls in Afghanistan; and</text></paragraph><paragraph id="id79e378ac012740c8b1ae633340b7d8a3" changed="not-changed"><enum>(4)</enum><text>repeals all edicts and policies curtailing, and takes demonstrable and consistent action to support and respect, the rights of ethnic, religious, and other minority groups within Afghanistan, including Hazara 2026</header><section id="id882adf00c09643638e65ec963d7c3d57" section-type="subsequent-section"><enum>2401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Stop Secret Spending Act of 2026</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="iddcea03a598104c5289eb502b1f79b549"><enum>2402.</enum><header>Other transaction agreement reporting</header><subsection commented="no" display-inline="no-display-inline" Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended—</text><paragraph commented="no" of enactment of the Stop Secret Spending Act of 2026, the Secretary shall ensure that, with respect to the website established under section 2, or any successor website—</text><paragraph commented="no" display-inline="no-display-inline" id="id5db269d3a29449e99e18eef5d8629ba0"><enum>(1)</enum><text display-inline="yes-display-inline">data relating to other transaction agreements is automatically transmitted to the website<deleted-phrase reported-display-style="strikethrough">,</deleted-phrase><added-phrase reported-display-style="italic">;</added-phrase><deleted-phrase reported-display-style="strikethrough"></deleted-phrase> and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6af8e0ecd5440f9899bc6ba3f4346bf"><enum>(2)</enum><text display-inline="yes-display-inline">a centralized view of the data described in paragraph (1) is available on the website.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id2396f86b9caf43d3b36fd95518e7f02a"><enum>(c)</enum><header>Annual report on unreported funding</header><text>Section 2 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id33D488123D254FF9A95C643304848C26"><subsection id="id75d383f37fc444a18ee5b36a7530b6fb"><enum>(h)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of the Stop Secret Spending Act of 2026, and annually thereafter, the Secretary, in consultation with the Director, shall post to the website established under this section a report that includes—</text><paragraph commented="no" display-inline="no-display-inline" id="idd1305c43bd574f4fbd88826a97dd9bd4"><enum>(1)</enum><text>the total amount of Federal spending on Federal awards for which data has not been posted to the website; and</text></paragraph><paragraph id="id1dd9c334bab04dca967389d937ad4dc1"><enum>(2)</enum><text>the reason data on the Federal spending described in paragraph (1) has not been posted to the website, including whether the Federal spending was—</text><subparagraph commented="no" display-inline="no-display-inline" id="id289e0d5f733f46c1901a72e3922fc70a"><enum>(A)</enum><text>national security-related or classified;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1696c77f432b43a7a4387e00c1b6e6ee"><enum>(B)</enum><text display-inline="yes-display-inline">a grant or contract awarded or entered into by a legislative or judicial branch agency; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id850028873ffd40f2bd843ede7cde88b3"><enum>(C)</enum><text display-inline="yes-display-inline">a subaward below a primary subaward.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id3504ff88ab4a44fdabf7cb8946466e65"><enum>(d)</enum><header>Implementation plan</header><paragraph commented="no" display-inline="no-display-inline" id="id9f6e48834bf24e41a1f441f0872b6f12"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="idd0a93e0613a346a289e70bf755c6ea6a"><enum>(A)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id134dd5ad58fb4e249ae9866ebe33901e"><enum>(B)</enum><header>Relevant agency</header><text>The term <term>relevant agency</term> means a Federal agency (as defined in section 2(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note)) that has the authority to enter into an other transaction agreement, as determined by the Director.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ef30f75a88545ccb3bb9488da5bd17e"><enum>(C)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Treasury.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48f595d7bd234499b4b970869634dad1"><enum>(D)</enum><header>USAspending.gov</header><text>The term <term>USAspending.gov</term> means the website established under section 2 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddd24cf6b2d6341098d5f6a73395c1dab"><enum>(2)</enum><header>Initial compilation</header><text>If the Secretary has not yet complied with subsection (e) of section 4 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note), as added by this section, by the date that is 1 year after the date of enactment of this Act, not later than 1 year after the date of enactment of this Act, the Secretary, in coordination with the Director and the heads of relevant agencies, shall publish on USAspending.gov a report that lists and includes a detailed description of all other transaction agreements entered into by the relevant agencies for the fiscal year preceding the fiscal year during which the report is published.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd68e04d98605433e8d5953cc50e3185a"><enum>(3)</enum><header>Plan</header><text>If the Secretary has not yet complied with subsection (e) of section 4 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note), as added by this section, by the date that is 2 years after the date of enactment of this Act, not later than 2 years after the date of enactment of this Act, the Secretary, in consultation with the Director and the heads of relevant agencies, shall submit to Congress a plan that includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf234ada91a914fbc96acfc40fd348609"><enum>(A)</enum><text display-inline="yes-display-inline">the status of including data relating to other transaction agreements on USAspending.gov; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9a31b184872c47dd9535a45c824a2147"><enum>(B)</enum><text display-inline="yes-display-inline">actions underway and planned to ensure that the data described in subparagraph (A) is fully incorporated into USAspending.gov by the date that is 3 years after the date of enactment of this Act.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ide439f4bf734a4e4bbb8ca91c7a90ffde"><enum>2403.</enum><header>Other amendments</header><subsection commented="no" display-inline="no-display-inline" id="id0fab097e52ba490ea6f4f0bea575e675"><enum>(a)</enum><header display-inline="yes-display-inline">Inspector General reports</header><text display-inline="yes-display-inline">Section 6(a) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended—</text><paragraph commented="no" section 3521(f) or 9105(a)(3) of title 31, United States Code, for the applicable fiscal year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id330cd5a742b748b6bb9da02e072d729e"><enum>(b)</enum><header>Full disclosure of Federal funds</header><paragraph commented="no" display-inline="no-display-inline" id="idc61e73be106645b89f507263f8c9e123"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3 of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idece542492406411f9e1fc225e6c828f7"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><clause commented="no" display-inline="no-display-inline" id="id2a5c05ba5bf34c61ad086a444c60e2d1"><enum>(i)</enum><text display-inline="yes-display-inline">paragraph (1), in the matter preceding subparagraph (A), by striking <quote>a Federal agency or component of a Federal agency</quote> and inserting <quote>a Federal agency or a component of a Federal agency included on the list posted under subsection (e)(2)</quote>; and</text></clause><clause id="id465a475b23104395bebfe14fedc6bdcb"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary and the Director, in consultation with the heads of Federal agencies, shall establish requirements to ensure that the information to be posted under subsection (b) that is posted by a Federal agency or component of a Federal agency is complete and accurate. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf3d5372cecf64aa69f96fa94ed8f0a1e"><enum>(2)</enum><header>Federal agency responsibility</header><text>The head of each Federal agency or component of a Federal agency posting data under subsection (b) shall ensure that the data is complete and accurate.</text></paragraph><paragraph id="idec050baeec99439db3dbd49ac6f72835"><enum>(3)</enum><header>Authority to verify accuracy</header><text>The Secretary and the Director may verify that the data posted under subsection (b) by a Federal agency or component of a Federal agency are complete, accurate, and consistent. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide3c352190e764b649a1e7f461187e9ec"><enum>(d)</enum><header display-inline="yes-display-inline">Display standards</header><text>The Secretary, in consultation with the Director, shall ensure that the heads of Federal agencies that post information under subsection (b) comply with display standards established by the Secretary.</text></subsection><subsection id="id9f412ce708064578bffd854e18fb6f28"><enum>(e)</enum><header>Agency reporting determination</header><text>Not later than 1 year after the date of enactment of the Stop Secret Spending Act of 2026, and not less frequently than once every 2 years thereafter, the Secretary, in coordination with the Director, shall—</text><paragraph id="id43fc6d986c2f4110ac72cfbbc5ddb354"><enum>(1)</enum><text>assess and make a determination with respect to which Federal agencies and components of Federal agencies are required to post information under subsection (b);</text></paragraph><paragraph id="id05113eaf9fb84418a48e2ff434fd19d6"><enum>(2)</enum><text>publish a list of the Federal agencies and components of Federal agencies determined under paragraph (1) on the website established under section 2(b)(1); and</text></paragraph><paragraph id="iddae8abf965b84733b6637a5adc9c1d76"><enum>(3)</enum><text>provide to the head and inspector general of each Federal agency or component of a Federal agency included on the list published under paragraph (2) written notice of the inclusion of the Federal agency or component of a Federal agency on the list.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id94e828ed7454490cba6f180d157499f7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1)(A) shall take effect on the date on which the Secretary publishes the first list under section 3(e)(2) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note), as added by paragraph (1).</text></paragraph></subsection></section><section id="id0398770f1f2949b09ff29d20c79e712b" commented="no" display-inline="no-display-inline" title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Preventing Deep Fake Scams Act</quote>.</text></section><section section-type="subsequent-section" id="HFA391C456ED44E59B95CA011E02B4B85"><enum>3102.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H0B262F072D144D01833AD9B79CA1D937"><enum>(1)</enum><text display-inline="yes-display-inline">Artificial intelligence is being used in new and innovative ways by the financial services sector.</text></paragraph><paragraph id="HB93750E54AB34F218BD03C449D6A66D3"><enum>(2)</enum><text display-inline="yes-display-inline">Artificial intelligence may provide benefits to banks, credit unions, and banking consumers.</text></paragraph><paragraph id="H4C4BDEDD6DAC4C939D576E177787F96D"><enum>(3)</enum><text display-inline="yes-display-inline">Artificial intelligence poses unique threats to the safety and security of customer accounts.</text></paragraph><paragraph id="H6DF2CD983115428A913A8BAF3DB7826C"><enum>(4)</enum><text display-inline="yes-display-inline">Voice banking is offered by many banks for security and convenience reasons.</text></paragraph><paragraph id="HE33E935232704F4BAE378CEA8C827E30"><enum>(5)</enum><text display-inline="yes-display-inline">The popularity of social media has made video and audio of potential targets easier to obtain for bad actors. These materials can be exploited to replicate the voices and appearances of other people in pursuit of data theft, identity theft, or fraud.</text></paragraph><paragraph id="HC0179BF981C245D1B5487FD4EC51CA9A"><enum>(6)</enum><text>Bad actors could utilize deep fakes, including voice and audio manipulation, to compromise and access the financial accounts of a consumer.</text></paragraph></section><section id="H8732C2C106DE485188814E80E490EB27"><enum>3103.</enum><header>Report</header><subsection commented="no" display-inline="no-display-inline" id="id7fed734096454781b1c5dd2ccae651f0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury, in consultation with the Office of the Comptroller of the Currency, the Board of Governors of the Federal Reserve System, the Federal Deposit Insurance Corporation, the Bureau of Consumer Financial Protection, the Financial Crimes Enforcement Network of the Department of the Treasury, the National Credit Union Administration, and private-sector stakeholders, shall submit to Congress a report containing the contents described in subsection (c).</text></subsection><subsection id="id4470ee0e007e4329b3534525d53ec7ac"><enum>(b)</enum><header>Consultation</header><paragraph id="id3f1338ba6c434dadae307cb22f3db01c"><enum>(1)</enum><header>Request for Information</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary of the Treasury shall solicit public feedback on the report required under subsection (a).</text></paragraph><paragraph id="id4753617734d94b0dac5e8a90638354ab"><enum>(2)</enum><header>Industry and expert stakeholders</header><text>In developing the report required under subsection (a), the Secretary of the Treasury shall seek out and consult with industry and expert stakeholders, including—</text><subparagraph id="ide0e31a1a5aa441d1b70ab901de8b6347"><enum>(A)</enum><text>depository institutions of varying asset sizes;</text></subparagraph><subparagraph id="idf3b51e842fa74e8aba161e07508f9de8"><enum>(B)</enum><text>credit unions of varying asset sizes;</text></subparagraph><subparagraph id="id4aea770e1c7e435cbcc4324a80cd1b8f"><enum>(C)</enum><text display-inline="yes-display-inline">third-party vendors who use artificial intelligence when providing services to depository institutions and credit unions; and</text></subparagraph><subparagraph id="id48114310c54040998b64fae8ec461666"><enum>(D)</enum><text>artificial intelligence experts.</text></subparagraph></paragraph></subsection><subsection id="ida8b28a5fda754bab90144a775d59a18e"><enum>(c)</enum><header>Contents</header><text>The contents of the report described in this subsection are as follows:</text><paragraph id="id1fba0cb217314d36949332247bb3e72b"><enum>(1)</enum><text display-inline="yes-display-inline">A description of how banks and credit unions proactively protect themselves and consumers from fraud utilizing artificial intelligence.</text></paragraph><paragraph id="id36ce22ac2b154039860b61aa4fe15483"><enum>(2)</enum><text display-inline="yes-display-inline">A list of standard definitions for the different manners in which artificial intelligence is used, including terms like <quote>generative AI</quote>, <quote>machine learning</quote>, <quote>natural language processing</quote>, <quote>algorithmic AI</quote>, and <quote>deep fakes</quote>.</text></paragraph><paragraph id="idfa793b5e07994eab8df822cf1bcd3701"><enum>(3)</enum><text display-inline="yes-display-inline">A description of potential risks that could result from the use of artificial intelligence by bad actors to steal data and identities of consumers and commit fraud.</text></paragraph><paragraph id="id545028055cac4a69b973b1bc9c169fa5"><enum>(4)</enum><text>A list of best practices for financial institutions to protect their customers from attempts to steal data and identities of consumers or commit fraud.</text></paragraph><paragraph id="ide22c76a4023e4fdb9a4f3c7b6fbc5e2b" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">Legislative and regulatory recommendations for the regulation of artificial intelligence and to protect consumers from data theft, identity theft, and display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section— </text><paragraph commented="no" display-inline="no-display-inline" id="idc774e8b938f74b208306c5a3b644a3f5"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>pandemic-era law</term> means—</text><subparagraph commented="no" subparagraphs (A) through (F); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbd5208b80ffe4dfeb5c4b1c1d9841976"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>pandemic-era program violation</term> means an offense or other violation of law involving conduct that relates to or involves— </text><subparagraph commented="no" display-inline="no-display-inline" id="id315182b4bf514431bc61c353fba4199c"><enum>(A)</enum><text display-inline="yes-display-inline">a program, project, or activity that was authorized or established by, or was carried out under, a pandemic-era law; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48a8baf45f5f466480783cf24334f87a"><enum>(B)</enum><text display-inline="yes-display-inline">funding provided under a pandemic-era law. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide82c787c25b94abd9f05ba17a57ab0d8"><enum>(b)</enum><header>Extension of statute of limitations</header><paragraph commented="no" display-inline="no-display-inline" id="id21e0c68aeab84b8c80215c19a8585ece"><enum>(1)</enum><header display-inline="yes-display-inline">Crimes</header><text>No person shall be prosecuted, tried, or punished for any pandemic-era program violation that is a criminal offense unless the indictment is found or the information is instituted— </text><subparagraph commented="no" display-inline="no-display-inline" id="idbb7ccdf4db9e4d018b833edafd3a6ecb"><enum>(A)</enum><text display-inline="yes-display-inline">notwithstanding section 3282(a) of title 18, United States Code, within 10 years after such offense shall have been committed; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id878099869a2f44c19801d313abe66b55"><enum>(B)</enum><text>within such longer period of years after such offense shall have been committed as is otherwise provided by law.</text></subparagraph></paragraph><paragraph id="id3e329fa2ca8743b2b7cc892160b16e97"><enum>(2)</enum><header>Tariff Act of 1930</header><text>Notwithstanding section 621 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1621">19 U.S.C. 1621</external-xref>), no civil action, suit, or proceeding for the forfeiture of property accruing under the customs laws of the United States related to a pandemic-era program violation shall be instituted unless such civil action, suit, or proceeding is commenced within 10 years after the time when the alleged pandemic-era program violation was discovered, or within 3 years after the time when the involvement of the property in the alleged pandemic-era program violation was discovered, whichever was later, except that the time of the absence from the United States of the person whose property is subject to forfeiture, or of any concealment or absence of the property, shall not be reckoned within the 10-year period of limitation.</text></paragraph><paragraph id="id8d452064e9704d38b1942506196057b9"><enum>(3)</enum><header>False claims</header><subparagraph commented="no" display-inline="no-display-inline" id="id824322b5ff75473ba880b94093abe9c1"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding section 3731(b)(1) of title 31, United States Code, a civil action under section 3730 of such title alleging a violation of section 3729 of such title that is a pandemic-era program violation may not be brought more than 10 years after the date on which the violation was committed. </text></subparagraph><subparagraph id="id73042c8a265c47cd9782dcb86aa9096f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Notice</header><text>Notwithstanding section 3808 of title 31, United States Code, a notice to the person alleged to be liable with respect to a claim or statement that involves a pandemic-era violation shall be mailed or delivered in accordance with section 3803(d)(1) of such title not later than 10 years after the date on which the violation of section 3802 of such title is committed. </text></subparagraph></paragraph></subsection><subsection id="id0de34b29ad3e45dcaac6a211cde20054"><enum>(c)</enum><header>Exclusion of offenses with a lapsed period of limitation</header><text>Subsection (b)(1)(A) shall not apply to a pandemic-era program violation that is a criminal offense for which, but for the extension under such subsection, the date by which an indictment was required to be found or an information was required to be instituted occurred before the date of enactment of this Act.</text></subsection></section></title><title id="id8c818bd6f6d549a7bcc96a2cfc503e8e" style="OLC"><enum>IV</enum><header>Fraud Alert Systems</header><section id="S1" section-type="subsequent-section"><enum>3401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Fraud Alert Systems Act</quote>.</text></section><section id="id02eabe72eba1415a9e2767d26e4a3644"><enum>3402.</enum><header>Mandatory reporting and verification of payment information</header><subsection id="idf51dcdcc4fe9403494e3afbc253babca"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/33">chapter 33</external-xref> of title 31, United States Code is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id9c4dac62aadf4ee0b4b7217532344ad6"><section id="id26b542d1641e475a88be25bcb2c7f47a"><enum>3337.</enum><header>Mandatory reporting and verification of payment information</header><subsection id="idfc5ea4bba58745ac94bf73ea182a904e"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9e76560677ac43eaab1baa981dd91671"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means—</text><subparagraph id="id7f865cd793324606a6e3fc7d6042d2be"><enum>(A)</enum><text>an executive agency; </text></subparagraph><subparagraph id="id46d950192a774703b2d71328177c4edd"><enum>(B)</enum><text>an independent regulatory agency, as defined in section 3502 of title 44; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide9200dbcd3224df0abd3231f1ff8e24b"><enum>(C)</enum><text display-inline="yes-display-inline">an entity that—</text><clause commented="no" display-inline="no-display-inline" id="id0ee9307ed24c4e449d292fbf1ecc0a23"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idda077f4b6ebc467081f477a557da2e5f"><enum>(I)</enum><text>is the Congress;</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="ida5ace97fad4f4dc9ab9b0316696f1d0a"><enum>(II)</enum><text>is a court of the United States;</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="idaa054335824c47d4a9605d07f13a84e9"><enum>(III)</enum><text>is a government of a territory or possession of the United States; or</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="idcb9d826e6b7a4f3b9a89794ae316fdcc"><enum>(IV)</enum><text>is the District of Columbia; and</text></subclause></clause><clause id="idcb8d39d071c64dbbaa9f8bfa8fadf765"><enum>(ii)</enum><text>uses a Treasury disbursement system.</text></clause></subparagraph></paragraph><paragraph id="id55ba74e8878446c6b4db78b55c007de7"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Treasury.</text></paragraph><paragraph id="id2cee0685eed84034928ea89221e351ae"><enum>(3)</enum><header>Treasury disbursement system</header><text>The term <term>Treasury disbursement system</term> means any system operated by the Secretary for the purpose of disbursing public money.</text></paragraph></subsection><subsection id="id2c2b5dca6bcc4ca580bbdae91e456b7e"><enum>(b)</enum><header>Mandatory reporting of payment information</header><text>For each payment authorized by the head of an agency that is submitted to a Treasury disbursement system for disbursement by the Secretary, the head of the agency shall provide to the Secretary, in such format as the Secretary requires, for inclusion in the Treasury disbursement system—</text><paragraph id="id88b0e6f96db04a4781f91f2337f5ad23"><enum>(1)</enum><text>a brief description of the purpose for which the payment is being made; </text></paragraph><paragraph id="idaa4ab0d576764c4aae1bf59118c37040"><enum>(2)</enum><text>the appropriations account (Treasury Account Symbol, or any successor thereto) from which the payment is to be drawn; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8731356b825645d39e87190063348094"><enum>(3)</enum><text display-inline="yes-display-inline">the type of activity being reported (Business Event Type Code, or any successor thereto). </text></paragraph></subsection><subsection id="id3aa5564cd4a746a5803e4ccc759639ea"><enum>(c)</enum><header>Periodic updates</header><text>Not less frequently than once each fiscal year— </text><paragraph commented="no" display-inline="no-display-inline" id="idb9173afd2d4040d89cb92e09ea87ca61"><enum>(1)</enum><text display-inline="yes-display-inline">for each payment—</text><subparagraph id="idf097d21abfbc456dab7b3de8bcd811dd"><enum>(A)</enum><text>the certifying official shall evaluate whether the information collected under subsection (b) is accurate and complete; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id483985a96e94462289651f07cded232f"><enum>(B)</enum><text display-inline="yes-display-inline">the head of each certifying agency shall provide written confirmation to the disbursing official attesting to the accuracy of such information; and</text></subparagraph></paragraph><paragraph id="id2f5b309446b14edf8150dbfc40b7546a"><enum>(2)</enum><text>the disbursing official shall consult with the certifying official to improve the management of the Treasury disbursement system.</text></paragraph></subsection><subsection id="id78e7f4065e934b3d9fc0ed3abb92bdba"><enum>(d)</enum><header>Public reporting</header><text>Not later than 30 days after the date on which each payment that is subject to this subchapter is certified, the Director of the Office of Management and Budget shall direct the Secretary, or, if the payment is disbursed by an accountable official who is not in a position in the Department of the Treasury, the head of the agency with jurisdiction over the accountable official, to make available on the public website operated under the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) the data required to be provided under subsection (b) with respect to the payment.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="id742e317128d748a791ca08a8d18838b1"><enum>(b)</enum><header>Implementation</header><text>The Secretary of the Treasury may issue regulations or guidance to implement the amendments made by this title.</text></subsection><subsection id="ide15cc2cbd76041bfb61ccec3ff741470"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section, or an amendment made by this section, shall be construed to impose a legal liability on a disbursing official resulting from any action taken pursuant to this section, or an amendment made by this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1fb63b2baa1542f9bf73b33ec90ebf0e"><enum>(d)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/33">chapter 33</external-xref> of title 31, United States Code is amended by inserting after the item relating to section 3336 the following:</text><quoted-block display-inline="yes-display-inline">Information to assist in the prevention of improper payments</header><subparagraph commented="no" display-inline="no-display-inline" id="ide23194ecff104ba094a5f06f5c06aea1"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary of the Treasury shall have access to the information in the National Directory of New Hires for the purpose of identifying, preventing, and recovering improper payments.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3eaade35fb644c0c971e035c54fdf26b"><enum>(B)</enum><header>Redisclosure</header><text>For the purpose of identifying, preventing, and recovering improper payments, the Secretary of the Treasury may redisclose information in the National Directory of New Hires to—</text><clause commented="no" display-inline="no-display-inline" id="id0c4996e46f584242a17ee0bdbf7257a9"><enum>(i)</enum><text display-inline="yes-display-inline">agents and contractors of the Secretary of the Treasury;</text></clause><clause commented="no" display-inline="no-display-inline" id="id621f6d1b28e94165bf27b1f0bf9e76bf"><enum>(ii)</enum><text display-inline="yes-display-inline">Federal and non-Federal agencies authorized to receive information in the National Directory of New Hires directly from the Secretary; and</text></clause><clause id="id13b3b4a5f28847f493f36eab10f28c05" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">such additional persons and entities as agreed to by the Secretary and the Secretary of the Treasury.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8fce4be040e04c849f2b138c1822d1e4"><enum>(b)</enum><header>Access to information covered by FCRA</header><paragraph id="idc484eae5234f43bda62a7f61098c4f9f"><enum>(1)</enum><header>Definitions</header><text>Section 603(k)(1) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a(k)(1)</external-xref>) is amended—</text><subparagraph id="id7165182890864950b8ac36edf801eb2e"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="ide398f4cf54284e53a0c104e8d1aeabb0"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id5287fd944fb143a09e960336a8771e7f"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id61868d802a3c44489b408e1f0061643e"><subparagraph id="id3c45b02502fa47daa5a989f2d7b5e48a"><enum>(C)</enum><text>does not include—</text><clause id="id5781065c03d4462cb0ca556c88bbad69"><enum>(i)</enum><text>any change to a Federal disbursement, including the pre-certification termination of such disbursement, that is—</text><subclause id="id868b3df15bd443069ecacf388f264ee5"><enum>(I)</enum><text>based on a consumer report; and</text></subclause><subclause id="id5e3f419c366c4fafbfbddd5df4aecd37"><enum>(II)</enum><text>made to improve the accuracy of the disbursement; or</text></subclause></clause><clause id="id29e748a777bc45a484f1a04467eedb0f"><enum>(ii)</enum><text>any action taken by an authorized user of the Working System of the Do Not Pay Initiative authorized by section 3354 of title 31, United States Code, in connection with the disbursement of a payment, as defined in section 3351 of that title, that is based on a consumer report.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idffab33e37736439fbdcfeeb2cf08f013"><enum>(2)</enum><header>Permissible uses of consumer reports</header><text>Section 604(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id74961ce2ced44fd89a99ce6273b29690"><paragraph id="id2f1eb717f967463183d18273c0057e06"><enum>(7)</enum><text>To the Secretary of the Treasury for purposes of assisting Federal and non-Federal entities identify, prevent, and recover improper payments, including redisclosing information in a consumer report to—</text><subparagraph id="idd71dda07c5bc43ad819a40b40827cc73"><enum>(A)</enum><text>agents and contractors of the Department of the Treasury; and</text></subparagraph><subparagraph id="idc2f0e875e8234c70abca6ce68f90dd27"><enum>(B)</enum><text>Federal and non-Federal entities authorized to receive such information directly from the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id558f158fb3df4175ad15e19286482e61"><enum>(c)</enum><header>Privacy-Preserving validation of select tax information</header><paragraph commented="no" display-inline="no-display-inline" id="id558e3ea58aef4d3cbd46cbbbdb5ac137"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103(i)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc529e089b83b4265a678364e48d532f1"><paragraph commented="no" display-inline="no-display-inline" id="idf74fb96f27864581ae182417df84aa1f"><enum>(9)</enum><header>Do not pay working system</header><subparagraph commented="no" display-inline="no-display-inline" id="id4ad6c333d36c4977845f193786a67f50"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In response to an inquiry by the Secretary with respect to a specific individual, the Commissioner shall provide the Secretary with any return information described in subparagraph (B) with respect to such individual for the applicable period, in a manner which preserves the confidentiality of such information, for the purposes of enhancing the Do Not Pay working system described in section 3354(c) of title 31, United States Code, which may include disclosing such information—</text><clause commented="no" display-inline="no-display-inline" id="idf09f42ed762a46248d26ef1e20f64fa1"><enum>(i)</enum><text display-inline="yes-display-inline">to agents and contractors of the Department of Treasury who are authorized to access the Do Not Pay working system, and</text></clause><clause commented="no" display-inline="no-display-inline" id="id736990ddd6ba441fbd74a786624da467"><enum>(ii)</enum><text>other Federal agencies and State agencies that manage Federally-funded State-administered programs (including agents and contractors of such agencies) who are authorized to access the Do Not Pay working system,</text></clause><continuation-text continuation-text-level="subparagraph">for purposes of using the Do Not Pay working system to identify, prevent, and recover improper payments.</continuation-text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26ac31fec27243aba7944681225ba254"><enum>(B)</enum><header>Return information</header><text>The return information described in this subparagraph is the following:</text><clause commented="no" display-inline="no-display-inline" id="id4498b9912e5d495eb92b11a42ad3bc52"><enum>(i)</enum><text display-inline="yes-display-inline">Taxpayer identification number.</text></clause><clause commented="no" display-inline="no-display-inline" id="id1e4ee5d3edbd446593b47be69b39a19e"><enum>(ii)</enum><text display-inline="yes-display-inline">Filing status.</text></clause><clause commented="no" display-inline="no-display-inline" id="id17686220709f4247985c2cc712f1c1a9"><enum>(iii)</enum><text display-inline="yes-display-inline">Adjusted gross income.</text></clause><clause commented="no" display-inline="no-display-inline" id="iddf467b1030844d2493b9ab9dfc03dbc6"><enum>(iv)</enum><text display-inline="yes-display-inline">Income or loss reported on Schedule C of Form 1040 (or successor forms).</text></clause><clause commented="no" display-inline="no-display-inline" id="id87d5931134ec49edbe6cda8327ec639a"><enum>(v)</enum><text display-inline="yes-display-inline">Filing year.</text></clause><clause commented="no" display-inline="no-display-inline" id="id418252a0322b47f1b14ae8d12a3f4026"><enum>(vi)</enum><text display-inline="yes-display-inline">Any reported identity theft related to the taxpayer identification number.</text></clause><clause commented="no" display-inline="no-display-inline" id="id212e387622b5487a8a7057722754ddea"><enum>(vii)</enum><text display-inline="yes-display-inline">Whether a tax return was not filed for any taxable year.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida3bc4a3302594f46b89b6a4b2e383a88"><enum>(C)</enum><header>Applicable period</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <term>applicable period</term> means, with respect to any individual, the period—</text><clause commented="no" display-inline="no-display-inline" id="id7be387146a394a4dabf3786987867fc6"><enum>(i)</enum><text display-inline="yes-display-inline">consisting of the number of taxable years specified by the Secretary in the inquiry made under subparagraph (A) (but not less than 3 taxable years), and</text></clause><clause commented="no" display-inline="no-display-inline" id="idfc151c82718f48b2ab2991b842a62b82"><enum>(ii)</enum><text display-inline="yes-display-inline">ending with the most recently completed taxable year for which the information described in such subparagraph is available.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id1c688e3b742d437999a87a2ec9d205a4" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Effective date</header><text>The amendment made by this subsection shall apply to disclosures made after the date of enactment of this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id01f12f3a8a29459da5b53e7f222de5e5"><enum>(d)</enum><header>Access to Social Security information</header><text>Title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="id04f6c17f73454d63bf901a56eabf934f" display-inline="no-display-inline" style="OLC"><section id="idae38050afcc34cf8bfa64f612f301f58"><enum>235.</enum><header>Disclosure of information for do not pay system</header><subsection commented="no" display-inline="no-display-inline" id="ide24f60750a064613af68a0a36782c112"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For the purposes described in subsection (b), the Commissioner of Social Security shall, upon request of the Secretary of the Treasury, enter into an agreement with the Department of the Treasury to regularly provide personally identifiable information held by the Social Security Administration, which shall, with respect to any individual, include, at a minimum, the name, date of birth, and Social Security number of such individual.</text></subsection><subsection id="id0fb9723930b34aeda98616042e5b6b0b" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">Information provided under subsection (a) shall be used solely for purposes of enhancing the Do Not Pay working system described in section 3354(c) of title 31, United States Code, with respect to identifying, preventing, and recovering improper payments, including fraudulent payments.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="idcacde0336a9741eb9812dc0a2a5f59c7" style="OLC"><enum>V</enum><header>Stopping Transfers of Public Funds Abroad</header><section id="id94c43eaff2b44ea6869c1cd791d3857c"><enum>3501.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Stopping Transfers of Public Funds Abroad Act</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ida31b13721031401a80ba7ff1be7db298"><enum>3502.</enum><header>Prohibiting individuals receiving public assistance from conducting remittance transfers</header><subsection commented="no" display-inline="no-display-inline" id="id78e59c19716743f3b116eead308390e3"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="no-display-inline" id="idcdb1eb642011422f952ec8ad8b529420"><enum>(1)</enum><header display-inline="yes-display-inline">Enforcement</header><text>The head of any Federal agency responsible for the administration of any public assistance program shall require any individual applying or reapplying for any payment or other benefit under such program to provide a written declaration, under penalty of perjury pursuant to section 1746 of title 28, United States Code, that such individual will not transfer any funds through a remittance transfer during any period in which such individual receives any payment or other benefit under such program. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7aa266fc3ba245d8a52526be6ea2dfec"><enum>(2)</enum><header display-inline="yes-display-inline">Penalty</header><text>Any individual who has provided a written declaration described in paragraph (1) and subsequently transferred funds through a remittance transfer during any period in which such individual received any payment or other benefit under the public assistance program to which such declaration applies shall be subject to a fine of $100,000.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3892a5da2a834567a26062d2488e95a5"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idd52eb615b3f446b29345a39c23898813"><enum>(1)</enum><header display-inline="yes-display-inline">Public assistance program</header><text>The term <term>public assistance program</term> means any program described in paragraph (1), (2), (3), (4), (5), or (7) of section 416.1142(a) of title 20, Code of Federal Regulations (as in effect of the date of enactment of this Act).</text></paragraph><paragraph id="id255421dc5df64f44b5e816a998b0b7c8"><enum>(2)</enum><header>Remittance transfer</header><text>The term <term>remittance transfer</term> has the same meaning given such term under section 920(g) of the Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693o-1">15 U.S.C. 1693o-1(g)</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id47440305061a4f40a09db80e38d3a286"><enum>(c)</enum><header>Effective date</header><text>This section shall apply to any payment or other benefit under a public assistance program which is provided after the date which is 30 days after the date of enactment of this Act.</text></subsection></section></title><title id="idc6fc5aa861d4475db83fe4f57bf4a869" style="OLC"><enum>VI</enum><header>Veterans Scam and Fraud Evasion Act of 2026</header><section id="id43d1517177cc45f185ec64ed9a914853" section-type="subsequent-section"><enum>3601.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Veterans Scam And Fraud Evasion Act of 2026</quote> or the <quote>VSAFE Act of 2026</quote>.</text></section><section id="ideb35389f-cbab-4599-8942-46ce904a2464" changed="not-changed"><enum>3602.</enum><header>Veterans Scam and Fraud Evasion Officer</header><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="idd2517e0a48884a88a6367ba00e5fe7ae"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/3">Chapter 3</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="idc2978560-338f-4621-8f23-bdbf1e6bb161" display-inline="no-display-inline" changed="not-changed"><section id="id2fbefd2c-e9ed-4de7-bab2-33c9b9f6484e" changed="not-changed"><enum>326.</enum><header>Veterans Scam and Fraud Evasion Officer</header><subsection id="id676e6537-1fb1-4a89-88e6-87835914de9a" changed="not-changed"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is in the Veterans Experience Office of the Department a Veterans Scam and Fraud Evasion Officer, who shall—</text><paragraph id="iddade6185-759c-40b6-a17b-a1dbaf0ff54d" changed="not-changed"><enum>(1)</enum><text>be responsible for fraud and scam prevention, reporting, and incident response plans at the Department; and</text></paragraph><paragraph id="id80ecc0d7-a87a-4669-8b6e-24833e7f2d99" changed="not-changed"><enum>(2)</enum><text>serve as a central point of contact to direct veterans to resources to prevent and mitigate fraud and scams.</text></paragraph></subsection><subsection id="id340106cc-7028-49f4-88d7-9a07b2bf89fd" changed="not-changed"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Veterans Scam and Fraud Evasion Officer shall carry out the following responsibilities:</text><paragraph id="idf7e3ef01-9aa8-4cd9-8726-0ff0eb9040a1" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">Providing comprehensive communication from the Secretary to employees of the Department and veterans, their families, caregivers, and survivors during strategic and time-sensitive fraud and scam incidents.</text></paragraph><paragraph id="id9da6ab6b-1740-4834-8b32-7e39cea05889" changed="not-changed"><enum>(2)</enum><text>Establishing consistent guidance across the enterprise for employees as well as veterans, their families, caregivers, and survivors on how to identify, report, and avoid fraud and scam attempts.</text></paragraph><paragraph id="id521d261e-e941-442e-a505-a2ea4f987c38" changed="not-changed"><enum>(3)</enum><text>Promoting the VSAFE Fraud Hotline and VSAFE.gov website of the Department (and any successor resources) and identifying other identity theft resources available to veterans, their families, caregivers, and survivors, including with respect to actions made by the Secretary to protect the identities of veterans and their beneficiaries.</text></paragraph><paragraph id="ida8613d8d-d03c-4e53-ae6c-0ad3a0f5776e" changed="not-changed"><enum>(4)</enum><text>Developing methods to monitor fraud and scam metrics within the Department to—</text><subparagraph id="id42321784-f1cb-4683-a75b-b700b3b268e2" changed="not-changed"><enum>(A)</enum><text>provide internal and external reporting;</text></subparagraph><subparagraph id="id815a301a-59ab-494a-8eb5-4aad3c541c01" changed="not-changed"><enum>(B)</enum><text>enable advanced data analytics; and</text></subparagraph><subparagraph id="id4de68265-94e1-4891-9634-45ddcd4312c9" changed="not-changed"><enum>(C)</enum><text>facilitate proactive and robust fraud and scam trend identification.</text></subparagraph></paragraph><paragraph id="id7e413163-b45c-48ab-ab4c-f4ed043725bf" changed="not-changed"><enum>(5)</enum><text>Developing comprehensive training plans for Department employees fielding fraud and scam inquiries and reports.</text></paragraph><paragraph id="ide5bd88af-61a0-4509-b530-f01b697f5ba4" changed="not-changed"><enum>(6)</enum><text>Coordinating with the Inspector General of the Department and other Federal departments and agencies, including the Executive Office of the President, the Office of Management and Budget, the Internal Revenue Service, the Department of Justice, the Department of State, the Consumer Financial Protection Bureau, the Department of Defense, the Department of Education, the Social Security Administration, and other relevant agencies to—</text><subparagraph id="ida07721cf-833c-4ee9-8392-8071d71f97e5" changed="not-changed"><enum>(A)</enum><text>develop a whole-of-government view within the Department to improve fraud prevention efforts within the Department; </text></subparagraph><subparagraph id="id73580175-52cf-464f-aad5-b1af333efc5d" changed="not-changed"><enum>(B)</enum><text>identify the proper avenues for veterans to report fraud attempts and receive assistance; and</text></subparagraph><subparagraph id="id64159aed-b26a-4500-af8f-178abba6eb2f" changed="not-changed"><enum>(C)</enum><text>identify opportunities for coordination with such departments and agencies.</text></subparagraph></paragraph><paragraph id="idb30ed3df-6240-4110-983a-c723ed094d6c" changed="not-changed"><enum>(7)</enum><text>Consulting with veterans service organizations and State, local, and tribal governments, as necessary, to improve understanding of potential fraud and scam risks to veterans.</text></paragraph></subsection><subsection id="idf57d4f9f-cc25-4a14-bb75-76d9387bcbcf" changed="not-changed"><enum>(c)</enum><header>Full-time employees</header><text>Nothing in this section authorizes an increase in the number of full-time employees otherwise authorized for the Department.</text></subsection><subsection id="id34c6ef72-a832-413b-8c1c-0903342d9821" changed="not-changed"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit the authority of the Office of Inspector General of the Department as otherwise provided in this title or in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/4">chapter 4</external-xref> of title 5 (commonly referred to as the Inspector General Act of 1978).</text></subsection><subsection id="HF96420D4794F49198109E9888D1CA72F" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">The requirements and authorities of this section shall terminate on September 30, 2030.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id7d7e40a1-4cf6-44bd-9924-50bb8f9f8ea4" changed="not-changed"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new and</text></subclause></clause><clause id="idaac39214-d8be-47e6-a4c0-039df4dfcc1f" changed="not-changed"><enum>(ii)</enum><text>by striking subparagraphs (A), (B), and (C) and inserting the following subparagraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2fed8b27-2bbf-4621-bd8d-413ba289752e" changed="not-changed"><subparagraph id="id82dec32f-cf0e-4166-bea0-af9b72e1f53e" indent="up1" changed="not-changed"><enum>(A)</enum><text>Refusing to obey an order that would require the protected individual to violate a law, rule, or regulation related to any contract, subcontract, grant, or subgrant.</text></subparagraph><subparagraph id="id9685ced3-fd49-4936-aff7-56def80feaa9" indent="up1" changed="not-changed"><enum>(B)</enum><text>Disclosing to a person or body described in paragraph (2) information that the protected individual reasonably believes is evidence of the following:</text><clause id="id12cedf69-8a55-4474-89e4-913a2d7e73a7" changed="not-changed"><enum>(i)</enum><text>Gross mismanagement of any Department of Defense contract or grant, any gross waste of Department funds, any abuse of authority relating to any Department contract, subcontract, grant, or subgrant, or any violation of law, rule, or regulation related to any Department contract or subcontract (including the competition for or negotiation of a contract or subcontract) or grant or subgrant.</text></clause><clause id="idcfda55ae-803b-4c33-baa8-663f458a6de9" changed="not-changed"><enum>(ii)</enum><text>Gross mismanagement of any National Aeronautics and Space Administration contract or grant, any gross waste of Administration funds, any abuse of authority relating to an Administration contract, subcontract, grant, or subgrant, or any violation of law, rule, or regulation related to any Administration contract or subcontract (including the competition for or negotiation of a contract or subcontract) or grant or subgrant.</text></clause><clause id="id484b8156-4114-4383-b054-62667ac0b581" changed="not-changed"><enum>(iii)</enum><text>A substantial and specific danger to public health or safety.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id823ab02c-9d35-46d0-bd21-b8324c896e3d" changed="not-changed"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="id34bfb644-4494-4858-b2cf-c127a959c251" changed="not-changed"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></clause><clause id="id38ecd76a-4477-4749-ad4c-f134e211885b" changed="not-changed"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idabe31bc9-677d-4304-a64b-9334d4bb3968" changed="not-changed"><subparagraph id="id19afe15c-4cb0-49fb-8dc3-637c7fa94911" indent="up1" changed="not-changed"><enum>(B)</enum><text>it shall not be within the authority of an executive branch official to request that a contractor, subcontractor, grantee, or subgrantee engage in a reprisal prohibited by paragraph (1).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id9aeb5a92-d292-4b3d-8211-89852a700436" changed="not-changed"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="idbd3695f6-c322-4807-a020-e3f97a5e8876" changed="not-changed"><enum>(A)</enum><text>in paragraph (1), by adding at the end the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8d2e6c89-3c1f-4f89-adb7-c96910e49954" changed="not-changed"><subparagraph id="idae2c4a80-de14-4a67-b679-97f8a81f4a0c" indent="up1" changed="not-changed"><enum>(E)</enum><text>Propose appropriate disciplinary action against any executive branch official for any request made of a contractor, subcontractor, grantee, or subgrantee that subjected the complainant to a reprisal prohibited by subsection (a).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idef3e28f1-14eb-4c21-a342-2152b5bccf00" changed="not-changed"><enum>(B)</enum><text>by striking paragraph (7) and inserting the following paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id52d4b443-7adb-4bc6-97f1-77abc2761cf1" changed="not-changed"><paragraph id="id51c3e424-cb6d-42e8-8b88-c679d91eb8b6" indent="up1" changed="not-changed"><enum>(7)</enum><text>The rights, forum, and remedies provided for in this section may not be waived by any public or private agreement, policy, form, or condition of employment, including by any predispute arbitration agreement.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id037fe896-e901-4dd1-9637-f04eaab50371" changed="not-changed"><enum>(3)</enum><text>by striking subsection (e) and redesignating subsections (f) and (g) as subsections (e) and (f), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c46e41d-2e6d-4acd-a5c2-e9f018602e5c" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (e), as so redesignated—</text><subparagraph id="id600b0910-c058-4797-b2cb-eb8f20d3e200" changed="not-changed"><enum>(A)</enum><text>by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></subparagraph><subparagraph id="id044c6500-97bf-432f-9477-814251c87169" changed="not-changed"><enum>(B)</enum><text>by striking <quote>the employee</quote> and inserting <quote>the protected individual</quote>; and</text></subparagraph></paragraph><paragraph id="id44535edb-632d-4709-b4f0-76ee6f04a2a4" changed="not-changed"><enum>(5)</enum><text>in subsection (f), as so redesignated, by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcba353bf-d857-418a-aac9-245d835a710c" changed="not-changed"><paragraph id="id913240ef-2c52-4c6b-af96-5cca0b1ab6f6" changed="not-changed"><enum>(8)</enum><text>The term <term>protected individual</term> means—</text><subparagraph id="id556bebc4-32fe-4ac0-bc01-1d765653d896" changed="not-changed"><enum>(A)</enum><text>a contractor, subcontractor, grantee, or subgrantee of the Department of Defense or the National Aeronautics and Space Administration, including—</text><clause id="id2107dcee-1f9a-4434-850a-efa7df90172a" changed="not-changed"><enum>(i)</enum><text> the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; </text></clause><clause id="id197e641e-35bb-4584-baf5-cd0e1e395a1e" changed="not-changed"><enum>(ii)</enum><text> the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id74a4198e-bcb6-4f73-be0f-4a15384cc6dd" changed="not-changed"><enum>(iii)</enum><text>an element of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) within the Department of Defense;</text></clause></subparagraph><subparagraph id="id074add4a-4ee8-4fb0-abc7-ac24e10ecef8" changed="not-changed"><enum>(B)</enum><text>an employee of a contractor, subcontractor, grantee, or subgrantee of the Department of Defense or the National Aeronautics and Space Administration, or a former employee of such contractor, subcontractor, grantee, or subgrantee whose protected disclosure or engagement in any activity protected against reprisal under this section occurred prior to termination, including an employee of—</text><clause id="idc3b471c4-5d71-4f17-9842-aa2141457ea6" changed="not-changed"><enum>(i)</enum><text>the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; </text></clause><clause id="id562b30b5-46ff-400e-af6e-8328aee45bbb" changed="not-changed"><enum>(ii)</enum><text>the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf487e127-ccb4-43ec-a0db-16eba4541a70" changed="not-changed"><enum>(iii)</enum><text>an element of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) within the Department of Defense; or</text></clause></subparagraph><subparagraph id="id451caac6-2464-4cee-abcc-28deacbf7bef" changed="not-changed"><enum>(C)</enum><text>a person performing personal services for the Department of Defense or the National Aeronautics and Space Administration pursuant to a contractual agreement for the performance of personal services, including a personal services contract or personal services agreement, and who engages in an activity for which any reprisal is prohibited under subsection (a), including a person performing personal services pursuant such a contractual agreement for—</text><clause id="idd31201a0-f9fa-440a-863d-5643c66960de" changed="not-changed"><enum>(i)</enum><text>the government of each of the several States, the District of Columbia, an Indian tribe or authorized tribal organization, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; </text></clause><clause id="id4c783d3e-0df7-42d0-a2c2-836740a37e60" changed="not-changed"><enum>(ii)</enum><text>the government of any political subdivision of, agency of, or instrumentality of, a government listed in clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8178d5f2-c710-41ad-9270-586ac2942407" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">an element of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) within the Department of Defense.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id96facade-7011-453e-a7df-c0650eba0d53" changed="not-changed"><enum>3703.</enum><header>Enhancement of non-defense contractor protection from reprisal for disclosure of certain information</header><text display-inline="no-display-inline">Section 4712 of title 41, United States Code, is amended—</text><paragraph id="id2d13c18b-4396-42f1-80ff-419ba955ad55" changed="not-changed"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id55fd9f1f-6619-4773-b607-b2c9365e0663" changed="not-changed"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb1fae1df-2254-47ef-983d-e54dbd92e4fd" changed="not-changed"><paragraph id="id28d99e27-5099-420a-acd1-641162e5a822" changed="not-changed"><enum>(1)</enum><header>In general</header><text>A protected individual may not be discharged, demoted, or otherwise discriminated against as a reprisal for the following:</text><subparagraph id="id2c3d246e-415e-4bf9-9521-a4b0d0491ad6" changed="not-changed"><enum>(A)</enum><text>Refusing to obey an order that would require the protected individual to violate a law, rule, or regulation related to any contract, subcontract, grant, or subgrant.</text></subparagraph><subparagraph id="id02bf23b5-18a3-4641-8432-4a6dd582226d" changed="not-changed"><enum>(B)</enum><text>Disclosing to a person or body described in paragraph (2) information that the protected individual reasonably believes is evidence of the following:</text><clause id="id79a2c025-e09c-4840-ad4c-3002479ceb9e" changed="not-changed"><enum>(i)</enum><text>Gross mismanagement of any Federal contract or grant, any gross waste of Federal funds, any abuse of authority relating to any Federal contract, subcontract, grant, or subgrant, or any violation of law, rule, or regulation related to any Federal contract or subcontract (including the competition for or negotiation of a contract or subcontract) or grant or subgrant.</text></clause><clause id="id0ba1cc38-c858-4a9b-8acd-22ed9cdc004a" changed="not-changed"><enum>(ii)</enum><text>A substantial and specific danger to public health or safety.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id9b930573-359a-4867-9fbd-c7fe67c3b927" changed="not-changed"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="id4957458a-b8df-4bae-b36f-45d7151ad9bc" changed="not-changed"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>an employee</quote> and inserting <quote>a protected individual</quote>; and</text></clause><clause id="idcbcd3a58-4abf-4c42-a5a4-cab45f9d1aa7" changed="not-changed"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfdcfbd5b-9614-48d6-b99d-bc7886204e72" changed="not-changed"><subparagraph id="id56a97f4a-cd36-4320-ae62-43aa9fd70421" changed="not-changed"><enum>(B)</enum><text>it shall not be within the authority of an executive branch official to request that a contractor, subcontractor, grantee, or subgrantee engage in a reprisal prohibited by paragraph (1).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id5f43a905-5088-48b7-9764-527674555207" changed="not-changed"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id01db60fa-f2e8-4c85-8809-9a9057131067" changed="not-changed"><enum>(A)</enum><text>in paragraph (1), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id88a2747f-98b5-4fa3-84d9-33084a9a97d6" changed="not-changed"><subparagraph id="id3c74ae48-2005-44df-abe6-0102e5c79cde" changed="not-changed"><enum>(E)</enum><text>Propose appropriate disciplinary action against any executive branch official for any request made of a contractor, subcontractor, grantee, or subgrantee that subjected the complainant to a reprisal prohibited by subsection (a).</text></subparagraph><after-quoted-block>;
