which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Defense to enter into multiyear contracts for the procurement of F–35 and F–15EX aircraft, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Airpower Acceleration Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb7972f483d6b4c42a47574c49d1cf372"><enum>2.</enum><header>Multiyear procurement authority for F–35 and F–15EX aircraft</header><subsection commented="no" display-inline="no-display-inline" id="idf1b9a68f544247ad9285bd28661640d8"><enum>(a)</enum><header>Multiyear procurement authority</header><text>Subject to section 3501 of title 10, United States Code, except as provided in this section, the Secretary of Defense may enter into one or more multiyear contracts for the procurement of F–35A, F–35B, F–35C, and F–15EX aircraft.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id741d88fce57841499313b694c34632a7"><enum>(b)</enum><header>Findings requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id9abd23cdc483455d834a6ea399ae3931"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A contract described in subsection (a) is deemed to meet the requirements of section 3501(a) of such title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f06dba400874ec4bdbad1bccd61e1a9"><enum>(2)</enum><header display-inline="yes-display-inline">Request</header><text>Section 3501(i)(2) of such title shall not apply for purposes of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4b3ed402d0a40f4b705241a79a80973"><enum>(3)</enum><header>Report</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense shall submit to Congress a report with respect to contracts described in subsection (a) containing preliminary findings of the agency head described in paragraphs (1) through (6) of section 3501(a) of such title, together with the basis for such findings.</text></paragraph></subsection><subsection id="idbd6d403d6d8f4a91a260f217c20e3e8f"><enum>(c)</enum><header>Advance procurement</header><paragraph commented="no" display-inline="no-display-inline" id="ida712578d54e34706a5da4728e9e4c203"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary of Defense may enter into one or more contracts for advance procurement of key components of F–35A, F–35B, F–35C, and F–15EX aircraft in economic order quantities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82c7310e1fe843c5a68fb74a4c52b6f4"><enum>(2)</enum><header>Certification</header><text>The Secretary of Defense shall include in any certification submitted under section 3501(i)(3) of such title a description of the specific components the Secretary intends to procure under the authority provided by paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0493e763cdf24be98f2c1b8ef09fe119"><enum>(d)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the implementation of section 3501(d) of such title is important to ensuring that all subcontractors, vendors, and suppliers promptly receive funds in order to supercharge the defense industrial base.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id0c9b503028a645c19cda006196202719"><enum>3.</enum><header>Modification of inventory requirements for Air Force fighter aircraft</header><subsection commented="no" display-inline="no-display-inline" id="ide8a1012bdb904d518f0bf16d0cdd7f79"><enum>(a)</enum><header>In general</header><text>Subsection (i) of section 9062 of title 10, United States Code, is amended to read as follows:</text><quoted-block id="idD51296FF464E49768117CF53887850F3" style="USC" act-name=""><subsection id="id19448674AADE49AAB6DC7DA12BD7D8AC"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id6ea5add9d7df4a358327b7794747a546"><enum>(1)</enum><text>The Secretary of the Air Force shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id13038071ceaa41c492b300b5ff83b653" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">during the period beginning on October 1, 2026, and ending on October 1, 2035, maintain a total aircraft inventory of fighter aircraft of not less than 1,800 aircraft; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id7027c219491b4ac4a023b981e35d0ffa"><enum>(B)</enum><text display-inline="yes-display-inline">maintain a total aircraft inventory of combat-coded fighter aircraft of—</text><clause commented="no" display-inline="no-display-inline" id="id2678c0316a04411f87bb0f3836ad0a67"><enum>(i)</enum><text display-inline="yes-display-inline">not less than 1,369 aircraft by December 31, 2030; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3ce643ce280642a69df6e2f8d7eb2138"><enum>(ii)</enum><text>not less than 1,558 aircraft by December 31, 2035.</text></clause></subparagraph></paragraph><paragraph indent="up1" commented="no" display-inline="no-display-inline" id="id4d1c5f4b0a2a4982931905b24e2d4920"><enum>(2)</enum><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id968251ef834245e1be448cd598247da7"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>fighter aircraft</term>—</text><clause commented="no" display-inline="no-display-inline" id="id81336fc05f25410c8d901ff8e7a979ad"><enum>(i)</enum><text display-inline="yes-display-inline">means an aircraft that—</text><subclause commented="no" display-inline="no-display-inline" id="ida3c58e9aeea645dc837819550e7f15a1"> <enum>(I)</enum> <text display-inline="yes-display-inline">is designated by a mission design series prefix of F– or A–;</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="iddfc4ad9b3da740b49f7de2ccc4fca8b0"><enum>(II)</enum><text display-inline="yes-display-inline">is manned by one or two crewmembers; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3e7164fde8c14b3b9df276bb6d5d0b0f"><enum>(III)</enum><text display-inline="yes-display-inline">executes single-role or multi-role missions, including air-to-air combat, air-to-ground attack, air interdiction, suppression or destruction of enemy air defenses, close air support, strike control and reconnaissance, combat search and rescue support, or airborne forward air control; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id976128a5c68745798b067d20287026a5"><enum>(ii)</enum><text display-inline="yes-display-inline">does not include collaborative combat aircraft.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfa2d67c9086444ecaefa6f8c32c5fb9d"><enum>(B)</enum><text>The term <term>primary mission aircraft inventory</term> means aircraft assigned to meet the primary aircraft authorization to a unit for the performance of its wartime mission.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8228152d6e2c4d0a8e5c44c7ff999fd3"><enum>(C)</enum><text>The term <term>total aircraft inventory of combat-coded fighter aircraft</term> means the total inventory of combat-coded fighter aircraft the Air Force possesses, including in—</text><clause commented="no" display-inline="no-display-inline" id="id4ffc13e8e7c8445ea74f0ed7e73e845c"><enum>(i)</enum><text display-inline="yes-display-inline">the primary mission aircraft inventory;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb837db0ec6af4c3aa0817f1d938309db"><enum>(ii)</enum><text display-inline="yes-display-inline">the backup aircraft inventory; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id08305e2333764b0e879a56a8e334d4e5"><enum>(iii)</enum><text display-inline="yes-display-inline">the attrition reserve.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idde732819a55b4eb2be3bd8a3012b64e9"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2026.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id868a2b232bfa4deebb2019410187fb1a"><enum>4.</enum><header>F–15EX aircraft fleet</header><subsection commented="no" display-inline="no-display-inline" id="idd4549d18a37f45c1b2a3bd741e4ccae9"><enum>(a)</enum><header>Authority</header><text>Subject to subsection (b), the Secretary of the Air Force may increase the size of the F–15EX aircraft fleet from 129 to 329 F–15EX aircraft.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id819aea51209d4374b8ad40fcc8aa57fb"><enum>(b)</enum><header>Condition</header><text>The Secretary of the Air Force shall use any F–15EX aircraft procured after the first 129 aircraft under the authority provided by subsection (a) exclusively for the purpose of recapitalizing the F–15E aircraft fleet of the Air Force.</text></subsection></section></legis-body></bill>
