which was read twice and referred to the <committee-name committee-id="SSBU00">Committee on the Budget</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify that the baseline is based on current laws and the assumption of continuation of current levels of discretionary appropriations, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Bias in the Baseline Act</short-title></quote>.</text></section><section id="id83f8be4bcfaf4cffb0b922cfd685821a"><enum>2.</enum><header>Modification of baseline calculation</header><subsection commented="no" display-inline="no-display-inline" id="id6be9e14f97fb4a78abe90e1e4250d6b9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 257 of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/907">2 U.S.C. 907</external-xref>) is amended—</text><paragraph id="ide1ec71a2f29c493a90284bbe33f42f10"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7757a4f54df647f0a134eb172153b628"><subsection id="id9320f2dae784436ea5fbfad9e89285c4"><enum>(a)</enum><header>In general</header><text>For any budget year, the baseline refers to a projection, based on current laws and the assumption of continuation of current levels of discretionary appropriations, of current-year levels of new budget authority, outlays, revenues, and the surplus or deficit into the budget year and the outyears based on laws enacted through the applicable date.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idb4634cb2e3f7461d9319c3459276c821"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id9c4b171b47374b889390da4d36fd0227"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id36FC35368D3B49279F449D3FE3482FB9"><paragraph id="ideebb4fe086094c5bb031ac863b4c0d42"><enum>(1)</enum><header>In general</header><text>Laws providing or creating direct spending and receipts are assumed to operate in the manner specified in those laws for each such year.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id956c7baeb5384c148fa703c52fd8904d"><enum>(B)</enum><text>by striking paragraph (2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfdc15e8f4e5d4b31b901885fd9d093bc"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (2); and</text></subparagraph></paragraph><paragraph id="id5baabe8bb90544e2b2ecff8f9d10e04a"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="ide6f9b427870c4cc18b12f861836dd6ba"><enum>(A)</enum><text>in paragraph (1), in the second sentence, by striking <quote>current year</quote> and all that follows through the period at the end and inserting <quote>excluding resources designated as an emergency requirement and any resources provided in supplemental appropriation laws.</quote>;</text></subparagraph><subparagraph id="ida6aa36cc4c164a73b0dd49a2cbcdecbc"><enum>(B)</enum><text>by striking paragraphs (2), (3), (4), and (5);</text></subparagraph><subparagraph id="ida54e3457bae94ccd946e7e646bb58451"><enum>(C)</enum><text>by redesignating paragraph (6) as paragraph (2); and</text></subparagraph><subparagraph id="ida2948b5589264c538ea532cdd574bc1c"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5d80c9a919054e85ac199d06bb4f2085"><paragraph id="id4f211f4cdc6143cd8fb22ebb48861d10"><enum>(3)</enum><header>No adjustment for inflation</header><text>No adjustment shall be made for inflation or for any other factor.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfed7378f4025439c88d48ab6dc83d546"><enum>(b)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id83c09f292a554439b4642b9a1e891c8d"><enum>(1)</enum><text display-inline="yes-display-inline">Section 202(e)(1) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/602">2 U.S.C. 602(e)(1)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id63124494d13540198c03bdf68eeaa49e"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>and</quote> before <quote>(B) the levels</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5af990610fea41f4b86836818501ed8e"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>, and (C)</quote> and all that follows through <quote>1985</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfc2678526ca54b999d608e22d657890a"><enum>(2)</enum><text>Section 403(a)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(a)(3)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id14444337f63e41378669e83bd740350e"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraph (G); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id47922c66eac94b9f9103ae5db94421c4"><enum>(B)</enum><text>by redesignating subparagraph (H) as subparagraph (G).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
