Antideficiency.</toc-entry></toc></subsection></section><section id="H66D077550D0A44648462430ABD687A81"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="HF2B6D8C7A41742C3B32F606E9ADCC66C"><enum>(1)</enum><text>to achieve a fair, equitable, and final settlement of all claims in the State of California to rights to water for—</text><subparagraph id="H703E1F62A4D34C56A04F341A7B085B68"><enum>(A)</enum><text>the Tribe; and</text></subparagraph><subparagraph id="H4C444993AAD04320921A68598FB0AFD1"><enum>(B)</enum><text>the United States, acting as trustee for the Tribe and Allottees;</text></subparagraph></paragraph><paragraph id="H92F7323FFC754F9ABFCD82A8FD90DEE5"><enum>(2)</enum><text>to achieve a fair, equitable, and final settlement of claims regarding the Tribe’s water related fees, the RAC, and the Tribal Possessory Interest Tax;</text></paragraph><paragraph id="H054F00DE430D48248248040A1C80757D"><enum>(3)</enum><text>to authorize, ratify and confirm the Agreement among the Tribe, CVWD, and DWA to the extent that the Agreement is consistent with this Act;</text></paragraph><paragraph id="H72D8D8AFFF734E758A75101334C5FD00"> <enum>(4)</enum> <text>to authorize and direct the Secretary—</text>
                <subparagraph id="H0A12264FC56F453A87FFFC6B4B80DC25">
                    <enum>(A)</enum>
 <text>to execute the Agreement; and</text> </subparagraph> <subparagraph id="H85E9C179C95542E68D19272A340EA856"> <enum>(B)</enum> <text>to take any other actions necessary to carry out the Agreement in accordance with this Act;</text>
                </subparagraph>
 </paragraph><paragraph id="H89D05AFB30F545938EA48E544C7B8198"><enum>(5)</enum><text>to authorize funds necessary for the implementation of the Agreement and this Act;</text></paragraph><paragraph id="HC930A42B8D2447409A2D3C483C52DA92"><enum>(6)</enum><text>to authorize the transfer of Federal land to the Tribe; and</text></paragraph><paragraph id="H7ACA910406D546D4A45DC33D38321AF8"><enum>(7)</enum><text>to authorize the sale of Federal land to CVWD.</text></paragraph></section><section id="HB0B3AE1A3E1F42AC95D7184881F39AEC"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H9CF97B51E0D64CCA9E8F94E766D1038F"><enum>(1)</enum><header>Adjacent lands</header><text>The term <term>Adjacent Lands</term> means lands that CVWD owns, leases, uses, occupies, controls, or manages that are immediately adjacent to the Facility.</text></paragraph><paragraph id="H3AD8A4AE8B3F420AA590B18714746094"><enum>(2)</enum><header>Afy</header><text>The term <term>AFY</term> means acre-feet per calendar year.</text></paragraph><paragraph id="HB68DE7035AF14AD6AE075FC671D9D10D"><enum>(3)</enum><header>Agreement</header><text>The term <term>Agreement</term> means—</text><subparagraph id="H75D84A5D636243EB92120D600890EF7D"><enum>(A)</enum><text>the document entitled <quote>Agua Caliente Band of Cahuilla Indians Water Rights Settlement Agreement</quote> and dated May 19, 2025, and exhibits attached thereto; and</text></subparagraph><subparagraph id="HE60543B489EF455FB48EF588574265BE"><enum>(B)</enum><text>any amendment to the document referred to in subparagraph (A) (including an amendment to an exhibit) that is executed to ensure that the Agreement is consistent with this Act.</text></subparagraph></paragraph><paragraph id="HFA91BEF25D1F4B2486E5A606DEB3480F"><enum>(4)</enum><header>Agua caliente or tribe</header><text>The term <term>Agua Caliente</term> or <term>Tribe</term> means the Agua Caliente Band of Cahuilla Indians, a federally recognized sovereign Indian Tribe with an elected legislative body operating under a Constitution and by-laws approved by the Commissioner of Indian Affairs on April 18, 1957, as amended.</text></paragraph><paragraph id="H263BB65BE0DA443FB2DD929C003B708A"><enum>(5)</enum><header>Agua caliente development projects</header><text>The term <term>Agua Caliente Development Projects</term> means water related projects which improve the water supply, water reliability, water infrastructure, or water quality for the Agua Caliente Indian Reservation and/or the Indio Subbasin.</text></paragraph><paragraph id="HE4BD5C5B5B344FF68B48B81ECC36B801"><enum>(6)</enum><header>Agua caliente indian reservation or reservation</header><text>The terms <term>Agua Caliente Indian Reservation</term> or <term>Reservation</term> means all land within the exterior boundaries of the Reservation, as established by Presidential Executive Order, Federal patent, or department order, and any other lands that are held in trust by the United States for the Tribe or Allottees.</text></paragraph><paragraph id="H562F114A67BF416396ED2EAA86876386"><enum>(7)</enum><header>Agua caliente indian reservation trust land</header><text>The term <term>Agua Caliente Indian Reservation Trust Land</term> means land or lands held in trust by the United States for the Tribe or Allottees.</text></paragraph><paragraph id="H0C240CB5A1264756A973D6DC6BE72276"> <enum>(8)</enum> <header>Agua caliente litigation</header> <text>The term <term>Agua Caliente Litigation</term> means Agua Caliente Band of Cahuilla Indians v. Coachella Valley Water District, et al., EDCV 13–883 JGB, Agua Caliente Band of Cahuilla Indians v. Coachella Valley Water District, et al., EDCV 20–174 JGB, or both.</text>
 </paragraph><paragraph id="HB4CB112D4BCA43D9B663C4F0C7948FF3"><enum>(9)</enum><header>Agua caliente water authority or acwa</header><text>The term <term>Agua Caliente Water Authority</term> or <term>ACWA</term> means the branch of the Agua Caliente Tribal government established by the Agua Caliente Water Authority Ordinance (Chapter 7.12 of the Tribal Code).</text></paragraph><paragraph id="H64CA0DDCF3B044F5ABF8BAF381C5ED09"><enum>(10)</enum><header>Allocate, allocated or allocation</header><text>The terms <term>Allocate</term>, <term>Allocated</term>, or <term>Allocation</term> means the Tribe’s administration of the Tribal Water Right under the Tribe’s Water Ordinance to Allottees.</text></paragraph><paragraph id="H32A3C2C4E5184E57B6FB7030244FC6B5"><enum>(11)</enum><header>Allotment</header><text>The term <term>Allotment</term> means a parcel of land held in trust by the United States for the benefit of an individual or individuals that is—</text><subparagraph id="HE9553305EFCA4BA19CBF0A038F7D030F"><enum>(A)</enum><text>located within the exterior boundaries of the Agua Caliente Indian Reservation; or</text></subparagraph><subparagraph id="HC06A6A4DC8484BE0AF327C4EE0663AE4"><enum>(B)</enum><text>Bureau of Indian Affairs tract numbers 584–1006 and 584–1010 in Riverside County, California, consisting of approximately 37 acres located in Sections 3, 11, 13 and 29, Township 4 South, Range 5 East, SBBM, set aside by the United States for the benefit of a Tribal Member.</text></subparagraph></paragraph><paragraph id="HDC3C6BF9029A406EB737888B808E1F3E"><enum>(12)</enum><header>Allottee</header><text>The term <term>Allottee</term> means a person with a beneficial real property interest in an Allotment.</text></paragraph><paragraph id="H55A3454A60DB43B4BC0B8B6E34F9E3D9"><enum>(13)</enum><header>Bureau of land management or blm</header><text>The term <term>Bureau of Land Management</term> or <term>BLM</term> shall mean the Bureau of Land Management in the United States Department of the Interior.</text></paragraph><paragraph id="H4460F7C240514D52A5E089184FABBCC7"><enum>(14)</enum><header>Claims</header><text>The term <term>Claims</term> means rights, claims, demands, actions, compensation or causes of action, whether known or unknown, and arising under any source of law.</text></paragraph><paragraph id="H27F6091EF4E44B2487C3F90F663589E4"><enum>(15)</enum><header>Coachella valley water district or cvwd</header><text>The terms <term>Coachella Valley Water District</term> or <term>CVWD</term> means a county water district formed in 1918 and organized and operating pursuant to the County Water District Law and the Coachella District Merger Law of the California Water Code.</text></paragraph><paragraph id="HF77B97A456594E71BF1FDF42428EEFFC"><enum>(16)</enum><header>Decree court</header><text>The term <term>Decree Court</term> means the United States District Court for the Central District of California or any successor Federal court with jurisdiction over the Agreement.</text></paragraph><paragraph id="H452704D6F17C4238A1ACC802FAEB1176"><enum>(17)</enum><header>Desert water agency or dwa</header><text>The terms <term>Desert Water Agency</term> or <term>DWA</term> means an independent special district created by a special act of the California State Legislature in 1961.</text></paragraph><paragraph id="HB160A909C9E04491AEB189EA357BC413"><enum>(18)</enum><header>Distribute or distribution</header><text>The term <term>Distribute</term> or <term>Distribution</term> means, when referencing the Tribal Water Right, the provision of water by the Tribe under the Tribal Water Right to Third Parties through lease, gift, transfer, or any other means.</text></paragraph><paragraph id="H427932BF64D94269B13961BABC711FA4"><enum>(19)</enum><header>Diversion</header><text>The term <term>Diversion</term> means to receive, withdraw, develop, produce, or capture water using a ditch, canal, flume, bypass, pipeline, pit, collection or infiltration gallery, conduit, well, pump, turnout, dam, or any other mechanism or device.</text></paragraph><paragraph id="HB261C1893D064B7796AA03E603AF1B38"><enum>(20)</enum><header>Domestic water</header><text>The term <term>Domestic Water</term> means potable water suitable for human consumption that is delivered for any purpose to a residential customer, nonresidential customer, commercial or industrial customer, governmental customer, or institutional customer.</text></paragraph><paragraph id="H81728728ABD84887B4C139C675B547CB"><enum>(21)</enum><header>Domestic water service</header><text>The term <term>Domestic Water Service</term> means the delivery of Domestic Water from CVWD’s or DWA’s water infrastructure (including water pipelines, booster stations, wells, treatment facilities, reservoirs, and hydrants) and delivery of water for public and private fire protection service.</text></paragraph><paragraph id="HACD96445F0A742DAAAB33D6DE1CE8862"><enum>(22)</enum><header>Enforceability date</header><text>The term <term>Enforceability Date</term> means the date described in section 8.</text></paragraph><paragraph commented="no" id="HFA11192E74EC42E6BD084140EAB0177F"><enum>(23)</enum><header>Facility land</header><text>The term <term>Facility Land</term> means the approximately 842.4 acres of land depicted on the map attached to Exhibit 5 of the Agreement and described as follows, subject to a final survey by the United States and any technical corrections to conform to that survey:</text><list list-type="none" level="subparagraph"><list-item>San Bernardino Meridian</list-item><list-item>Area A: T. 3S., R. 3E, section 14: S1/2NE1/4SE1/4</list-item><list-item>Area B: T. 3S., R. 3E, section 14: SE1/4SE1/4</list-item><list-item>Area C: T. 3S., R. 3E, section 23: NE1/4NE1/4 (BLM lot 4 North of Highway 111)</list-item><list-item>Area D: T. 3S., R.3E, section 23; NW1/4NE1/4 (North of Highway 111)</list-item><list-item>Areas E, F and G: T. 3S, R. 3E, section 24: N1/2NE1/4, N1/2NW1/4 (BLM lot 1 and 2 north of Highway 111)</list-item><list-item>Areas H, I and J: T. 3S., R. 4E. section 20: S1/2NE1/4, S1/2NW1/4, S1/2</list-item><list-item>Areas K and L: T. 3S., R. 4E. section 28: W1/2NW1/4NW1/4, NW1/4SW1/4NW1/4</list-item><list-item>Area M: T. 3S., R. 4E. section 30: N1/2NE1/4 (north of Highway 111)</list-item></list></paragraph><paragraph id="H4FC2986F175E4A5A98F30A2D9E3F53B4"><enum>(24)</enum><header>Final decree</header><text>The term <term>Final Decree</term> means the <quote>Final Judgment and Decree</quote> to be entered by the Decree Court with respect to the Tribal Water Right—</text><subparagraph id="H440A1671D1134E9CA8484DD1658928A9"><enum>(A)</enum><text>that is substantially in the form set forth in Exhibit 2 of the Agreement, as amended if needed to ensure consistency with this Act; and</text></subparagraph><subparagraph id="H02ABF53FA1E54E7A97C6088D31F279F0"><enum>(B)</enum><text>from which no further appeal may be taken.</text></subparagraph></paragraph><paragraph id="HEE018C8FDABB4F7F8A4AEC277332E853"><enum>(25)</enum><header>Groundwater</header><text>The term <term>Groundwater</term> means the water beneath the surface of the ground and within the zone of saturation that is below the water table of the Indio Subbasin excluding water flowing in defined beds and banks of creeks and rivers.</text></paragraph><paragraph id="H5350202DC05349E5BBA2D08611FB1448"><enum>(26)</enum><header>Imported water</header><text>The term <term>Imported Water</term> means water that any person or entity imports into the Indio Subbasin.</text></paragraph><paragraph id="HEBA81852401F494FBAE0D3D73FB8D69E"><enum>(27)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HD2B786794ECD4F868F7FF7E78E3E061A"><enum>(28)</enum><header>Indio subbasin</header><text>The term <term>Indio Subbasin</term> means the Indio Subbasin (Subbasin 7–21.01) as defined by California Department of Water Resources Bulletin 118.</text></paragraph><paragraph id="HFF2D4DDA8C684962B304F477EF4EF061"><enum>(29)</enum><header>Irrigation</header><text>The term <term>Irrigation</term> means water used for agricultural purposes.</text></paragraph><paragraph id="H90504725D5CB476484B09F1FFEBE4F22"><enum>(30)</enum><header>Memorandum of cooperation</header><text>The term <term>Memorandum of Cooperation</term> means the Memorandum of Cooperation Regarding Water Management among and between Agua Caliente, CVWD, and DWA (attached as Exhibit 1 to the Agreement).</text></paragraph><paragraph id="H58F3BDB227DA4E349F1A66067C925E21"><enum>(31)</enum><header>Most likely descendant</header><text>The term <term>Most Likely Descendant</term> has the same meaning as used in California Code, Public Resources Code 5097.98.</text></paragraph><paragraph id="H02C6C6B75A1F4DBA868BBE7B9A3C9372"><enum>(32)</enum><header>Native groundwater</header><text>The term <term>Native Groundwater</term> means the water which naturally replenishes and accumulates in the aquifer and does not include Imported Water.</text></paragraph><paragraph id="HF2493201E5A54A558A293C314F2BC9E2"><enum>(33)</enum><header>Non-consumptive use</header><text>The term <term>Non-Consumptive Use</term> means any use that does not remove water from a natural water body.</text></paragraph><paragraph id="HB72A345791B141208CAB5735F5CFF5C0"><enum>(34)</enum><header>Operations, maintenance, and replacement</header><text>The term <term>operations, maintenance, and replacement</term> means—</text><subparagraph id="HF353943FEA7640D79F3EC34C4777CBA1"><enum>(A)</enum><text>any recurring or ongoing activity associated with the day-to-day operation of a project;</text></subparagraph><subparagraph id="H9D8AEAFD97B84166B80814BA0C11DF4A"><enum>(B)</enum><text>any activity related to scheduled or unscheduled maintenance of a project; and</text></subparagraph><subparagraph id="H916D8309BC7A4DAD9C5B6E6D3783E73E"><enum>(C)</enum><text>any activity relating to repairing, replacing, or rehabilitating a feature of a project.</text></subparagraph></paragraph><paragraph id="H1D90DB08636E4F1883E2C4F62A05537E"><enum>(35)</enum><header>Other public agency</header><text>The term <term>Other Public Agency</term> shall mean any and all political subdivisions or public agencies of the State of California, other than Riverside County, that but for the preemption in this Act otherwise would have received revenue from the Riverside County Ad Valorem Property Tax imposed on Possessory Interests.</text></paragraph><paragraph id="H945DFCE34C8B4B559FA6EC37198D7CF0"><enum>(36)</enum><header>Parties</header><text>The term <term>Parties</term> means Agua Caliente, CVWD, DWA, and the United States.</text></paragraph><paragraph id="H0334D78C8FEF46FFB417C0995A1614BF"><enum>(37)</enum><header>Possessory interest</header><text>The term <term>Possessory Interest</term> means possession of, claim to, or right of possession of land or improvements that is independent, durable, and exclusive of rights held by others in the property, except when coupled with ownership of the land or improvements in the same person when such lands or improvements are within the exterior boundaries of Agua Caliente Indian Reservation Trust Land.</text></paragraph><paragraph id="HF237E6CC459C4ABE9984F51EF3A54651"><enum>(38)</enum><header>Produce, producing, or production of water</header><text>The terms <term>Produce</term>, <term>Producing</term>, or <term>Production of water</term> means the extraction of Groundwater or the diversion of surface water, by pumping or any other method.</text></paragraph><paragraph commented="no" id="HBA195F8201C045ABB665A0B092ED23F7"> <enum>(39)</enum> <header>Rac</header> <text>The term <term>RAC</term> means the replenishment assessment charge that a Water District levies on the production of Groundwater or the diversion of surface water as described in Cal. Water Code § 31630, et seq. or Cal. Water Code Appendix § 100–15.4(b), or any comparable charge or fee.</text>
 </paragraph><paragraph id="H54C2DDC512244948BC7CB5A73D7F0D69"><enum>(40)</enum><header>Reservation customer</header><text>The term <term>Reservation Customer</term> means water users located on Agua Caliente Indian Reservation Trust Land receiving delivery of Domestic Water from the Water Districts.</text></paragraph><paragraph id="H5E7DF2AAB2FB4CEA8AA537FB411E87B0"><enum>(41)</enum><header>Riverside county</header><text>The term <term>Riverside County</term> means the County of Riverside in the State of California.</text></paragraph><paragraph id="H732DB5AED27E493299B1D3EEABC63F7E"><enum>(42)</enum><header>Riverside county ad valorem property tax</header><text>The term <term>Riverside County Ad Valorem Property Tax</term> means the ad valorem property tax imposed by Riverside County on a Possessory Interest, as authorized by the California Constitution, article XIII, section 1, on behalf of various taxing entities, that is subject to the limit described in section 93(b) of the California Revenue &amp; Taxation Code or any similar tax levied by the Riverside County in the future. The term shall not include any tax levy on behalf of any taxing entity that is not subject to the limit described in section 93(b), such as any levy identified in sections 93(a), 93(c), or 96.31(a) of the California Revenue &amp; Taxation Code.</text></paragraph><paragraph id="HF04C389859674E05AA08736445696AAF"><enum>(43)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H9C8C0A26035D43039BDABD008795CC61"><enum>(44)</enum><header>State</header><text>The term <term>State</term> means the State of California and all officers, agents, departments, and political subdivisions of the State of California.</text></paragraph><paragraph id="H5B4FF7AA3E3F489E854C0D223E32066B"><enum>(45)</enum><header>Tax apportionment schedule</header><text>The term <term>Tax Apportionment Schedule</term> means the schedule established by Riverside County for distributing funds from the Riverside County Ad Valorem Property Tax to taxing entities.</text></paragraph><paragraph id="HD234DFAF711B4C13A8C43EC2A093764A"><enum>(46)</enum><header>Tribal cultural resource</header><text>The terms <term>Tribal Cultural Resource</term> means—</text><subparagraph id="H7C84545BC75D458786DA10D6783EBBA8"><enum>(A)</enum><text>human remains and associated grave goods;</text></subparagraph><subparagraph id="H36A0F8CCFA384B14B866E0B364128146"><enum>(B)</enum><text display-inline="yes-display-inline">a burial site (as defined in section 2 of the <short-title>Native American Graves Protection and Repatriation Act</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>));</text></subparagraph><subparagraph id="HFC293088031D43B9835C4999C282B5E2"><enum>(C)</enum><text display-inline="yes-display-inline">cultural items (as defined in section 2 of the <short-title>Native American Graves Protection and Repatriation Act</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>));</text></subparagraph><subparagraph id="H87ADDE6819184EE5962A0D3BA2100F0F"><enum>(D)</enum><text>archaeological resources (as defined in section 3 of the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470bb">16 U.S.C. 470bb</external-xref>)); or</text></subparagraph><subparagraph id="H045F0FE00B2E437CA0A1C7AED4EFDEC1"><enum>(E)</enum><text>Native American historic property (as defined in section 300308 of title 54, United States Code).</text></subparagraph></paragraph><paragraph id="H3239B951FA464D61B46835B04D881904"><enum>(47)</enum><header>Tribal law</header><text>The term <term>Tribal Law</term> means any law duly enacted by Agua Caliente.</text></paragraph><paragraph id="H922E01792E8C41F1A921A22996F47620"><enum>(48)</enum><header>Tribal member</header><text>The term <term>Tribal Member</term> means any person who is a duly enrolled member of the Agua Caliente.</text></paragraph><paragraph id="H3045AEF5428240808F07A3CCCC71FC93"><enum>(49)</enum><header>Tribal possessory interest tax</header><text>The term <term>Tribal Possessory Interest Tax</term> or <term>Tribal Tax</term> means the Tribe’s tax on Possessory Interests that the Tribe has the sovereign governmental authority to impose, assess, collect, and disburse pursuant to this Act.</text></paragraph><paragraph id="H178EB080A6A4443A8C2447BFEB5BF8FD"><enum>(50)</enum><header>Tribal possessory interest tax ordinance</header><text>The term <term>Tribal Possessory Interest Tax Ordinance</term> means an ordinance adopted by Agua Caliente and authorized by this Act governing the imposition, assessment, levy, charge, or collection of the Tribal Possessory Interest Tax on the Reservation.</text></paragraph><paragraph id="H3FBCEB9A0C0D443B9BDC82E8B30FD246"><enum>(51)</enum><header>Tribal production fee</header><text>The term <term>Tribal Production Fee</term> means the fee authorized by this Act that Agua Caliente may levy or impose under Tribal Law on the Production of Groundwater that is part of the Tribal Water Right.</text></paragraph><paragraph id="H649007543D3D40369059D59AF2B648CF"><enum>(52)</enum><header>Tribal water delivery charge</header><text>The term <term>Tribal Water Delivery Charge</term> means the charge authorized by this Act that Agua Caliente may levy or impose under Tribal Law on Reservation Customers using the Tribal Water Right and that is retained by a Water District pursuant to a water services contract.</text></paragraph><paragraph id="H9C5F2A4A67B947CE83305B03C86649A9"> <enum>(53)</enum> <header>Tribal water fee</header> <text>The term <term>Tribal Water Fee</term> means the fee authorized by this Act that Agua Caliente may levy or impose under Tribal Law on Reservation Customers receiving the delivery of Domestic Water.</text>
 </paragraph><paragraph id="H97E76C1FAFD046F5BAA1CD95B760064C"><enum>(54)</enum><header>Tribal water right</header><text>The term <term>Tribal Water Right</term> means the Agua Caliente’s water rights—</text><subparagraph id="H36FD082FBF1446E7AA3928840EE525B3"><enum>(A)</enum><text>as identified in Section III of the Agreement and section 5 of this Act, and</text></subparagraph><subparagraph id="H535B97BB03A8461D81710E9E2CCD7009"><enum>(B)</enum><text>as confirmed in the Final Decree.</text></subparagraph></paragraph><paragraph id="H93DC22DCB3074EDD970A0BD54A2A06FD"><enum>(55)</enum><header>Tribe’s water ordinance</header><text>The term <term>Tribe’s Water Ordinance</term> means the Agua Caliente Water Authority Ordinance (Chapter 7.12 of the Tribal Code), as amended, or any other ordinance enacted by Agua Caliente governing water on the Reservation.</text></paragraph><paragraph id="HF531579E890C44FF8B4C992A141EBE55"><enum>(56)</enum><header>United states</header><text>The term <term>United States</term> means the United States of America and all departments, agencies, bureaus, officers, and agents thereof.</text></paragraph><paragraph id="HE28C81E74E3A445EA912B45A672CEB79"><enum>(57)</enum><header>Use or using or used</header><text>The terms <term>Use</term> or <term>Using</term> or <term>Used</term> mean the consumption, application, or other use of water for any purpose, including but not limited to by allocation, distribution, exchange, or lease.</text></paragraph><paragraph id="H636BFBECAF334933991C816318EB7A56"><enum>(58)</enum><header>Water district</header><text>The term <term>Water District</term> means CVWD or DWA.</text></paragraph><paragraph id="H67F6D4D0971D4F8F8CE477CBCB838F24"><enum>(59)</enum><header>Water districts</header><text>The term <term>Water Districts</term> means CVWD and DWA.</text></paragraph><paragraph id="H1AB651ACBFCC4EBD80DC5A831FE28118"><enum>(60)</enum><header>Whitewater river recharge facility or facility</header><text>The terms <term>Whitewater River Recharge Facility</term> or <term>Facility</term> mean the facility that CVWD operates northwest of Palm Springs that CVWD, in cooperation with DWA, uses to replenish the Indio Subbasin.</text></paragraph></section><section id="H5AB9BEA14A54422BB4C0EE717099BA61"><enum>4.</enum><header>Ratification of Agreement</header><subsection id="H9F699D20965545E09EDBDB6E85703F25"><enum>(a)</enum><header>Ratification</header><paragraph id="H12AD92ADE0FE4BF897CB561F35401427"><enum>(1)</enum><header>In general</header><text>Except as modified by this Act, and to the extent that the Agreement does not conflict with this Act, the Agreement is authorized, ratified, and confirmed.</text></paragraph><paragraph id="H6813220B74114A32BBE5C235CDCB2104"><enum>(2)</enum><header>Amendments</header><text>If an amendment to the Agreement or an exhibit to the Agreement requiring the signature of the Secretary is executed in accordance with this Act to make the Agreement consistent with this Act, the amendment is authorized, ratified, and confirmed.</text></paragraph></subsection><subsection id="H8BAFDC71D78548CA894D09284CADFC03"><enum>(b)</enum><header>Execution</header><paragraph id="H80586F0B09D44309BE6808490D9926CD"><enum>(1)</enum><header>In general</header><text>To the extent the Agreement does not conflict with this Act, the Secretary shall execute the Agreement, including all exhibits to or parts of the Agreement requiring the signature of the Secretary.</text></paragraph><paragraph id="H4FA2CEE2B1DA4229AA87C6A50790FB49"><enum>(2)</enum><header>Modifications</header><text>Nothing in this Act prohibits the Secretary, after execution of the Agreement, from approving any modification to the Agreement, including an exhibit to the Agreement, that is consistent with this Act, to the extent that the modification does not otherwise require congressional approval under 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other applicable provision of Federal law.</text></paragraph></subsection><subsection id="H2DA330F23D4D4BF18FFD25BF11BDF746"><enum>(c)</enum><header>Environmental compliance</header><paragraph id="HE45A49FA74374661AFBA92211CE4A823"><enum>(1)</enum><header>In general</header><text>In implementing the Agreement and this Act, the Secretary shall comply with—</text><subparagraph id="H7D4AE345AF8842248F7AED65832DFD21"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph><subparagraph id="HCEC06F28E13B42BDA5E1915EFCDAB2AF"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the applicable implementing regulations of that Act; and</text></subparagraph><subparagraph id="H0FC00ECA7CD04478B6FF2EB1DBBA8B31"><enum>(C)</enum><text>all other applicable Federal environmental laws and regulations.</text></subparagraph></paragraph><paragraph id="H4D1214B996284A62ADF444B209156432"><enum>(2)</enum><header>Compliance</header><subparagraph id="HE4AE60C3969B45DBB87481F02A52B52C"><enum>(A)</enum><header>In general</header><text>In implementing the Agreement and this Act, the Tribe shall prepare any necessary environmental documents consistent with—</text><clause id="H1A43F5B75DA24138963EA38ECE40E80C"><enum>(i)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause><clause id="H753BAEB5A8F845969807B7474A0E556C"><enum>(ii)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the applicable implementing regulations of that Act; and</text></clause><clause id="H56BC79BAFB5C462FBE31845D0A28F731"><enum>(iii)</enum><text>all other applicable Federal environmental laws and regulations.</text></clause></subparagraph><subparagraph id="H88AD6019CBA84A0CB24863D39306C2EA"><enum>(B)</enum><header>Authorizations</header><text>The Secretary shall—</text><clause id="H6A76E400BAF14E28911176842B54FB9D"><enum>(i)</enum><text>independently evaluate the documentation required under subparagraph (A); and</text></clause><clause id="H4CA2BAB76CA149F0B41168BEB299D71B"><enum>(ii)</enum><text>be responsible for the accuracy, scope, and contents of that documentation.</text></clause></subparagraph></paragraph><paragraph id="HA8C911CDD209409E84B009378F39A73A"><enum>(3)</enum><header>Effect of execution</header><text>The execution of the Agreement by the Secretary under this section shall not constitute a major Federal action under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph><paragraph id="H2BC9A42F449B430397F03757C562289D"><enum>(4)</enum><header>Costs</header><text>Any costs associated with the performance of the compliance activities under this subsection shall be paid from funds deposited in the Agua Caliente Settlement Trust Fund, subject to the condition that any costs associated with the performance of Federal approval or other review of such compliance work or costs associated with inherently Federal functions shall remain the responsibility of the Secretary.</text></paragraph></subsection></section><section id="H42A4521E320D4EEDB039B1958A216B98"><enum>5.</enum><header>Tribal water right</header><subsection id="HA809CCDF1C8A4AC3A85B76DF6D81B30D"><enum>(a)</enum><header>Confirmation of tribal water right</header><paragraph id="H5D025FDC0A7449F3B02CC615B9611528"><enum>(1)</enum><header>In general</header><text>The Tribal Water Right is ratified, confirmed, and declared to be valid.</text></paragraph><paragraph id="HA98F03EF1B2843FF974A3D1E83FE86A8"><enum>(2)</enum><header>Quantification</header><text>The Tribal Water Right consists of the right to Produce and/or Use up to 20,000 AFY of Groundwater as provided in Section III of the Agreement.</text></paragraph><paragraph id="H0D381D8A7342431683CD15335AAF57A2"><enum>(3)</enum><header>Priority</header><text>The Tribal Water Right shall have a priority date no later than the 1876 and 1877 Executive Orders establishing the Reservation and is prior and paramount to all rights claimed by the Water Districts to Native Groundwater in the Indio Subbasin.</text></paragraph><paragraph id="HE4D45D03E24B4D95B6111FC39096D82A"><enum>(4)</enum><header>Use</header><text>Any Use of the Tribal Water Right shall be subject to the terms and conditions of the Agreement and this Act.</text></paragraph></subsection><subsection id="HEC1A40562E694DF7A4A633B0FF345AD9"><enum>(b)</enum><header>Intent of congress</header><text>It is the intent of Congress to provide to each Allottee benefits that are equivalent to, or exceed, the benefits the Allottees possess on the day before the enactment of this Act, taking into consideration—</text><paragraph id="H6971EA871E254E4E88CFD75A7F776B92"><enum>(1)</enum><text>the potential risks, costs, and time delay associated with litigation that would be resolved by the Agreement and this Act;</text></paragraph><paragraph id="H9ECA68435C144973A8FC5797C4951BAD"><enum>(2)</enum><text>the availability of funding under this Act from other sources;</text></paragraph><paragraph id="H86A57E09B4AC43AB836EC742931BD467"><enum>(3)</enum><text>the availability of water from the Tribal Water Right; and</text></paragraph><paragraph id="H57EE4EB0555B4C4AAFFAB8856F384B9C"> <enum>(4)</enum> <text>the applicability of section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), and this Act to protect the interest of Allottees.</text>
 </paragraph></subsection><subsection id="HC624403878684CACA59902084492D755"><enum>(c)</enum><header>Trust status of the tribal water right</header><text>The Tribal Water Right shall be held in trust by the United States on behalf of Agua Caliente and Allottees in accordance with the Agreement and this Act. The Tribal Water Right shall not be subject to State law, regulation, or jurisdiction, except as part of a comprehensive adjudication of Groundwater rights in the Indio Subbasin if permitted by applicable Federal law.</text></subsection><subsection id="H6870676DC5034E84B40BEC72813A1997"><enum>(d)</enum><header>Forfeiture and abandonment</header><text>The Tribal Water Right shall not be subject to loss through non-use, forfeiture, abandonment, or other operation of law.</text></subsection><subsection id="H444E2CD7CA4D491F8E1CBBE4417F2C45"><enum>(e)</enum><header>Authority of the tribe</header><paragraph id="HD88438AF61B54628B6A64805A172E8A7"><enum>(1)</enum><header>In general</header><text>Agua Caliente shall have the authority to Use the Tribal Water Right on the Reservation in accordance with the Agreement, this Act, and applicable Federal law.</text></paragraph><paragraph id="H0CA4808B285946409B76391064D39C9B"><enum>(2)</enum><header>Use off the reservation</header><subparagraph id="HB77201FCA22D45259F64D92C62CE01C7"><enum>(A)</enum><header>In general</header><text>Agua Caliente may Use the Tribal Water Right off the Reservation, subject to and in accordance with the terms of the Agreement, this Act, applicable Federal law, and subject to the approval of the Secretary.</text></subparagraph><subparagraph id="H0CF9EB4FBF9A4CBF98656C02E14A3BDF"><enum>(B)</enum><header>Maximum term</header><text>The maximum term of any lease, including all renewals under this paragraph, shall not exceed 99 years.</text></subparagraph></paragraph><paragraph id="H87597D211BDD4BCB9A941ACF43D4A333"><enum>(3)</enum><header>Allottee lease rights</header><text>An Allottee may lease any interest in land held by an Allottee, together with any portion of the Tribal Water Right determined to be appurtenant to the interest in the land, in accordance with the Tribe’s Water Ordinance, this Act, and the Agreement.</text></paragraph><paragraph id="H83416265621F46B19CF9EDF3EF2403E3"><enum>(4)</enum><header>Lawful purpose</header><text>Subject to the terms of the Agreement and this Act, Agua Caliente may Use the Tribal Water Right for any lawful purpose.</text></paragraph><paragraph id="H7878BC29F083417493E5F3722DA3903C"><enum>(5)</enum><header>Reuse</header><text>Agua Caliente may reuse water that has been produced as part of the Tribal Water Right, subject to and in accordance with the terms of the Agreement.</text></paragraph></subsection><subsection id="H80B133DF500148C3B1C5D5E146A48078"><enum>(f)</enum><header>Administration</header><paragraph id="H9468752D6861484A83199FBA38CA8031"><enum>(1)</enum><header>No alienation</header><text>The Tribe shall not permanently alienate any portion of the Tribal Water Right.</text></paragraph><paragraph id="HC04B0212E92949F4B247F4ED2C04E538"><enum>(2)</enum><header>Purchases or grants of land from indians</header><text>An authorization provided by this Act for the allocation, distribution, leasing, or arrangement entered into pursuant to this Act shall be considered to satisfy any requirement for authorization of the action required by Federal law.</text></paragraph><paragraph id="HE56575A66ABF4A7ABA0D9ABDB0E07D51"><enum>(3)</enum><header>Prohibition On Forfeiture</header><text>The non-use of all or any portion of the Tribal Water Right by any water user shall not result in the forfeiture, abandonment, relinquishment, or other loss of all or any portion of the Tribal Water Right.</text></paragraph><paragraph id="H489BCB6D66844563835EF27ED16F39CE"><enum>(4)</enum><header>Forbearance by the tribe</header><text>Groundwater on which the Tribe does not impose a Tribal Production Fee in accordance with the forbearance provisions of Section V(A)(3) of the Agreement will not be counted as a portion of the Tribal Water Right, and the failure to impose a Tribal Production Fee pursuant to Section V(A)(3) of the Agreement will not result in the forfeiture or abandonment or loss by other operation of law of any portion of the Tribal Water Right.</text></paragraph></subsection><subsection id="HEF0F9A1241584FFB9DC03E69FBDBF872"><enum>(g)</enum><header>Water related fees</header><paragraph id="HE6885EC61C3B4CF9A63A753653F9B858"><enum>(1)</enum><header>Preemption of the rac</header><text>The Tribal Water Right shall not be subject to a RAC, in accordance with the Agreement. The provisions of this subsection shall preempt any and all State or local laws, decisions, rules, regulations, or actions having the effect of law insofar and only insofar as they are inconsistent with the provisions of this subsection.</text></paragraph><paragraph id="H87261ED9E24747A399F63B45EAF277D0"><enum>(2)</enum><header>Tribal production fee</header><text>The Tribe shall have the authority to impose, assess, and collect a Tribal Production Fee, subject to and in accordance with the terms of the Agreement. The Tribal Production Fee shall be governed exclusively by this subsection, the Agreement, and the Tribe’s Water Ordinance.</text></paragraph><paragraph id="H600EC7577EEB4D8398055D7E334A8ABD"><enum>(3)</enum><header>Tribal water fee</header><text>The Tribe shall have the authority to impose, assess, and collect a Tribal Water Fee, subject to and in accordance with the terms of the Agreement. The Tribal Water Fee shall be governed exclusively by this subsection, the Agreement, and the Tribe’s Water Ordinance.</text></paragraph><paragraph id="H86CC1D9E86F54DBCB0C37F1DE9EEF40E"><enum>(4)</enum><header>Tribal water delivery charge</header><text>The Tribe shall have the authority to impose, assess, and collect a Tribal Water Delivery Charge, subject to and in accordance with the terms of the Agreement. The Tribal Water Delivery Charge shall be governed exclusively by this subsection, the Agreement, and the Tribe’s Water Ordinance.</text></paragraph><paragraph id="HC232CA527E77446D8218D69D52724031"><enum>(5)</enum><header>Tribal deliveries</header><text>Subject to and in accordance with the Agreement, the Tribe shall have the right to deliver water to water users on the Reservation Using the Tribal Water Right at rates, fees, and terms and conditions determined by the Tribe. Such Use of the Tribal Water Right shall not be subject to a RAC.</text></paragraph></subsection><subsection id="H89C136F18D454214B7FE1D22C238BB80"><enum>(h)</enum><header>Allottees</header><paragraph id="HBDCC0C5571D34D27AF69D7DC3CA8A618"> <enum>(1)</enum> <header>Applicability of the act of february 8, 1887</header> <text>The provisions of section 7 of the Act of February 8, 1887 (<external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), relating to the use of water for Irrigation purposes, shall apply to the Tribal Water Right.</text>
 </paragraph><paragraph id="H1CD95B4E8338479E8A76862CBCDFB566"><enum>(2)</enum><header>Entitlement to water</header><text>Any entitlement to water of an Allottee under Federal law shall be satisfied from the Tribal Water Right and from the Tribe’s surface water rights identified in subsection (m)(1).</text></paragraph><paragraph id="H440F8128EEC24BCC9EF3FDB54D380918"><enum>(3)</enum><header>Allocations</header><text>An Allottee shall be entitled to a just and equitable distribution of water for Irrigation purposes.</text></paragraph><paragraph id="H4D2BF73314C849DFA582EE8A35E12F07"><enum>(4)</enum><header>Claims</header><subparagraph id="H5A24F123F9824A968B548854E890042F"> <enum>(A)</enum> <header>Exhaustion of remedies</header> <text>Before asserting any claim against the United States under section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119, <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), or any other applicable law, an Allottee shall exhaust remedies available under the Tribe’s Water Ordinance or other applicable Tribal Law.</text>
                    </subparagraph><subparagraph id="HA52AE83F4C864CA9BE6B4C0D60DCD816">
                        <enum>(B)</enum>
                        <header>Action for relief</header>
 <text>After the exhaustion of all remedies available under the Tribe’s Water Ordinance or other applicable Tribal Law, an Allottee may seek relief under section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), or other applicable law.</text>
 </subparagraph></paragraph><paragraph id="HCD157F9FCFE946B5A13DA9DB4973047B"><enum>(5)</enum><header>Authority of the secretary</header><text>The Secretary shall have the authority to protect the rights of Allottees in accordance with this section.</text></paragraph></subsection><subsection id="H608535B558A3458D8B2318D669D7D7F0"><enum>(i)</enum><header>The tribe’s water ordinance</header><text>To the extent necessary, and subject to and in accordance with the approval of the Secretary, the Tribe shall amend the Tribe’s Water Ordinance to provide—</text><paragraph id="H666030AD7AF447D9868292799A7FABC9"><enum>(1)</enum><text>that use of water by Allottees shall be satisfied with water from the Tribal Water Right and the Tribe’s surface water right described in subsection (m)(1);</text></paragraph><paragraph id="H036F1EEAED394D51B7C510E251F11709"> <enum>(2)</enum> <text>a process by which an Allottee may request that the Tribe provide water for Irrigation in accordance with this Act, including the provision of water under any Allottee lease under section 4 of the Act of June 25, 1910 (36 Stat. 856, chapter 431; <external-xref legal-doc="usc" parsable-cite="usc/25/403">25 U.S.C. 403</external-xref>);</text>
 </paragraph><paragraph id="H3F8066EEB85B4946AE1596156ACFE82D"><enum>(3)</enum><text>a due process system for the consideration and determination by the Tribe of any request of an Allottee (or a successor in interest to an Allottee) for an allocation of water for Irrigation on an Allotment, including a process for—</text><subparagraph id="HA0F9BA21EF014BCAB8045AB04CAE1EED"><enum>(A)</enum><text>appeal and adjudication of any denied or disputed distribution of water;</text></subparagraph><subparagraph id="HF7A246DF3B4F47F394D194D510D23DC0"><enum>(B)</enum><text>resolution of any contested administrative decision; and</text></subparagraph><subparagraph id="H27EA881BD7E34EA2A3023B980DE4A594"><enum>(C)</enum><text>a requirement that any Allottee asserting a claim relating to the enforcement of rights of the Allottee under the Tribe’s Water Ordinance, including to the quantity of water allocated to land of the Allottee, shall exhaust all remedies available to the Allottee under Tribal Law before initiating an action against the United States or petitioning the Secretary pursuant to subsection (h)(4)(B); and</text></subparagraph></paragraph><paragraph id="HFC26DD52995D4BCEA6DA6EB1BA912ACB"><enum>(4)</enum><text>a process by which an owner of fee land within the Reservation may apply for Use of a portion of the Tribal Water Right, subject to and in accordance with the Agreement and this Act.</text></paragraph></subsection><subsection id="H3673A47B700044418F3E8F5A69361F16"><enum>(j)</enum><header>Action by the secretary</header><paragraph id="H9BF62665C8E54F28805AA9A1172AC157"><enum>(1)</enum><header>In general</header><text>During the period beginning on the date of enactment of this Act and ending on the date on which the Tribe’s Water Ordinance is amended pursuant to subsection (i), the Secretary shall administer, with respect to the rights of the Allottees, the Water Rights identified under subsection (i)(1).</text></paragraph><paragraph id="H86A013DF7E964BBBB7E12A514E2C62DD"><enum>(2)</enum><header>Approval</header><text>The Tribe’s Water Ordinance, amended pursuant to subsection (i), shall not be valid unless—</text><subparagraph id="HF96D55169C2B403FB004B9A97B770432"><enum>(A)</enum><text>the amendments described in that subsection have been approved by the Secretary; and</text></subparagraph><subparagraph id="HC8CF9E69B25D4ACAA0F6ACDD253C99DA"><enum>(B)</enum><text>each subsequent amendment to the Tribe’s Water Ordinance that affects the rights of an Allottee is approved by the Secretary.</text></subparagraph></paragraph><paragraph id="HDF3B150922C84ABAB62C82AC23FC5482"><enum>(3)</enum><header>Approval period</header><subparagraph id="H32D890BFB9C44787970F95D98F0271F8"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary shall approve or disapprove the Tribe’s Water Ordinance amendments described in subsection (i) not later than 180 days after the date on which the amendments are submitted to the Secretary.</text></subparagraph><subparagraph id="HF64D9D94ED6645C1A4328D31945EDF3B"><enum>(B)</enum><header>Extension</header><text>The deadline described in subparagraph (A) may be extended by the Secretary after consultation with the Tribe.</text></subparagraph></paragraph></subsection><subsection id="HC1F9652614B64E71A0D759A41D42CE4E"><enum>(k)</enum><header>Effect</header><text>Except as otherwise expressly provided in this section, nothing in this Act—</text><paragraph id="HF670A9F3C9C246B38F4C0F5BBDA8CD4F"><enum>(1)</enum><text>authorizes any action by an Allottee against any individual or entity, or against Agua Caliente, under Federal, State, Tribal, or local law; or</text></paragraph><paragraph id="H2364BCD53B3E418D86749A0E234EE10B"><enum>(2)</enum><text>alters or affects the status of any action brought pursuant to section 1491(a) of title 28, United States Code.</text></paragraph></subsection><subsection id="HFC442E3463FF433BB0E4E558B8C64C1C"><enum>(l)</enum><header>Domestic water service</header><text>Subject to and in accordance with the Agreement, the Water Districts shall have the authority to provide Domestic Water Service on the Reservation.</text></subsection><subsection id="HCD326F587B0844428D46B2B3AB93065F"><enum>(m)</enum><header>Tribe’s surface water rights</header><paragraph id="H9CE872F703784FB4802B5DDAD1168A0D"><enum>(1)</enum><header>Tahquitz creek and andreas creek</header><text>The Tribe’s water rights in Tahquitz Creek and Andreas Creek, as described in Section VII(A) of the Agreement, shall be held in trust by the United States on behalf of the Tribe and Allottees in accordance with the Agreement and this Act. The Tribe’s Diversion and Use of the surface water shall be subject to and in accordance with the Agreement.</text></paragraph><paragraph id="H81B223F08E6E48B1967A2E501F65B1EB"><enum>(2)</enum><header>Whitewater ranch</header><text>The Tribe’s water rights to the surface water at Whitewater Ranch, as described in Section VII(B) of the Agreement, shall be held in trust by the United States on behalf of the Tribe in accordance with the Agreement and this Act. The Tribe’s Diversion and Use of the surface water shall be subject to and in accordance with the Agreement.</text></paragraph></subsection><subsection id="H07E07A0705264A06B90363528696A51D"><enum>(n)</enum><header>Traditional and cultural uses</header><text>The Tribe and Tribal Members shall have the right to produce and use water from wells, streams, seeps, and springs on the Reservation for traditional and cultural purposes. Such uses shall not be counted as use of the Tribal Water Right as long as it is for Non-consumptive use.</text></subsection><subsection id="H672EBC370F524EAD85C30890382B7B50"><enum>(o)</enum><header>Storage of imported water</header><text>The Tribe shall have the right to store Imported Water in the Indio Subbasin and recover such stored water, subject to and in accordance with the Agreement.</text></subsection></section><section id="H3A2F41A4D9324F72B07E571D62F23E0D"><enum>6.</enum><header>Settlement trust fund</header><subsection id="H71D5876FCE7A4325AB0DA9F2EF89CC09"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a trust fund, to be known as the <quote>Agua Caliente Settlement Trust Fund</quote>, to be managed, invested, and distributed by the Secretary and to remain available until expended, withdrawn, or reverted to the general fund of the Treasury, consisting of amounts deposited in the Agua Caliente Settlement Trust Fund under subsection (c), together with any investment earnings, including interest, earned on those amounts, for the purpose of carrying out this Act.</text></subsection><subsection id="HC41BD0441B1F4A6D95B964F0B6A3E038"><enum>(b)</enum><header>Agua caliente settlement trust fund accounts</header><text>The Secretary shall establish in the Agua Caliente Settlement Trust Fund the following accounts:</text><paragraph id="HED11B8A34E2C41EB985E95F7A9C61B8F"><enum>(1)</enum><text>Agua Caliente Development Projects Account.</text></paragraph><paragraph id="H3B2F8524ABDE4E8F938D70866E08D099"><enum>(2)</enum><text>Agua Caliente Groundwater Augmentation Account.</text></paragraph><paragraph id="HBC0F704CC04449E188D4A8941BD70E22"><enum>(3)</enum><text>Agua Caliente Water Management Account.</text></paragraph><paragraph id="H49BC41CEA0A7436DA6C1AD5AB09C4612"><enum>(4)</enum><text>Agua Caliente Operation, Maintenance, and Replacement Costs Account.</text></paragraph></subsection><subsection id="H5BAFCF08A2A1495F9A03624ECBEEDC63"><enum>(c)</enum><header>Deposits</header><text>The Secretary shall deposit in the Agua Caliente Settlement Trust Fund the amounts made available under section 7(a).</text></subsection><subsection id="H328FE22FE56047619FAB177BB3F5D07E"><enum>(d)</enum><header>Management and interest</header><paragraph id="H9C672D2B05E34EE99152B35C01EC81AF"><enum>(1)</enum><header>Management</header><text>On receipt and deposit of funds into the Agua Caliente Settlement Trust Fund under subsection (c), the Secretary shall manage, invest, and distribute all amounts in the Agua Caliente Settlement Trust Fund in a manner that is consistent with the investment authority of the Secretary under—</text><subparagraph id="H430117AC2D6C49F5BBC8B02C7768154D"> <enum>(A)</enum> <text>the first section of the Act of June 24, 1938 (<external-xref legal-doc="usc" parsable-cite="usc/25/162a">25 U.S.C. 162a</external-xref>);</text>
 </subparagraph><subparagraph id="HCA5E0F9C21F64B56B91FD3F09938FF67"><enum>(B)</enum><text>the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H2ADA6EB550164FC89A00CE151B729491"><enum>(C)</enum><text>this subsection.</text></subparagraph></paragraph><paragraph id="H3C88FB88E59545B58CC8C66BD3294EB7"><enum>(2)</enum><header>Investment earnings</header><text>In addition to the amounts deposited under subsection (c), any investment earnings, including interest, earned on those amounts, held in the Agua Caliente Settlement Trust Fund are authorized to be used in accordance with subsections (e) and (h).</text></paragraph></subsection><subsection id="HC1209BE1B02E4DB19E403CDFC74BE5C3"><enum>(e)</enum><header>Availability of amounts</header><paragraph id="H8EC5FDDBC0244C4EB7C9EE25097CCD5F"><enum>(1)</enum><header>In general</header><text>Amounts appropriated to, and deposited in, the Agua Caliente Settlement Trust Fund, including any investment earnings or interest earned on those amounts, shall be made available to the Tribe by the Secretary beginning on the Enforceability Date, subject to the requirements of this section, except for funds to be made available to the Tribe pursuant to paragraph (2).</text></paragraph><paragraph id="H4B93616C75524974BF1FF90BC7F2610B"><enum>(2)</enum><header>Implementation and initial development project funds</header><text>Notwithstanding paragraph (1), $50,000,000 of the amounts deposited into the Agua Caliente Development Projects Account shall be available to the Tribe on the date on which the amounts are deposited, for uses described in subsection (h)(1).</text></paragraph></subsection><subsection id="HD47141042D8C46B39211D1DCC3BB4CDE"><enum>(f)</enum><header>Withdrawals</header><paragraph id="H4D479F34E2F7496FAB29B732E712AD2D"><enum>(1)</enum><header>Withdrawals by the tribe under the american indian trust fund management reform act of 1994</header><subparagraph id="HB476BD591DD74F2FBBBC4DAC3AAA65AD"><enum>(A)</enum><header>In general</header><text>The Tribe may withdraw any portion of the amounts in the Agua Caliente Settlement Trust Fund on approval by the Secretary of a Tribal management plan submitted by the Tribe in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>).</text></subparagraph><subparagraph id="H524CB0FE85764F3DA381223078F891DA"><enum>(B)</enum><header>Requirements</header><text>In addition to the requirements under the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>), the Tribal management plan under this paragraph shall require that the Tribe shall spend all amounts withdrawn from the Agua Caliente Settlement Trust Fund, and any investment earnings (including interest) earned in those amounts, through the investments under the Tribal management plan, in accordance with this Act and the Agreement.</text></subparagraph><subparagraph id="H25C926285C964C809C19EE45FDC9180C"><enum>(C)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce the Tribal management plan under this paragraph to ensure that amounts withdrawn by the Tribe from the Agua Caliente Settlement Trust Fund under subparagraph (A) are used in accordance with this Act.</text></subparagraph></paragraph><paragraph id="H9A3D8A0079814ABA9C88D79AC3FFB6FE"><enum>(2)</enum><header>Withdrawals by tribe pursuant to an expenditure plan</header><subparagraph id="H42E161B057E74344BDEF22A23C062B96"><enum>(A)</enum><header>In general</header><text>The Tribe may submit to the Secretary a request to withdraw amounts from the Agua Caliente Settlement Trust Fund pursuant to an approved expenditure plan.</text></subparagraph><subparagraph id="HED7838A98B084E7296C59702C03D3B99"><enum>(B)</enum><header>Requirements</header><text>To be eligible to withdraw amounts under an expenditure plan under subparagraph (A), the Tribe shall submit to the Secretary an expenditure plan for any portion of the Agua Caliente Settlement Trust Fund the Tribe elects to withdraw pursuant to this subparagraph, subject to the condition that the amounts shall be used for the purposes described in this Act and the Agreement.</text></subparagraph><subparagraph id="H61BCEE73A8D54D9C9E16A69F3DE0B93A"><enum>(C)</enum><header>Inclusions</header><text>An expenditure plan submitted under this paragraph shall include a description of the manner and purpose for which the amounts proposed to be withdrawn from the Agua Caliente Settlement Trust Fund will be used by the Tribe, in accordance with this subsection and subsection (h).</text></subparagraph><subparagraph id="H8141FE9B07B64931BA21803E36FA494F"><enum>(D)</enum><header>Approval</header><text>The Secretary shall approve an expenditure plan submitted under subparagraph (A) if the Secretary determines that the expenditure plan—</text><clause id="H215E7380FAE34A3C95C63B7E2D2E0E8C"><enum>(i)</enum><text>is reasonable; and</text></clause><clause id="HEA1BD333E493469196BA27F99C46F0CB"><enum>(ii)</enum><text>is consistent with, and will be used for, the purposes of this Act.</text></clause></subparagraph><subparagraph id="H94D31C368F16454E81A0B807C60B7E1B"><enum>(E)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce an expenditure plan to ensure that amounts withdrawn under this paragraph are used in accordance with this Act.</text></subparagraph></paragraph></subsection><subsection id="H34692FA9AD2D400C8742FF90C63E658F"><enum>(g)</enum><header>Effect of section</header><text>Nothing in this section gives the Tribe the right to judicial review of a determination by the Secretary relating to whether to approve the Tribal management plan under paragraph (1) of subsection (f) or an expenditure plan under paragraph (2) of that subsection, except under subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subsection><subsection id="H7EC58297ECF64079B2B789616CE5A538"><enum>(h)</enum><header>Uses</header><paragraph id="H6DDEE122362144B5A2C2C9BE3BC80CBE"><enum>(1)</enum><header>Agua caliente development projects account</header><text>The Agua Caliente Development Projects Account established under subsection (b)(1) may be used for the cost of planning, permitting, designing, engineering, investing in, and constructing water-related projects and facilities which improve the water supply, water reliability, water infrastructure, or water quality for water supplying the Agua Caliente Indian Reservation or the Indio Subbasin, including but not limited to recycling projects, and for conducting related activities, including environmental compliance in the development and construction of projects under this Act.</text></paragraph><paragraph id="HDD2CCBA70D114A1F9A9F73EB5EAC5028"><enum>(2)</enum><header>Agua caliente groundwater augmentation account</header><text>The Agua Caliente Groundwater Augmentation Account established under subsection (b)(2) shall be used by the Tribe, subject to and in accordance with the Agreement, to reimburse, together with any interest earned on those funds, the Water Districts for investments that the Water Districts have made or will make in projects that will augment Groundwater supplies in the Indio Subbasin and support Groundwater levels under the Reservation.</text></paragraph><paragraph id="H83CEE173B4F44242A62B6C512E2BCC7A"><enum>(3)</enum><header>Agua caliente water management account</header><text>The Agua Caliente Water Management Account established under subsection (b)(3) may be used for Tribal Water Right management and administration.</text></paragraph><paragraph id="H591A29D0335742DF9024AFEC40F274E9"><enum>(4)</enum><header>Agua caliente operation, maintenance, and replacement costs account</header><text>The Agua Caliente Operation, Maintenance and Replacement Costs Account established under subsection (b)(4) may be used for operating, maintaining, rehabilitating, reconstructing and replacing water infrastructure for any Agua Caliente Development Projects, including but not limited to recycled water projects.</text></paragraph></subsection><subsection id="H5088E98371D4433792F91CE98080214C"><enum>(i)</enum><header>Liability</header><text>The Secretary and the Secretary of the Treasury shall not be liable for the expenditure or investment of any amounts withdrawn from the Agua Caliente Settlement Trust Fund by the Tribe under paragraph (1) or (2) of subsection (f).</text></subsection><subsection id="HF8663C9152254F0BA2BED6BD6FF0C22F"><enum>(j)</enum><header>Expenditure reports</header><text>The Tribe shall annually submit to the Secretary an expenditure report describing accomplishments and amounts spent from the use of withdrawals under the Tribal management plan or an expenditure plan under paragraph (1) or (2) of subsection (f), as applicable.</text></subsection><subsection id="H680E6A7F8FCB464191A3E7EC5E7F91E9"><enum>(k)</enum><header>No per capita distributions</header><text>No portion of the Agua Caliente Settlement Trust Fund shall be distributed on a per capita basis to any Tribal Member.</text></subsection><subsection id="H0035C2FDE73A433691E7B175832B537F"><enum>(l)</enum><header>Title to infrastructure</header><paragraph id="H0988AB2A4EE14CB9A99BB5CAB20275D2"><enum>(1)</enum><text>Title to, control over, and operation of any project constructed using funds from the Agua Caliente Settlement Trust Fund shall remain in the Tribe, unless the Tribe otherwise agrees, and except for projects that receive funding under this Act, only through the Agua Caliente Groundwater Augmentation Account, in accordance with the Agreement.</text></paragraph><paragraph id="HCB1F5DFB4F3047B28F212CDB09A99397"><enum>(2)</enum><text>Notwithstanding section 5(i), if the Tribe and a Water District agree to fund a project from both the Agua Caliente Groundwater Augmentation Account and other sources of funding secured by the Tribe, the Tribe and Water District will determine appropriate title, control, and operation of the project or project components.</text></paragraph></subsection><subsection id="H5BE5137EEE3B454BB2522F6C87BA5228"><enum>(m)</enum><header>Operation, maintenance, and replacement costs</header><paragraph id="HE6C724D2989D4A86A259F4345B547D1B"><enum>(1)</enum><text>All operation, maintenance, and replacement costs of any project constructed using funds from the Agua Caliente Settlement Trust Fund shall be the responsibility of the Tribe, unless the Tribe otherwise agrees, and except for projects that receive funding under this Act, only through the Agua Caliente Groundwater Augmentation Account, in accordance with the Agreement.</text></paragraph><paragraph id="H607EC1E353B443D2AF69E9A55416ACF9"><enum>(2)</enum><text>Notwithstanding section 5(i), if the Tribe and a Water District agree to fund a project from both the Agua Caliente Groundwater Augmentation Account and other sources of funding secured by the Tribe, the Tribe and Water District will determine the appropriate sharing of operation, maintenance, and replacement costs.</text></paragraph></subsection></section><section id="H9A704F859A134367BB954E61798379A3"><enum>7.</enum><header>Funding</header><subsection id="HE70F0FBF0F31480E96A0E01670853E8B"><enum>(a)</enum><header>Mandatory appropriations</header><text>Out of any money in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary the following amounts to deposit in the following accounts:</text><paragraph id="H21F0425625D04770BE4141FDA0B5C052"><enum>(1)</enum><header>Agua caliente development projects account</header><text>$300,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></paragraph><paragraph id="HD0D19E3312BA4EDCBE2F495A76DCC091"><enum>(2)</enum><header>Agua Caliente Groundwater augmentation account</header><text>$100,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></paragraph><paragraph id="H393CCDC01A22465DB9406759E497516A"><enum>(3)</enum><header>Agua Caliente Water management account</header><text>$50,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></paragraph><paragraph id="H2E27CC7921BC4A408AB64DB099899601"><enum>(4)</enum><header>Agua Caliente Operation, maintenance and replacement costs account</header><text>$50,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></paragraph></subsection><subsection id="HDAEB0E3D317646F4BAAACBA1E3DA512D"><enum>(b)</enum><header>Fluctuation in costs</header><paragraph id="H21C82E42AD5D4D71B94F9AB0ADBD1A7E"><enum>(1)</enum><header>In general</header><text>The amounts appropriated under subsection (a) shall be increased or decreased, as appropriate, by such amounts as may be justified by reason of ordinary fluctuations in costs, as indicated by the Bureau of Reclamation Construction Cost Index-Composite Trend.</text></paragraph><paragraph id="H2A34F01ABE424F44859A17B7B5686799"><enum>(2)</enum><header>Construction cost adjustment</header><text>The amounts appropriated under subsection (a) shall be adjusted to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering costs indices, as determined by the Secretary, including repricing applicable to the types of construction and current industry standards involved.</text></paragraph><paragraph id="HD73A0877EB4C4A6D86F66A7077B3440A"><enum>(3)</enum><header>Repetition</header><text>The adjustment process under this subsection shall be repeated for each subsequent amount appropriated until the authorized amount, as adjusted, has been appropriated.</text></paragraph><paragraph id="H9A21A0FB13474DA7B3C907CFB33BB3CE"><enum>(4)</enum><header>Period of indexing</header><text>The period of indexing and adjustment under this subsection for any increment of funding shall start on May 19, 2025, and shall end on the date on which funds are deposited in the Agua Caliente Settlement Trust Fund.</text></paragraph></subsection></section><section id="HCE94B05A37554BCE9CB4DD074CC02F2D"><enum>8.</enum><header>Enforceability date</header><subsection id="H078FEEC1BA344C949D04D76F52EAB2A1"><enum>(a)</enum><header>In general</header><text>The enforceability date shall be the date on which the Secretary publishes in the Federal Register a statement of findings that—</text><paragraph id="H80763BCFB41840E68F0E6165AB69851B"><enum>(1)</enum><text>to the extent that the Agreement conflicts with this Act, the Agreement has been amended to conform with this Act;</text></paragraph><paragraph id="HF6F7D54584E2472AA1D1207A2BBFAF9B"><enum>(2)</enum><text>the Agreement, as amended, has been executed by the all the parties to the Agreement, including the United States;</text></paragraph><paragraph id="HE39D7B8153DB447998D7030EAEA2444B"><enum>(3)</enum><text>Congress has fully appropriated, or the Secretary has provided from other sources, all funds for deposit in the accounts under section 7(a);</text></paragraph><paragraph id="H330F8834321D47819963801AFB90C121"><enum>(4)</enum><text>the Decree Court has approved the Agreement and entered the Final Judgment and Decree; and</text></paragraph><paragraph id="HD1B50A65F0E1499EA213661ABB205B6A"><enum>(5)</enum><text>the waivers and releases under section 9 have been executed by the Tribe and the Secretary.</text></paragraph></subsection><subsection id="HF4A74538CFC84189AA9A448F591549C3"><enum>(b)</enum><header>Expiration</header><paragraph id="HDD37EB553A3F4DA2B6AB99F6821E1D04"><enum>(1)</enum><header>In general</header><text>This Act shall expire in any case in which the Secretary fails to publish a statement of findings under subsection (a) by not later than—</text><subparagraph id="HC543307ED8D848B495652B8FABF011FE"><enum>(A)</enum><text>December 31, 2035; or</text></subparagraph><subparagraph id="HEAE45A4661264D488AF602F82311EAFE"><enum>(B)</enum><text>such alternative later date as is agreed to by the Tribe, the Secretary, CVWD, and DWA.</text></subparagraph></paragraph><paragraph id="H050C73C4527B48708E4050925E71AD54"><enum>(2)</enum><header>Consequences</header><text>If this Act expires under paragraph (1)—</text><subparagraph id="HCE260E9E0DBA46B4B839C415C8B526FE"><enum>(A)</enum><text>the waivers and releases under subsections (a), (b), and (c) of section 9 shall not become effective;</text></subparagraph><subparagraph id="HC788C9BFEE024EFDAB1D1CB8BA2331C4"><enum>(B)</enum><text>the authorization, ratification, confirmation, and execution of the Agreement under section 4 shall no longer be effective;</text></subparagraph><subparagraph id="H77EBB9CC13114164B8E7C359849C1FFB"><enum>(C)</enum><text>any action carried out by the Secretary, and contract or agreement entered into, pursuant to this Act shall be void;</text></subparagraph><subparagraph id="H56A71E082CC94EA0ADD5629FFDA5DDAB"><enum>(D)</enum><text>any unexpended Federal funds appropriated or made available to carry out the activities authorized by this Act, together with any interest earned on those funds, and any water rights or contracts to use water and title to other property acquired or constructed with Federal funds appropriated or made available to carry out the activities authorized by this Act, shall be returned to the Federal Government, unless otherwise agreed to by the Tribe and the United States and approved by Congress; and</text></subparagraph><subparagraph id="H5827583CE95547FEA57300DE7EE5F484"><enum>(E)</enum><text>except for Federal funds used to acquire or construct property that is returned to the Federal Government under subparagraph (D), the United States shall be entitled to offset any Federal funds made available to carry out this Act that were expended or withdrawn, or any funds made available to carry out this Act from other Federal authorized sources, together with any interest accrued on those funds, against any Claim against the United States relating to water rights in the State as asserted by the Tribe or any user of the Tribe’s rights or any other matter covered by this subsection; or in any future settlement of water rights of the Tribe.</text></subparagraph></paragraph></subsection></section><section id="H945E497A6B4948EA808662B926BD3BF6"><enum>9.</enum><header>Waiver and release of claims</header><subsection id="H9472F072808C4EA598C79A34A92E6A36"><enum>(a)</enum><header>Waivers and releases of claims by the tribe and the united states as trustee for the tribe</header><text>Subject to the reservation of rights and retention of Claims set forth in subsection (e), as consideration for the recognition of the Tribal Water Right and the other benefits described in the Agreement and this Act, the Tribe on its own behalf (and on behalf of Tribal Members where the Claims of the Tribal Members derive from rights of the Tribe) and the United States, acting as trustee for the Tribe, shall execute a waiver and release of all Claims for—</text><paragraph id="HCA3216ABAC2B4FED8CE9540D76C0A2FF"><enum>(1)</enum><text>water rights that the Tribe, or the United States acting as trustee for the Tribe, asserted or could have asserted in any proceeding, including the Agua Caliente Litigation, on or before the Enforceability Date, except to the extent that such rights are recognized in the Agreement and this Act;</text></paragraph><paragraph id="H21F790293A794095BE87F1B7BB931D08"><enum>(2)</enum><text>rights to pore space that the Tribe, or the United States acting as trustee for the Tribe, asserted or could have asserted in any proceeding, including the Agua Caliente Litigation, on or before the Enforceability Date, except to the extent that rights related to pore space are recognized in the Agreement and this Act;</text></paragraph><paragraph id="H65EC71E004A34207B729892168ED743B"><enum>(3)</enum><text>damages, losses, or injuries to water rights or claims of interference with, diversion of, or taking of water rights (including Claims for injury to land resulting from such damages, losses, injuries, interference with, diversion, or taking of water rights) against CVWD or DWA arising or occurring at any time up to and including the Enforceability Date or arising or occurring after the Enforceability Date as the result of actions consistent with the provisions of the Agreement and this Act;</text></paragraph><paragraph id="H4657E1DA1139463B883EA23310F47E75"><enum>(4)</enum><text>damages, losses, or injuries resulting from Groundwater overdraft, including subsidence or loss of storage capacity, against CVWD or DWA arising or occurring at any time up to and including the Enforceability Date or arising or occurring after the Enforceability Date as the result of actions consistent with the provisions of the Agreement and this Act;</text></paragraph><paragraph id="H58C2FAE5413F45A0B2DBC3427FC84775"><enum>(5)</enum><text>damages, losses, or injuries resulting from CVWD’s or DWA’s imposition, assessment, levy, charge, or collection of RAC on the Reservation at any time up to and including the Enforceability Date or arising or occurring after the Enforceability Date as the result of actions consistent with the provisions of the Agreement and this Act;</text></paragraph><paragraph id="HCC735FE7D6E443EA8BFBCC0B18792319"><enum>(6)</enum><text>water quality degradation against CVWD and DWA where the water that is the basis for the Claim meets all relevant Federal and State water quality requirements;</text></paragraph><paragraph id="H3442AE13D3A5477E95D021DB8FC6C790"><enum>(7)</enum><text>damages, losses or injuries resulting from CVWD’s or DWA’s exercise of their authority under California law to provide water service to customers on the Reservation at any time up to and including the Enforceability Date, or after the Enforceability Date when as a result of actions consistent with the Agreement and this Act; and</text></paragraph><paragraph id="H4D538590CF044ACE8B844A7112513687"><enum>(8)</enum><text>damages, losses, or injuries arising out of, or relating to, the negotiation, execution, or adoption of the Agreement or the negotiation or execution of this Act.</text></paragraph></subsection><subsection id="HB8932FE2ED3642FA8D74E410323BF657"><enum>(b)</enum><header>Waivers and releases of claims by the united states as trustee for allottees</header><text>Subject to the reservation of rights and the retention of Claims under subsection (e), and in consideration for recognition of the Tribal Water Right and the other benefits described in the Agreement and this Act, the United States, acting as trustee for the Allottees, shall execute a waiver and release of all Claims for water rights within the Reservation that the United States, acting as trustee for the Allottees, asserted or could have asserted in any proceeding, including the Agua Caliente Litigation, on or before the Enforceability Date, except to the extent that such rights are recognized in the Agreement and this Act.</text></subsection><subsection id="HA2E838EBC9314A7D832F1FF9B00DDC66"><enum>(c)</enum><header>Waivers and releases of claims by the tribe against the united states</header><text>Subject to the reservation of rights and retention of Claims under subsection (e), the Tribe shall execute a waiver and release of all Claims against the United States (including any agency or employee of the United States) for or related to—</text><paragraph id="H8E32673869F348C7B739641D0B14C765"><enum>(1)</enum><text>water rights that the United States, acting as trustee for the Tribe, asserted or could have asserted in any proceeding, including the Agua Caliente Litigation, on or before the Enforceability Date, except to the extent that such rights are recognized as part of the Tribal Water Right under the Agreement or this Act;</text></paragraph><paragraph id="HF04D098532F949C29914A44817068341"><enum>(2)</enum><text>foregone benefits from non-Tribal use of water, on and off the Reservation, first arising before the Enforceability Date;</text></paragraph><paragraph id="H884A44AF80DD442892170B29CAF9B8A4"><enum>(3)</enum><text>damages, losses, or injuries to water, water rights, land, or natural resources due to loss of water or water rights (including damages, losses, or injuries to hunting, fishing, gathering, or cultural rights due to loss of water or water rights, Claims relating to interference with, diversion of, or taking of water, or Claims relating to failure to protect, acquire, replace, or develop water, water rights, or water infrastructure) first arising before the Enforceability Date;</text></paragraph><paragraph id="HF46395B73C0F4A3AA93445BF847EB983"><enum>(4)</enum><text>failure to prevent degradation of water quality in the Indio Subbasin consistent with the Agreement, or resulting from use of Recycled Water under the Agreement;</text></paragraph><paragraph id="HC2CEC71A088C43F99A91F07A37DCA419"><enum>(5)</enum><text>failure of CVWD or DWA to deliver Domestic Water, or provide Domestic Water Service, to Reservation Customers under terms consistent with the Agreement and the exhibits thereto;</text></paragraph><paragraph id="HDD2F5B5FC3024249B3FABE5436ACC97E"><enum>(6)</enum><text>failure of CVWD or DWA to comply with the Memorandum of Cooperation;</text></paragraph><paragraph id="H6358E02FC459436589AAE7BAAA3A0019"> <enum>(7)</enum> <text>failure of the City of Palm Springs to comply with a future agreement for a RW Project described in Section XVI(B) of the Agreement;</text>
 </paragraph><paragraph id="H437A054987F740189267DA5EBDA0B2A3"><enum>(8)</enum><text>failure of the County of Riverside to comply with an intergovernmental agreement entered into under section 11(b)(6) of this Act;</text></paragraph><paragraph id="H898309ED5F8B4C62BA62B6A20B2EE931"><enum>(9)</enum><text>the litigation of Claims relating to any water right of the Tribe in the Indio Subbasin, first arising before the Enforceability Date; and</text></paragraph><paragraph id="H3AEA6622B427499CA7A2BF3830C607CC"><enum>(10)</enum><text>damages, losses, or injuries arising out of, or relating to, the negotiation, execution, or adoption of the Agreement or the negotiation or execution of this Act, first arising before the Enforceability Date.</text></paragraph></subsection><subsection id="HEC122F191BB14ADC97F8E69E66318C29"><enum>(d)</enum><header>Effective date</header><text>The waivers and releases described in subsections (a), (b), and (c) shall take effect on the Enforceability Date.</text></subsection><subsection id="H21B23276D8054AA3B9188908A0BF2041"><enum>(e)</enum><header>Reservation of rights and retention of claims by the tribe and the united states as trustee for the tribe and allottees</header><text>Notwithstanding the waivers and releases under subsections (a), (b), and (c), the Tribe and the United States, acting as trustee for the Tribe and Allottees, shall retain—</text><paragraph id="H31A72BB171514C7B89DA6BE3B8866E5D"><enum>(1)</enum><text>all Claims for enforcement of the Agreement, this Act, and the Final Judgment and Decree;</text></paragraph><paragraph id="H5EEBAE185E564AC38EB62D20F53579F9"><enum>(2)</enum><text>except as provided by Sections XIV(D) and XV(C) of the Agreement, all Claims under State and Federal law related to activities affecting the quality of water, including Claims under—</text><subparagraph id="HAB06992A6B594A9A97202A603C99D75C"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) and amendments thereto, including for damages to natural resources;</text></subparagraph><subparagraph id="HF1A4FD5AC2E0483593403B1811469DD6"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="H69B14C726E464985B78B867F08900E77"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (commonly referred to as the <quote>Clean Water Act</quote>) and amendments thereto; and</text></subparagraph><subparagraph id="H0D5A8870738E4E3F9101CF8B8E2A8356"><enum>(D)</enum><text>any regulations implementing the Acts described in subparagraphs (A) through (C).</text></subparagraph></paragraph><paragraph id="H8A052BC3E27D4ED092393A8C669735DC"><enum>(3)</enum><text>the right to use and protect water rights acquired after the enactment of this Act;</text></paragraph><paragraph id="HCC11960332F64C008C51AA73A2885025"> <enum>(4)</enum> <text>Claims for damages, losses, or injuries to land or natural resources, including hunting, fishing, gathering, or cultural rights, that are not due to loss of water or water rights under subsection (a)(3) and are not covered by subsections (a)(2) and (a)(4) through (a)(7);</text>
                </paragraph><paragraph id="HFF7022DBAE0A4140A8BD70CA4E797F7B">
                    <enum>(5)</enum>
 <text>Claims for damages, losses, or injuries resulting from a Water District’s failure to obtain the requisite permission, consent, or authority to use or to construct and maintain water infrastructure or other improvements on Agua Caliente Indian Reservation Trust Land as required by Federal law;</text>
                </paragraph><paragraph id="H7D846E15933A4CB89790B3C9F0C7B769">
                    <enum>(6)</enum>
 <text>Claims for damages, losses, or injuries resulting from a Water District’s negligent, reckless, or willful misconduct;</text>
 </paragraph><paragraph id="HAA3A86546CF74FE19667095CE9E32E71"><enum>(7)</enum><text>all rights, remedies, privileges, immunities, and powers and Claims not waived and released pursuant to the Agreement or this Act; and</text></paragraph><paragraph id="H9A14DCB82A5D4CBB9F9C05485BDA78A9"><enum>(8)</enum><text>the right to assert all defenses, including sovereign immunity, that the Tribe and United States otherwise could assert in response to the Claims retained by CVWD and DWA in section XIX(F) of the Agreement.</text></paragraph></subsection><subsection id="HB579AE0EAE1B4A08B3CBA8A309F60016"><enum>(f)</enum><header>Effect of title</header><text>Nothing in this Act—</text><paragraph id="HB244582E17444D73A8B3ABD8BD882795"><enum>(1)</enum><text>reduces or extends the sovereignty (including civil and criminal jurisdiction) of any government entity, except to the degree that specific actions are preempted, prohibited, authorized, or required;</text></paragraph><paragraph id="H5216FF5205C9412E8A92D32B491FF72F"><enum>(2)</enum><text>affects the ability of the United States, acting as sovereign, to carry out any activity authorized by law, including—</text><subparagraph id="H8D7235119F0E445D879B94564AB7A918"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) and amendments thereto;</text></subparagraph><subparagraph id="H053367C970DC4A0CAE446135D7D03117"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>) and amendments thereto;</text></subparagraph><subparagraph id="HDA6B762C53D747AF9D25B6156904AE8A"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (commonly referred to as the <quote>Clean Water Act</quote>) and amendments thereto;</text></subparagraph><subparagraph id="HA31FB399220247059A0EBDE9EB55573D"><enum>(D)</enum><text>the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>); and</text></subparagraph><subparagraph id="HC052D770A1234F67AF2F62029824E858"><enum>(E)</enum><text>any regulations implementing the Acts described in subparagraphs (A) through (D).</text></subparagraph></paragraph><paragraph id="HA270D3B96B004FE19F0DADF5CCCCF216"><enum>(3)</enum><text>affects the ability of the United States to act as trustee for any other Indian Tribe or an allottee of any other Indian Tribe;</text></paragraph><paragraph id="HAFF6DD65AFAC49E2BE0BCBBDE0D74231"><enum>(4)</enum><text>confers jurisdiction on any State court—</text><subparagraph id="HD95CBD1B3ABB4E1F978DFEDDFAB65A9B"><enum>(A)</enum><text>to interpret Federal law relating to health, safety, or the environment;</text></subparagraph><subparagraph id="HCD705B1D6F2F4D8EB626F75A39C1DBB1"><enum>(B)</enum><text>to determine the duties of the United States or any other party under Federal law regarding health, safety, or the environment;</text></subparagraph><subparagraph id="H3B60AFD1CAEE48839A099B6C34968FF0"><enum>(C)</enum><text>to conduct judicial review of a Federal agency action; or</text></subparagraph><subparagraph id="H7DB38397A39F449E9701BFF2F3D4EE2B"><enum>(D)</enum><text>to interpret Tribal Law; or</text></subparagraph></paragraph><paragraph id="H355FCE6251DC41F0802D256D68A08CC9"><enum>(5)</enum><text>waives any Claim of a Tribal Member in an individual capacity that does not derive from a right of the Tribe.</text></paragraph></subsection><subsection id="H81A4956E86644212AE05EF4F978BE5FB"><enum>(g)</enum><header>Tolling of claims</header><paragraph id="HAA39C9AADF6848E29BBB61E936C17E60"><enum>(1)</enum><header>In general</header><text>Each applicable period of limitation and time-based equitable defense relating to a Claim described in this section or in Section XIX of the Agreement shall be tolled for the period beginning on the date of enactment of this Act and ending on the Enforceability Date.</text></paragraph><paragraph id="HB25DB1F29ACB40F6BC7B35F318BA3A75"><enum>(2)</enum><header>Effect of subsection</header><text>Nothing in this subsection revives any Claim or tolls any period of limitation or time-based equitable defense that expired before the date of enactment of this Act.</text></paragraph><paragraph id="H85B8AF45EFD44EE4BAC250C0510E08C7"><enum>(3)</enum><header>Limitation</header><text>Nothing in this section precludes the tolling of any period of limitation or any time-based equitable defense under any other applicable law.</text></paragraph></subsection></section><section id="H9F046FA392CC46D587D5CDE7B8BAE959"><enum>10.</enum><header>Satisfaction of claims</header><subsection id="H257040D1667E4563B555897CA54D113D"><enum>(a)</enum><header>In general</header><text>The benefits provided to the Tribe under this Act shall be in complete replacement of, complete substitution for, and full satisfaction of all Claims of the Tribe against the United States that are waived and released pursuant to section 9(c).</text></subsection><subsection id="HBFC3302206AC48C8A9010BD3DC79B0E3"><enum>(b)</enum><header>Allottee claims</header><text>The benefits realized by the Allottees under this Act shall be in complete replacement of, complete substitution for, and full satisfaction of—</text><paragraph id="H4FFC8D41BB784B37BFC23A4BBDC725C9"><enum>(1)</enum><text>all Claims that are waived and released pursuant to section 9(b); and</text></paragraph><paragraph id="HC1A8672DCB744EB4AB719AD2EC85B80C"><enum>(2)</enum><text>any Claims of the Allottees against the United States that the Allottees have or could have asserted that are similar in nature to any claim described in section 9(b).</text></paragraph></subsection></section><section id="H615F0A7657414AD29ABB5C6C4171F2D8"><enum>11.</enum><header>Possessory interest tax</header><subsection id="HA4710E4BF66E4CE68F29F2E6ECC35D9E"><enum>(a)</enum><header>Preemption of riverside county ad valorem property tax</header><paragraph id="H98F9E61E329A4BB3AEABAB5ABB9ADF68"><enum>(1)</enum><header>In general</header><text>No Possessory Interest shall be subject to the Riverside County Ad Valorem Property Tax for any taxable period when the Tribe imposes a Tribal Tax on such Possessory Interest. The provisions of this section shall preempt any and all State or local laws, decisions, rules, regulations, or actions having the effect of law insofar as inconsistent with the provisions of this section.</text></paragraph><paragraph id="HDC7BDF22D0BD497BB78D581F820C82B6"><enum>(2)</enum><header>Limited applicability</header><text>The preemption in this section shall not apply to any fee, tax, assessment, levy, or other charge imposed by any Other Public Agency.</text></paragraph></subsection><subsection id="H2E39AD6D463B4CEB959C6001AF3EAD90"><enum>(b)</enum><header>Tribal possessory interest tax</header><paragraph id="H52B55638A50744069A6B80CBD7CE8C4E"><enum>(1)</enum><header>In general</header><text>The Tribe shall have the authority to impose, assess, collect, and distribute a Tribal Tax on Possessory Interests in lieu of the Riverside County Ad Valorem Property Tax. Such tax shall be governed exclusively by this section and any law adopted by the Tribe to implement the Tribal Tax. The Tribe may delegate this authority to the Riverside County via an intergovernmental agreement as provided in paragraph (6).</text></paragraph><paragraph id="H1ABBC636263D4789A0972A8CB69DD032"><enum>(2)</enum><header>Amount of tribal tax</header><text>The Tribal Tax shall not for any taxable period be imposed with respect to any Possessory Interest at a rate or on an assessed value lower than the rate and any assessed value that, but for the preemption in this section, would have formed the basis for imposition and assessment of the Riverside County Ad Valorem Property Tax with respect to such Possessory Interest for such taxable period.</text></paragraph><paragraph id="H416255BCEDA84999A5985A8876D30FA6"><enum>(3)</enum><header>Exemptions</header><text>Leaseholds, easements, rights of way, and other property interests or enterprises held or conducted by governments or nonprofit organizations that are exempt from property taxation under California law shall be similarly exempt from any Tribal Tax.</text></paragraph><paragraph id="H4807F58118BE424AB09174176FDE101C"><enum>(4)</enum><header>Distributions to other public agencies</header><text>Subject to paragraph (8), the Tribe shall distribute Tribal Tax proceeds to Other Public Agencies in the amounts that, but for the preemption in this section, such Other Public Agencies would have been entitled to receive from the levy of the Riverside County Property Tax on the Possessory Interests. These distributions will take priority over any other use of the Tribal tax proceeds and will be made in accordance with the Tax Apportionment Schedule.</text></paragraph><paragraph id="HFB5699C21988481683E0A164461037BC"><enum>(5)</enum><header>Enforcement</header><text>The requirements of this section, including the distributions to Other Public Agencies pursuant to paragraph (4), shall be enforceable by Other Public Agencies in Federal district court, except to the degree that enforcement is available in an intergovernmental agreement with the County pursuant to paragraph (6). The Tribe waives its sovereign immunity for the specific and limited purpose of enforcing those requirements.</text></paragraph><paragraph id="H27832B53B69B4130BCF83B9462EC1B88"><enum>(6)</enum><header>Delegation of authority</header><text>The Tribe may delegate its authority to assess, collect, and distribute the Tribal Tax to Riverside County through an intergovernmental agreement. Such agreement shall provide that Riverside County shall distribute to Other Public Agencies the amounts that, but for the preemption in this section, such Other Public Agencies would have been entitled to receive from the levy of the Riverside County Property Tax on the Possessory Interests and in accordance with the Tax Apportionment Schedule. Such agreement will also provide that the Other Public Agencies are third-party beneficiaries of the Agreement and entitled to enforce its terms.</text></paragraph><paragraph id="HA96CA52BA0514D46BE36362F0BE16ECE"><enum>(7)</enum><header>Use of tribal tax proceeds</header><text>Tribal Tax proceeds shall not be used for per capita distribution to Tribal Members and shall be used solely for the following purposes—</text><subparagraph id="H85C94E903E804E0488CD15566FEABE0F"><enum>(A)</enum><text>offsetting the operating cost of the Agua Caliente Water Authority;</text></subparagraph><subparagraph id="H54F8F0A012384AE8AB1B51DA3E7E881F"><enum>(B)</enum><text>offsetting the cost of operation, maintenance, repair, and replacement of the Tribe’s water project infrastructure;</text></subparagraph><subparagraph id="H54A3892E26BA445891BC9DEDB79E0A94"><enum>(C)</enum><text>funding the Tribe’s government, including but not limited to offsetting costs associated with administering the Tribal Tax; and</text></subparagraph><subparagraph id="HEB8427D56D0F49E59E725EAB59D29E71"><enum>(D)</enum><text>providing funds to Other Public Agencies, including assurance that the Other Public Agencies will receive proceeds from the Tribal Tax at least equivalent to the distributions that they would have received from the levy of the Riverside County Property Tax on the Possessory Interests but for the preemption in this section.</text></subparagraph></paragraph><paragraph id="H11A819AC659C4D7BB6325B7944AF926D"><enum>(8)</enum><header>Limitation on distributions to other public agencies</header><text>Unless the Tribe determines otherwise, in no event will the Tribe be required to distribute Tribal Tax proceeds such that Other Public Agencies receive a greater amount of combined State or Tribal Tax revenue, than the Other Public Agencies would otherwise receive pursuant to California law but for the preemption in this section.</text></paragraph></subsection><subsection id="HF7C0C38B4B944677BEE5651132DBDAF2"><enum>(c)</enum><header>Effective date</header><text>This section shall take effect on the first day of January following the Enforceability Date.</text></subsection></section><section id="H6DED6B4F04BF43B8AD5E2CF5F9BC0930"><enum>12.</enum><header>Transfer of land into trust</header><subsection id="H08CF4B5676BD445284CF2322DEA8E867"><enum>(a)</enum><header>Transfer of land to trust</header><paragraph id="H07D86053C1F64B5B921677FF4598314A"><enum>(1)</enum><header>Lands to be held in trust</header><text>Subject to valid existing rights, and the requirements of this subsection, all right, title, and interest of the United States in and to the land described in paragraph (2) shall be held in trust by the United States for the benefit of the Tribe as part of the Agua Caliente Reservation upon the Enforceability Date.</text></paragraph><paragraph id="HA08D3563477F49EAA99E687E780A62E0"><enum>(2)</enum><header>Bureau of land management lands to be held in trust</header><text>The land referred to paragraph (1) is—</text><subparagraph id="HE5975746A816497EA88D1DBBB889CB55"><enum>(A)</enum><text>approximately 640 acres of land located in Section 32, Township 5 South, Range 4 East, San Bernadino Base and Meridian;</text></subparagraph><subparagraph id="H64BCC003CB4C4A72BB3F3370E6CA13E7"><enum>(B)</enum><text>approximately 145 acres of land located in—</text><clause id="H1A6EACD44E5A42E0932A0CB91F1CDE2A"><enum>(i)</enum><text>the North ½ of Government Lot 2 and the South ½ of Government Lot 1 in the Northwest ¼ of Section 18, Township 4 South, Range 4 East, San Bernadino Base and Meridian;</text></clause><clause id="H8A7618D3726B4325BAFD3E83C1DBCBA8"><enum>(ii)</enum><text>the Northwest ¼ of the Northeast ¼ of the Southwest ¼ of Section 18, Township 4 South, Range 4 East, San Bernadino Base and Meridian;</text></clause><clause id="H0DA1C9BA65604A6384D584BFA9631F92"><enum>(iii)</enum><text>the Northeast ¼ of the Northeast ¼ of the Southwest ¼ of Section 18, Township 4 South, Range 4 East, San Bernadino Base and Meridian; and</text></clause><clause id="H28AF784AED2F46BEA27BF52706583A0A"><enum>(iv)</enum><text>the West ½ of the Northeast ¼ of Section 18, Township 4 South, Range 4 East, San Bernadino Base and Meridian.</text></clause></subparagraph><subparagraph id="H9594446AAAD34B67BFBEC2043DCFC3BD"><enum>(C)</enum><text>approximately 647 acres of land comprising Section 5, Township 5 South, Range 4 East, San Bernadino Base and Meridian;</text></subparagraph><subparagraph id="HD00B685213104A2BBA547D3FFF1DE4A1"><enum>(D)</enum><text>approximately 640 acres of land comprising Section 36, Township 5 South, Range 4 East, San Bernadino Base and Meridian;</text></subparagraph><subparagraph id="H3D9F088609CA46BAA76A4277EDB66626"><enum>(E)</enum><text>approximately 640 acres of land located in Section 16, Township 4 South, Range 4 East, San Bernadino Base and Meridian; and</text></subparagraph><subparagraph id="H55F6F84E3BB645B481A1301A93945888"><enum>(F)</enum><text>approximately 30 acres of land located in—</text><clause id="H6E854CEB881B4EA5877D0A4EBD7EB2B5"><enum>(i)</enum><text>the East ½ of the West ½ of the Northwest ¼ of the Northeast ¼ of Section 17 Township 4 South, Range 4 East San Bernadino Base and Meridian;</text></clause><clause id="H913DE40A57334089B578D7AA31919DFF"><enum>(ii)</enum><text>the West ½ of the West ½ of the Northwest ¼ of the Northeast ¼ of Section 17 Township 4 South, Range 4 East, San Bernadino Base and Meridian; and</text></clause><clause id="H48D01AF230A34CF89AE0E15DD198D6D6"><enum>(iii)</enum><text>the West ½ of the East ½ of the Northwest ¼ of the Northeast ¼ of Section 17 Township 4 South, Range 4 East, San Bernadino Base and Meridian.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H32083A79A574462AADE6D0CD4619FBDB"> <enum>(3)</enum> <header>CDPA</header> <text>The lands referred to and delineated in clauses (ii), (iii), and (iv) of paragraph (2)(B) shall be transferred notwithstanding section 714(b) of the California Desert Protection Act of 1994 (16 U.S.C. 410aaa–81c(b)).</text>
 </paragraph><paragraph commented="no" id="HEA278A1418924FB697755A095840B102"><enum>(4)</enum><header>Santa rosa and san jacinto mountains national monument act of 2000</header><text>The lands referred to and delineated in paragraph (2)(A) through (E) shall be transferred notwithstanding section 5(i)(1)(a) of the Santa Rosa and San Jacinto Mountains National Monument Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/351">Public Law 106–351</external-xref>).</text></paragraph></subsection><subsection id="HAF953A91CB70480CB4637A1C7E2008E3"><enum>(b)</enum><header>Terms and conditions</header><paragraph id="H24D5BF308E2F43E49DEFF6D65EF9F0C6"><enum>(1)</enum><header>Existing authorizations</header><text>Any Federal land transferred under this section shall be conveyed and taken into trust subject to valid existing rights, contracts, leases, permits, and rights-of-way, unless the holder of the right, contract, lease, permit, or right-of-way requests and earlier termination in accordance with existing law. The Bureau of Indian Affairs shall assume all benefits and obligations of the previous land management agency under such existing rights, contracts, leases, permits, or rights-of-way, and shall disburse to the Tribe any amounts that accrue to the United States from such rights, contracts, leases, permits, or rights-of-ways after the date of transfer from any sale, bonus, royalty, or rental relating to that land in the same manner as amounts received from other land held by the Secretary in trust for the Tribe.</text></paragraph><paragraph id="HDE7F6A67247A417F8C6F2924D2B6B061"><enum>(2)</enum><header>Improvements</header><text>Any improvements constituting personal property, as defined by State law, belonging to the holder of a right, contract, lease, permit, or right-of-way on lands transferred under this section shall remain the property of the holder and shall be removed no later than 90 days after the date on which the right, contract, lease, permit, or right-of-way expires, unless the Tribe and the holder agree otherwise. Any such property remaining beyond the 90-day period shall become the property of the Tribe and shall be subject to removal and disposition at the Tribe’s discretion. The holder shall be liable for costs the Tribe incurs in removing and disposing of the property.</text></paragraph></subsection><subsection id="H3F8756B1FC2C4445B44ED53C98A2C586"> <enum>(c)</enum> <header>Withdrawal of Federal lands</header> <paragraph id="H01597D750DCE429B9E184DB94FA77FA0"> <enum>(1)</enum> <header>In general</header> <text>Subject to valid existing rights, effective on the date of enactment of this Act, all Federal lands within the parcels described in subsection (a)(2) are withdrawn from all forms of—</text>
                    <subparagraph id="H7DF34323A1DF4AD4BE455439458FFC03">
                        <enum>(A)</enum>
 <text>entry, appropriation, or disposal under the public land laws;</text> </subparagraph> <subparagraph id="HCE20508BCB1C43059835728456503AAF"> <enum>(B)</enum> <text>location, entry, and patent under the mining laws; and</text>
                    </subparagraph>
                    <subparagraph id="HF51AE19D9F6940BD9C7F52BF3AA38A9D">
                        <enum>(C)</enum>
 <text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text>
                    </subparagraph>
                </paragraph>
 </subsection><subsection id="H05E7FB81D11549F197268B9FEAA597F7"><enum>(d)</enum><header>Technical corrections</header><text>Notwithstanding the descriptions of the parcels of land in subsection (a)(2), the United States may, with the consent of the Tribe, make technical corrections to the legal land descriptions to more specifically identify the parcels to be transferred into trust for the Tribe.</text></subsection><subsection id="H197B3058F3A44C48B43007B6F5110B6C"><enum>(e)</enum><header>Survey</header><paragraph id="HF54F06A7AB40468AB720FFF157C34C17"><enum>(1)</enum><text>Unless the United States or the Tribe requests an additional survey for the transferred land or a technical correction is made under subsection (d), the description of land under this section shall be controlling.</text></paragraph><paragraph id="HF9807485939D4D6BBD4C5429AF169E4E"><enum>(2)</enum><text>If the United States or the Tribe requests an additional survey, that survey shall control the total acreage to be transferred into trust under this section.</text></paragraph><paragraph id="H52240DF2C50548B3986A85DC24792CBA"><enum>(3)</enum><text>The Secretary of Interior or Secretary of Agriculture shall provide such assistance as may be appropriate—</text><subparagraph id="HC080B0D47712403E9691905808912FA8"><enum>(A)</enum><text>to conduct additional surveys of the transferred land; and</text></subparagraph><subparagraph id="H92319AFBD8FE41D5A5606AC0C3D2EB9D"><enum>(B)</enum><text>to satisfy administrative requirements necessary to accomplish the land transfers under this section.</text></subparagraph></paragraph></subsection><subsection id="H52A26AC82E6545A7B4565A3BC8D91904"><enum>(f)</enum><header>Date of transfer</header><text>The Secretary shall issue trust deeds for all land transfers under this section by not later than 10 years after the Enforceability Date.</text></subsection><subsection id="H500FB38A269C4B058098CF32F8C79421"> <enum>(g)</enum> <header>Restriction on gaming</header> <text>Lands taken into trust pursuant to this section shall not be considered to have been taken into trust for, nor eligible for, class II gaming or class III gaming (as those terms are defined in section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>)).</text>
 </subsection><subsection id="H7AB2DE56D89B44F68CDCE2A55F0C2465"><enum>(h)</enum><header>Status of water rights on transferred lands</header><text>Any water rights associated with the lands transferred pursuant to subsection (a)(1) shall be held in trust for the Tribe but shall not be included in the Tribal Water Right.</text></subsection></section><section id="H74D6513D6CBF46B4A92AF14D3CF414F7"><enum>13.</enum><header>Conveyance of Federal land to the Coachella Valley Water District</header><subsection id="H8117047CC1184F7DA2F7995653B11121"><enum>(a)</enum><header>In general</header><text>Notwithstanding the land use planning requirements of sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713), if not later than 30 days after completion of the appraisal required under subsection (b), CVWD submits to the Secretary an offer to acquire the Facility Land for the Fair Market Value as determined pursuant to subsection (b), the Secretary shall, not later than 30 days after the date of the offer, convey to CVWD all right, title, and interest to the Facility Land, subject to valid existing rights.</text></subsection><subsection id="HA8CC808C50264E96BD6D9208AA4AB76E"><enum>(b)</enum><header>Determination of fair market value</header><paragraph id="H173D574685704D119A6EC008B57FF645"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the Enforceability Date, the Secretary shall determine the fair market value of the Facility Land—</text><subparagraph id="H652D81FA712C4ED891481EAFF275E37F"><enum>(A)</enum><text>in accordance with the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H0923189448004183AEE64F3E82D19C3C"><enum>(B)</enum><text>based on an appraisal that is conducted in accordance with—</text><clause id="HAEF2311281294B21B8104A5E89F1410A"><enum>(i)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></clause><clause id="HB41D4FCD8D4A443EA8DBE53B3772FD96"><enum>(ii)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text></clause></subparagraph></paragraph><paragraph id="H31A5DB5CF8C74FCD965FDFEB3D150087"><enum>(2)</enum><header>Cost of appraisal</header><text>All costs associated with the appraisal under paragraph (1) shall be borne by CVWD.</text></paragraph></subsection><subsection id="HCDBA5716F99D48E496004493C9926626"><enum>(c)</enum><header>Payment of consideration</header><text>Not later than 30 days after the date on which the Facility Land is conveyed under subsection (a), as a condition of the conveyance, CVWD shall pay to the Secretary an amount equal to the fair market value as determined under subsection (b).</text></subsection><subsection id="H3C4B28EA987B4990B0EAEDDA9B85BA77"><enum>(d)</enum><header>Costs of conveyance</header><text>In addition to the fair market value determined under subsection (b), CVWD, as the buyer, shall pay all costs related to the applicable conveyance, including surveys and appraisals.</text></subsection><subsection id="HB13A533C16684B49BE5F1E803980156B"><enum>(e)</enum><header>Disposition of proceeds</header><text>The proceeds from the sale of the Facility Land shall be—</text><paragraph id="H84B011FC301B4F6587FC9B48FD9246FF"><enum>(1)</enum><text>deposited in the Federal Land Deposit Account established by section 206 of the Federal Land Transaction Facilitation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/2305">43 U.S.C. 2305(a)</external-xref>); and</text></paragraph><paragraph id="H6CD0C76AA0494A928584D3FB6D1FD25D"><enum>(2)</enum><text>used in accordance with that Act.</text></paragraph></subsection><subsection id="H09F7A837FD014F10ACD0D92387C8093B"><enum>(f)</enum><header>Technical corrections</header><text>Notwithstanding the descriptions of the Facility Land as defined in section 3, the United States may, with the consent of CVWD, make technical corrections to the legal land descriptions to more specifically identify the parcels to be transferred to CVWD.</text></subsection><subsection id="H421730EE247E4109B0428270673A629E"><enum>(g)</enum><header>Protection of cultural resources</header><paragraph id="HC04F4F0151954F15A81A671A7D44E5D2"><enum>(1)</enum><header>Cessation of ground disturbing activity upon discovery of tribal cultural resources</header><text>Upon the discovery of any suspected Tribal Cultural Resources at the Facility and Adjacent Lands CVWD shall immediately cease, or cause the cessation of, all ground disturbing activity in the immediate vicinity (defined as an area sufficient to protect the discovery of the resource and a buffer zone sufficient to allow safe investigation of the discovery and to protect any other potentially associated features) of the suspected Tribal Cultural Resources.</text></paragraph><paragraph id="H97473BF6C43F40939E253ABC05AC4FD0"><enum>(2)</enum><header>Duration of cessation of ground disturbing activity</header><text>All ground disturbing activity in the immediate vicinity of any suspected Tribal Cultural Resources at the Facility or Adjacent Lands shall remain suspended until—</text><subparagraph id="H136284FEA04D4A218524F58041DF9267"><enum>(A)</enum><text>a conclusive determination has been made that the discovery does not involve a Tribal Cultural Resource; or</text></subparagraph><subparagraph id="H8423B8DD152E449EA6BDFE06448A0BA7"><enum>(B)</enum><text>final treatment and disposition of the Tribal Cultural Resource in compliance with this subsection.</text></subparagraph></paragraph><paragraph commented="no" id="H5D3827DC973E4CDFB0DCE8A1A059936A"><enum>(3)</enum><header>Discovery of cultural resources</header><subparagraph commented="no" id="H8CE04C1435B34A8B8FA06EE05F49CDB9"><enum>(A)</enum><header>Notice</header><text>If CVWD or its representatives discover potential Tribal Cultural Resources, excluding human remains, at the Facility or Adjacent Lands, CVWD shall promptly notify the Agua Caliente Director of Historic Preservation and General Counsel.</text></subparagraph><subparagraph commented="no" id="H43757EC846DE4EDABAACD24BB2D8B5AD"><enum>(B)</enum><header>Human remains</header><text>If CVWD or its representatives discover human remains, CVWD shall—</text><clause commented="no" id="H3F417B408909493E839391847F5BE9C3"><enum>(i)</enum><text>promptly notify—</text><subclause commented="no" id="H0B1525776FB142868AFB6C31B607CD21"><enum>(I)</enum><text>the Agua Caliente Director of Historic Preservation;</text></subclause><subclause commented="no" id="H000762E893204F028D86D8AC79733716"><enum>(II)</enum><text>General Counsel; and</text></subclause><subclause commented="no" id="H97BE891825414D87ADE110566C61C050"><enum>(III)</enum><text>the County Coroner, requesting a determination as to whether the remains are Native American human remains; and</text></subclause></clause><clause commented="no" id="H69688CD1E6F042BCB31C150204ACEE4E"><enum>(ii)</enum><text>cover reasonable fees and costs charged by the County Coroner, if applicable.</text></clause></subparagraph><subparagraph commented="no" id="H828E22CDD8E4480CB83610DB0813AFB4"><enum>(C)</enum><header>Tribal involvement</header><text>If the Tribe is identified as the Most Likely Descendant with respect to a Tribal Cultural Resource, in addition to requirements of applicable State law, CVWD shall—</text><clause commented="no" id="HFA61DA17C0724AEE8D8CA6814555EC96"><enum>(i)</enum><text>give access to the Tribe to inspect the discovery site and to decide, at the sole discretion of the Tribe, on the treatment and disposition of the Tribal Cultural Resource; and</text></clause><clause commented="no" id="H559DEA092A0D4E6CA3A5BBFFE06E8AC5"><enum>(ii)</enum><text>if the Tribe chooses reburial for the Tribal Cultural Resource, facilitate or secure authorization for on-site reburial at a location—</text><subclause commented="no" id="HF10D9801A4564372A1C9EC02DB9BCEEC"><enum>(I)</enum><text>mutually agreed upon; and</text></subclause><subclause commented="no" id="H8771F2F6733748489B03B1E5D8C55CA0"><enum>(II)</enum><text>not subject to future disturbance.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="HDDDF370483A54C9B9D1A2458F4FAA09F"><enum>14.</enum><header>Miscellaneous provisions</header><subsection id="H1E59806044E942BCAC4555D34FBD37FF"><enum>(a)</enum><header>Limited waiver of sovereign immunity by the united states</header><text>For purposes of compelling compliance with the terms of this Act and the Agreement, the United States waives its sovereign immunity to the extent provided by Federal law.</text></subsection><subsection id="H95FEB34CBD0D41A089241E2DE6D1928D"><enum>(b)</enum><header>No precedential effect</header><text>Nothing in this Act establishes any standard for the quantification or litigation of Federal reserved water rights or any other Indian water claims of any other Indian Tribe in any other judicial or administrative proceeding.</text></subsection><subsection id="H2C3931D93D1C4805AA6B329C8C74C52F"><enum>(c)</enum><header>Other indian tribes not adversely affected</header><text>Nothing in this Act quantifies or diminishes the water rights, claims, or entitlements to water of any other Indian Tribe, band, or community other than Agua Caliente.</text></subsection><subsection id="H95DE2305B3974085896CC8CE71AB6BC0"><enum>(d)</enum><header>Disclaimer</header><text>This Act shall not be construed as establishing the taxing authority of any other Indian Tribe, other than Agua Caliente, or preempting the taxing authority of any other water district, agency, State, or local government.</text></subsection><subsection id="HD64C6542F563481EB9FB60FFC2B110DA"><enum>(e)</enum><header>Conflict</header><text>In the event of a conflict between the Agreement and this Act, this Act shall control.</text></subsection><subsection id="H1551722D426340E7B1359DBF67D95B44"><enum>(f)</enum><header>Effect on current law</header><text>Nothing in this Act affects any provision of law (including regulations) in effect on the day before the date of enactment of this Act with respect to pre-enforcement review of any Federal environmental enforcement action.</text></subsection></section><section id="HCD14517AB1A44BE29A4EDB4B710A61D9"><enum>15.</enum><header>Antideficiency</header><text display-inline="no-display-inline">The United States shall not be liable for any failure to carry out any obligation or activity authorized by this Act, including any obligation or activity under the Agreement, if adequate appropriations are not provided expressly by Congress to carry out the purposes of this Act.</text></section></legis-body></bill>
