<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4361</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260421">April 21, 2026</action-date><action-desc><sponsor name-id="S427">Mr. Schiff</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the reasonable requirements that may be imposed on pet owners living in public housing, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pets Belong with Families Act</short-title></quote>.</text></section><section id="idda247576b36a461bba28336c80fb3865"><enum>2.</enum><header>Prohibition on breed restrictions</header><text display-inline="no-display-inline">Section 31 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437z-3">42 U.S.C. 1437z–3</external-xref>) is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25618d7f45f14f66aceebe990f9d5114"><subsection id="idb2cb0dd8b3d54f11adc17c9a4c3d33e6"><enum>(b)</enum><header>Reasonable requirements</header><paragraph id="idf3f86961e8a44d3082c87ad7fb60ebba"><enum>(1)</enum><header>In general</header><text>The reasonable requirements referred to in subsection (a) may include—</text><subparagraph id="id4d8766820aae4a2a9cae3e116602c207"><enum>(A)</enum><text>requiring payment of a pet deposit by a tenant owning or having pets, except that—</text><clause commented="no" display-inline="no-display-inline" id="id7b506505ecbc4a3ca43bda4ba4f29448"><enum>(i)</enum><text display-inline="yes-display-inline">the pet deposit—</text><subclause commented="no" display-inline="no-display-inline" id="id325dbe578d3b4202a75859798497d635"><enum>(I)</enum><text display-inline="yes-display-inline">shall not exceed 10 percent of the tenant’s monthly base rent; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8866b4d526c54227bda3d85e5878432c"><enum>(II)</enum><text display-inline="yes-display-inline">shall be amortized over not less than 3 months as part of a tenant’s rental payments; and </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id02f611cac763497fae6ac6ef1c7bfa13"><enum>(ii)</enum><text display-inline="yes-display-inline">any amount of a pet deposit that is unused at the termination of the tenancy shall be reimbursed to the tenant within 30 days of vacating a dwelling unit;</text></clause></subparagraph><subparagraph id="id3f7e7530f3f247c98028ae52c32d78db"><enum>(B)</enum><text>limitations on the number of animals in a dwelling unit or building, based on unit size or other relevant conditions;</text></subparagraph><subparagraph id="ide22927abd2144f13be1484977d9a427d"><enum>(C)</enum><text>prohibitions on certain species of animals prohibited by State or local law; and</text></subparagraph><subparagraph id="id1a4a6d3516b54dfabf28cbc28dd49b9f"><enum>(D)</enum><text>prohibitions on any individual animal that is declared a threat to public health and safety by a court of competent jurisdiction or whose ownership is otherwise prohibited by State or local law.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90fa5230014444519905809b97726453"><enum>(2)</enum><header>Prohibition on withholding</header><text display-inline="yes-display-inline">A public housing agency may not withhold a pet deposit described in paragraph (1) for damage unrelated to the pet, including due to ordinary wear and tear.</text></paragraph><paragraph id="id673df11b8ad1441abbae854c4a1947b4"><enum>(3)</enum><header>Limitation</header><text>The reasonable requirements described in subsection (a) shall not include any prohibition based on the breed, size, or weight of an animal.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
