which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Water Pollution Control Act to establish the Southeast New England Program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Southeast New England Program Authorization Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id69bba66b87314654852a565fac4a06e1"><enum>2.</enum><header>Southeast New England Program</header><text display-inline="no-display-inline">Title I of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id1BC8C592C50F4D3B80AB7F58370FDBA8" style="OLC" act-name=""><section id="id2448BBE449A147FC8ACD2F941D1A7722" section-type="subsequent-section"><enum>127.</enum><header>Southeast New England Program</header><subsection commented="no" display-inline="no-display-inline" id="id1167ba2de6d546deb54328c1371133a8"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of coastal watersheds of southeast New England</header><text>In this section, the term <term>coastal watersheds of southeast New England</term> means all of the watersheds of Rhode Island and southeastern Massachusetts that drain into coastal waters between Long Island Sound and the Gulf of Maine.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf03a1655d5d24b2e9dff7b0fefc6ac65"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text>There is established in the Environmental Protection Agency a program, to be known as the <quote>Southeast New England Program</quote> (referred to in this section as the <quote>Program</quote>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0e9e842947d847178125ce234faab161"><enum>(c)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the Program shall be to protect, enhance, and restore the coastal watersheds of southeast New England by developing, funding, and advancing implementation of protection and restoration projects in collaboration with partners across the southeast New England region.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6e95b32be79b43199a6e85075867907f"><enum>(d)</enum><header>Grant program</header><paragraph commented="no" display-inline="no-display-inline" id="id3fc1839df75c49dc89c0fec7b36a36dd"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>In carrying out the Program, the Administrator may award grants to support and carry out projects in the coastal watersheds of southeast New England that assist in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id14161dc56fc748ac98543992973c9aab"><enum>(A)</enum><text display-inline="yes-display-inline">eliminating or reducing pollution;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3cc7e6d4366a4b46bd73860a9c9d5a86"><enum>(B)</enum><text display-inline="yes-display-inline">restoring contaminated sites;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3840e2792a77481689854ea077bfdc1a"><enum>(C)</enum><text>protecting or restoring ecosystems or habitat;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbc927358fa7f4ccfa120ae9980566802"><enum>(D)</enum><text display-inline="yes-display-inline">improving water quality;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3fdaddcc9c34352af8b972986971d4a"><enum>(E)</enum><text display-inline="yes-display-inline">monitoring watersheds to evaluate trends;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4881819d692e4d78be0754c99343da7a"><enum>(F)</enum><text display-inline="yes-display-inline">reducing stormwater runoff;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7fb5d938a0d047ecb2a54cfdc40b0e58"><enum>(G)</enum><text display-inline="yes-display-inline">promoting resilience of the coastal watersheds;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb60398d2611e45c6bf78c67c65c056d3"><enum>(H)</enum><text display-inline="yes-display-inline">supporting workforce development, training, or education initiatives that contribute to the health of the coastal watersheds of southeast New England; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id583f71909e934507b2f93dd08a4cc427"><enum>(I)</enum><text>providing technical assistance in carrying out projects described in subparagraphs (A) through (H).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09b9bcc0ee7a4d6a9c0576b5b7523eb7"><enum>(2)</enum><header>Eligible recipients</header><text display-inline="yes-display-inline">An entity eligible for a grant under this subsection is—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbaf50a82c097440e82721ab03e4b9298"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id051ddc59bdcc4fdda930ab2c9f0a100e"><enum>(B)</enum><text display-inline="yes-display-inline">a county or local government, or a subdivision of such a government;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id92989fda26f14af3af98c07b240ec5f5"><enum>(C)</enum><text display-inline="yes-display-inline">a federally recognized Indian tribe;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd2cd06bd98644fe7b9752dd078bce8b0"><enum>(D)</enum><text display-inline="yes-display-inline">a regional planning organization;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5215cade657a4a0e8258601428690d01"><enum>(E)</enum><text display-inline="yes-display-inline">a nonprofit organization; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88e8b05305d040409fdb7aed711be237"><enum>(F)</enum><text display-inline="yes-display-inline">an institution of higher education.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee7fe7deb81640c7b1c8d64fa8009a3e"><enum>(3)</enum><header>Cost-share</header><text display-inline="yes-display-inline">The Federal share of an activity carried out using a grant under this subsection shall not exceed 75 percent.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3c7a5b06cf5b4dd39fd315c9603176dd"><enum>(e)</enum><header>Coordination</header><text>The Administrator shall coordinate the actions of Federal agencies that affect water quality and the living resources of the coastal watersheds of southeast New England to improve those resources and enhance efficiency.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id071efe984ff646e0897de9a2a8cdc569"><enum>(f)</enum><header>Authorities and duties of Administrator</header><paragraph commented="no" display-inline="no-display-inline" id="id8cc4e579beba4f11ace59a9e90834e24"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out this section, the Administrator may—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7e0dc65613714970893647daf7f1e972"><enum>(A)</enum><text display-inline="yes-display-inline">enter into interagency agreements;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87c4b5c6dd8e4452bdca03e78f464580"><enum>(B)</enum><text>establish interagency working groups; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18b32f13b2ee454083054a00b705ae77"><enum>(C)</enum><text>contract for services to carry out the purposes of this section.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6847fce661114b6d8cce08cd2e9e5865"><enum>(2)</enum><header>Staffing</header><text>The Administrator shall provide adequate staff to carry out this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1cf41411d68042bc82404f95815baf8b"><enum>(g)</enum><header>Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" id="id517ea526dc70489491b7b0e8f8d7972d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>There is authorized to be appropriated to the Administrator to carry out this section $30,000,000 for each of fiscal years 2027 through 2031, to remain available until expended.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id897ab56992df4eaf84371c6d414a9220"><enum>(2)</enum><header>Technical assistance</header><text>Of the amounts made available to award grants under subsection (d) in a fiscal year, not more than 10 percent may be used to award grants the primary purpose of which is providing technical assistance pursuant to paragraph (1)(I) of that subsection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c1caa12c1184db482f9b9f50376ad6f"><enum>(3)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">Of the amounts made available under paragraph (1) in a fiscal year, not more than 5 percent may be used for administrative expenses.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
